CCC’s vice president, Tendai Biti, convicted for verbally assaulting a Russian national, Tatiana Aleshina, on Monday has apologised.
As reported by <a href="https://www.newzimbabwe.com/former-minister-biti-apologises-for-assaulting-foreign-investor-awaits-sentencing/">NewZimbabwe.com</a>, during mitigation, Biti through his lawyer Alec Muchadehama, told Harare magistrate Vongai Muchuchuti that he didn’t mean to hurt Aleshina. He said he was genuinely sorry for what happened. Said Muchadehama:
<blockquote>
The accused is genuinely sorry about the incident. What happened is unlikely to occur again.
Accused has no appetite to engage in that conduct again. He knows what will happen if this sorry case happens again.
He is not a threat to the complainant. Calling Biti a huge gigantic person as she did is an insult especially when looking at Biti.
So he was also insulted. So the complainant now has hit back but the accused makes no offence of that.
My submission is that it’s not necessary to protect the complainant in this case.
The accused had no intention to harm the complainant, he is genuinely sorry, and the matter was blown out of proportion.
There was no physical assault, the accused is not a violent person and what happened is likely not to happen again.

He said Biti is a father of five adding that three of his children are in university abroad.
He also said he takes care of his elderly mother and supports orphans and widows in his former constituency, Harare East.
Muchadehama told the court that Biti also said he runs a law firm and piggery business with over 40 employees depending on him.
His mother is diabetic and hypertensive and requires constant medication.
However, prosecutor Tafara Chirambira said despite personal circumstances other factors should be considered including previous convictions. He said:
<blockquote>
The issue that he is a legal practitioner places him in a situation where he has an ethical duty to respect the law.
The offence was committed in the corridors of the magistrates courts. The state implores the court to consider that in coming up with its sentence.
The previous conviction certificate placed before the court is for the court to note.
This shows this is not the first time the accused has been convicted for an offence before this court.
The court cannot ignore that submission. That submission was made with no objection…
A fine will not meet the justice of the crime. His mitigation shows he is a man of means and therefore a financial punishment will not be painful to him.
The court is well within its rights to consider community service. Imposing a fine on a person who will not feel it as a punishment will be a waste of time.
Would it be just for the court to say, okay pay another fine when he was fined five years ago?
Suffice it to say, that the penalty for the offence starts from a fine to imprisonment, the State respectfully submit that a fine is too trivial.

Biti Apologises For Verbally Assaulting Tatiana Aleshina

Gamuchirai Chaburumunda, the Organising Secretary of the <a href="https://www.pindula.co.zw/University_of_Zimbabwe/">University of Zimbabwe</a> Student Union, was arrested and sent to Chikurubi Maximum Female Prison for staging a demonstration on campus. She endured hardships during her month-long incarceration and is now writing a book about her experiences.
Chaburumunda, a third-year accounting and finance student, was arrested for protesting against the unjust imprisonment of lawyer and opposition leader <a href="https://www.pindula.co.zw/Job_Sikhala/">Job Sikhala</a>. She has been sharing pages of her book on a WhatsApp group as she writes. She said in an interview with University World News:
<blockquote>
I started writing the book on the day of my release. The WhatsApp storytelling comes as a way to reach out to as many peers as possible since most of my generation have lost a reading culture. Almost everyone uses WhatsApp so, at least, the story can be told. The chapters on WhatsApp are just a glimpse of what’s to come in the book.
Fellow students and youth across the country have been really sympathetic but, most importantly, they are understanding why we need to take it upon ourselves as a generation to advocate for everyone’s rights, prisoners included.

The story shared on WhatsApp begins with Chaburumunda’s arrest on campus, which felt like a kidnapping. She was then taken to the Harare central police station, where she experienced further horrors. Chaburumunda believes she was targeted due to her role as a student leader and her influence on other students.
In the police cells, she encountered dirty blankets infested with lice and two cement bunk beds. After spending a night there, she was taken to court and eventually transferred to Chikurubi Maximum Prison. Chaburumunda noticed many foreign women, especially from Malawi, who had been arrested while attempting to enter South Africa illegally.
Disturbingly, prisoners were sometimes forced to strip naked for searches, which deeply affected Chaburumunda emotionally. She also witnessed women detained with their children, some of whom were just months old. The older children attended a preschool within the prison. Chaburumunda emphasized that children struggled to cope with prison life, inappropriate language, and hygiene issues.
The prison conditions were harsh, with limited food and no amenities. Porridge without sugar or peanut butter was served in the mornings, and they occasionally received stale bread discarded by a local bakery. Sometimes, there were boot prints on the bread. Tea had no sugar or milk. Lunch consisted of boiled vegetables with minimal salt, as they were told salt affects sex hormones. Supper mostly comprised beans without onions or tomatoes.
The prisoners used pit latrines, had no running water or electricity, and the cells were always dark. They had no beds.
Tragically, death visited the prison, and a baby passed away. Pregnant women and nursing mothers had their own cells. Chaburumunda witnessed a mother desperately running to the clinic with her baby in hand, without shoes. Although the baby did not survive, the mother held onto hope, according to information shared by other inmates. She said:
<blockquote>
The prison officers took the mother and baby to an office to wait for the nurse on duty to arrive. The nurse declared the baby dead. I don’t think the mom was given time to mourn. In fact, she was moved out of Cell Three to cells where mentally disturbed inmates stayed.

