MDC Alliance president Nelson Chamisa on Sunday said he had warned the late human rights activist Dewa Mavhinga against coming to Zimbabwe, a few days before he died.
Chamisa was addressing mourners at Mavhinga’s burial at his rural home in Chivhu yesterday.
Mavhinga, who was the Human Rights Watch director, resided in Johannesburg, South Africa.
He died a few days after he returned to Johannesburg from a research mission in Zimbabwe.
In his eulogy, Chamisa described Mavhinga as a resolute defender of human rights. He said:
<blockquote>
I had told Dewa to defer his visit to Zimbabwe, but he insisted that he would come.
He told me that he was in the southern region visiting other countries including Mozambique.
He inquired why I was stopping him from coming to Zimbabwe. I also insisted that he should not come to Zimbabwe.
About four weeks ago, we held a virtual meeting with Dewa and three others for over an hour planning the way forward on the 2023 elections.
Dewa was a veteran, a stalwart, very resolute and a beast in fighting for human rights.
It is not possible to become a human rights defender without a human rights attacker.
He was a defender because our people are being attacked. We have been robbed as a country, as the whole world, as a generation.

Several senior opposition party members, civic society members, and human rights activists were present at Mavhinga’s funeral.

Chamisa: I Warned Dewa Mavhinga Not To Return To Zimbabwe

The Human Rights Watch has mourned the death of prominent human rights defender and the director of Human Rights Watch for southern Africa division, <a href="https://www.pindula.co.zw/Dewa_Mavhinga">Dewa Mavhinga</a>.
Mavhinga succumbed to COVID-19 on Saturday in Johannesburg, South Africa, where he was based.
In a statement, the Human Rights Watch said Mavhinga was a beloved colleague to many activists across the human rights movement. They said:

Mavhinga was known not just for his passion, commitment, and leadership on human rights but above all for his great heart, his kindness, and solidarity with others.
</blockquote>
Kenneth Roth, executive director of Human Rights Watch described Mavhinga as a highly effective human rights activist who worked for the betterment of people’s lives. Said Roth:

Dewa was a deeply empathetic and highly effective human rights activist whose work made many people’s lives better, whether it was pushing the Zimbabwe government to respect the right to protest in the face of economic hardship or ensuring that victims of human rights abuses across Southern Africa have access to justice.
</blockquote>
Mavhinga joined the Human Rights Watch as senior Zimbabwe researcher in 2012 and spent years documenting human rights violations in the country during the latter years of Robert Mugabe’s reign as well as under President Emmerson Mnangagwa.

Human Rights Watch Mourns Dewa Mavhinga

Southern Africa Director with the Africa Division at Human Rights Watch, <a href="https://www.pindula.co.zw/Dewa_Mavhinga?utm_source=PindulaArticle&amp;utm_campaign=PindulaArticle">Dewa Mavhinga</a> has died.
Sources close to the Mavhinga family said the prominent lawyer succumbed to COVID-19. He died in Johannesburg, South Africa, where he was based. 
His colleagues say he recently attended a funeral in Zimbabwe where he’s feared to have contracted Covid-19.
One of his closest friends, Pedzisai Ruhanya who is also an MDC Alliance activist, posted on social media mourning the legal expert. He said:

In life, there are real friends, top-notch friends. You were one among such important friends. Wandirwadza Dewa. RIP my brother.
</blockquote>
Norman Matara, a local medical doctor also mourned Mavhinga. He said:

Former Local government minister, Saviour Kasukuwere also paid tribute to the prominent lawyer. He said:

A great Zimbabwean Dewa Mavhinga has gone. Painful and distressing. A fair and committed human rights fighter, full of integrity and passionate about his country. Rest in Peace.

Former Education Minister and MDC Alliance Treasurer General, David Coltart described Mavhinga as a champion for the protection of human rights. He said:

I am very saddened to hear that Dewa Mavhinga has died, apparently of <a class="link-complex" href="https://twitter.com/search?q=%23Covid" rel="hashtag noopener" target="_blank">#Covid</a> in South Africa. He was a great champion for the protection of human rights. My condolences are extended to his family and friends.

