A Malawian Judge, Judge Mankhambira Charles Mkandawire will smile all the way to the bank after the regional bloc Southern African Development Committee eas ordered to compensate him after they reportedly wrongfully terminated his contact as the bloc’s Registrar of the SADC Tribunal, Nyasa Times reports.
Mkandawire who had been locked in a legal battle with SADC will reportedly be compensated for US$380 184.71 less his cumulative earnings in Malawi from the time of the termination of his contract up to 30th November 2016.
Additionally, the judge will also get a 10% interest on the amount of claim from 30th November 2016 until the whole amount is paid in full.
The Tribunal that ruled in Judge Mkandawire’s favor was chaired by fired judge Justice Francis Bere at the SADC Administrative Tribunal in Gaborone, Botswana under application number 2 of 2019. Justice Bere reportedly chastised the SADC Secretariat for humiliating Judge Mkandawire and ordered the latter to pay for the cost of the suit.
In delivering his ruling Justice Bere reportedly said:
The Applicant’s departure from SADC was characterized by extreme humiliation which negatively impacted on the general welfare of his family. His wife and Son who were enrolled at some universities in Namibia had to cut short their studies. In short, the Applicant made an unceremonious exit from SADC. The whole script makes sad reading.
