A High Court judge has dismissed an application from Ashford Potera, a Harare man seeking to deny his ex-wife, Monica Chigariro, an equal share of their property and mansion in Borrowdale, citing her alleged involvement in an adulterous affair, reported <a href="https://www.newsday.co.zw/local-news/article/200032494/cheating-no-ground-for-refusal-to-share-property-high-court">NewsDay</a>.
The couple, who were in an unregistered customary union since 1999, divorced in September 2022. Potera argued against the equal division of their assets, claiming saying he was the one formally employed.
However, Justice Amy Tsanga ruled in favor of Chigariro, saying Potera should have filed a separate claim for damages for adultery instead. Ruled the judge:

Defendant (Potera) mentioned a cellphone that was purportedly given to a boyfriend long after the property was built.
It is true that the affair may have sounded the death knell to their customary union, but there is no evidence that it had an impact on the property acquired together. Moreover, the property is registered in both names.
Where property is registered in both names, its distribution is generally equal between the owners unless there are compelling reasons for deviation from equal sharing.
To centre adulterous conduct in property sharing should only be “just” where the evidence is clear that it impacted on their marital assets and diminished their marital estate in some way.
The adultery may very well have no relevance to the proprietary issues and can often be the result of an already broken marriage.

Justice Tsanga said Chigariro contributed to the acquisition of the disputed property by making cross-border trips to obtain goods for resale, in addition to managing the home and caring for the family.
The judge further noted that the property is registered in both their names, affirming their joint ownership.
The judge said Chigariro has pressing needs, as she is responsible for their minor child and a major child who is still in school.
Justice Tsanga also stated that the duration of the marriage is a key factor in determining a 50% share of assets in lengthy marriages.
Justice Tsanga ordered that the property be divided equally, with 50% to be transferred within six months.
Potera was also directed to pay US$400 in outstanding maintenance for his minor child and US$50 monthly until the child turns 18.
Chigariro had requested equal sharing of their assets, citing their family life and the acquisition of both movable and immovable property during their marriage.
Potera argued that her contribution was minimal since she was not formally employed, initially offering only 10% and later 15% of the property.
He also claimed the marriage ended due to Chigariro’s alleged infidelity.

A man tried to stop his ex-wife from getting half of their house because she cheated. But the judge said cheating doesn't matter when sharing property. The judge said both of them owned the house, so they have to share it equally. The judge also said the wife helped get things to sell and took care of the family. The wife will get 50% of the house and the man has to pay money for their child. Cheating doesn't affect sharing property, according to the judge.

High Court Rules Adultery Not A Valid Reason To Deny Property Sharing With Unfaithful Wife

A senior member of the Zimbabwe Republic Police (ZRP) has been removed from his position for having an illicit affair with one of his married junior officers, reported <a href="https://www.hmetro.co.zw/adulterous-affair-leads-to-senior-cops-demotion/">H-Metro</a>.
Chief Superintendent Reason Ncube was removed from his position as Officer Commanding Norton District after his adulterous affair with Constable Ethel Kusangaya was exposed.
The illicit affair was exposed after Ethel’s husband, Stalin Muvengwa, fitted a car tracking system on the family vehicle.
It is alleged that Ethel, clad in police uniform, drove the family vehicle to Norton after telling her husband she was going to a different place.
Chief Supt Ncube told Ethel to park her vehicle and the two cops took a romantic drive in his car unaware that Muvengwa was trailing them.
After noticing that there was a vehicle following them, Chief Supt Ncube called someone to tow Ethel’s vehicle to a car park in Kuwadzana Extension. But it was too late as Muvengwa confronted them.
H-Metro reported sources as saying Ethel pleaded with her husband not to assault her in uniform while Chief Supt Ncube also pleaded with Muvengwa for forgiveness.
Muvengwa lambasted Chief Supt Ncube, saying that his lust had wrecked his family. He said:

Does it mean that his promotion was to abuse junior officers?
Ncube has damaged my family, my children and my standing in society.
We are now undergoing counselling to heal our children and to find peace with my in-laws.
My wife stooped so low that she emotionally and socially damaged my trust.

Cst Kusangaya is stationed at Warren Park Police Station.
Neither Ncube nor Ethel have commented on the situation.

Senior Cop Demoted For Dating Married Junior Police Officer

Chief Makoni recently overturned the ruling by a headman’s court that had found a villager guilty of having an affair with his neighbour’s wife.
The complainant, Taurai Nyamukachi, claimed that his children informed him that their mother was having an illicit affair with a neighbour, Arthur Mugoti.
Nyamukachi of Maparura Village approached Chief Makoni’s court after Mugoti allegedly reneged on his pledge to compensate him for having an affair with his wife when the matter was brought before Headman Maparura’s court.
According to <a href="https://www.manicapost.co.zw/children-sell-out-cheating-mom/">The Manica Post</a>, Nyamukachi told Chief Makoni’s court that his children and other villagers tipped him off about the alleged affair between Mugoti and his wife, which led to their divorce. He said:
<blockquote>
Whenever I was away from home, Mugoti would visit my homestead. He would take my wife away and bring her back in the evening.
I was informed of this development by my own children who were fed up with their mother’s unbecoming behaviour.
Fellow villagers whom I had contracted to sink a well at my homestead also informed me of Mugoti’s frequent visits to my homestead during my absence.
At one time Mugoti came during the evening when I was around and my wife rushed to the door to inform him of my presence. My son who is doing Form Four saw him.
My son and his sibling informed me that their mother and Mugoti were seeing each other.
I reported the matter to Headman Maparura’s court. Mugoti pleaded guilty before the court and was fined a beast and three goats but he is now refusing to pay the fine.
Before the matter appeared at the village court, my mother-in-law gave me a divorce token and took her daughter away.
We are divorced now. I want Mugoti to compensate me with eight cattle for ruining my marriage.

