The Zimbabwean government has announced new regulations regarding exemptions from the ban on importing motor vehicles older than 10 years.
In March 2024, the government banned the importation of vehicles over 10 years old from the date of manufacture, requiring those bringing them in to cover re-exportation costs.
But in July 2024, Statutory Instrument 111 of 2024 allowed inherited cars, vehicles of returning citizens, and diplomats’ cars to be imported even if older than 10 years.
Further amendments have now been introduced through Statutory Instrument 172 of 2024, published in a supplement to the Government Gazette Extraordinary on October 18, 2024.
Statutory Instrument 172 of 2024, alongside SI 54 and SI 111 of 2024, exempts all immigrants, as defined by Customs and Excise regulations, from the ban on importing motor vehicles older than 10 years.
To qualify for this exemption, individuals must meet the eligibility requirements set by the Zimbabwe Revenue Authority (ZIMRA). Reads Statutory Instrument 172 of 2024:

IT is hereby notified that the Minister of Industry and Commerce, in terms of section 4(1) of the Control of Goods (Import and Export) (Commerce) Regulations, 1974, published in Rhodesia Government Notice 766 of 1974, hereby makes the following regulations:-
1. These regulations may be cited as the Control of Goods (Import and Export) (Commerce) (Amendment) Regulations, 2024 (No. 13).
2. The Control of Goods (Import and Export) (Commerce) Regulations, 1974, published in Statutory Instrument 766 of 1974 (“hereinafter called the principal regulations”), is amended in section 3(2) by the deletion of paragraph (iii) and the substitution of the following-
“(iii) “immigrant” as defined in terms of section 9 NO (1) of the Customs and Excise Suspension Regulations, 2003, published in Statutory Instrument 257 of 2003; and
(iv) “immigrant” as defined in terms of section 105(1) of the Customs and Excise (General) 
Regulations, 2001, published in Statutory Instrument 154 of 2001.”.
3. The principal regulations are amended by the insertion of new sections after section 3 as follows-
“3A. Motor vehicles that were imported into Zimbabwe or were at the border post awaiting clearance prior to the publication of this statutory instrument in the Gazette and fall within the exempted categories shall be similarly exempted. This exemption shall be deemed to have come into effect on 29th March, 2024.
3B. Antique, classic, vintage, and historic vehicles that are at least 25 years or older from the date of manufacture and satisfying the following characteristics are exempted-
(i) design and engineering: representative of its 
era;
(ii) originality: retains most of its original features; (iii) condition: well-maintained or restored;
(iv) rarity: limited production numbers or unique features;
(v) significant historical or cultural importance.”.
4. The principal regulations are amended by the deletion of the explanatory note and the substitution of the following-

“All categories listed in section 3(2)(i) to (iv) must fulfil the necessary eligibility requirements as required by the Zimbabwe Revenue Authority.
“The vehicles exempted under section 3B will require an Import Permit from the Ministry of Industry and Commerce prior to importation.”

The government in Zimbabwe changed the rules about importing old cars. In March 2024, they said no cars over 10 years old could be imported. But in July, they made exceptions for certain people like returning citizens and diplomats. Now, in October, they made more changes. Immigrants can also bring in older cars, as long as they follow the rules set by the Zimbabwe Revenue Authority. Some old cars like antiques can also be brought in with a special permit. Government Revises Ban On Importing Vehicles Over 10 Years Old

The Government of Zimbabwe has lifted the ban on the importation of vehicles older than 10 years if they meet certain criteria.
According to Statutory Instrument 111 of 2024 [CAP. 14:05] Control of Goods (Import and Export) (Commerce) (Amendment) Regulations. 2024 (No. 11), inherited cars, those of returning citizens and diplomats can be imported into the country even if the cars are older than 10 years. Reads the Statutory Instrument:

It is hereby notified that the Minister of Industry and Commerce, in terms of section 4(1) of the Control of Goods (Import and Export) (Commerce) Regulations, 1974, published in Rhodesia Government Notice 766 of 1974, hereby makes the following regulations:-Notwithstanding section 3(1), second hand motor vehicles aged ten years and above belonging to the following shall be allowed entry into Zimbabwe, deceased estates (inherited motor vehicles); or diplomats returning to Zimbabwe from their postings abroad; or returning residents.

