A Harare magistrate has today postponed the case of the opposition MDC’s National Organiser, Amos Chibaya and his deputy, Sibusisiwe Masara to 03 February 2020.
The duo is facing charges of <a href="https://news.pindula.co.zw/2019/08/22/mdc-national-organiser-arrested-for-not-stopping-demos-mdc/">failing to take enough steps to stop the demonstrations</a> which were scheduled to start on the 16th of August in Harare.
Although the State blocked all the demonstrations, protesters thronged to the streets of Harare on the 16th saying demonstrations were their constitutional right.
The State claims that it will be ready to commence trial by the 3rd of February 2020 a “long delay” which left the defence seriously concerned.

Court Postpones Case Of MDC's Chibaya Who Is Facing Charges Of "Failing To Stop MDC Demos"

Nelson Chamisa, leader of the opposition MDC has confronted police chiefs over the deployment of police to disperse non-violent party supporters on the 16th of August in Harare.
The youthful leader also wanted to know the identity of people behind the abduction of party members and human rights defenders.
Speaking to the Daily News, party Secretary-General, Chalton Hwende confirmed the development saying that the MDC wrote a letter also demanding to know why all their demonstrations were being blocked. He said:
<blockquote>We wrote a letter to police commissioner-general Godwin Matanga, to express our displeasure on the treatment meted out to demonstrators on August 16.
Some of the police officers who were bashing people were clearly not police officers. The police must give us the names of the officers who were on duty that day.
In our letter we also want to find out why members of the police are abducting people, and if they are not the police, why the people behind the abductions are not being arrested.</blockquote>
Meanwhile, police spokesperson, Assistant Commissioner Paul Nyathi has said that he has not yet seen the letter.

Zimbabwe’s main opposition party, MDC, has opened Hotlines for human rights violations in Zimbabwe. The move follows <a href="http://Abductionhttps://news.pindula.co.zw/2019/08/17/activist-claims-zanu-pf-used-police-uniforms-to-abduct-protestors/" rel="noopener noreferrer" target="_blank">several abductions and torture of activists</a> over the past few weeks. There was also evidence of Zimbabwe Republic Police officers beating citizens in Harare who were demonstrating.

Following a ruling by the High Court upholding a ban on the MDC 16 August 2019 demonstrations by police, prominent journalist, Ruvheneko speaks to MDC Vice President Tendai Biti.

It is now clear we did everything possible using the available legal routes in order to exercise our rights but all avenues are closed.We’re confronted by an unjust system – unjust rulers, unjust rules and unjust playing field but will never doubt the justice of our cause.
There comes a point in the affairs of humankind when a people must challenge an unjust system, when compliance is as good as reaffirming the unjust system and your own mental and physical subjugation.
Throughout the course of history no oppressed people have achieved freedom by complying with the dictates of an unjust system.They have challenged it.This is the historic task of our people;our generation. The system a vicious machinery but the people have a valiant spirit.
The world saw for itself how brutal the regime is despite attempts to paint a picture that it is a New Dispensation.Sights of police brutalising defenceless civilians, beating up women and the elders are tragic but they also confirm why this demonstration was necessary.
The State has not reformed and it lacks the moral authority to govern, hence the resort to use of excessive force. In fact, those in power today clearly show us that they have learnt nothing and forgotten nothing from the yesterpolitics.
We’ve always called for the need of political reforms underpinning economic reforms. Images going around the world as a result of the excessive force used by the state against the people shame Zimbabwe &amp; make the country less attractive as an investment destination.
What the government has done reaffirms the need for political reforms and reinforces our argument about the importance of restoring legitimacy. No government that enjoys untrammelled legitimacy behaves as the Zimbabwean government has behaved today.
Ahead of August 16 there had already been signs of the brutal hand of the regime. Political activists were abducted and brutally tortured by agents. The state’s bad history in this regard places responsibility upon its shoulders, they carry the duty to protect citizens.
Going forward,Zimbabweans have no choice but to continue peacefully expression.All authority comes from the people as it is up them to assert it.ED has made the choice for you,remain steadfast in the face of violence and intolerance and keep fighting for your rights.
In the days,weeks and months ahead, peaceful action is our force. To the people who will come out to express themselves we say it’s important to exercise your rights and to do so peacefully.