However, Mugoti denied the allegations, saying he only visited Nyamukachi’s homestead to buy tomatoes and was never in a relationship with his wife. Said Mugoti:

I visited Nyamukachi’s homestead twice to buy tomatoes. He later called me to his homestead and confronted me about dating his wife and I denied that.
He took the matter to the headman’s court, but he failed to provide evidence of my alleged affair with his wife.
He later shifted goalposts and said I should pay him for setting foot on his homestead. I was fined a beast and two goats and I am disputing the ruling.

In its ruling, Chief Makoni’s court cleared Mugoti of any wrongdoing, saying Nyamukachi had failed to provide evidence to prove the alleged illicit relationship between Mugoti and his ex-wife.
The court quashed the headman’s ruling and said visiting someone’s homestead does not constitute cheating, adding “One cannot be fined for visiting a neighbour’s homestead”.

The Zimbabwe Republic Police (ZRP) has reported several cases of crime across the country, including murder and drug possession.
Adultery-accused Father Whips Daughter To Death:
In Nyanga, a man named Amos Rutendo Nyamangodo was arrested for the murder of his daughter, Rufaro Nyamangodo. She was allegedly hit with a mulberry tree switch all over her body. The incident occurred on 23 December 2023 in Mangwanda Village, Mutasa, Honde Valley. The suspect accused the victim of having an affair with a neighbour.
Crystal Meth Dealers Arrested:
On 29 December 2023, detectives from CID Drugs and Narcotics in Harare arrested Brenda Jinjike (40), also known as Mai Dee, for the unlawful possession of 50 grams of Crystal Meth, valued at ZWL$5,000,000. The suspect was intercepted along Makumbe Drive, Madokero, Harare, and the drugs were found in her Mercedes Benz vehicle. Additionally, the suspect’s sister, Letina Jinjike (47), alias Mai Mobby, was arrested at a house in St Marys Chitungwiza for the unlawful possession of three grams of Crystal Meth, valued at ZWL$30,000.
Murder in Hopley Zone 5 Farm:
In Harare, the police are appealing for information regarding the murder of Tichaona Choto (40). His body was found with a wound on the ear and bruises all over his body at a house in Hopley Zone 5 Farm, Waterfalls, on 29/12/23. Anyone with information is urged to report it to the nearest police station.  
Death after House Collapse in Nyanga:
A tragic incident occurred in Nyanga South, where Perpetual Muzengembuya (19) and her niece, Lessly Maroka (4 months), died when their house collapsed due to heavy rains on 29/12/23. The house was located at a timber company.

Crime Watch: Man Whips Daughter To Death For Accusing Him Of Adultery

A Rusape man who was last year fined five cattle by a community court for dating his son’s wife was last week fined two cattle after it emerged that they did not terminate the illicit sexual relationship.
Isaac Marowa of Masvosva Village was brought before Chief Makoni’s court for sleeping with his son, Bartholomew Marowa’s wife, Forget Marowa.
In February last year, Isaac was found guilty of dating his daughter-in-law. This was after his son, Bartholomew, found love messages between the two in Forget’s cellphone.
After the betrayal, Bartholomew sent his wife packing but later forgave her and took her back.
However, he discovered that the two were still dating and sending a lot of love messages to each other.
Narrating his case before the community court recently, Bartholomew said Forget had saved his father’s number as YYU in her phone.
He said that in one of the messages, they were planning to meet in Rusape for some “quality time”. Said Bartholomew:

This is my second time coming before this court, suing my father for dating my wife. He is still seeing my wife.
In March 2023, I scrolled my wife’s phone and came across a contact saved as YYU. She was exchanging love messages with that contact.
They were also planning to travel to Rusape to have some quality time. I made some inquiries, only to realise that YYU was my father. Both my wife and father denied dating.

Isaac, however, denied ever dating his daughter-in-law adding that his son is just suspicious and does not have any evidence.
He also revealed that Bartholomew set his house on fire, accusing him of sleeping with Forget.
Forget also denied dating her father-in-law and claimed that there was no way she could ever communicate with Isaac as her phone was always with her husband.
Despite the denials, Chief Makoni’s court found Isaac guilty of adultery and fined him two cattle.
Isaac was also found guilty of incest and was fined one beast.
He was also ordered to hand over two goats to his son as the cost of the lawsuit.

