<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The High Court Court has dismissed an application filed by villagers from Chilonga Communal lands, Chiredzi, Masvingo, which sought to challenge the government’s plans to evict them from their ancestral lands.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The villagers were challenging Sections 4 and 6 of the Communal Lands Act which vests rural land in the President which they argued was a colonial relic premised on a racist concept that an African could not own land.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The villagers also argued that the Communal Lands Act is a racist and a colonial creature which regards Africans as too uncivilised as to own land. </span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The villagers queried how an African can own a house in Harare’s plush suburb of Borrowdale but cannot own his ancestral home in areas such as Chiredzi, Mwenezi, Dotito, Chendambuya, Nkayi or Tsholotsho.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">About 12 000 villagers face displacement.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The evictions are meant to pave way for a commercial irrigation venture. </span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">Chilonga villagers were being represented by MDC Alliance Vice President, Tendai Biti who is a Zimbabwe Lawyers for Human Rights member. </span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">Early last year, the Human Rights Watch (HRM) said the planned eviction <strong><a href="https://news.pindula.co.zw/2021/03/12/eviction-of-chilonga-people-violates-international-law-human-rights-watch/">violates the principles of international human rights law.</a></strong></span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">In March 2021, Chiredzi Rural District Council (RDC) chairman Mr Aldermen Edward <strong><a href="https://news.pindula.co.zw/2021/03/21/chilonga-evictions-no-one-will-be-displaced-chiredzi-rdc-chair/">Matsilele said contrary to reports in the media, “no one living in the Chilonga area will be displaced</a></strong>, only a few might need their houses shifted a short distance to allow irrigation canals to pass through.”</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">He added that local headmen, chiefs and councillors are being consulted so that their people get to understand what is being planned.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The government initially issued a Statutory Instrument that indicated that the state intended to take the land and evict the people to a land that had already been identified.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The announcement triggered a public outcry prompting authorities to issue more Statutory Instruments amending the earlier one.</span></p>
<p><span style="font-size: 14pt; font-family: 'times new roman', times, serif;">The tone in the latest Statutory Instrument even suggests that the government will compensate some villagers who would have been affected by the “irrigation project.”</span></p>

<div class="margin-tl txt-mute txt-size-variable--12">7) The never-never story claims Govt used “Chief” Tshovani in respect of land under Chief Sengwe; well, there is only one chief called Sengwe; the rest are headmen presently, which is why part of VP’s message was to upgrade the headmen to Chiefs!!!!! Matter-of-factly, VP Chiwenga only met Chief Sengwe in person to consult on that new proposal to upgrade headmen under him.</div>

<div class="margin-tl txt-mute txt-size-variable--12">The rest of the traditional leadership was met in an open tent in a stadium alongside many other leaders who included MPs, councillors, service chiefs and Govt officials who included the writer! As it transpired from consultations, Chief Sengwe confessed his real land and jurisdiction in terms of tradition was in Gezani area, not in the area in question where he was thrust there by colonial settlers after all Shangaan-speaking communities were evicted from Mwenezi. Trevor’s Un-Zimbabwe Independent does not know that!!!!</div>

<div class="margin-tl txt-mute txt-size-variable--12">8) The paper restates that only traditional leaders met VP Chiwenga; the accompanying picture exposes the emptiness of that claim co-manufactured by some Chikutu informant who was completely invisible at, and inconsequential in the meeting, assuming he attended it. Interestingly, journalists covered all the proceedings, with ZimInd showing by its conspicuous absence!!!</div>

<div class="margin-tl txt-mute txt-size-variable--12">The flag-canoe newspaper claims VP Chiwenga sought to placate irate Chilonga villagers through fresh allocations for Kilimanjaro Cane Project; in reality, the VP was sent by His Excellency the President to announce a nullification of the list of beneficiaries for Kilimanjaro so a new one consistent with the policy of local beneficiation is drawn up for sight and approval by the Presidency!!!</div>

The paper will not allow even the law to stand in the way of a good yarn!!! Instead the story suggests a stale SI and the extant one “were used to grab land from villagers”!!! To date, no land has been alienated whether by law or physically. Indeed, no land will be alienated when the development scheme takes place!!!</div>

All the facts were placed in the public domain, including images from that meeting. Equally, media across the divide covered the story; that included NewsDay, sister paper to Zimbabwe Independent.</p>
<p class="js-tweet-text tweet-text with-linebreaks" lang="en">Significantly, the whole yarn draws from this one source, VHELEMU LEVISON CHIKUTU whose presence and status in the meeting I have already stated. Yet the paper’s yarn admits to a throng as attendees of the consultative meetings. Why such a paucity of sources??? I won’t bore readers with details of what transpired last Sunday; it’s available on my Twitter handle.</p>
<p class="js-tweet-text tweet-text with-linebreaks" lang="en">All I can say to the Editor of the Zimbabwe Independent is, it’s not very nice to sell such tall tales relating to a project which has been embraced and which will proceed to excoriate you in future and forever.</p>

