A Zimbabwean court on Monday, November 18, ordered the Zimbabwe Republic Police (ZRP) to return electronic gadgets, including mobile phones and laptops, that had been unlawfully confiscated from three prominent pro-democracy campaigners.
According to the Zimbabwe Lawyers for Human Rights (ZLHR), the three pro-democracy campaigners namely Namatai Kwekweza, Robson Chere and Samuel Gwenzi were on Wednesday 31 July 2024 seized from a plane in Harare in July and tortured before being prosecuted on charges of disorderly conduct in a public place.
They had boarded at Robert Mugabe International Airport in Harare, while on their way to attend a conference in Victoria Falls. Said ZLHR:

Kwekweza, the leader of WeLead Trust, Chere, the Secretary-General of Amalgamated Rural Teachers Union of Zimbabwe and Gwenzi, a former Councillor for Ward 5 in Harare, were charged with disorderly conduct in a public place as defined in section 41(b) of the Criminal Law (Codification and Reform) Act and accused of allegedly participating in an unsanctioned demonstration reportedly held at Harare Magistrates Court in June, where they protested against the detention of Citizens Coalition for Change political party leader Jameson Timba and some of the opposition party members and demanding their release from prison.
The trio, who are out of prison custody on bail and are represented by Jeremiah Bamu, Tinashe Chinopfukutwa and Kelvin Kabaya of Zimbabwe Lawyers for Human Rights, recently filed an application at Harare Magistrates Court, where they asked the court to order ZRP to release their mobile phone handsets and laptops, arguing that their electronic gadgets were being unlawfully held by ZRP as according to prosecutors, the seized devices, were not required to be used during their trial.
On Monday 18 November 2024, a Harare Magistrate ordered ZRP to release and return Kwekweza, Chere and Gwenzi’s mobile phone handsets and laptops.
Kwekweza, Chere and Gwenzi together with Vusumuzi Moyo, Phillies Pikitayi, Dephine Gutsa, Simbarashe Blackson, Emmanuel Sitima and Last Chinodya, return to court on 9 December, where a ruling on their application for exception to the charges of disorderly conduct, will be handed down.

A court in Zimbabwe told the police to give back phones and computers taken from three activists. The activists were arrested after a protest. The activists asked for their things back, saying they didn't need them for the trial. The court agreed and said the police must return the items. The activists will find out in December if they will still be charged. The activists are out of jail now, but will have to go back to court soon.

Court Orders ZRP To Return Seized Gadgets Of Pro-Democracy Activists

The Kofi Annan Foundation, an independent, not-for-profit organisation that works to promote better global governance, has called on Zimbabwean authorities to release pro-democracy campaigners Namatai Kwekweza, Robson Chere and Samuel Gwenzi.
On Monday, August 19, ZANU-PF party spokesperson Christopher Mutsvangwa said opposition activists and pro-democracy campaigners arrested in the lead-up to the 44th SADC Summit, held on August 17, may now be released.
Mutsvangwa claimed the arrests were intended to prevent potential demonstrations during the summit.
However, on Monday, August 26, Kwekweza, Chere and Gwenzi were further remanded in custody until September 3, pending trial when they appeared before a magistrate.
In a statement, the Kofi Annan Foundation expressed concern over the continued detention of the activists, saying that there was no legitimate reason for their ongoing incarceration. It said:

Last week, ZANU PF spokesperson Christopher Mutsvangwa admitted there was no reason to continue to detain Namatai Kwekweza.
Today, 26 August 2024, despite evidence of her innocence, the courts continue to deny Namatai’s bail and have extended her detention until 5 September 2024.
We again call on Zimbabwean authorities to immediately release Namatai and her fellow human rights defenders and to drop all of the clearly spurious charges against them.

The three activists are being represented by the Zimbabwe Lawyers for Human Rights (ZLHR), a prominent human rights organisation in the country.
The trio face allegations of protesting outside the Harare Magistrates Court against the arrest and continued detention of dozens of opposition CCC activists. They are all denying the charge.

The ZANU-PF party says they might be released. But they were kept in custody until their trial on September 3. The foundation says there is no good reason to keep them in jail. Kofi Annan Foundation Demands Release Of Jailed Zimbabwean Activists