Rusape Man Fined For A Second Time For Bedding Daughter-in-law, Again

The Zion Christian Church Kumuka Kwavakafa Nhaudzashe (ZCCKK), has expelled a bishop for putting the church into disrepute.
The defrocked cleric, Lyphet Matenda Mugaviri, allegedly tried to lure his daughter-in-law into an illicit sexual relationship.
Mugaviri reportedly sent his nudes to Olinda Mashavave, who is the wife of his brother’s son, Lesly Mugaviri.
After she had been bombarded with nudes and love proposals by the bishop via WhatsApp, Olinda reported the matter to her husband, Lesly.
Lesly then trapped his uncle by chatting with him using his wife’s WhatsApp, and he took the bait.
ZCCKK representative, Elder Ngonidzaishe Hungwe, confirmed to <a href="https://www.hmetro.co.zw/shamed-and-shunned-love-struck-bishop-expelled-from-church/">H-Metro </a>that Bishop Mugaviri had been excommunicated. He said:

The bishop’s act has put the church in a bad light. The church has expelled him.
The bishop was recently accused of attempting to commit adultery with his daughter-in-law.
The church distances itself from such immoral acts and views them as contrary to our core values, doctrines, beliefs and practices.
After monitoring and investigating the issue, the church noted that the bishop not only damaged his personal reputation but also portrayed the entire church in bad light.

Hungwe said they will meet in August at a memorial service of one of the church members and they will announce a new bishop at the event.

Bishop Expelled From Church For Attempting To Bed His Daughter-in-law

A businessman was axed to death and had his legs chopped off by his alleged lover’s husband on Sunday in Tafira village under Chief Mashayamombe.
The victim, Abia Vimbai Mapininga (67) of Chindavata General Dealer, was allegedly murdered by Doubt Dzama, a suspected gold panner.
<a href="https://www.hmetro.co.zw/cheating-businessman-axed-to-death-legs-chopped-off-lured-to-married-lovers-home-through-whatsapp-gold-panner-took-control-of-his-wifes-cellphone/">H-Metro</a> reported sources as saying Mapininga was lured to Dzama’s house in a WhatsApp conversation where he was murdered.
Dzama reportedly found Mapininga’s love messages in his wife Sharon Dzama’s cellphone and he decided to trap him. Said the source:

Vimbai had been bedding Sharon for some time. He would visit her at night whenever Dzama was away gold panning.
Residents tipped Dzama and he returned unexpectedly and took his wife’s mobile phone.
</blockquote>
Abia was lured to the house and, when he entered, Dzama struck him on the head with an axe and also chopped his legs off.
ZRP spokesperson Assistant Commissioner Paul Nyathi confirmed the murder. He said:

Police are investigating a murder that took place in Tafira village under Chief Mashayamombe.
The deceased was reported to have left his home at around 9 pm. He told his wife that he was going to the shops, but instead went to visit his married lover.
Upon arrival, he found his lover with her husband and the two fought and the deceased was struck with an axe.
He was rushed to a clinic and pronounced dead upon arrival.
The accused person was reported to have informed the kraal head and disappeared.

Nyathi urged members of the public to avoid taking the law into their own hands.

Businessman Axed To Death At Married Lover's Home

A High Court judge has defended the delict of adultery and said it must remain in the statutes to protect the institution of marriage.
Justice Sunsley Zisengwe of the Masvingo High Court said this when he ordered Provincial Medical Director (PMD), Dr. Amadeus Shamu’s mistress Ancercaria Taderera to pay US$13 000 to his wife Tatyana Shamu.
According to <a href="https://masvingomirror.com/adultery-mistress-to-pay-us13-000/">The Mirror</a>, Justice Zisengwe said that Tatyana broke down in court as she narrated how her husband built a house for his mistress when she as a wife didn’t have any.
The Judge said he even felt pity for Tatyana as she was on the witness stand and recounting her experience. Said Justice Zisengwe:
<blockquote>
The plaintiff cast a sorrowful and pitiful sight on the witness stand as she recounted the humiliation, pain and indignity she had to endure on account of the adulterous relationship.
As a consequence, she lapsed into a depression necessitating medical intervention.

The Mirror reported that the judge warned that the introduction of civil partnerships under the new Marriage Act, Chapter 5:15 last year does not remove the delict of adultery.
He said civil partnerships were only introduced to deal with sharing of properties where a relationship had existed.
The existence of civil partnerships in the Marriage Act does not, therefore, remove adultery as it serves a different purpose, Justice Zisengwe said.
He further said that the delict of adultery was important in the laws to serve two purposes; as a deterrent to would-be transgressors and therefore preserve the sanctity and protect marriages.
Justice Zisengwe said that damages from adultery give solace to the innocent spouse who is affected.
Shamu’s relationship with Taderera started in 2011 and resulted in two children. Tatyana only discovered the affair in 2019.
There was an out-of-court settlement in which Taderera paid US$5 000 in compensation for monies and other favours that she had received from Dr. Shamu.
After the settlement, the parties agreed that Taderera would stop the adulterous relationship.
However, Tatyana decided to sue for US$50 000 after realizing that the two continued with their affair.
The damages claimed by Tatyana were for contumelia and loss of consortium.
Justice Zisengwe granted Tatyana US$5 000 for contumelia. The judge said Taderera’s case was worsened by her lack of contrition.
In court, Taderera said Tatyana’s depression was not caused by the illicit relationship but by the war in Ukraine because she is a Ukrainian.
For contumelia, Justice Zisengwe granted Tatyana US$8 000 because her marriage had all but collapsed.

