A Mutare resident, Ebson Tembenuka, has regained possession of his home after a judicial officer intervened against the City of Mutare’s (CoM) attempts to evict him.
According to the Zimbabwe Lawyers for Human Rights (ZLHR), Tembenuka, a 56-year-old self-employed man from Sakubva, was forcibly evicted by CoM municipal police officers on September 17, 2024, who locked him out of his residence.
Tembenuka has been peacefully residing in his home since June 2012 under a valid lease agreement with CoM.
On August 16, 2024, Tembenuka received a notice from CoM about alleged rental arrears of US$128 and was invited to contest the claim. He submitted his objections to the Finance Department on August 30, 2024. Said ZLHR:

Despite the engagement, which he had with CoM’s officials, Tembenuka was surprised to be ambushed by the local authority’s municipal police officers, who forcefully removed him from the house and locked the door to his house.
While he had pleaded with CoM’s municipal police officers to allow him access to some of his personal belongings and items, the employees insisted that he should visit the local authority’s offices to explain himself as they were only carrying out instructions.
After failing to obtain relief through engaging CoM officials, Tembenuka then sought the services of Zimbabwe Lawyers for Human Rights, whose lawyer Tatenda Sigauke, filed an ex-parte application at Mutare Magistrates Court on 18 September 2024 seeking an order to compel CoM to remove its locks and to restore the resident’s occupation and possession of the house.

During court proceedings, Tembenuka argued that the eviction violated his constitutional rights against arbitrary eviction, as the CoM did not possess a court order to justify their actions.

On October 1, 2024, Magistrate Purity Gumbo ordered CoM to remove the locks from Tembenuka’s property and restore his access, and not to evict him without following due process of the law.

A man in Mutare named Ebson Tembenuka got his house back after the council tried to kick him out illegally. He had a lease agreement with the council but they said he owed money. Even though he tried to explain, they still locked him out. He asked for help from lawyers who went to court. The judge said the council had to give his house back and couldn't do that again without a good reason. In the end, he won and got his home back from the council.

Mutare Resident Regains Home After Court Thwarts Illegal Eviction By Council

The City of Mutare has issued a one-month notice to all property owners and occupants of buildings in the Central Business District.
The notice requires them to undertake repairs, refurbishment, and repainting. The primary goal is to enhance aesthetics.
The local authority said a failure to comply with this corrective action by April 8, 2024, will result in legal consequences under the relevant Act and Town Planning Scheme. Reads the notice:

The City of Mutare wherein referred to as the Local Planning Authority, is giving one (1) month notice to all property owners and occupants of buildings in the Central Business District to have these repaired/ refurbished, and repainted.
This is being done to improve the aesthetics. It can be widely agreed that most buildings in the Central Business District have gone for a long time unattended, thereby dilapidating.
This is also in contravention of the provisions of the said Act and the operative Town Planning Scheme covering the area.
This corrective action should be taken not later than 8 April 2024, failure which Council will proceed to take legal action in line with the provisions of the Act.

Mutare Council Orders CBD Property Owners To Repair And Repaint Buildings

The Mutare City Council has urged residents to be on high alert and take precautionary measures to ensure safety as Tropical Cyclone Freddy is expected to bring torrential rains and strong winds to parts of Zimbabwe.
In a notice issued to the public on Wednesday, the local authority urged residents, especially those in low-lying areas, to follow weather updates and monitor the situation. The notice reads:

Notice is hereby given to all Mutare residents and stakeholders that heavy rain is expected to hit Zimbabwe and Mozambique from February 25 to March 3.
Residents should be on high alert for the possibility of Cyclone Freddy which is threatening to affect Zimbabwe and Mozambique.
All residents in low-lying areas should constantly monitor the situation as the possibilities of flooding are very high.
In light of the above, we are encouraging all residents to exercise necessary precautions to keep safe and prevent loss of lives and damage to property.
</blockquote>

Tropical Cyclone Freddy made landfall on the eastern coast of Madagascar on 21 February 2023.
The weather system is projected to make landfall in Mozambique between Govuro and Vilankulo (Inhambane province) on 24 February, as a severe tropical storm, according to <a href="https://reliefweb.int/report/mozambique/mozambique-severe-tropical-storm-freddy-and-floods-flash-update-no4-23-february-2023">reliefweb</a>.

ZESA: Notice Of Interruption Of Power Supply In Mutare

The refurbishment of Sakubva Stadium by Mutare City is reportedly underway. The local government authority is taking advantage of the postponement of the Castle Lager Premier Soccer League to expedite the process.
Reports suggest that the extension of changing rooms is now at window level while players’ tunnel from changing rooms to pitch is almost complete.
The interior perimeter fence has also been installed.
The development was triggered mainly by local stadia ban by the Confederation of African Football for international tournaments.
ZIFA also condemned some of the local stadiums saying that they would not be used for the 2020 Castle Lager Premier Soccer League in their current state.

PICTURES: Refurbishment Of Sakubva Stadium Underway

City Of <a href="https://www.pindula.co.zw/Mutare">Mutare</a> has notified residents that service delivery particularly refuse collection has been disrupted by fuel shortages that have been ravaging the country for weeks on end, Manica Post reports.
The City published a statement to residents that read:
<blockquote>Notice is hereby given to all residents and stakeholders that the fuel challenges experienced in the country have affected service delivery… there will be numerous interruptions in service delivery programmes such as attending to water and sewer bursts and refuse collection.</blockquote>
According to the publication, Mutare City’s Public Relations Manager assured residents that normal service delivery would resume once the city received adequate fuel supplies.
