The High Court has nullified a multi-million-dollar transaction in which the National Social Security Authority (NSSA) purchased 526 hectares of land in Chegutu from businessman Phillip Chiyangwa.
The contentious 526-hectare piece of land at Hintonville Extension was illegally sold to Chiyangwa’s company in 2001 for $10.5 million.
Two years later, the company sold it to NSSA before concluding its initial transaction with Chegutu Municipality in violation of laid down procedures.
Chegutu Municipality maintained that there was no proof either supporting Gabroc’s purchase of the land or NSSA’s subsequent right to ownership, therefore, the alleged sale was null and void because of the laid down procedures.
Council argued that the procedure was not followed when Chiyangwa’s company purchased the land, hence there was no binding sale agreement.
The case spilt into the High Court with Gabroc seeking to compel the council to approve the sale. Justice Charles Hungwe ruled that the said sale of the land was a nullity hence the court could not sanitise it. Said justice Hungwe:
<blockquote>_Clearly for this court to grant the relief sought, would be to condone an illegality. The transaction between first applicant (Gabroc Investments) and the respondents (Chegutu Municipality and the town clerk) contravenes the clear provisions in the Urban Councils Act._
_The rationale behind Section 152 of the Act is to promote transparency in the administration of public assets. The agreement executed by the parties in 2001 did not comply with this public policy thrust as set out in the Act._
_The courts cannot sanitise a transaction that is abjectly illegal._</blockquote>
The judge expressed shock at how NSSA released public funds to buy the same land from Gabroc without due diligence adding “simple and cost-effective due diligence could have saved it a fortune.”
The judge nullified the transaction and threw out the application by Grabroc and NSSA with costs.
A report released by Auditor-General Mildred Chiri last month raised a red flag after the land was not part of NSSA’s assets despite millions of dollars having been paid to Chiyangwa’s Gabroc Investments.
This would suggest that US$3.5 million of pensioners’ money went down the drain.

High Court Nullifies Chiyangwa, NSSA Multi-million Land Deal

Martin Zimani, former Chegutu mayor and Zanu-PF’s Mashonaland West provincial member has died.
Without disclosing the cause of death, Zimani’s son Victor said that the former mayor died yesterday.
The former mayor won the mayoral role post from the MDC IN 2006.
Incumbent mayor, Councillor Henry Muchatibaya expressed his condolences. Muchatibaya said:
<blockquote>During his tenure as the mayor, he proved to be a very good man who was welcoming regardless of political affiliation. As Chegutu Municipality we will provide him with a grave and water bowser while we have availed transport to be used for his final resting place.</blockquote>

JUST IN: Chegutu Ex-Mayor Dies

The Herald Zimbabwe reports that Chegutu residents are currently demonstrating demanding the resignation of the entire council management for failing to address perennial sewage issues. The publisher posted the following message on twitter:
<blockquote>Chegutu residents are currently demonstrating at Town House calling for the immediate ouster of the entire management led by Town Clerk Mr Alex Mandigo whom they are accusing of failing to address perennial water &amp; sewer challenges since 2008 when the town was hit by cholera</blockquote>

Below is a full statement from Mr Manu Mituka.
<blockquote>Dear Chegutu Municipality
Firstly I would like to say am writing this with a bleeding heart, sometimes last month you promised us to solve the sewage issues that have been a catastrophic disaster in many locations.

You promised that you were going to change the pipes and put new ones since the old ones are outdated but till today no progress have been made.
I would like to give an example ward 8,sewage is everywhere flowing non stop. You as our municipality you also put gravel in magamba street as a way of closing potholes but since you put the gravel its stil hills of gravel that are not yet leveled but today am not going to talk about the state of our roads.
The gravel that you put in magamba street is now even holding the sewage flowing down now we having places were the sewage is held by this gravel hills and mosquitoes are now everywhere and i will not talk about cholera because we all know what happened here in Chegutu before. For the sake of our health we kindly ask you to help us by fixing this sewage problem that have became a daily basis situation in Chegutu.
Another problem we would also like our municipality to solve the problem of water, out 5 houses you will find out that only one house have tap water whilst the other the taps are dry, how can we survive with such conditions.
NB*The issues of sewage and tape water need to be addressed and solved as early as yesterday!
Our Mayor, town clerk, MP we kindly ask you to come to our locations and see how bad the situation is if a cholera outbreak can hit us we will loose many lives, please work together with councilors please for the sake of us!