Adultery: High Court Orders Mistress To Pay US$13 000

A man from Mutasa, Manicaland Province, claims his in-laws defrauded him by marrying off his wife of six years to another man behind his back.
Livingstone Chimombe (36) told <a href="https://www.manicapost.co.zw/double-dipping-in-laws-marry-off-daughter-to-new-man/">The Manica</a><a href="https://www.manicapost.co.zw/double-dipping-in-laws-marry-off-daughter-to-new-man/"> Post</a> that his wife, Pamela Nyarukuwa (30) was married off by her family on 17 December after he was made to believe that she was only visiting her family for a traditional rite. He said:
<blockquote>
Pamela was my wife for six years and we have a five-month-old baby together. In December, she told me that she was travelling to her maternal grandparents’ home as her brothers wanted to pay chiredzwa for her to her grandparents who looked after her as she grew up.
I gave her US$40 to buy drinks for my in-laws and US$20 for her well-being. Little did I know that she was going to get married to someone else.
She would tell me that everything was going on well because I had failed to accompany her due to work commitments.
I honestly thought she was talking about the chiredzwa (thank you token) proceedings, but instead, she was talking about her marriage.
After her marriage, she went back to the house I was renting for her in Sakubva and stayed there while I was at work in Old Mutare.

Chimombe further claimed that he only got to know of Pamela’s new husband after her uncle informed him. He said:
<blockquote>
The uncle told me that they were shocked when a new man appeared on the day as they expected me as they had been told.
When I went to Sakubva to confront her, Pamela called the police and I was arrested.
I am so heartbroken that I do not know what to do. She even changed goalposts and claimed that the child was not mine.
She should come back and collect her belongings that are still at my house in Old Mutare.

Chimombe said that he was in the process of reporting the matter at Chief Mutasa’s court so that the Nyarukuwas will reimburse his roora.
However, the Jerera and Nyarukuwa families denied that Chimombe was their son-in-law.
They said that during the course of the six-year-old partnership between Chimombe and their daughter, no bride price was paid to them.
Pamela said she was never married to Chimombe but was only dating him saying they were not staying together. She said:

I left this man some months back. I even blocked all his numbers as he keeps pestering me, asking me to rekindle our lost love.
I never stayed with [him]. He stayed elsewhere while I stayed in Sakubva. He only paid my rent because we were dating.
</blockquote>
Nyarukuwa’s uncle, Billy Jerera, confirmed that his niece stayed with Chimombe for six years but that he did not pay the bride price.
Chimombe confirmed not paying the bride price for Pamela, saying she always denied him access to her relatives. He said:
<blockquote>
I would have paid lobola for her in 2017, but she refused, saying that chiredzwa had not yet been paid to her grandparents.
I took this woman to school with my money, but she is now paying me back in this manner.

Mutasa Man Accuses His In-laws Of Marrying Off His Wife Behind His Back

A woman from Headlands in Manicaland Province was left disappointed last week after she approached a traditional court with the intention of suing her husband’s alleged mistress.
Resinita Makukutu appeared before Chief Makoni’s court seeking the court to order Nyasha Nyarai of Zambara Village, Headlands to pay her three beasts as compensation for allegedly dating her husband.
Makukutu is legally married to Jefter Makukutu under Chapter 5.11.
She, however, left Chief Makoni’s court empty-handed after she was advised to approach the High Court for recourse.
Nyarai absconded the court hearing.
Sometime in 2022, Nyarai’s husband dragged Makukutu’s husband to the same court, accusing him of dating his wife but the case was dismissed due to lack of evidence.
Resinita alleged that she once confronted Nyarai over the issue and she promised to end the relationship, but their affair is still on. She said:

Nyarai has been dating my husband, Jefter Makukutu, since 2014. I came across some love messages on my husband’s phone.
The woman’s husband once reported my husband to this court over the two’s illicit affair but the case was thrown out due to lack of evidence.
Nyarai and her husband have since divorced because of this affair and she has relocated to South Africa.
I have messages that I extracted from my husband’s phone where he was chatting with Nyarai’s aunt.
My husband listed down what he had bought for Nyarai when she wanted to end the relationship.
He was complaining to her aunt. Jefter bought a fridge, a cow, five goats and clothes for her.
He sent Nyarai’s kids to school and spruced up her parent’s homestead. He even promised to buy her a residential stand in Marondera.

Resinita added that she is married to Makukutu under Chapter 5.11 and wanted to be compensated with three herd of cattle.
However, the court ruled that she had brought her case before the wrong court.
Chief Makoni ruled that a woman cannot sue another woman for adultery in a community court. He said:
<blockquote>
If you are married under Chapter 5.11 of the Marriage Act, this community court cannot hear your case. Only the High Court has the authority to preside over disputes emanating from the said Act.
Community courts preside over customary marriage issues. Keep the evidence you have and Nyarai’s former husband will be your key witness at the High Court.
However, even if you were married under customary law, this court was not going to handle the matter. Men are allowed to marry as many wives as they want.
That is acceptable and normal traditionally. A woman cannot sue another woman for adultery in a community court.