Before joining Human Rights Watch, Dewa worked as the Regional Coordinator for Crisis in Zimbabwe Coalition based in Johannesburg. 
In 2012 <a href="https://www.pindula.co.zw/Dewa_Mavhinga?utm_source=PindulaArticle&amp;utm_campaign=PindulaArticle">Dewa</a> co-founded the Zimbabwe Democracy Institute, a public policy research think-tank based in Harare. He is a recipient of the British Chevening and Canon Collins Trust scholarship, Dewa holds a bachelor of law honors degree (LLB) from the University of Zimbabwe and a master of law degree in international human rights (LLM) for Essex University, United Kingdom.

JUST IN: Dewa Mavhinga Has Died

The Human Rights Watch (HRM) has said Zimbabwe’s planned eviction of Chilonga people in Chiredzi violates the principles of international human rights law.
Zimbabwe intends to evict Chilonga people to pave way for Dendairy’s lucerne grass project.
Dewa Mavhinga, the Southern Africa director at the Human Rights Watch said the African Union and members of the Southern African Development Community (Sadc) should pressure Zimbabwe to respect and protect the rights of the Chilonga community in accordance with national and international law. He said:
<blockquote>It is not disputed that under <a href="https://news.pindula.co.zw/2019/05/02/war-veteran-warns-zanu-pf-against-land-evictions/">section 10 of the Communal Land Act</a>, the minister responsible for Local Government, Urban and Rural development can set aside communal land for any purpose, after consultation with the local Rural District Council. The Act permits the minister to order evictions under certain limited circumstances, including after providing reasonable notice, and in compliance with the country’s constitution, which in section 74 prohibits eviction in the absence of a court order. This means that in the absence of a court order, the Chilonga eviction would be unlawful.
Forced displacement without compensation, termed as forced evictions, violates international human rights law. The African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa, which Zimbabwe ratified, requires in article 3(1)(a) that states parties “refrain from, prohibit and prevent arbitrary displacement of populations. That Zimbabwe signed and ratified the African Union Convention for the protection and assistance of internally displaced people should stop the Zanu PF government from pushing the people of Chilonga into arbitrary relocation.
The African Commission on Human and Peoples’ Rights has stated that the right to property includes the recognition of communities’ traditional and collective ownership of land and their protection from forced evictions.
In General Comment 7, the UN Committee on Economic, Cultural, and Social Rights defines forced evictions as “the permanent or temporary removal against their will of individuals, families and/or communities from the homes and/or land which they occupy, without the provision of, and access to, appropriate forms of legal or other protection.”</blockquote>
Mavhinga added that the committee also urged governments to adequately compensate victims and ensure that “prior to any evictions, particularly those involving large groups, all feasible alternatives are explored in consultation with affected people, with a view to avoiding, or at least minimizing, the use of force.”

Eviction Of Chilonga People Violates International Law -Human Rights Watch

Dewa Mavhinga, the director of Human Rights Watch, Southern Africa says Mambo’s Chicken have taken it too far by joking over the alleged assault on former MDC-T interim leader, Thokozani Khupe at the party’s congress held Sunday.
It is alleged that Khupe was slapped by one of Douglas Mwonzora’s supporters as she tried to stop or influence the cancellation of the congress which she said was being rigged in Mwonzora’s favour.
Mambo’s Chicken made an advert which made fun of the incident. Said Mambo’s Chicken:
<blockquote>Huyai tikupei Huku. Monday Blues don’t have to SLAP so hard</blockquote>
In response to the advert, Mavinga said:
<blockquote>Mambo’s Chicken <a data-user-name="mamboschicken" href="https://twitter.com/mamboschicken/" rel="noopener user noreferrer" target="_blank">@mamboschicken</a> must not joke about violence against Madam Khupe. Stop <a href="https://twitter.com/search?q=%23GBV" rel="hashtag noopener noreferrer" target="_blank">#GBV</a>. Not funny! Say Sorry!</blockquote>
Some, however, alleged that Khupe likely staged the slap while some said it was not gender-based violence but political violence.
As the congress degenerated into chaos, Khupe and other presidential contestants left the HICC auditorium where the elective congress was being held.
The party’s Independent Electoral Management Body eventually announced that Mwonzora had a landslide victory after polling 883 votes out of a declared 1 027 total ballots issued.