Human rights activist Makomborero Haruzivishe has claimed that Zanu PF youths were used to abduct protestors during the 16 August Demonstration in Harare. The Zanu PF, he said, were wearing Zimbabwe Republic Police uniform.
Haruzivishe posted pictures on Twitter of a 32-year-old man who was apparently abducted and tortured at Zanu PF HQ as part of the operation.
Said Haruzivishe:
<blockquote>Zenzo, a 32 year old youth was abdudcted in Mbuya Nehanda Street at around 1200hrs yesterday by a group of ZanuPf youths who were in @PoliceZimbabwe uniform.
He was taken to a basement at ZanuPf headquarters and tortured. He sustained injuries all over his body.
He was tortured together with around a dozen other citizens. The ZanuPf youths used logs, baton sticks, open hands &amp; fists to beat them. He saw some who had either fainted or died being thrown into what appeared like a drainage way that led from the basement.
During torture one of the youths hit him on the head with a pistol threatening to kill him for participating in the <a class="css-4rbku5 css-18t94o4 css-901oao css-16my406 r-1n1174f r-1loqt21 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0" data-focusable="true" dir="ltr" href="https://twitter.com/hashtag/FreeZimbabweCampaign?src=hashtag_click" role="link">#FreeZimbabweCampaign</a>. He was also hit on his backside, hands, knees, &amp; legs with baton sticks, logs. They kicked, slapped him with open &amp; hit with fists.
He saw some of the victims who after being tortured were force-given knives &amp; catapults before being taken to Harare Central Police Station. This is fabrication of evidence of possession of weapons for use in violence as means to further persecute using the justice system.
One of the ZanuPf youths who may have either recognized Zenzo or his surname during interrogation requested his ID card at around 1800hrs. He then forced him to eat sadza &amp; later vouched for his release. They took his money We are not sure of what really became of others.
Those with missing friends/relatives need to check out with ZanuPf. Activist Claims Zanu-PF Used Police Uniforms To Abduct Protestors

The photo of a woman lying conscious while journalists focus on taking photos has sparked debate on Zimbabwe’s social media. On one side are people that are saying journalists should have helped instead of focusing on their professional work.
The other side says that journalists need to focus on their professional work so that the story of the events are told as they are.
The woman had beaten by the police while fleeing as the Zimbabwe Republic Police Offers dispersed protestors with batons and teargas.

<h2>POLICE UPDATE ON THE SECURITY SITUATION IN ZIMBABWE</h2>
The Zimbabwe Republic Police informs the nation that following the issuance of a prohibition notice by the Regulating Authority for Harare Central District, the MDC Alliance filed an urgent chamber application with the High Court. The High Court ruled against the holding of the demonstrations but the MDC Alliance activists went on to gather at Africa Unity Square and other parts of Harare Central Business District, in defiance of the court ruling.
Some of the youths went on to engage in confrontational acts which include threats, intimidation and disruption of the smooth flow of traffic in the Central Business District. The police moved in and dispersed the unlawful gatherings, in the process 91 people were arrested for various offences in Chitungwiza, Harare Central Business District and Harare South.
We have also noted with concern falsehoods by some online publications that the police shot into the crowds and killed two people, which is false. No live rounds were used by the police. No one was shot or injured by police through firearms.
The police is firm on the ground to ensure that law and order is maintained. We are appealing to members of the public to remain calm and peaceful. They should continue to conduct day to day activities in a peaceful manner.
We want to assure all citizens that the police stand ready to protect Zimbabweans and visitors in line with its constitutional responsibility. Let us be responsible and shun acts of violence, destruction, looting of property and disturbing business operations in the country.

Following the violent dispersion of protestors in Harare CBD, the Zimbabwe Republic Police (ZRP) has said that it expects the public to respect the High Court Verdict.
The statement also said that the ZRP is aware of plans by some “unruly elements” to disrupt business activities in Harare.
Said the ZRP:
<blockquote>The ZRP would like to assure the nation that generally the situation is calm. The High Court has given a ruling against the demonstrations and we expect all peace loving and law abiding citizens to respect the verdict.
We are aware that there are some unruly elements bent on fomenting anarchy by disrupting the smooth flow of business activities in Harare CBD in defiance of the court ruling. We are firmly on the ground to maintain law and order.  @HeraldZimbabwe @ZBCNewsonline @NhauRadio</blockquote>
Earlier today, the High Court dismissed an application by the MDC to have a police ban on the 16 August demonstrations lifted.
The MDC leadership announced that the demonstration had been called off and advised people to stay at home.
A crowd had, however, already gathered in town in preparation for the protests. The ZRP dispersed the crowds using tear gas and baton beatings. One lady fell unconscious during the crowd dispersion and has reportedly been admitted to a hospital for treatment.
Outside the violent beatings by the police, there’s no evidence so far that the crowd had itself been violent.

Zimbabwe anti-riot police beat protestors who had gathered for the 16 August MDC demonstration in Harare. One woman lost consciousness during the process and was rushed to the hospital. It is not clear yet if it was the beatings or the stampeding crowd that hurt her.

The High Court has upheld the ban on MDC Demo by the police. This means the demonstration remains baned.
The MDC had made an urgent chamber application seeking nullification of the prohibition order which banned its planned demonstration.
There are however reports that MDC members and supporters of the demonstration have already grouped and are marching and singing songs along Jason Moyo Avenue in Harare.