Chaburumunda believes that the Zimbabwean government targets students and subjects them to such difficult situations because they pose a threat. Student leaders are seen as young, intelligent, and courageous, which makes the regime feel insecure. The government fears that these fearless student leaders may go to extreme lengths in their fight for justice. Chaburumunda intends to address the persecution of students in her book to bring attention to this issue.
Human rights lawyer Alec Muchadehama, who has represented students for many years, explains that these students are arrested on false charges. None of them have been convicted, highlighting the fact that they are unjustly detained. The state opposes bail, causing some students to miss their examinations.
Chaburumunda was fortunate as she was arrested on the last day of her exams. Muchadehama also observes a change in the way the police treat students. They are becoming increasingly harsh, especially towards women students. This suggests that there may be political pressure involved in targeting students. Muchadehama said:

It seems the police are acting under political pressure. The authorities want everyone to be quiet to give the impression that all is well in Zimbabwe. The shift to arresting female students is part of a political message that anyone who dares, ‘we will come for you.

Two years ago, Nancy Njenge, the former Gender Secretary of the <a href="https://www.pindula.co.zw/Zimbabwe_National_Students_Union/">Zimbabwe National Students Union (ZINASU)</a>, was arrested for protesting against the detention of fellow student leaders. She was then placed in a crowded and unsanitary cell where she contracted COVID-19. Since then, it seems that targeting women has become a strategy to discourage them from engaging in student activism.
In an interview with University World News, Njenge explained that the arrests of students have taken on a gender aspect as a means to prevent more women from participating in student activism. This strategy seems to be effective as it instils fear in other female students. Njenge emphasized that these arrests are a form of persecution and are meant to intimidate. The fear and vulnerability of women make them more susceptible to such tactics. Consequently, some students are reluctant to associate themselves with ZINASU and are afraid of the government’s actions.

UZ Student Union Secretary Writes A Book About Her Experiences At Chikurubi Maximum Female Prison

A Harare Magistrate has reserved to Wednesday a ruling in a bail hearing case for opposition <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change (CCC)</a> Members of Parliament (MPs) for Zengeza West and Chitungwiza North, in that order, <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> and <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> of Chitungwiza North.
The duo was arrested last week in connection with the violence that erupted in Nyatsime, Chitungwiza at a memorial service of slain CCC activist, <a href="https://www.pindula.co.zw/Moreblessing_ali">Moreblessing Ali</a> with authorities accusing the two of inciting the violence.
They were brought to court on Monday in leg irons, accused of inciting violence in Nyatsime.
Prosecutors <a href="https://www.pindula.co.zw/Michael_Reza">Michael Reza</a>, Chris Mutangadura and Lovemore Masuku allege that Sikhala, who is also the Ali family lawyer, urged Zimbabweans to avenge Ali’s murder.
Sithole is charged with participating in inciting violence and arranging lorries which allegedly transported CCC activists who attacked the homes of ZANU PF supporters.
Both <a href="https://news.pindula.co.zw/2022/06/17/sikhala-sithole-spend-third-night-in-jail/">denied the charges</a> through defence lawyers Jeremiah Bamu and Alec Muchadehama who said the charges against their clients were a creation by the state.
Bamu last week said that Sikhala is not the one who posted the video in which he is alleged to have incited violence and that he did not utter any statements inciting violence.

BREAKING: CCC's Job Sikhala, Godfrey Sithole Bail Ruling Reserved For Wednesday

Harare magistrate Chido Garwe has issued a warrant of arrest against former Finance Minister Tendai Biti after he failed to appear in court for trial, reported The Herald.
Biti is facing allegations of assaulting a Russian national Tatiana Aleshina outside the Harare Magistrates Court.
His lawyer Aleck Muchadehama was not present in court to represent his client.
This led senior prosecutor Micheal Reza to apply for a warrant of arrest.
Aleshina claims that on November 30 last year as she was about to leave the court gallery after a court session, Biti allegedly threatened to harm her.
She said the MDC Alliance vice president insulted and assaulted her outside the courtroom but within the complex premises. Said Aleshina in her complaint:

It was clear to all people who were in the court gallery that Mr Biti took delight not only in verbally abusing me but in trying to intimidate me and felt that, as a woman and foreigner of Russian origin, he would use every extrajudicial means to crush me or harm or destroy me for daring to be a witness in the criminal matter against his client.