The Marriages Act, which came into operation in September 2022, recognises the following types of marriages:
<ul>
<li>A civil marriage which is a monogamous marriage between a man and a woman.</li>
<li>A registered customary marriage which is potentially polygamous and done according to customary rites.</li>
<li>A qualified marriage which is a union contracted according to religious rites which is not registrable as civil or customary marriage and is potentially polygamous.</li>

A Woman Can Not Sue Another Woman For Adultery, Says Chief Makoni

A Manyame Park man was attacked by Johanne Masowe church members after they found him having sex with a woman later proven to be his brother-in-law’s wife at their shrine. 
Tanaka Musengeyi aged 30, lured his brother-in-law Solomon Chawira’s wife, only identified as Nyasha aged 19, to a bushy area where they were caught by Sowe reJerusalem members having sex.
This did not sit well with the church members who in turn assaulted the two for defiling their place of worship, H-Metro reported.
A passerby recorded a video of the church members assaulting the two and posted it on social media.
Nyasha confirmed the incident, saying Tanaka had been proposing to her whenever he visited them.

We were bashed by three men after they caught us.
Tanaka murume we wehanzvadzi yemurume wangu, mukuwasha.

According to religious beliefs, adultery is considered a sin, however, in the eyes of the law, it is a breach of contract. 
It is considered an infringement or damage to a marriage, however, it is not a crime. It is not possible to be arrested for committing adultery, however, one can claim damages from a third party who has caused harm to a marriage by intentionally interfering in the marital relationship.

Man Found Having Sex With Brother-in-law's Wife At Johanne Masowe Shrine

A 4-month-old baby died in Shamva on Friday last week during a dispute over alleged adultery involving its mother and another woman.
A police report seen by Pindula News says the baby was fastened on its mother’s back. The mother was assaulted and pushed to the wall by another woman who was accusing her of taking her husband. Reads the report by the Zimbabwe Republic Police:

Meanwhile, a four months old infant, who was strapped on the back of his mother, died after the mother, Prisca Dhirau (23) was assaulted and pushed to the wall of a shop by the suspect only identified as Mai Shumai Kanyoka, on 09/12/22 at Logan Shopping Centre, Shamva.
The suspect had accused Prisca Dhirau of having an extra-marital affair with her husband. Investigations are in progress.

In a different case, ZRP is investigating a murder case which also occurred on Friday last week along Kadoma-Blue Ranges Road. 
It is alleged that the victim, Elisha Gundu (27), died after he was stabbed with a double-blade flick knife on the head and throat by the suspect, Hussen Nenji (38).
Gundu had accused Nenji of having an extra-marital affair with his wife. Nenji has since been arrested.

A 4-month-old Baby Dies After Its Mother Was Pushed To The Wall

Indonesia’s parliament approved a new criminal code on Tuesday that bans premarital sex and sex outside marriage with a punishment of up to one year in jail.
The new code, which will apply to Indonesians and foreigners alike, also prohibits cohabitation between unmarried couples, according to <a href="https://www.reuters.com/world/asia-pacific/indonesias-parliament-passes-controversial-new-criminal-code-2022-12-06/">Reuters. </a>
It will also ban insulting the president or state institutions, spreading views counter to the state ideology and staging protests without notification.
The laws were passed with support from all political parties.
However, the code will not come into effect for three years to allow for implementing regulations to be drafted.
Currently, Indonesia bans adultery but not premarital sex.
Maulana Yusran, deputy chief of Indonesia’s tourism industry board, said the new code was “totally counter-productive” at a time when the economy and tourism were starting to recover from the pandemic.
Foreign arrivals in the holiday destination of Bali are expected to reach pre-pandemic levels of six million by 2025, the tourism association has said previously.
Indonesia is also trying to attract more so-called “digital nomads” to its tropical shores by offering a more flexible visa.
Speaking at an investment summit, U.S. Ambassador to Indonesia Sung Kim said the news could result in less foreign investment, tourism and travel to the Southeast Asian nation.
Albert Aries, a spokesperson for Indonesia’s justice ministry, said the new laws regulating morality were limited by who could report them, such as a parent, spouse or child of suspected offenders. He said:

The aim is to protect the institution of marriage and Indonesian values, while at the same time being able to protect the privacy of the community and also negate the rights of the public or other third parties to report this matter or ‘playing judge’ on behalf of morality.

These laws are part of a raft of legal changes that critics say undermine civil liberties in the world’s third-largest democracy. Other laws include bans on black magic.
Responding to the criticism, Indonesia’s Law and Human Rights Minister Yasonna Laoly told parliament:

It’s not easy for a multicultural and multi-ethnic country to make a criminal code that can accommodate all interests.
</blockquote>
Legal experts say that an article in the code on customary law could reinforce discriminatory and sharia-inspired bylaws at a local level, and pose a particular threat to LGBT people.
The public response to the new code has been muted so far, with only small protests held in the capital, Jakarta, on Monday on Tuesday.

