The Zimbabwe Union of Journalists (ZUJ) has commended the repealing of the Access to Information and Protection of Privacy Act (AIPPA).
ZUJ secretary-general Foster Dongozi said the scrapping of AIPPA came after wide consultations with all media stakeholders and everything was done openly. Dongozi said:
<blockquote>The process of scrapping AIPPA was done after wide consultation with all media stakeholders including media unions, media rights groups, civic society groups and media experts, among others.
The process of consultations was done fairly and the debates were very robust.</blockquote>
AIPPA was scrapped and replaced with the new Freedom of Information Act that became law on Wednesday after approval by President Emmerson Mnangagwa.
The new law states that all information held by public institutions, including State-owned companies, can potentially be made public, with the exception of Cabinet discussions and certain information in victim-friendly courts.
However, defence and national security information, plus certain financial matters like proposed taxes in the pipeline, secret industrial processes, diplomatic matters, and some personal details of individuals can be withheld.

Zimbabwe Union of Journalists Welcomes Scrapping Of AIPPA

The Freedom of Information Bill became law on Tuesday after the final amended version from Parliament was approved by President Emmerson Mnangagwa and gazetted.
The Freedom of Information Bill repeals the draconian Access to Information and Protection of Privacy Act (AIPPA) which was enacted at the turn of the Millenium.
In a statement on Tuesday night, the Minister of Information, Publicity and Broadcasting Services Monica Mutsvangwa said:
<blockquote>The enactment of the Freedom of Information Act is indeed a momentous occasion, not only for Government but for the media fraternity and the citizens. AIPPA had aroused a lot of animosity over the years.</blockquote>
The new law states that all information held by public institutions, including State-owned companies, can potentially be made public, with the exception of Cabinet discussions and certain information in victim-friendly courts.
The new mandatory information officer in each entity, who is either the head of that entity or a person appointed by the head, has up to 21 days to consider each request for information.
The information officer can refuse to make all or some of the requested information public, but under strictly set criteria, and all these decisions are subject to appeal.
However, defence and national security information, plus certain financial matters like proposed taxes in the pipeline, secret industrial processes, diplomatic matters, and some personal details of individuals can be withheld.
Moreover, where third parties are involved in the requested information, they have the right to agree or to make representations on why the information should not be released.

AIPPA Discarded, Freedom of Information Bill Signed Into Law

A United Nations (UN) representative said that they are happy with Zimbabwe’s media reforms following the gazetting of three Bills that are meant to replace the Access to Information and Protection of Privacy Act (AIPPA).
There are three Bills, that is, the Freedom of Information Bill, the Zimbabwe Media Commission Bill and the Protection of Personal Information/Data Protection Bill that has been tabled before the Cabinet.
Speaking to the media on the sidelines of a media workshop in Masvingo on Monday, UN communications specialist Mr Sirak Gebrehiwot said:
<blockquote>So far there are three Bills tabled before the Cabinet.
One relates to broadcasting services, the other on data protection and the third one freedom of information. These are Bills that have been aligned to the Constitution and they offer good space for media but at the same time, they protect personal data.
These are global practices that are being contextualised in Zimbabwe in line with the country’s constitution. As the UN, we are happy with all the process.
We would have to see how these Bills will be ratified by Cabinet, by Members of Parliament and later on by the Head of State according to the law of the land.
But so far, the process, policy stakeholders seem to appreciate and there have been some comments from certain media institutions in terms of specific issues.
This has been received by the Ministry of Information, Media and Broadcasting Services positively and they say they will take note of the issues that are transpiring from this discussion.
So it has opened the space for debate, the space for amendments, and the space for promoting freedom of information which the United Nations stands for and support and also the fulfilment of the Declaration of Human Rights Article 19.</blockquote>