Human Rights Defender Reprimands Mambo's Chicken Over Khupe Joke

Yesterday during Aljazeera’s The Stream, with Aljazeera’s reporter Femi Oke, Zanu PF Infomation and Publicity Director Tafadzwa Mugwadi is seen in the following short clip uttering obscene words directed at the panel which had MDC National Spokesperson Fadzayi Mahere and Dewa Mavhinga who were discussing the human rights abuses in Zimbabwe.
Mugwadi opened the interview by attacking Mahere and called her a new politician, a relevant seeker and her party was decimated by the Supreme Court ruling and they are desperate to find relevancy and said she is lying and that her party is lying about fake abductions.

Dewa Mavhinga, the Human Rights Watch Director for Southern Africa has opined that the persecution of journalists in Zimbabwe is a strategy to get to their sources who helped in the exposure of grand corruption by some government officials and departments.
Mavhinga who investigates human rights abuses in Zimbabwe, South Africa, eSwatini &amp; Malawi speaks when journalists Hopewell Chin’ono and Mduduzi Mathuthu have been targeted by the state after they exposed corruption in the country. Posting on social media on Saturday, Mavhinga said:
<blockquote>Persecution/harassment of prominent journalists Hopewell Chin’ono &amp; @Mathuthu, &amp; their families, is for the Zimbabwe authorities to get to their sources who helped expose high-level Covid19 PPE corruption.</blockquote>
Chin’ono was arrested on 20 July and charged with inciting public violence after rallying the citizenry to participate in anti-corruption protests that had been scheduled for 31 July.
Meanwhile, Mathuthu has gone into hiding but his family is being harassed by state security personnel. His nephew Tawanda Muchehiwa was recently abducted, tortured and detained by police who wanted him to reveal Mathuthu’s whereabouts.
Speaking to SABC News last night, the Secretary for Information, Nick Mangwana said relatives of wanted individuals who do not reveal the whereabouts of their relatives are being arrested for “obstructing justice.”

Persecution Of Journos In Zim: “Authorities Want Identity Of Sources Who Helped Expose Corruption” – Human Rights Watch

A Zimbabwean human rights defender, Ttaenda Mombeyarara has said that he is terrified by the recent reports of abduction and torture of three MDC Alliance trio – Joana Mamombe, Cecilia Chimbiri and Netsai Marova.
Mombeyarara was last year kidnapped from his home at ungodly hours, tortured and sustained a fractured leg.
He is one of many people who were last year arrested on grounds that they were intending to subvert a constitutionally established government. Speaking to <a href="https://www.dw.com/en/in-zimbabwe-dissent-can-lead-to-disappearances-and-torture/a-53862165">DW</a>, Mombeyarara said dissent can lead to abduction and torture. He said:
<blockquote>I am petrified and terrified. It is a difficult situation to become a villain when you are the victim. You are forced to decide to keep to yourself to prevent further victimization. You have to remain gagged to heal. The nature of harm caused on you goes beyond physical.</blockquote>
Although the identity of the perpetrator of these human rights abuses is not yet known, the opposition MDC and human rights organizations say in most incidences, the pattern of the violations points towards the state.
The government, however, has denied involvement with the Home Affairs Minister Kazembe Kazembe saying the government does not engage or permit any of its agencies and institutions to use methods such as torture, forced disappearances or abductions.
Kazembe accused the opposition of working with foreign organizations to destabilize the government of President Emmerson Mnangagwa adding that “torture and forced disappearances are alien to us.”
Meanwhile, Human Rights Watch Southern Africa Director Dewa Mavhinga observes that Zimbabwe’s failure to decisively deal with cases of abductions disappearances and torture severely undermines the standing of the country within the international community and reengagement efforts.

"I'm Petrified And Terrified," - Abduction And Torture Victim Speaks

Political analysts have said the general populace in Zimbabwe is likely to end up taking it to the streets, again, to register displeasure on the deteriorating state of affairs.
The prediction is made when the coronavirus induced-lockdown that was initially imposed in March has shattered the economy, further deteriorating the living standards of the majority that is living on hand to mouth.
Rashweat Mukundu, a political analyst, told Daily News that the only way out for Zimbabwe was a national dialogue that would map out a national vision. He said:

<div>These sentiments were echoed by Political Science lecturer Eldred Masunungure, World Politics Professor Stephen Chan and Human Rights lawyer Dewa Mavhinga who said Zimbabwe is divided, highly polarised and needs healing.</div>