The MDC has complained that the police is denying people their constitutional right to demonstrate. In a statement posted on the party’s Facebook page the <a href="https://www.pindula.co.zw/Nelson_Chamisa">Nelson Chamisa</a> led party said:
<blockquote>The ZRP is brazenly violating the country’s Constitution, repressing citizens, proscribing legitimate political activity and treating the MDC as a terrorist organization in clear violation of the basic tenets of prudent policing as enshrined in the law and in international best practice.
Instead of servicing the Zimbabwean population in accordance with the laws of the land, the police service which clearly behaves like Boko Haram decimating and violating all forms of the rule of law.
We have seen the police service involved in serious human rights violations such as; 
-Disregarding court orders 
-Selective application of the law 
-Unnecessary abductions and assaults on innocent members of the public 
-Unlawful detentions 
-Denying and disrupting MDC meetings and peaceful demonstrations
It is pertinent to state that when the police are notified of any demonstration or meeting, it is not for them to approve but to deploy their officers to facilitate the exercise of the right to assemble. The police have become the source of all forms of riotous behavior and chaos in the country. They cannot stop any meeting or demonstrations because it is not one of their duties to do so but to deploy their officers to make sure that no crime is committed.
We feel there should be a deliberate retraining programmes for all police officers. There are so many criminal cases committed by the police, many of which go unreported for fear of victimization. Only such cases like armed robbery, rape, extortion and others end up in courts.
We demand that the police should come up with serious reforms to align them with Constitutional behavior and with international best practice. The Constitution and the law are very clear that for the purposes of preserving the internal security and maintaining law and order in Zimbabwe, there shall be a police service and every member of that police service is charged with the general duty of maintaining law and order by taking all steps necessary for:
-Preserving peace 
-Protecting property from malicious injury 
-Preventing crime 
-Detecting crime 
-Apprehending offenders 
-Suppressing all forms of civil commotion or disturbances that may occur in any part of Zimbabwe 
-Upholding the constitution and enforcing the law without fear or favour 
-The police service must be non-partisan, national in character, patriotic, professional and surbodinate to the civilian authority as established by the constitution.

Abducted And Assaulted Musician, Platinum Prince 's Grandmother Speaks Out

Reports indicate that the Zimbabwe Republic Police (ZRP) on Monday morning deployed an anti-riot unit at the <a href="https://www.pindula.co.zw/Rotten_Row" rel="noopener noreferrer" target="_blank">Rotten Row</a> court as activists protested the killing of a vendor, Hilton Tafadzwa Mangani whilst in custody.

MDC Activists Arrested At Rotten Row Court - Report

A Zimbabwe Independent report reveals that the Zimbabwe National Army’s Military Intelligence (MI) unit has put on its watchlist a number of civil society activists it suspects of working hand in glove with the United States of America to overthrow the Zimbabwean government.
Those placed under surveillance include an organisation known as Generation Consensus, led by Ostalus Siziba; the Children of Zimbabwe War Veterans Association (Cozwa), led by Munyaradzi Shoko; and the Crisis in Zimbabwe Coalition (CiZC), according to the Zimbabwe Independent.
The report further claims to have in its possession an internal memorandum circulated recently by the MI in which it makes several claims. The memo reads in part:
<blockquote>Information was gleaned to the effect that on May 10 2019, four American nationals namely Nell Penner, Peter Tony and two others yet to be identified as well as Willie Spies, a South African member of Afriforum held a meeting at Parktonian Hotel, Braamfontein, South Africa.
The workshop is code-named Savannah revolution, running under the theme ‘National Order and Economic Revolution in Zimbabwe’.
Information at hand shows that the workshop entered day two on May 11 2019, where one of the American facilitators, Will Spies, highlighted that there was a need for a political revolution in Zimbabwe in order to bring national order which would ultimately reclaim and unlock massive economic growth in the country.
Spies claimed that no meaningful development can take off without considering a political revolution.</blockquote>
However, CiZC director Thulani Mswelanto said that his organisation never sent people to the workshop. He said:
<blockquote>We never sent people to that workshop. It’s sad that they continue to generate reports so that they can create an opportunity to crack down on civil society.
Let them know that civil society does not reconstitute the political order. We are not aware of any plans to undertake a revolution next week or any other time.</blockquote>

Military Places Civil Rights Activists Under Surveillance - Report

Two activists who were arrested last month and charged with subversion were released on bail on Monday by the High Court.
The duo, Rita Nyamupinga and Stabile Dhewa, were arrested on arrival at the Robert Gabriel Mugabe International Airport on their return from the Maldives where they had gone to attend a workshop.
High Court judge, Justice Amy Tsanga ordered their release on Monday on $1 000 bail each.
<blockquote>In an interview with AFP, Zimbabwe Lawyers for Human Rights spokesman Kumbirai Mafunda said:
We welcome the court’s decision in releasing the human rights campaigners. They did not deserve to have been in prison in the first place.</blockquote>
Mafunda, however, revealed that the two were released on stringent bail conditions as they are required to report to the police every day among other conditions.
Their release follows that of the other five activists who were released on bail on Friday.
The arrest of the 7 activists came soon after State-controlled publication, The Herald published an article which claimed that they were in the Maldives for training on subversive activities.

