Chitungwiza Man Faces Murder Charge After He Allegedly Killed An Intruder

A 22-year-old man, Benson Macharangwanda, has been charged with murder following the alleged killing of an intruder in Chitungwiza. The incident occurred around 4:30 AM on December 2.

It is alleged that Macharangwanda woke up when an anti-theft alarm on his phone was activated.

In the Harare Magistrate Court on Monday, it was revealed that Macharangwanda had placed US$250 in the pouch of his phone. Upon hearing the alarm, he discovered the intruder attempting to steal his phone through the window.

Macharangwanda pursued the intruder, guided by the sound of the alarm, and confronted him, demanding the return of his phone. The intruder claimed it had fallen inside his room, leading Macharangwanda to take him there.

A struggle ensued, during which the intruder produced a knife and attempted to stab Macharangwanda. However, with the timely shout of his landlady warning him of the imminent attack, Macharangwanda was able to block the knife.

In the scuffle, he managed to retrieve his phone from the intruder’s shorts. The intruder was subsequently escorted from the premises but soon began to complain of injuries he had sustained during the fight.

He was taken to Chitungwiza Hospital by his relatives, where he was pronounced dead on arrival.

Macharangwanda has been remanded in custody as he awaits indictment from the High Court.

If this officers of nowadays could read the CP&E Act properly this is no longer treated as murder as the section was repealed and amended with the reference of a similar case which had occurred in which a security guard shot dead an intruder he found stealing some chickens on the premises he was guarding and was arrested for murder, after almost 2 years in remand prison he was later set and this case was then used as a case study which caused the repealing and amendment of a section in the CP&E Act.As it is in this case both the police and the trial magistrate erred in remanding Benson M. in custody they should have just remanded him out of custody pending further investigations.
