High Court Ruling Has Adverse Impact On M.D.C. & Zimbabwe - Experts
The Daily News reports that fears abound over possible effects of the High Court ruling which nullified Nelson Chamisa’s presidency.
Analysts argue that the matter can have a far-reaching adverse impact on the country’s future and the MDC. Experts are wary of a possible sudden inward collapse of the MDC considering that it already has intraparty conflicts. United Kingdom-based academic Alex Magaisa said:
It is a strategic and insidious assault on the very existence of the MDC led by Chamisa. It is…a calculated existential assault upon the country’s leading opposition because it goes to the core of its foundation.
FeedbackHis sentiments were shared by researcher Tinashe Muzamhindo who said that the ruling weakens the party.
Professor Lovemore Madhuku, law expert, however, said that the law remains the law in as much as the people had the right to express their perceptions. He said:
The bottom line is that whatever judgment that is given by any court, it must be respected until it is set aside by an appeal.
The court judgment was not about determining the leader of a political party, it only declared that what was done was not done in terms of the MDC constitution.
What is the purpose of a constitution? That is why divorces, for example, are settled in courts. You can’t accuse the court of meddling in your love affair.
Madhuku also mentioned that the courts only adjudicate a matter brought before them and this was not an issue peculiar to Zimbabwe.