Two More Human Rights Defenders Released On $1 000 Bail Each

The Zimbabwe Republic Police was called to order by a High Court judge over the human rights violations of 7 human rights defenders who were arrested at the RGMI Airport on arrival from the Maldives recently.
Justice Tawanda Chitapi on Friday granted five of the activists $1 000 bail each while the other two activists’ bail application will be considered on Monday.
In granting bail to the five, Justice Chitapi reminded the police of Chapter 4 of the Constitution of Zimbabwe, in particular, Section 44. He ruled:
<blockquote>The circumstances around the arrest were as detailed by them (activists).
I would in this regard remind the police of Chapter 4 of the Constitution of Zimbabwe, in particular, Section 44.
They have a duty to respect fundamental rights to freedom, protect and promote basic freedoms.</blockquote>
The judge berated the police for putting the cart before the horse, that is, arresting citizens in order to investigate when it should be the opposite.
Meanwhile, Zimbabwe Lawyers for Human Rights (ZLHR) executive director Roselyn Hanzi expressed delight in the manner in which Justice Chitapi handled the issue. She said:
<blockquote>It was very clear in the manner in which they were arrested that the state officials that were involved were acting outside the constitution.
We are so excited that the issue of arresting to investigate that we have always spoken about was noted by the judge, that it is a wrong practice and we hope that going ahead, the police are going to institute sweeping reforms to ensure those police officers and any other officials involved in the arrests follow the dictates of the constitution.</blockquote>

High Court Rebukes Police Over Activists' "Unlawful" Detention

The five human rights activists who were arrested on arrival at the Robert Gabriel Mugabe International Airport while returning from a trip from the Maldives have been released on bail.
The five are George Makoni (38), Tatenda Mombeyarara (37), Gamuchirai Mukura (31), Nyasha Mpahlo (35) and Farirai Gumbonzvanda aged 26.
They were released by High Court Judge Justice Tawanda Chitapi who ruled that the State had no compelling reason to oppose bail by the applicants. He said:
<blockquote>It is not clear on what the workshop covered as a program cannot be used to determine the contents of the workshop.
There was no meaningful dispute to the challenges put forward by applicants.</blockquote>
The five, who are all facing treason charges, are being represented by the Zimbabwe Lawyers for Human Rights led by Jeremiah Bamu.
Meanwhile, two other activists arrested days after the first five will learn if they get bail on Monday, June 10, after Justice Tsanga withheld judgment on Friday. Stabile Dewa and Beauty Rita Nyamupinga face treason charges.

5 'Maldives Conspirators' Freed On Bail

<h4>Nonviolence is a basic human right</h4>
The Center for Applied Non-Violent Action and Strategies (CANVAS) firmly condemns the illegal arrest of seven (7) Zimbabwean civil society activists on their way home from attending a training workshop organized by CANVAS in the Maldives from May 15 to 19, 2019.
All of them have been denied bail so far. Six are remanded in person. The seventh person has serious health issues – she is remanded in a public hospital and denied the right to seek treatment in her preferred private clinic.
Their names are George Makoni, Nyasha Frank Mpahlo, Tatenda Mombeyarara, Gamuchirai Mukura, Farirai Gumbonzvanda, Stabile Dewa, and Rita Nyampinga.
During the workshop, the State-controlled newspaper, The Herald, published an article that falsely accused participants of plotting to unleash violence in Zimbabwe in a bid to overthrow the Government.
CANVAS would like to inform Zimbabweans and the international community that the charges against these activists are blatantly false.
The charges include: “subversion”, “counterintelligence”, and “being trained in the use of small arms”.
The activists could face up to twenty years in prison for these charges. The workshop focused on advocacy and civic engagement capacity building such as Developing Shared Vision of Tomorrow; Civic Engagement; Effective Communications; Protecting Privacy and Security; and Organizational Planning.
For a decade and a half, CANVAS’ mission has been focused on the fact that nonviolence is morally and ethically superior to violence, and more likely to produce constructive outcomes and build strong and stable societies.
The arrests clearly violate provisions of the Zimbabwean Constitution on freedom of assembly and expression and the African Charter on Human and People’s Rights.
Basic universal principles of due process, the presumption of innocence until proven guilty, and conducting an unbiased investigation before arrest need to be upheld.
As long as the Government continues to violate the fundamental rights the constitution confers to Zimbabweans, it will not be seen by citizens and the international community as democratic or law abiding.
CANVAS calls on the Government of Zimbabwe to immediately and unconditionally release the seven (7) activists and follow the rule of law.
Participation in a workshop with a focus on peacebuilding and nonviolence should never be considered a crime, as the practice of nonviolence and peaceful assembly are fundamental human rights.