Indonesia Bans Premarital Sex, Sex Outside Marriage, Offenders To Be Jailed

Lawyers say the Marriages Act passed into law late in May by President Emmerson Mnangagwa promotes adultery.
The Act repealed the Marriages Act (Chapter 5:11) and Customary Marriages Act (Chapter 5:07) and introduced a civil partnership and a qualified civil marriage.
The new law also recognises an unregistered customary law union as a marriage.
Speaking to <a href="https://newsday.co.zw/local-news/article/17074/new-marriage-law-promotes-adultery-lawyers">NewsDay</a> recently, Zimbabwe Women Lawyers Association director Abigail Matsvayi Pasipanodya said:
<blockquote>
We are… concerned that unregistered customary law unions (kuroorana pachivanhu) are not fully recognised, and that civil partnerships can co-exist with civil marriages with the effect of eroding the monogamous nature of civil marriages.
</blockquote>
The Marriages Act stipulates that all marriages are entered into between a man and a woman above 18 years of age.
It also criminalises the marriage of children under 18 years and imposes heavy penalties on those who facilitate the marriage of underage people.
A lawyer, who spoke to NewsDay on condition of anonymity, said:

The Act has brought some changes in that it has added marriages that were not initially recognised.
It has brought in civil partnerships in that before, they were not supposed to be in any other relationship with any other person. That was taken as adultery.
The new Act, however, brings relief to adultery in that a person who is married can have another relationship outside their marriage.
In a way, the new Act addresses another gap where if a man had a small house in case of death, that family, when it came to property sharing, was left out.
The property-sharing process only catered for the legal spouse, so it’s (Act) trying to address a problem of catering for both, however, creating other issues again.

New Marriage Law Promotes Adultery - Lawyers

A woman from Gokwe South, who became seriously ill and thought she might die, confessed that she cheated and revealed that one of their children was not her husband’s.
The woman, Filda Mabhuku from Nyire Nyire Village under Chief Nemangwe, told her husband Robert Chiyangwa that the child in question was sired by his cousin Tinotenda Mpofu from Zvikwete.
Mabhuku confessed that she had been having a secret affair for some time with Tinotenda and he was the biological father of her third child.
She reportedly made the confession while she was in the hospital fighting for her life and thought she wouldn’t make it.
After the confession, Chiyangwa reportedly confronted his cousin who also confessed to having a relationship with Mabhuku.
Chiyangwa then approached Chief Nemangwe’s traditional court demanding six beasts from his cousin as compensation for impregnating his wife.
Chief Nemangwe confirmed the incident, saying when he summoned the parties, both Tinotenda and Mabhuku confessed they had a secret affair. Said the traditional leader:

When I asked Mabhuku why she decided to confess, she said she thought she was going to die.
On why she cheated on her husband, Mabhuku said it was because he was no longer active in bed hence she decided to approach his cousin so that he could quench her thirst.
Tinotenda, although he was not sure that the child was his, also confessed that he had a relationship with Mabhuku.

He said Mabhuku was the one who forced him into the relationship saying her husband was no longer satisfying her in bed.
Chief Nemangwe’s court ordered Tinotenda to pay five beasts to his cousin as compensation for impregnating his wife.

Gokwe Woman Makes Adultery Confession On Deathbed

A Bishop with Zion Church in Bikita, Masvingo Province was recently fined five beasts by a Community Court after being found guilty of impregnating a married woman.
Bishop Joel Musariri from Musariri Village was fined five cattle by Chief Mpakwa for bedding Admire Manganye’s wife, Tendai Muguraumwe.
The adulterous affair between the clergyman and Muguraumwe reportedly started in 2009 and went undetected for many years until some villagers, who knew what was happening between the two, revealed to Manganye that he was not the biological father to one of Tendai’s children.
Manganye then confronted his wife about the allegations and she confessed that she had been sleeping with the Bishop behind her husband’s back and that one of the children was sired by the churchman.
This prompted Manganye to approach Chief Mpakwa’s traditional court suing Musariri for bedding his wife.
<blockquote>
Both Muguraumwe and Musariri confessed their illicit affair before Chief Mpakwa’s court.
</blockquote>
The traditional leader ruled that it was unfair for Musariri to make Manganye look after his own child for over 10 years without his knowledge.
Chief Mpakwa confirmed to B-Metro that he ordered Musariri to pay five beasts as compensation for impregnating Manganye’s wife. Said the chief:

Manganye was disappointed and felt upset and betrayed. This was after he discovered that for years he had been looking after another man’s flesh and blood.
As a Chief, I felt that it was unfair for Musariri to order Manganye to bear full responsibility for a child who was not his and that’s why I ordered him to pay five beasts as compensation.

The traditional leader also said he chided Musariri for his adultery as his actions were against social customs, values and ethos and also unbecoming for a purported man of God.

A traditional leader in Gutu District, Masvingo Province, has ordered a man to pay five cows after finding him guilty of taking a neighbour’s wife.
Chief Gutu ruled that Josiah Madziva of Mbirikira Village in Thornhill Farm should pay five beasts for adultery.
Madziva was found guilty of having an extramarital affair with David Mtizwa’s wife.
It is alleged that sometime this month Madziva and Mtizwa’s wife were caught red-handed at Mtizwa’s homestead.
They were found in the house by the husband David and his brother Tanaka Mtizwa.
When they were caught Madziva said that he had come to collect holy water from Mtizwa’s wife who is a prophetess.
The court said Madziva was caught after David was tipped off by his brother Tanaka.
Delivering the judgment, Chief Gutu said Josiah Madziva was a cruel home breaker and he deserved to be punished severely for his wrongdoings.
The chief said the evidence given in court showed beyond a shadow of a doubt that Madziva and Mtizwa’s wife had an adulterous affair in which they had a child together.
Meanwhile, Madziva and Matizwa’s wife reportedly ran off in shame to Eastdale Range near Matizha village.