Analysts Predict "Renewed Protests" Against Govt

Journalist, <a href="https://www.pindula.co.zw/Dewa_Mavhinga" rel="noopener noreferrer" target="_blank">Dewa Mavhinga</a>, has claimed on Twitter that a Zimbabwean national allegedly killed a South African police officer in Diepsloot, Johannesburg on 17 January resulting in the eruption of xenophobic violence. He wrote:
<blockquote>A #Zimbabwean national allegedly killed a police officer in Diepsloot, Johannesburg on 17 January. The killing sparked Xenophobic violence which is raging still.</blockquote>
However, another Twitter user going by the Twitter handle <a href="https://twitter.com/Khodi_M/status/1220253118505590785?s=20" rel="noopener noreferrer" target="_blank">@Khodi_M</a> has disputed reports claiming that xenophobic attacks have flared up again, saying that there is a difference between xenophobia and protests.

There are currently no attacks taking place, the people in Diepsloot are Protesting by burning tires and blocking roads as a call to the government, they are not ATTACKING anyone!</blockquote>
The Zimbabwean man accused of the murder was reportedly arrested and is in police custody.

Xenophobic Attacks Erupt In Jo'burg After Zimbabwean Man Kills SA Police Officer - REPORT

Human Rights Watch’s Southern Africa Director, Dewa Mavhinga has reported that a civil society leader, Obert Masaraure was abducted by suspected state agents. Masaraure is the president of ARTUZ, a teacher’s labor union. Reports suggest that ARTUZ members have currently suspended their services demanding the government to increase their salaries. Civil Society Leader Abducted By Suspected CIO Agents

Some Zimbabweans are opposed to Zimbabwe’s involvement in Burundi’s bid to be admitted into the 16-member Southern African Development Community (SADC).
Dewa Mavinga, the director of Human Rights Watch, Southern Africa is concerned with Burundi’s poor record on human rights. He is also concerned by President Nkurunziza’s amendment of the constitution in 2015.
Mavhinga said that Burundi has had issues with the constitution human rights record and factor that into its decision to admit it. He said:
<blockquote>There are a lot of problems taking place in Burundi that involve serious human rights violations, and that is what is forcing Burundi to have to send an envoy to Zimbabwe to help make a case for it to be admitted to SADC.</blockquote>
Paradza who responded to the above message said:
<blockquote>Burundi is part of the African Union, Burundi is part of COMESA, if there are any misdemeanors which are offending human rights advocates, surely they must go and have that sorted out with the African Union. Analysts Opposed To Zimbabwe's Involvement In Burundi's Bid To Join SADC

Human rights and political activist Dewa Mavhinga expressed disappointment with the association to an alleged plot to oust Emmerson Mnangagwa’s government from power.
The alleged plot was first <a href="https://www.herald.co.zw/mzembi-tyson-plot-govt-ouster/">reported by state-controlled daily newspaper The Herald</a> today. The report claimed that former minister in Mugabe’s government Walter Mzembi has roped Mutumwa Mawere and Dewa Mavhinga to assist him in isolating Mnangagwa regionally and internationally in order to effect regime change in Zimbabwe.
Tweeting his displeasure, Mavhinga said:
<blockquote>Paranoid Herald Zimbabwe has a false &amp; malicious article about me in a fabricated Emmerson Mnangagwa Government ouster. [Editor] Tichaona Zindoga you have my number, give your reporter to check with me first before slander. Shame!😡</blockquote>
Today, an alleged WhatsApp conversation between Walter Mzembi and Mutumwa Mawere was leaked on Twitter (<a href="https://news.pindula.co.zw/2019/03/16/leaked-mawere-walter-mzembi-whatsapp-conversation-mnangagwa-ouster/">we posted the conversation here</a>). In the conversation, reference is made to a Dewa. Mawere suggests that Dewa had been sent some messages that he needed to go through and Mzembi says Dewa’s participation is key in making an issue topical in the US politically.
Mavhinga, however, says he is not mentioned by surname in the leaked chats so a conclusion cannot be made that he is the Dewa referred to.

An apparent WhatsApp conversation between Mutumwma Mawere and Walter Mzembi has been leaked on Twitter. The conversation is about the two individual’s plan to ouster Emmerson Mnangagwa by isolating him regionally and internationally.