Magistrate Chido Garwe Issues Arrest Warrant For Biti

Lawyers representing MDC Alliance MP Joanna Mamombe have asked for a temporary suspension of her bail reporting conditions because she is not feeling well and is actually under the care of a psychiatrist, Daily News reports.
Mamombe’s Lawyer Alec Muchadehama told the court that Mamombe who is facing charges of faking her abduction is unstable:
<blockquote>The accused has been taken ill and currently under the care of a psychiatrist because of her unstable condition… the doctor had recommended a further two weeks to manage her and proposed the suspension till September 25.</blockquote>
The state did not oppose Muchadehama’s application and the magistrate granted the application. Mamombe and 2 other MDC activists were abducted at a protest in Warren Park and were tortured before they were dumped near Bindura. The government has accused the ladies of faking their abduction.

Joanna Is Not Feeling Well - Mamombe's Lawyer Apply For Reporting Conditions Suspension

MDC T Secretary-General Douglas Mwonzora has made sensational claims that less than 15 MDC Alliance MPs are still in Nelson Chamisa’s camp as he said a lot of them have decided to side with his party after the Supreme Court restored the MDC T’s 2014 party structures and declared Nelson Chamisa the illegitimate MDC T leader.
The matter came to light at the High Court where Chamisa is challenging Khupe and her allies recalling legislators and taking over the MDC Alliances offices countrywide, Mwonzora said the document present by Chamisa’s legal team in court signed by MDC Alliance MPs was a forgery:
<blockquote>
Their application was accompanied by forged affidavits. The MPs were made to sign blank affidavits without anything. If you look at the affidavits that were filed in the main original body and the tail end is where the applicant signature is, it’s a photocopy that was forged. We also had Members of Parliament who were disowning the affidavits. 
I raised that with some of the MDC-A people and they said they had no idea; that is when we realised that the whole application had been forged. I got in touch with a number of MPs and they professed ignorance of the application. I think it was withdrawn specifically because of that

Mwonzora also said the MPs who support Nelson Chamisa are less than 15 and not 51 as alleged by the supposed affidavit:
<blockquote>
They wanted to present that they still have 51 members of Parliament. That is the impression they wanted to create because right now they have less than 15 MPs sympathetic to them out of 111. They wanted to give an impression that MPs were behind them and against us. 
It was simply political posturing, an awkward political manoeuvring that confirms our earlier assertion that these people are criminals. They are crooks who forged the succession. They try to forge papers of ownership of Harvest House. They now have forged this application who ought to be prosecuted.
</blockquote>
The MDC alliance lawyer Alec Muchadehama denied that the signatures were forged as alleged by Mwonzora.

Out Of 111 MDC Alliance MPs, Only 15 Are Sympathetic To Chamisa - Mwonzora Boldly Declares

The High Court yesterday reserved judgement on the urgent chamber application filed by the MDC Alliance after MDC T forcefully took their headquarters using state apparatus last week, The Herald reports.
In the case which was heard by Justice David Mangota, MDC alliance is seeking that the court declares the takeover illegal and restores the use of the building to the MDC Alliance.
According to the publication, MDC Alliance lawyer Mr Alec Muchadehama argued that:
<blockquote>The notice by recently reinstated secretary general, Mr Douglas Mwonzora of the handover-takeover to their members was the factual foundation that proves the MDC-T was not in occupation of Harvest House before the eviction.
Mr Muchadehama added that the presence of the police and the army on the day in question to assist Dr Khupe to take total ownership of the building and was an indication that the act was not peaceful as alleged</blockquote>
Khupe’s lawyer Lovemore Madhuku argued that the case lacked merit as the MDC Alliance reportedly failed to produce a lease agreement. According to The Herald, Madhuku:
<blockquote>Contended since the inception of the MDC as a political party it had been in charge of the Harvest House despite factional disputes. The MDC-T led by Dr Khupe was the legally recognised MDC party and so had the right to the building.</blockquote>
Madhuku in his argument reportedly said:
<blockquote>The MDC-A has failed to even produce an lease agreement to support their case. The handover-takeover was of the security personnel which belong to MDC as an entity. Changes were caused by issues of allegiance within the MDC factions.</blockquote>
The Police who were also cited as respondents said they were only present to ensure that lockdown restrictions were adhered to.