The government of Zimbabwe has continued its crackdown, civic organisation leaders, after the Zimbabwe Republic Police (ZRP) made two more arrests on Monday.
The Director of Female Prisoners Support Trust Rita Nyampinga and Stabile Dewa, and the Director of Women’s Academy for Leadership and Political Excellence were arrested on arrival at the RGMI Airport on their return from attending a workshop in the Maldives.
They were taken to Harare Central Police Station for further investigations and will appear in court soon.
The government accuses the activists of having undergone training on how to mobilise anti-government protests.
Only last week, five other activists were arrested on their return from the Maldives and have since been charged with attempting to subvert a constitutionally-elected Government.

Farirai Gumbonzvanda, a 26-year-old volunteer for Rozaria Trust was arrested alongside Tatenda Mombeyarara, George Makoni, Nyasha Frank Mpahlo and Gamuchirai Mukura on arrival at the RGMI Airport on their return from attending a workshop in the Maldives.
The five face charges of Subverting a constitutional government as defined in section 22(2)(a)(iii) of the Criminal Law (Codification and Reform) Act.

ZIMBABWEANS REACT: Arrest Of Young Woman On Treason Charges

Four pro-democracy activists who were arrested on arrival at the Robert Gabriel Mugabe International Airport have been charged with treason.
This was revealed by the Zimbabwe Lawyers for Human Rights (ZLHR) in a statement which reads:
<blockquote>Zim authorities charge four pro-democracy campaigners George Makoni, Tatenda Mombeyara, Gamuchirai Mukura and Nyasha Mpahlo with subverting constitutional government for allegedly plotting to overthrow President Emmerson Mnangagwa’s administration.</blockquote>
In a statement, the Ministry of Information and Publicity said:
<blockquote>The Police have arrested 4 members of 3 CSOs ( COTRAD, International Socialist Organisation and Green Governance Zimbabwe) who are suspected of breaking the law.
Investigations are currently underway and the rule of law should be allowed to take its course.</blockquote>

4 Pro-democracy Activists Charged With Treason

Police have arrested four human rights activists at the Robert Gabriel Mugabe International Airport on their return from a foreign trip.
Police officers also took away cellphones and laptops belonging to the activists.
In a statement on Tuesday, Zimbabwe Lawyers for Human Rights (ZLHR) spokesman Kumbirai Mafunda said:
<blockquote>They were detained upon disembarking from a South African flight at Robert Mugabe International Airport last night and held for several hours without access to their lawyers.</blockquote>
The four are George Makoni, 38, advocacy officer for the NGO Centre for Community Development Zimbabwe; Tatenda Mombeyarara, 37, coordinator for lobby group Citizens Manifesto; Gamuchirai Mukura, 31, executive director of Community Tolerance Reconciliation and Development (COTRAD); and Nyasha Mpahlo, 35, governance officer at Transparency International Zimbabwe.
Lawyers were only allowed access to the four, 5 hours hours after they were arrested.
The arrest of the human rights activists follows a report carried in State daily publications, The Herald and Chronicle that suggested that civic organisations are plotting to cause mayhem in the country.
The civil society alliance Crisis in Zimbabwe Coalition condemned the latest arrests. It said in a statement:
<blockquote>The police, government and state media have been colluding to criminalise the work of human rights defenders, laying unfounded allegations against civil society leaders as agents of regime change who want to topple the government.</blockquote>

Govt Goes After Human Rights Activists

ZANU PF claims that one of its members from Samora Machel in Stoneridge was attacked by suspected opposition party activists who broke into her house on Tuesday night.
<blockquote>The attackers allegedly used a knife in the attack and it is suspected that they wanted to kill her. A statement posted by the ‘ZANU PF Patriots’ reads as follows:
ZANU PF Chairwoman from Samora Machel Stoneridge was attacked with knives by opposition members who broke into her house last night. The knife cuts clearly show the intent was to kill her.</blockquote>

Activists deliver letter of apology to S.A. embassy following Grace Mugabe assault on Gabriella Engels

Former Deputy Prime Minister Arthur Mutambara has urged student activists who do not excel in their studies to stay away from activism and concentrate on their studies instead. Mutambara described these students as dull while launching his book “In Search of the Elusive Zimbabwean Dream: An Autobiography of Thought Leadership (Volume One)” in Mutare. He also urged locals to document their own histories rather than waiting for foreigners to become authorities on Zimbabwean history.
Said Mutambara:
<blockquote>Don’t just make noise but also excel in your studies; if you don’t have the brains for academia stay out of activism.
It’s embarrassing that Zimbabweans have a very limited written history about their culture and ways. Locals should document their family history and not let foreigners to be authorities on locals’ history.
Let us craft our own history so that we become authorities on the history of Africa. We must be masters of our own narratives.</blockquote>