Government Modifies Ban On Imports Of Vehicles More Than 10 Years Old

As of Monday, July 1, 2024, new regulations have come into effect regarding the importation of vehicles into Zimbabwe, particularly through the Beitbridge and Plumtree border crossings.
Under these revised rules, Zimbabweans importing vehicles must now obtain number plates from the Central Vehicle Registry (CVR) before departing the ports of entry or designated transit sheds where their import documents are processed.
<a href="https://www.herald.co.zw/zimra-tightens-vehicle-import-rules/">The Herald</a> reported that only vehicles imported by diplomats or registered car dealers are allowed to leave the border on temporary registration plates.
The new vehicle import regulations were introduced as a response to an increase in fraud cases, where vehicles were being smuggled into the country and then fraudulently registered.
To address this issue, the Zimbabwe Revenue Authority (ZIMRA) began implementing the new rules at the Beitbridge and Plumtree border crossings on Monday.
According to a ZIMRA official at the Beitbridge border, who spoke to The Herald on condition of anonymity, customs clearing agents were advised of the upcoming changes at the beginning of June.
The official said the law has always been there as provided by section 49A (Registration of imported vehicle) of the Customs and Excise Act Chapter 23:02 and the authority has decided to use it to curb rising cases of customs fraud. Reads part of the section in the Act:

Imported vehicles shall be registered for the purposes of the Vehicle Registration and Licencing Act [Chapter 13.14] at the time entry is made in terms of section 40 — (a) on submission of an application on the prescribed form, and (b) on payment of the prescribed fee. Provided that vehicles to be warehoused in terms of section 70 shall be registered at the time the vehicle is taken out of the warehouse in terms of section 71. [Section inserted by Act 18 of 2000].
</blockquote>
Before the new regulations came into effect, car importers were releasing the vehicles from the border on temporary registration plates with a validity of 14 days.
In a public notice, ZIMRA said:

The Zimbabwe Revenue Authority advises members of the public, who intend to import vehicles through Plumtree Border Post, that with effect from July 1, 2024, all vehicles cleared at Plumtree Border Post would be required to obtain registration and number plates before release from ZIMRA.

The regulations are applicable at the Beitbridge Border Post, where vehicle imports are processed at the border, at Manica, Malindi and Beitbridge Transit Sheds. Reads the notice:

Clients who wish to acquire motor vehicle registration books and number plates should have the following; valid police clearance stamped by Vehicle Theft Squad (VTS). The Form is valid for 14 days, original ASYCUDA receipt-of-duty payment, and Original Insurance Cover Note accompanied by a photocopy of the same.
</blockquote>
Other requirements are; proof of residence (utility bills), stamped and authorised by a commissioner of oaths, photocopy of national identity documents stamped and authorised by a commissioner of oaths, an affidavit or letter of authority stamped by the police or power of attorney stamped or notarised by a legal representative of the client authorising the registration of the motor vehicle on the owner’s behalf (where applicable) and copy of ID of the authorised person, an ID copy of the representative, valid ZIMRA stamped ID in the case where the representative is a registered clearing agent and, for immigrants/returning residents, original passport is required and all export documents from the shipping country and the Consignment Based Conformity Assessment (CBCA) certificate. Said ZIMRA:

All Imported Vehicles Now Required To Obtain Registration, Number Plates Before Release From ZIMRA

Zimbabwe has banned the importation of vehicles that are more than 10 years old from the date of manufacture, and those bringing any shall bear the costs of re-exportation.
Statutory Instrument 54 of 2024 cited as Control of Goods (Import and Export) (Commerce) (Amendment) Regulations, 2024 (No. 10) gazetted by Industry and Commerce Minister Mangaliso Ndlovu on Thursday, deletes the old 2021 need for an import licence for older cars and replaces it with a pure ban plus a re-export requirement. It reads:

Second-hand vehicles aged 10 years and above from the date of manufacture shall not be imported. Any second-hand vehicle prohibited under this subsection shall be re-exported by the owner of the said vehicle at his or her expense.
</blockquote>
The previous and now repealed section said people were required to obtain an import licence from the Ministry of Industry and Commerce to import vehicles that were 10 years or older.
Imports of commercial vehicles, tractors, haulage trucks, earth-moving equipment and other specialised vehicles used in mining and construction sectors remain exempted from the ban.

Zimbabwe Bans Importation Of 10-year-old Used Vehicles

Fifty per cent of duty on car imports will now be paid in local currency, according to Statutory Instrument 72A of 2022 published on Friday.
Under the new regulations, half of the import duty payable will now be paid in foreign currency and the balance in local currency at the prevailing official auction rate.
However, Government departments will continue paying 100 per cent duty in local currency, at the prevailing rates. SI 72A of 2022 reads:

IT is hereby notified that the Minister of Finance and Economic Development, in terms of section 115(3) of the Customs and Excise Act [Chapter 23:02], made the following notice:—
1. This notice may be cited as the Customs and Excise (Designation of Foreign Currency Dutiable Goods) (Amendment) Notice, 2022 (No. 4).
2. The Customs and Excise (Designation of Foreign Currency Dutiable Goods) Notice, 2018, published in Statutory Instrument 252A of 2018, is amended in section (3) by the deletion of subsection (2) 
and insertion of the following—
“(2) Every person who imports any goods designated in terms of this notice shall pay duty in foreign currency: 
Provided that duty on designated motor vehicles imported by Government Ministries and Departments shall be paid in local currency at the official weekly average foreign currency exchange 
rate.
(2A) Fifty per centum (50%) of the duty on motor vehicles of tariff codes 8703.21.90 and 8703.22.90 imported by any other person other than those mentioned in (2) shall be payable in foreign currency, whereas the remainder shall be payable in local currency at the official weekly average foreign currency exchange rate.”

50% Of Import Duty On Vehicles Now To Be Paid In Zimbabwe Dollars

Following the promulgation of Statutory Instrument 89 of 2021 on the importation of second-hand cars that are more than 10 years old, the Ministry of Industry and Commerce, in collaboration with ZIMRA is extending the administrative transitional arrangement up to 30 June 2021.
This has been done to allow the clearance and processing of outstanding vehicles purchased prior to the gazetting of SI 89 of 2021.
The following will still apply:

<li>Motor vehicles must have been paid for on or before 30 June 2021</li>
<li>Proof of payment in line with the RBZ Exchange Rate Control Regulations must be attached; and</li>
<li>Any Other supporting documents.</li>
</ul>

Ministry Of Industry & Commerce Statement On Second-hand Vehicle Imports {Full Text}

Finance and Economic Development Minister <a href="https://www.pindula.co.zw/Mthuli_Ncube" rel="noopener noreferrer" target="_blank">Mthuli Ncube</a> has defended clause 25 of the Finance (No 3) 2019 Bill, which states that older second-hand car vehicle imports will pay less duty than newer vehicles.
Responding to <a href="https://www.pindula.co.zw/Dzivarasekwa" rel="noopener noreferrer" target="_blank">Dzivarasekwa</a> MP <a href="https://www.pindula.co.zw/Edwin_Mushoriwa" rel="noopener noreferrer" target="_blank">Edwin Mushoriwa</a> (MDC Alliance), who had suggested that older cars should pay more duty due to environmental impact concerns, Ncube said:
<blockquote>We are not trying to necessarily restrict the old vehicles over new vehicles. The intention rather is to recognise the remaining life and making sure the excise duty is progressive enough.
Those with newer cars pay more because of longer shelf life and those with older cars pay less. That is how we have designed it and we think it is fair to design it that way.</blockquote>
Clause 25 of the Finance (No 3) 2019 Bill outlines the Zimbabwe dollar rates of special excise duty on second-hand motor vehicles, which will take effect from January 1, 2020.
For instance, an imported second-hand vehicle with a lifespan of zero to four years and an engine capacity of up to 1 000cc will pay excise duty of $3 000, while one that is over 20 years, all engine capacities, will pay ($500).

Older Imported Second-hand Cars To Pay Less Duty

The Herald reports that Government is considering the addition of second-hand vehicle imports from Japan on the list for conformity assessment in order to protect consumers from sub-standard vehicles as well as to promote local assemblers. This means that if approved, all vehicle imports from Japan will be subject to evaluation by Bureau Veritas and issued with conformity assessment certificates before they can be allowed into the country.
Said Industry and Commerce Minister <a href="http://www.pindula.co.zw/Mike_Bimha">Mike Bimha</a>:
<blockquote>In a number of countries, cars from Japan especially cannot just come into countries due to issues to do with radiation. Some countries are very strict about the importation of cars from Japan, which I think we need to move towards to as well. It is incumbent for every country to ensure its citizens are protected against sub-standard products. It may be costly but the benefits outweigh the cost.</blockquote>
However the Bureau Veritas has been accused of delaying the issuing out of conformity certificates.

Govt considers putting import restrictions on second-hand Japanese vehicles

In May, the <a href="http://www.pindula.co.zw/Reserve_Bank_of_Zimbabwe">Reserve Bank of Zimbabwe</a> came up with a four-tier import priority list for the efficient use of foreign exchange resources, with a bias towards supporting the productive sectors of the economy and reducing the import bill. Due to growing cash constraints owing to the shortage of the United States dollar, the central bank came up with the import priority list to keep as much money in the country.
The list was grouped into four parts, priority list one to three and non-priority, the latter is where imported vehicles fall under. With this list in place, those wishing to import vehicles now have to go through a rigorous process, which involves getting approval from the central bank, a process which can take up to five months. The process involves extreme vetting to ascertain the reason and nature of the purchase.