Deaths, Assaults, Rape, Arrests In Numbers: Protest & Crackdown Statistics

In a Facebook comment yesterday, Strive Masiyiwa said that it was sad that people had cyberbullied his wife off Twitter. He also said that his wife, Tsitsi Masiyiwa, had contributed immensely to Zimbabwe using the non-profit organization he founded Higherlife Foundation.
In his comment Strive also said that he is personal friends with the employers of one the foremost cyberbullies that hounded his wife off Twitter and bitterly said he hoped the person was happy now that she had shut her account.
Said Strive Masiyiwa:
<blockquote>Sadly one of the foremost bullies is a Zimbabwean who works for an international organization that is highly respected for its work on human rights. It’s founder, now 95 is a close family friend. I hope my human rights friend is happy now that he has stopped her from using Twitter. Maybe now he and others like him will stop this pathetic misogyny.
What about the rights of women like my wife to also express an opinion?</blockquote>
Responses from social media users have generally identified Dewa Mavhinga, a human rights and political activist, as the person he was referring to as having cyberbullied Tsitsi Masiyiwa off twitter.
Tsitsi Masiyiwa torched a twitter storm when, around December 18, she said on Twitter:
<blockquote>Some outcries and actions in pursuit of justice seem and look so right until you discover the source of the outcry and sponsor of the cause. Take a step back and reflect on some of the things we consider good and just causes.</blockquote>
Human Rights Watch Southern Africa Director Dewa Mavhinga replied:
<blockquote>” If you are implying that all and any outcry and pursuit of justice is sponsored then that really is sad. When your husband pursued his fight to be licensed it was a just cause. In such position of privilege, you should choose your words more carefully, lest you promote injustice.”</blockquote>
Tsitsi subsequently deleted her twitter account @t_masiyiwa.
Earlier in the year, Masiyiwa also torched another twitter storm when she implied that Zimbabweans had a poor work ethic and that this was bad for the country’s economy.

Strive Masiyiwa Defends Wife Who Was "Cyberbullied", Says He's Friends With The Bullies' Employer