UN Happy With Zimbabwe's Media Reforms

Constitutional law expert and lecturer at Kent University, United Kingdom, Alex Magaisa said that there is no reason to celebrate yet with the government’s announcement that the Access to Information and Protection of Privacy Act (AIPPA) will be repealed.
He cautioned that a more draconian law could be passed to replace the loathsome AIPPA. Saiid Magaisa:
<blockquote>ZANU PF types, including opportunists who only recently discovered its virtues can’t understand why there is no pomp and ceremony over the repeal of AIPPA, the media law. For them, a man must be congratulated for announcing that he will wash up after deliberately soiling himself.
Those familiar with ZANU PF have learnt not to celebrate just because they found eggs in the chicken run. Experience has taught them they may not all be chicken eggs. ZANU PF will milk the repeal of AIPPA and afterwards drop a similar or worse law. They are a deceptive lot.
That’s why people take the news with a huge dose of caution. They know the wisdom of the ancestors, that when you see a crocodile pulling a piece of cloth, leaving the man, it’s because the crocodile has a plan. Until we see the proposed replacement, there’s no cause for joy.
Killing AIPPA is one thing. It was long overdue and keeping it on the statute books was embarrassing. What comes after it is far more important and we will be waiting to see it and also subject it to scrutiny as responsible citizens ought to do.</blockquote>

Mnangagwa Could Replace AIPPA With A More Draconian Law - Political Analyst

The Minister Information, Publicity and Broadcasting Services, Monica Mutsvangwa said that the government is moving to repeal the Access to Information and Protection of Privacy Act (AIPPA).
Mutsvangwa said this while addressing the media during a weekly briefing on Cabinet deliberations in Harare on Tuesday. She said:
<blockquote>Cabinet considered principles for the repeal of the Access to Information and Protection of Privacy Act, commonly known as AIPPA, presented by the Minister of Information, Publicity and Broadcasting Services.
Cabinet noted that the proposed amendment is in fulfilment of the requirement to align the country’s laws to the Constitution and to deepen the country’s democratic processes and accordingly approved the principles.</blockquote>
AIPPA has been very unpopular with citizens since its enactment at the turn of the milleluim. It has been considerdd a government move to stifle freedom of expression.

Govt To Set Aside AIPPA In Order To 'Deepen Democratic Processes'

President Emmerson Mnangagwa said that his government is moving to repeal ‘toxic’ laws that make the country unattractive to foreign capital.
He identified AIPPA, POSA and the Indigenisation laws as counterproductive. While addressing the press at State House on Wednesday night, Mnangagwa said:
<blockquote>That is why we have moved quickly to do away with the indigenisation law. The move gained us 11 points on the global ease of doing business last year alone.
It was part of a group of statutes that we were advised by the World Bank that they were an impediment to investment. They include the Public Order and Security Act as well as the Access to Information and Protection of Privacy Act.
We did not think it was necessary for an investor to bring $500 million into Zimbabwe and then we turn around and ask for 49% from them just like that.
If we fail, we must admit it. This is because as a country an investor comes, brings new technology, employs our people, builds infrastructure, pays taxes and brings new skills. If we can get more out of an investor, the better.</blockquote>
Mnangagwa revealed his admiration of the Rwandan economic model. Rwanda is a tiny but lush country located in Eastern-central Africa which recovered from a genocide that killed almost 1 million people in 100 days to become one of the fastest growing economies in Africa.

Mnangagwa Says Indigenisation Law, POSA & AIPPA Are Bad For The Country

The United States Ambassador to Zimbabwe Brian Nichols said that the country should prioritize the implementation of political and economic reforms if the country is to come out of isolation.
While speaking during a courtesy call to the Speaker of the House of Assembly, Jacob Mudenda, in Harare on Monday, Nichols said
<blockquote>The proposals from this government have been wonderful, but we need to see concrete action and Parliament is where those actions take place: repeal of [Public Order and Security Act] Posa and [Access to Information and Protection of Privacy Act] Aippa, electoral reforms, implementation of some of the recommendations of the observer missions and improving the environment for doing business. That is all parliamentary business.</blockquote>
Mudenda said that the Parliament has started the process to realign some pieces of legislation with the Constitution. Said Mudenda
<blockquote>Any electoral reforms that need to take place will come through Parliament like Posa. The Constitutional Court has already ruled that section 27 of Posa seems to offend the free assembly of people, so Parliament has no choice, but to amend that section of the Constitution.
We have indicated to the ambassador [Nichols] that we have started the process through the administration of the Parliament to ensure that the pieces of legislation that were proposed by his Excellency the President [Emmerson Mnangagwa] during the State of the Nation Address are pursued with vigour to ensure that the legislative process is consummated in the next few months.</blockquote>