Zimbabwe faces a milk shortage and is having to import powdered milk from South Africa. Has the AMH Group been lobbied by South Africa’s MILK</p>

Mnangagwa's Spokesperson Accuses Trevor Ncube's Paper Of Lying On Chilonga, Chiwenga Meeting

<p>Vice President Constantino Chiwenga was reportedly forced to reschedule a meeting with Chilonga villagers after it had appeared that the villagers were angry with the government’s intention to remove them from their ancestral lands.</p>
<p>The intended relocation is meant to pave way for irrigation projects which the state claim will be of great benefit to the local people.</p>
<p>Chiwenga was scheduled to have a meeting with the concerned people in Chilonga but ended meeting headmen and chiefs at a closed-door meeting at Gibbo Stadium in Triangle, several kilometres away from Chilonga.</p>
<p>The Independent reports that the villagers had met Masvingo’s minister of state and Provincial Affairs, Ezra Chadzamira and demanded offer letters if they are indeed beneficiaries of the projects as the government claims. A source told the Zimbabwe Independent this week:</p>
<blockquote><p>They, however, met resistance and immediately rescheduled Chiwenga’s visit for last Sunday at Gibbo Stadium in Triangle. Only traditional leaders were invited to the meeting.</p></blockquote>
<p>A representative of Chilonga village head Vhelemu Livison Chikutu said traditional leaders reportedly turned down verbal promises. Chikutu told Chadzamira during a meeting which was a precursor to Chiwenga’s visit:</p>
<blockquote><p>If you are saying we are no longer going to be moved and we are going to be beneficiaries of the grass project, then we want offer letters. You are not going to be our minister of state forever. You might be fired or you may die tomorrow and your successor will simply ask for the agreement we had with the government not with Chadzamira as a person.</p>
<p>As villagers of Chilonga, we are worried that you are misleading the nation that there were proper consultations. We are totally opposed to the government decision to forcibly move us from our land. We are also worried that you are using Chief Tshovani as the leader whose area of jurisdiction is affected yet it belongs to Chief Sengwe who is not here. We feel you are trying to mislead the world that our traditional leader is in support with whatever is happening.</p></blockquote>
<p>The Chilonga contentious issue was not discussed in-depth as the traditional leaders asked for more time to consult their people.</p>

Angry Chilonga Villagers Force Chiwenga To Change Meeting Venue

<p>The government has issued Statutory Instrument 63A of 2021 that amends Statutory Instrument 50 of 2021 that was issued last week to legalise the eviction of Chilonga people.</p>
<p>The new SI, however, only altered the wording in some provisions without necessarily affecting the motive, implying the evictions could still go on. SI 63A of 2021 reads in part:</p>
<blockquote><p>It is hereby notified, for general information, that the Communal Land (setting aside of land) (Chiredzi) notice, 2021, published in SI 50 of 2021, contained errors.</p></blockquote>
<p>It further notes that 50 of 2021 was corrected “by the deletion of the words purpose of lucerne production” and substitution of “establishment of an irrigation scheme.”</p>
<p>The eviction of Chilonga people from their ancestral lands <a href="https://news.pindula.co.zw/2021/03/06/magistrate-grants-interim-order-barring-eviction-of-chilonga-villagers/">has been resisted</a> by stakeholders including the MDC Alliance that has since sent a delegation to meet with the residents.</p>
<p>Law expert and president of opposition National Constitutional Assembly (NCA), professor Lovemore Madhuku described the evictions as unconstitutional and “colonial mentality.”</p>
<p>It is alleged that at the weekend, President Emmerson Mnangagwa ordered a high-level ministerial meeting to deal with the matter that was getting out of hand.</p>
<p>The residents argue that the state has a tendency of evicting people and dump them without compensating them for losses incurred.</p>
<p>Chilonga people cite the eviction of Tugwi-Mukorsi flood victims as a case in point saying the government left them without all the necessities such as schools.</p>

Government Amends SI Legalising Eviction Of Chilonga People

<p>A new political party in Zimbabwe, Economic FreedomFighters Zimbabwe has threatened to destroy a lucerne project by Dendairy if the government evicts Chiredzi villagers.</p>
<p>The government has earmarked Chilonga area in Chiredzi, Masvingo Province for the grass project, a move that has faced resistance from the villagers.</p>
<p>Speaking to NewsDay over the matter, EFF Zimbabwe’s president Innocent Gagu Lutshutsha Ndibali said:</p>
<blockquote><p>My understanding is that the Land Task Force is not willing to work with us, but will push harder for our people as EFF Zimbabwe, we will not relent if need be, will destroy the project itself.</p></blockquote>
<p>Villagers have since written to the Minister of Local Government, July Moyo seeking explanation on the matter saying they were not consulted. They are also threatening to drag the government to court.</p>
<p>Chilonga residents cite the government’s failure to cater for the welfare of victims of Tokwe-Mukorsi floods as another reason for not wanting to leave their ancestral lands.</p>
<p>In the letter they wrote to the Minister of Local Government, they also wanted to know how they were set to benefit from the intended project.</p>
