High Court judge Justice David Mangota has dismissed the MDC Alliance’s two application to recover possession of Harvest House, also known as Morgan Richard Tsvangirai House.
MDC-T youths seized Harvest House several weeks ago in the dead of the night with the help of the military and police.
The building has been the opposition party’s headquarters since its formation in 1999 and was under the MDC Alliance’s control since 2018.
In dismissing the MDC-A application, Justice Mangota said that Chamisa’s party failed to prove the use of police and military in the takeover. Part of the ruling read:
I have considered all the circumstances of HC2811/20 and HC 2814/20.
I am satisfied that the applicants in each case failed to prove their applications on a balance of probabilities.
In the result, it is ordered that: HC2811/20 be and is hereby dismissed.