Chief Gutu Fines Man 5 Cows For Adultery

A Mutare woman has been ordered to pay US$3 000 as damages to her lover’s wife after cohabiting with a married man.
Earlier this year, Ngaatendwe Matanda approached the Mutare Civil Courts seeking US$6 000 as compensation from Auxilia Muriro.
Muriro has been cohabiting with Washington Matanda who is married to Ngaatendwe Matanda.
Muriro and Washington Matanda have three children, although one of them is now late.
Ngaatendwe revealed that she has gone through a torrid time at the hands of her husband’s mistress, Muriro.
In her ruling, Mutare magistrate, Purity Gumbo ordered Muriro to pay US$3 000 as damages to Ngaatendwe Matanda: She said:
<blockquote>The plaintiff is married to Washington Matanda in terms of the Marriage Act (Chapter 5:11). The marriage is supposed to be monogamous.
It is not in dispute that intimacy took place between the defendant and the plaintiff’s husband, of which three children were born from that union, one who is now late.
Judgment is hereby entered for the plaintiff in the sum of US$3 000 to be paid in local currency at the official prevailing bank rate at the time of payment.</blockquote>
Ngaatendwe told the court that she once approached Muriro and advised her to stay away from her husband, all to no avail.
She said she said first got wind of the affair in 2010 but dismissed the reports as mere gossip.
Ngaatendwe said it was only in 2015 that she finally confirmed that her husband was having an affair with Muriro.

An <a href="https://www.pindula.co.zw/Apostolic_Faith_Mission_in_Zimbabwe" rel="noopener noreferrer" target="_blank">Apostolic Faith Mission in Zimbabwe</a> church pastor has been accused of bedding a married congregant, Tracy Tsitsi Mutengezanwa who is married to Amos Mapisa.
Mapisa approached New Covenant Family Worship Centre, Domboshava, accusing pastor Maizivei Padzinza of being involved with his wife, whom she accused of dating two other men after she came across chats on her WhatsApp. Said the aggrieved husband:
<blockquote>I found out that my wife has been cheating on me after I went through her phone. She was dating Pastor Padzinza and two other men.
All that I am saying can be supported by these chats which are on this phone. I have come here to let the church know what kind of a pastor they have.
This will help other men to know what their wives are doing at church and maybe he is not only doing it to my wife but to other women in the church.</blockquote>
Mapisa demanded an apology from the pastor and the AFM church. A member of the church’ board reportedly offered an apology to Mapisa and promised to take the issue to the high office in the church.

AFM Pastor In Adultery Storm Involving Married Woman

A senior diplomat at the Egyptian embassy in Harare, Ms Raina, has been dragged to court by a Zimbabwean woman, Bilkis Banu Ismail, who alleged that the former snatched her husband.
Banu Ismail is seeking $1,5 million compensation in adultery damages and has since issued summons against Raina through her lawyers, Laita and Partners of Marondera.
Raina’s business address is cited as the Embassy of Egypt situated at number 7 Aberdeen Road, Avondale in Harare.
In her declaration, through her lawyers, Ismail said she has been married to Mahmoud Eid Ahmed Eid for more than 12 years;
<blockquote>The basis of the plaintiff (Ismail)’s claim is that the defendant (Raina) is having an adulterous relationship with the plaintiff’s husband since 2018.
The plaintiff has now lost the affection and companionship of her beloved husband as a result of the defendant’s actions.
The plaintiff, because of the actions of the defendant, is being deprived of her conjugal rights that used to be her preserve as the husband has actually moved in to stay with the defendant.
The plaintiff believes that adultery is an act of sexual incontinence and the deliberate intrusion into her marriage by the defendant is an attack on her dignity as she is just an innocent party.
… The plaintiff has no other recourse except to approach this honourable court for expiation. Wherefore, the plaintiff’s claim against the defendant is $1 000 000 adultery damages and $500 000 for loss of consortium and contumelia, plus the cost of suit.</blockquote>
The senior diplomat has not yet responded to the summons.

Egyptian Diplomat Sued For 'Snatching' Zim Woman's Husband

A Marondera man has dragged Chief Svosve Gahadza to court after he was ordered to pay five beasts for having an affair with Elizabeth Dengu who is married to Fari Hwenjere.
Gilbert Muchenje, who lives with a disability, was last month convicted at the Chief’s court but has challenged the ruling, arguing that he was not allowed to prove his innocence.
Muchenje argued that Chief Svosve based his judgement on text messages on the complainant, Fari Hwenjere’s mobile phone. He appealed:
<blockquote>
The Chief’s court erred and misdirected itself on a point of fact by making a finding that the appellant had committed adultery with the first respondent’s wife merely because the first respondent had said so without allowing the appellant to present his side of the story.
The second respondent misdirected himself by not instructing the first respondent to provide any proof to support his allegations, especially considering that such proof did not 
exist.
… The second respondent also erred and misdirected by awarding the first respondent a herd of five cattle, which is too much for adultery.
</blockquote>
The matter could not be heard on Wednesday as the chief reportedly failed to attend court.