The full text of the testimony of Southern Africa Director for Human Rights Watch, Dewa Mavhinga, before the United States Senate Foreign Relations Subcommittee.
<blockquote>Introduction – Thank you, Chairman Flake, Ranking Member Booker, and other members of this subcommittee for giving me the opportunity to testify on behalf of Human Rights Watch at this hearing on Zimbabwe. I would like to request that my statement in its entirety be submitted for the record.
My name is Dewa Mavhinga. I am Southern Africa director in the Africa Division of Human Rights Watch where I lead, among other duties, our human rights investigation work on Zimbabwe. I frequently travel to Zimbabwe and last month I was in Harare when the military takeover occurred on November 15, 2017. I have met with leaders of the main political parties, private media, and key civil society groups to assess human rights conditions since the military takeover and ahead of national elections scheduled for 2018. A Zimbabwean national myself, I maintain daily contact with local activists, and religious and business leaders in the country who regularly update me on the situation there.
Mr. Chairman, my testimony will first lay out the human rights situation in Zimbabwe since the military takeover of government functions on November 15, and then highlight key recommendations to the US government for action to press the new Zimbabwean government to ensure a rights-respecting environment leading to democratic, credible, transparent and peaceful elections and political stability thereafter.
<h2>I. Current Human Rights Situation</h2>
<h3>The Military Takeover and Mugabe Ouster</h3>
Following the military takeover, Robert Mugabe resigned as president on November 21 after 37 years of authoritarian rule marred by countless serious human rights violations. On November 24, Mugabe was replaced by his former deputy, Emmerson Mnangagwa, who has his own long record of rights violations. In his inaugural speech, Mnangagwa confirmed that elections will take place by August 2018 as scheduled, but he did not address critical issues, notably the security sector, media, and electoral reforms necessary to ensure credible, free, and fair elections. There has been no indication that the Mnangagwa administration intends to ensure the independence and enhance the professionalism of the Zimbabwe Electoral Commission (ZEC).
As reports of abuses by the military since the takeover began to emerge, the excitement and euphoria that many Zimbabweans greeted the end of Mugabe’s rule quickly fizzled out to be replaced by uneasiness and uncertainty. Allegations are rife that between November 14 and 24, the army arrested and detained a number of Mugabe’s associates without providing information about the arrests, or places and conditions of detention. Since the military takeover, soldiers have not returned to the barracks, but instead are now involved in policing the streets. This is the same military that has been credibly implicated in rights violations against the general population during the Mugabe years. Mugabe openly encouraged partisanship of the military as a tool for maintaining his grip on power. The new president, Mnangagwa, assumed office with military backing, and appointed two army generals to cabinet, Air Marshal Perence Shiri, and Maj. Gen. Sibusiso Moyo.  This raised concerns about Mnangagwa’s independence from the armed forces, suggests further entrenchment of the military in civilian affairs.
<h3>Legalization of Military Involvement in National Politics</h3>
On November 24, High Court Judge George Chiweshe ruled that the military intervention that led to Mugabe’s ouster was lawful under Zimbabwe’s constitution. Whatever the merits of the ruling, the judgment could embolden the military to carry out further incursions in Zimbabwe’s political or electoral affairs in the future. The highly partisan stance of Zimbabwe’s military leadership, particularly without meaningful security sector reforms, significantly reduce the chances that free, fair and credible elections can be held.
The military has a long history of partisanship with the ruling party, ZANU-PF, interfering in the nation’s political and electoral affairs in ways that adversely affected the ability of citizens to vote freely. The partisanship of the security forces’ leadership has translated into abuses by these forces against civil society activists, journalists, and members and supporters of the opposition political party, the Movement for Democratic Change (MDC).
There is an urgent need, ahead of the elections, for Zimbabwe’s Constitutional Court to review Judge Chiweshe’s ruling, and ensure that members of the security forces observe strict political neutrality. Failure to ensure a professional, independent and non-partisan role for the security forces may make it difficult to deliver the elections needed to put Zimbabwe on a democratic and rights-respecting track.
<h3>Zimbabwe’s Re-engagement with the International Community</h3>
Following the military takeover, the leadership of the Southern African Development Community (SADC) called on all stakeholders in Zimbabwe to peacefully resolve the nation’s political challenges. SADC leaders also welcomed Mugabe’s decision to resign, pledging to support the 2018 elections.
While the African Union initially condemned the military takeover, the regional body later welcomed Mugabe’s resignation. The AU said it recognized that the Zimbabwean people have expressed their will that there should be a peaceful transfer of power and Mugabe’s decision to resign paved the way for a transition process, owned and led by the people of Zimbabwe.
The AU and SADC have yet, however, to address the need for the new administration to design a roadmap for democratic elections and the political neutrality and non-interference of the security forces in civilian and electoral affairs of the country.
In early December, the European Union ambassador to Zimbabwe, Phillipe van Damme, said the EU will not provide significant new funding to Zimbabwe until the country holds free, fair, and credible elections.
Human Rights Watch is of the view that full re-engagement with the Zimbabwean government should be based on a firm commitment from the interim administration in Harare that they will institute measures that will ensure tangible and long overdue democratic and electoral reforms. A key benchmark for increased US government engagement should be an independent assessment of the environment in which the 2018 elections are conducted and the transfer of power to an elected civilian government. It is important now that the military leadership publicly announce its commitment to credible, free and fair elections and that it respects the outcome of the elections.
