Chamisa Should Not Have Been Appointed Vice President - High Court

High Court Court Judge, Justice Edith Mushore on Wednesday ruled that the late former Prime Minister, Morgan Tsvangirai violated the MDC governance charter by appointing Nelson Chamisa and Elias Mudzuri as deputy presidents in July 2016.

The Constitution provided that the vice presidents of the party could be chosen in an elective congress.

The applicant, Elias Mashavira had argued among other things that Thokozani Khuphe whom the party had elected vice president at the previous Congress should have taken over from Tsvangirai. He also opined that the council that had claimed to have given Tsvangirai powers to appoint his VPS had failed to provide proof of the meeting that made the resolution. The applicant also said that, as a congress delegate, he should have been invited to the meeting.

The judge ruled that the MDC was not being represented in the case. She indicated that Komichi’s affidavit deposited in his capacity as national chairperson did not have locus standi to represent the MDC, Mwonzora, and Mudzuri. Resultantly, Khuphe and Douglas Mwonzora were barred from the proceedings for failing to deposit opposing affidavits.

Chamisa has pledged to challenge the ruling and proceed with the Congress scheduled for the 24th to the 26th this month.