'Adulterous' Man Appeals Chief Svosve's Ruling

One of the largest and oldest denominational churches in Zimbabwe, the Anglican Church has been rocked by allegations of sexual misconduct within the clergy.
Reverend Talent Makanga of the Anglican Church Diocese of Manicaland wrote a letter to the Bishop following the alleged adulterous relationship between his wife (Lynnette Manyumwa) and another pastor, Reverend Position Chikuruwo.
In a letter seen by Manica Post, Rev Makanga wrote to Bishop Eric Ruwona in which he requested the Bishop to intervene in the adultery case. The letter reads as follows:
<blockquote>On Friday, June 7, 2019, an incident occurred around midnight at our parish house where I and my cousin William witnessed Rev Chikuruwo and my wife in a spare bedroom.
Upon arrival, we were astonished and disheartened with the kind of night dress that my wife was putting on and Reverend (Chikuruwo) was trying to put back his shirt.
I failed to get a clear explanation and went to bed. The following morning I informed my relatives and the Dean about the issue.
The family resolved that my wife needs some time in her home village. On 11 June, the DS and Ven Chikore, his wife and a neighbour came to hear the story that had gone viral.
The conclusion was that what the two did was not proper and (they)were supposed to apologise of which they accepted.
Lord Bishop this issue has devastated and traumatised me and I am confused.
As a family we have done our part and (we) will follow the procedures according to Shona culture. I just pray that as for my brother priest it is up to the church to decide.
As I have presented my facts before to the DS and his delegation and they all agreed that the issue was very sensitive. I am now leaving the issue to them. For me to discuss it further it is quite disheartening.</blockquote>
Reverend Makanga told Manica Post in an interview this Thursday that the Bishop has denied knowledge of the matter yet he received the letter.
Meanwhile, Reverend Makanga has since separated from his wife.

Anglican Church Rocked By Adultery Allegations Within Its Clergy

Suspended chief magistrate Mishrod Guvamonbe’s wife is demanding $100 000 for adultery damage from his girlfriend.
Guvamombe’s wife, Angeline Guvamombe, who is the former officer commanding of the Zimbabwe Republic Police, (ZRP) Support Unit summoned Sheila Mandiseka for being her husband’s mistress. Guvamombe’s wife filed summons at High Court claiming that Mandiseka has caused adultery damages. Guvamombe said that the extramarital affair with her husband offended her. Guvamombe’s wife said she is still married to the suspended chief magistrate in terms of Marriage Act  [Chapter 5:11] of the 25th of February 2000 at Bindura.
According to summons filed at High Court, Guvamombe’s wife claims her husband and his mistress ended up having a child as a result of sexual intercourse on different occasions. Guvamombe is already facing two criminal abuse of office charges on different dockets.

Suspended Chief Magistrate's Wife Demands $100 000 From Girlfriend

A nurse from Mpilo Central Hospital in Bulawayo Vushe Marime is facing a US$10 000 adultery lawsuit after he allegedly engaged in an extra marital affair with a married woman.
Marime is also accused of pressuring his lover Mrs Judy Takanai to kill her husband Mr Claudio Takanai to sustain their relationship. He allegedly volunteered to organise some injections and tablets for Mrs Takanai which she could use to kill her unsuspecting husband. In papers filed at the Civil Court at Tredgold Building, Mr Takanai’s lawyer Mrs Sheron Drau from Pundu 7 Company Legal Practitioners said her client had been denied conjugal rights ever since his wife started sleeping with Marime. 
Mr Takanai said Marime refused to terminate the adulterous relationship when he approached him in November last year. According to papers filed by Mr Takanai, his wife confessed about the relationship during a family meeting and asked him to forgive her.  Takanai says he has suffered damages namely contumelia inflicted upon him in the sum of US$5 000 and the loss of consortium in the sum of US$5 000.

Nurse Accused Of Pressuring Lover To Murder Husband, Faces US$10 000 Adultery Lawsuit

Vice President and Acting President Kembo Mohadi’s girlfriend Juliet Mutavhatsindi has been sued by Mohadi’s estranged wife Tambudzani Bhudagi Mohadi (nee Muleya). Tambudzani has filed a lawsuit at the High Court demanding $1.5 million in damages. Tambudzani has said that she is still legally married to Mohadi, although the couple is in the middle of a nasty divorce which is yet to be finalized. In her court papers, Tambudzani says,
<blockquote>Since July 2017, the defendant [Mutavhatsindi] unlawfully and intentionally committed adultery with the plaintiff’s husband [Mohadi] and inflicted contumelia on the plaintiff; she alienated Kembo Mohadi’s affection for the plaintiff and caused plaintiff’s loss of Kembo Mohadi’s companionship, comfort and service…As a consequence of the defendant’s conduct, the plaintiff has suffered damages in the sum of $1 500 000 made up as follows; (1) contumelia inflicted on the plaintiff by the defendant — $250 000 and (2) alienation of affection, loss of comfort, society and services of Kembo Mohadi — $1 250 000.</blockquote>
Mutavhatsindi is yet to respond.