<h3>Accountability and Justice for Past Abuses</h3>
Mnangagwa’s government should be encouraged through public statements to demonstrate commitment to accountability, justice for human rights abuses, and respect for the rule of law in Zimbabwe. We believe that Mnangagwa’s recent calls to “let bygones be bygones” should not extend to serious human rights violations since 1980, many of which implicate the military. The first post-independence overt military involvement in Zimbabwe’s political affairs was during the period from 1982 to 1987 when the government deployed a section of the army, the Fifth Brigade, ostensibly to quell a military mutiny in the Midlands and Matabeleland provinces. The Fifth Brigade carried out widespread abuses including torture and unlawful killing of an estimated 20,000 people. In 1988 the government granted amnesty to all those involved in human rights violations committed between 1982 and 1987.
The military has also interfered in the nation’s political and electoral affairs in ways that adversely affected the ability of Zimbabwean citizens to vote freely, particularly during the 2008 elections when the army engaged in numerous systematic abuses including political violence, torture, and arson targeting political opponents. That violence resulted in the killing of more than 200 people, the beating and torture of 5,000 more, and the displacement of about 36,000 people. ZANU-PF-affiliated military leaders who were implicated in the violence and abuses were never held to account. The military’s historical record should not go unnoticed as Zimbabwe prepares for another election.
In October 2008, soldiers killed more than 200 people and committed other serious human rights abuses in Chiadzwa, a village in Marange district, eastern Zimbabwe, and violently seized control of the district’s diamond fields. Human Rights Watch investigations showed that between 2008 and 2014 the government rotated army brigades into Marange to ensure that different brigades had an opportunity to benefit from the diamond trade. Soldiers harassed and threatened miners and other civilians into forming syndicates so that the soldiers could control diamond mining and trade in Marange.
<h3>Independence of the Zimbabwe Electoral Commission</h3>
Currently, the Zimbabwe Electoral Commission’s secretariat – which is charged with overseeing the 2018 election process – is dominated by partisan state intelligence and military officials. Electoral reforms should start with making the Zimbabwe Electoral Commission independent and professional. The commission is compiling a new voters’ register. Unlike countries like Botswana or Mozambique that guarantee the diaspora vote, there is no provision for Zimbabwean citizens in the diaspora to vote from outside the country, unless in diplomatic missions. In early December, the chairperson of the Zimbabwe Electoral Commission, Justice Rita Makarau, resigned from her post without stating reasons. Mnangagwa will replace Makarau with a former judge or a person qualified to be a judge. A key part of Zimbabwe’s election credibility rests on ensuring that the chairperson is replaced by someone known to be independent, impartial, non-partisan and with the capacity to deliver a democratic election. If Makarau is replaced by a person aligned to the military, and lacking in independence and professionalism, a credible election will not be possible.
<h3>Restrictions on Rights to Freedom of Expression, Association, and Assembly</h3>
The Mnangagwa government should also take steps to amend or repeal repressive laws such as the Access to Information and Protection of Privacy Act (AIPPA), the Public Order and Security Act (POSA), and the Criminal Law (Codification and Reform) Act. These laws were used under Mugabe to severely curtail basic rights through vague defamation clauses and draconian penalties. Partisan policing and prosecution has worsened the impact of the repressive provisions in the AIPPA and POSA laws. Failure to repeal or significantly revise these laws and to develop mechanisms to address the partisan conduct of the police leaves little chance of the full enjoyment of rights to freedom of association and peaceful assembly prior to and during the coming elections.
<h2>II. Key Recommendations to the US Government</h2>
Historically, the US government has shown a strong interest in promoting respect for the rule of law, good governance and human rights in Africa. The Trump administration has yet to demonstrate leadership on human rights issues in Africa so it is more important than ever that Congress promotes human rights as a core pillar of US foreign policy. To that end, Congress should support the people of Zimbabwe by calling on the Mnangagwa government to set and implement a clear roadmap for democratic elections.
Specifically, Human Rights Watch urges Congress to:
<ol>
<li>Maintain existing US policy toward Zimbabwe until the military removes itself from politics and the 2018 elections are legitimately assessed to be peaceful, transparent, free and fair and that power is smoothly transmitted to the newly elected government.</li>
<li>Press, through public statements and support to nongovernmental organizations in Zimbabwe, for accountability and justice for past serious abuses and respect for the rule of law.</li>
<li>Urge the Trump administration to make Zimbabwe’s transition a priority in the region and to work closely with SADC to press Zimbabwe’s political leadership to:
<ul>
<li>ensure the political neutrality of the security forces;</li>
<li>impartially investigate and appropriately prosecute alleged abuses by military personnel;</li>
<li>provide for the timely and sufficient deployment of domestic and SADC-led international election observers to Zimbabwe to promote credible, free and fair elections, and maintain such monitors for a suitable period after the elections to deter violence and intimidation; and</li>
<li>ensure the repeal or amendment of repressive sections of the Criminal Law (Codification and Reform) Act, the Public Order and Security Act, and the Access to Information and Protection of Privacy Act.</li>
</ul>
</li>
<li>Provide direct financial and technical support to the government that comes to power through credible, free and fair elections that is committed to strengthening democratic state institutions and promoting the rule of law, good governance, and human rights.</li>
</ol>
