CASE ALERT PRESIDENT APPOINTS NEW SUPREME COURT JUDGES DESPITE DENIALS UNDER OATH 3 JUNE 2021

Luke Malaba, the former Chief Justice who was forced into retirement by a court order is today expected to defy the order when he presides over a swearing in ceremony for six new judges of the Supreme Court. The swearing in comes right in the middle of litigation attempting to bar the unprocedural appointments. NGO Forum filed an urgent chamber application on behalf of its client Chamunorwa Chingwe. Chingwe is seeking to bar the appointment of the judges without following section 186 of the Constitution.

Chingwe cited the Judicial Services Commission, President Mnangagwa and Justice Minister Ziyambi Ziyambi. In their opposing affidavits, all three Respondents vehemently denied any plans to appoint new judges. However, in a surprise turn of events, information started filtering in on Wednesday that new Supreme judges would be sworn in on today.

The list of judges to be sworn in includes the Judge President, Justice George Chiweshe, and Justices Samuel Kudya. Alpheous Chitakunye, Felistas Chatukuta, Hlekani Mwayera and Joseph Musakwa.
