Mahere Defends Controversial CCC Constitution

Former Citizens Coalition for Change (CCC) spokesperson Fadzayi Mahere, who is also the Mt Pleasant Member of Parliament, has defended the party’s interim constitution which, according to critics, falls “far below international best practices.”

Article 7.3 of a document that has been cited as the CCC constitution read:

There shall be a leader and Change Champion in Chief (Adv Nelson Chamisa) who shall be the Administrator and President tasked by the citizens to champion, lead and guide processes of the movement in between sessions of the CNA until an elective citizen convention is held. The Change Champion in Chief shall be the chief spokesperson and chief representative of the CCC as well as the custodian of its documents, property and wellbeing.

Self-exiled political commentator Jonathan Moyo said it is “unheard of” that a person is named in the constitution of a political party as its leader.

Another political commentator, Brighton Mutebuka said the document reported to be the CCC constitution clearly falls far below international best practices and creates avoidable reputational harm for the party and its leader.

However, posting on X, Mahere argued that the so-called CCC constitution is an interim document that was aimed at preventing the capture and destruction of the party by ZANU PF.

She also rejected claims that the document was written “secretly, by a select few party officials, with minimum consultation”, saying it was actually a product of an extensive nationwide engagement process. Said Mahere:

While the nation quickly slips into a one-party dictatorship, some choose to fake fuss over an interim arrangement that was specifically designed to prevent ZANU PF from robbing us again of the authentic opposition.

This arrangement, the CCC party symbol and the entire birth of the new party were borne out of an extensive nationwide engagement process undertaken across all provinces.

The unanimous position of the citizens was that there was a need to create a brand new party and that this party must have in place shocks to prevent ZANU PF from pulling another Mashavire.

The citizens did not want the state or the system to impose a leader on the opposition. The people wanted their will respected.

The people had the foresight to see that someone would crop up one day and try to steal what was hard fought for and build through blood, sweat and tears by ordinary citizens who simply want a better life.

Zimbabweans need to watch the magician’s hand and not be distracted by an obvious, superficially argued sideshow.

We need to collectively do whatever it takes to prevent ZANU PF from attaining a two-thirds majority and entrenching a one-party state that will see Mr Mnangagwa perpetuating mass suffering and his dictatorial, violent rule.

Zimbabweans want and deserve new, ethical leaders who put the citizens first and centre in governance and decision-making.

That's the way to go Nero. In this struggle we have who even steal the opposition leader's face and claim that it's theirs. The police are complicit to the theft. With no assurance of security, don't blame us for hiding our money in our socks and other private spaces. We have daring thieves and we will do anything to outsmart them. Zanu Pf is obviously livid that CCC are fortifying their treasure. When civilisation and real democracy is upon us, all these extreme measures will be a thing of the past. Godisinit

An interim constitution is a document governing a newly formed organization before the actual constitution takes effect. One man can start an organization whose constitution would need a quorum and minutes of a council which effects it. Before such their must be a steering constitution to guide an organization before the full law is effected.

I'm a lifelong supporter of CCC, but I'm beginning to question the direction it is taking. We seem to be endorsing or making another dictator in Chamisa. We seem to be copying all the ingredients if dictatorship from Zanu. How can it be that one person holds all the power in a people owned party? I just see CCC being modelled ne China Communist part where power is centered on one person. Democracy is far from us. Cry Zim cry

I think in life one has to be honest with themselves, and give credit to where it is due. This party has managed to achieve marvelous results in the very short time it has been in existence. A political party is there to win elections, and that is what that party has achieved. It is interesting to note that people wanted to see and know its structure as if there is a template for political party structures from the laws of the country, from SADC, AU or UN. What these people should have been interested in is, maybe their cabinet or shadow cabinet. There are a lot of people who feel threatened by having a strong party as it threatens their livelihood and comfort. A lot of money has been thrown in to fight and destroy the party which has managed to have, officially as ZEC published, 44% of the share of voters with 11 candidates sharing. With most of the money, most of the press and media not on its side, this party still has those people who voted on its side. What is now happening where there is an effort to destroy that party by throwing away money that is supposed to go to uplifting the lives of people and having fully equipped hospitals being used for continuous election cycles which look like will go on for the life of the present parliament, is like burning a field with wheat ready for harvest to catch mice. We need some of our respected people, mostly the retired and those who have no political side to intervene and save us from self destruction.