JUST In: High Court Upholds Ban On MDC Demo

Chief Felix Nhlanhlayamangwe Ndiweni has reportedly been remanded in custody for sentencing tomorrow in a case in which he stands accused of destroying a villager’s crops.
The outspoken traditional leader has been vocal in calling for citizens to take part in the MDC-organised demonstrations set to commence tomorrow. He released a video in which he said:
<blockquote>I’m hopeful that on this occasion these protests will be a family day. Bring out your whole family, let’s all come out on the day of protest; a peaceful legal protest because it’s about engagement, it’s about communication with the current administration.</blockquote>

Chief Ndiweni Kept In Custody Ahead Of Sentencing

The European Union (EU) has reaffirmed Zimbabweans’ right to freedom of assembly, association and peaceful protest.
The EU has urged demonstrators to abstain from violence or vandalism, and security forces to exercise restraint. It said in a statement:
<blockquote>On the eve of planned demonstrations, the EU reiterates that citizens have rights to freedom of assembly, association, expression and to peaceful protest.
We urge demonstrators to abstain from violence or vandalism and call on security forces to exercise constraint and proportionality!</blockquote>
Meanwhile, the Zimbabwe Republic Police has accused the protests convenors of plotting to unleash violence. Part of the ZRP statement reads in part:
<blockquote>The Zimbabwe Republic Police (ZRP) informs the nation that based on the notifications given by MDC A to regulating authorities to hold demonstrations in Harare, Bulawayo, Gweru, Masvingo, Mutare and surrounding towns on August 16, 19, 20, 21 and 22 , intelligence and concrete evidence on the ground has revealed that indeed these so-called ‘peaceful’ demonstrations will turn out to be violent.</blockquote>

EU Speaks On MDC's Planned Demonstrations

The Zimbabwe Republic Police on Thursday afternoon deployed its officers in full force in Harare ahead of protests planned by the opposition Movement for Democratic Change (MDC) set for Friday, 16 August 2018.
Police with water cannons patrolled the streets and warned residents, “you will rot in jail” if they participate in the demonstrations.

The government will not interfere with the planned MDC demonstration tomorrow unless there are signs of violence that will need security forces to intervene.
Zim Morning Post reports that a high-level meeting was held at President Emmerson Mnangagwa’s Munhumutapa Offices and a decision to allow the demonstrations to proceed was made.
The permanent secretary for the Ministry of Information, Publicity and Broadcasting Services, Ndavaningi Nick Mangwana is quoted as saying:
<blockquote>The president who is also the head of state said the demonstration will go on with no disturbances from the security forces unless there in need for involvement.
In terms of section 59 of the Constitution, it is every person’s right to demonstrate and the government will not infringe on this right.
Security forces are found in every establishment for the reason of safeguarding human life, dignity, property, peace and maintain order.
The forces have to ensure the safety and protection of individuals participating in the demonstrations and also those not participating.</blockquote>

Mnangagwa Permits MDC's Planned Demonstrations - Report

The government said that there will be enough buses to carry people to their destinations tomorrow in light of the MDC’s planned demonstrations.
Zimbabwe United Passengers Company (ZUPCO) chief executive Everisto Madangwa to The Herald that the company will provide adequate coaches for everyone. He said:
<blockquote>As ZUPCO, we are saying our commuters should not be worried about transport issues during the so-called demonstrations. There will be enough buses for them.
We will not be affected at all by the demonstrations and our buses will be operating as usual, so we are assuring all citizens countrywide that there will be reliable and adequate transport for them.</blockquote>
During the January 2019 protests, hundreds of commuters were left stranded after transporters suddenly pulled their vehicles off the road. Some commuters were forced to walk from the city centre to Chitungwiza, a distance of approximately 27km.

Govt Promises To Deploy Enough ZUPCO Buses Tomorrow

MDC vice president, Tendai Biti told ZimLive.com that President Emmerson Mnangagwa is not genuine about genuine dialogue.
The MDC has planned demonstrations across the country’s major cities to force ZANU PF to come to the negotiating table to chart the way forward over the untenable socio-economic situation currently prevailing in the country. Said Biti:
<blockquote>The right to demonstrate is enshrined in the constitution and it is our democratic right to exercise the same.
Mnangagwa is not genuine about genuine dialogue. If he was, he would create the conditions necessary for that to happen. He would stop abducting our people.
He would not seek to negotiate on Twitter. He would ensure that the issue is tabled in Dar es Salaam to allow SADC to guarantee the process and allow an agreed facilitator.

Zimlive reports that Government Intelligence sources have told it the identity of the man that government claims came into the country to assist MDC with the 16 August Demonstrations.
The man, <a href="https://en.wikipedia.org/wiki/Sr%C4%91a_Popovi%C4%87_(activist)">Srđa Popović</a>, is a 46-year-old Serbian political activist who is apparently credited for helping topple the tyrant, Slobodan Milosevic as well as assisting in the Arab Spring protests that toppled governments in North Africa.
According to the sources, Popović was in Bulawayo.
The report also says Popović organised a civil disobedience training for Zimbabwean activists in May and that this is the one that resulted in the arrest of several activists in that month:

Identity of Foreigner That Government Claims Came For MDC Demonstrations

The Movement for Democratic Change (MDC) has been criticised for what has been described as poor communication ahead of its mass protests planned for the 16th, 19th and 20th August.
The party’s Secretary-General announced yesterday that details of the planned protests would be made available on Wednesday 14 August as the party feared disruption of its plans by the government. However, some commentators have indicated that it’s online communication channels are not being used to communicate any coherent messages.