@doug. I find your conclusion noteworthy. An intervention by the retired democracy veterans and disenchanted activists requires inclussivity. That inclussivity is only possible if the CCC is depersonalised. Right now the Change Champion has fortified his personal position by barricading himself with a very personal constitution. The upshot is that true democrats would not want to assiciate with hypocritical activities that pretend to simulate constitutionalism while in fact galvanising one man's megalomaniacal autocracy. In essence the CCC has 23 years of experience in opposition politics, vin government (GNU) and in parliament. You can change your name, but, you can never change your history and your DNA.

Anyone who knows how ZANU used Khupe and Mwonzora to capture MDC-T, and how Mwonzora appropriated MDC Alliance just prior to the March 2022 by election will understand why CCC took the route it did, even putting Chamisa's face as the symbol. No Sir, @Anonymous it is not a joke. It was and still is the most pragmatic decision to make. Any other structure and interim constitution would have opened the doors to ZANU infiltration big time. CCC would not have survived to fight the 2023 elections. the Tshabangu debacle actually shows that this was a politically astute decision to make. Given this document, I can't see Tshabangu getting away with it in court.

Fadzai Mahere, having been unceremoniously knocked off her high perch upon which she smuggly occupied the role of the CCC Spokesperson, is now attempting to get back into Mukomana's good graces by strenuously defending the indefensible autocratic powers that Mukomana has arrogated to himself. Mentioning himself in the interim Constitution by name, lends credence to the widely held perception that the CCC is Chamisa's personal pet project & everyone else is merely a blind follower with no stake in the proprietary political entreprise owned by mukomana. The level of hypocrisy in the CCC is appalling. Fadzai Mahere is herself a lawyer. She should be concerned about principles such as "Seperation of Powers". There is no seperation of powers in the interim CCC constitution. Every office is vested in one person. In Zanu Pf, Mnangagwa is the President and first Secretary of the Party. In CCC Chamisa is the President and Administrator Spokesperson, etc etc. Essentially Zanu Pf & CCC are just different phases / faces of the same moon. At least Zanu Pf is not hypocritical - they never pretend to be democratic. Vesting all the powers and functions in one person results in a Conflict of Interest, lack of accountability and transparency because the Change Champion is accountable to noone by virtue of being too powerful. Blaming Zanu PF and making up excuses is easier for the CCC than taking responsibility for its mistakes. That victim mentality implies that the CCC will never know growth. Releasing an interim Constitution after two years and after losing court cases is a sign of gross incompetence, indecisiveness and lack of strategic direction. I and many other perceptive individuals advocated for a CCC Constitition right from CCC's inception, but visionless supporters egged Chamisa on. It turns were right after all. All the current troubles & squabbles could have been averted, had the Change Champion in Chief listened to reason early. But, there is still hope. All that's needed is to depersonalise the CCC.

There's nothing new in putting a name in a constitution. Precedent was set ar the setting up of the GNU, in which a one-time Constitutional Amendment named Tsvangirai pre rosso.

You are confused. Its only within the MDC/CCC thinking that a constitution names a leaders. Read across all constitutions you can think of , even sport clubs. No individual is named a leader. I think CCC is only for the retards, that's why you have to repeat the letter C three times.

I've been using the name Weasel for for very good reason. Check the dictionary meaning. CCC will be de-personalised very soon. As soon as ZANU stops using state apparatus to cripple legitimate and vibrant opposition. And mark my words, that's going to be soon, very soon, when ZANU sits in opposition benches. You are probably aware that CC, outside of The Law Society of Zimbabwe has the largest concentration of lawyers in any voluntary organisation. They were very much alive to the issues you raised of constitutionalism but as an evasive measure settled on that Interim constitution. It's worked well because Tshabangu and handlers weren't aware of what they were against. That's going to be their Waterloo. Once the Intellectual Property case is heard, Tshabangu & Co. will not have a leg to stand on. Comeuppance time. Tshabangu and his handlers (CIO/FAZ?) vamhanya makarimwa.
