Harare lawyer Lovemore Madhuku told NewZimbabwe.com that former first lady Grace Mugabe was unlikely to receive a fair trial in South Africa for assault and grievous bodily harm charges.
Grace allegedly used an electrical cord to attack a South African model, Gabriella Engels who was friends with her two sons. South African courts this week issued a warrant of arrest for Grace to come and stand trial. Madhuku said Grace’s trial ceases to be a normal trial. Said Madhuku:
<blockquote>It ceases to be a normal trial. Because of that, the (Zimbabwean) government will likely look into issues such as hiring legal representation in SA. Certain legal guarantees should be made by the two governments before anything is done. We all make mistakes but, Grace and husband (Robert Mugabe) must be allowed to get out of public life. The crime was allegedly committed when she was a First Lady and no ordinary person should have behaved in the manner she did.</blockquote>
Madhuku said the Emmerson Mnangagwa’s government, has an obligation to protect Grace and any other citizen if they commit crimes in other countries. Said Madhuku:
<blockquote>Definitely not; not just because she is Grace. Any country has an obligation to protect its citizens even if they commit crimes in other countries. Under international law, countries are allowed to refuse with their citizens.</blockquote>
Zimbabwe’s deputy information minister Energy Mutodi has ruled out chances of Zimbabwean authorities handing over Grace to their neighbours.

Grace Mugabe Unlikely To Receive Fair Trial In SA For Assaulting Model Gabriella Engels- Madhuku

On Wednesday, it was revealed that a South African court issued an arrest warrant for Zimbabwe’s former First Lady Grace Mugabe. Mrs Mugabe is a wanted person for allegedly assaulting and injuring a South African model, Gabriella Engels, with an electrical extension cord.
On a visit to South Africa sometime last year, Mrs Mugabe encountered Engels in a hotel room in the company of her two sons, Robert Mugabe Jr and Bellarmine Chatunga. Grace reportedly flew into a rage and attacked the model.
The South Africa Police Service has already sought the assistance of Interpol for the arrest and extradition of Mrs Mugabe to South Africa to face trial. However, Zimbabwe’s Deputy Minister of Information and Publicity, Energy Mutodi considers such a move detestable to Harare. He said
<blockquote>An attack on Grace Mugabe is an attack on the former President. President (Robert) Mugabe is our founding father and liberation icon and his misery is undesirable to us.
We will not smile on any attempt to embarrass, ill-treat or diminish the image of former President Robert Mugabe or his immediate family members.</blockquote>
It remains to be seen if Mrs Mugabe will indeed be arrested and extradited to South Africa or whether the Zimbabwe government will reject such a move and sour relations with South Africa.

SA, Zim On Collision Course Over Grace Mugabe Arrest Warrant

Former President Robert Mugabe’s son Robert Junior is facing a criminal case in South Africa after a case of intimidation was opened against him this week.
The case was opened by Gabriella Engels on Thursday. She is the same woman who was allegedly assaulted by Grace Mugabe with an electric extension cord in a Sandton hotel in August last year.

Robert Mugabe Junior Faces Criminal Case In South Africa For Intimidating Model Gabriella Engels

According to Dr Llewellyn Curlewis, senior lecturer in criminal and procedural law at the University of Pretoria, told News24 that Zimbabwe’s former First Lady Grace Mugabe faces arrest if she enters South Africa.
Curlewis said summons can be issued for Mugabe to appear in court and if she refuses she could either be extradited or arrested as soon as she enters South Africa. This comes after the <a href="https://news.pindula.co.zw/2018/07/30/south-african-court-revokes-grace-mugabes-immunity-for-assaulting-model/">South Gauteng High Court in Johannesburg, South Africa has overturned the decision to grant diplomatic immunity to former first lady Grace Mugabe</a>. Said Curlewis:
<blockquote>This can be done by either the National Prosecuting Authority (NPA) or, should the NPA for whatever reason decide not to prosecute, by the alleged victim (Engels) or her representative. Either way, a summons will be issued for Mugabe to appear in court to face charges. If she refuses, she could either be extradited or arrested as soon as she enters South Africa. There is no obligation on any country to extradite a citizen to another country, it’s a diplomatic and political issue. But she will be arrested should she come to South Africa, once she has been summonsed to appear in court and refused.</blockquote>

Grace Mugabe Faces Arrest If She Enters South Africa: Legal Experts

The South Gauteng High Court in Johannesburg, South Africa has overturned the decision to grant diplomatic immunity to former first lady Grace Mugabe. Judge Bashier Vally ruled that the decision to grant Grace diplomatic immunity was inconsistent with the South African Constitution, and must be set aside.
Grace was granted diplomatic immunity by South Africa’s former Minister of the Department of International Relations and Cooperation (Dirco) Maite Nkoana-Mashabane following her alleged assault of South African model Gabriella Engels in Johannesburg last year. Aggrieved with the decision, the Democratic Alliance (DA) and lobby group AfriForum approached the courts and filed an application to have the decision to grant Mugabe amnesty reviewed and set aside.
The decision means that Grace now faces the risk of being extradited to South Africa to face trial.  The minister was slapped with the costs of the suit.

South African Court Revokes Grace Mugabe's Immunity For Assaulting Model

Willie Spies, the lawyer for Gabriella Engels, has said that former first lady Grace Mugabe will not be arrested if she enters South Africa despite the fall of former president Robert Mugabe. Spies conceded that Grace still has diplomatic immunity for assaulting Engels with an electrical cable last year at a South African hotel.
Speaking to the daily publication, NewsDay, Spies said:
<blockquote>The fact remains that the prosecuting authority in South Africa does nothing [in bringing Grace to justice] while the immunity granted to the former First Lady, still stands.</blockquote>
However, Spies added that a South African court will hear a motion to set aside Grace’s immunity between 10 and 11 May.
Engels’s mother Debbie added:
<blockquote>We are aware that she is no longer a person of power, that her husband was ousted from office and that the government of Zimbabwe said she does not enjoy any immunity anymore.
In light of the latest developments, our lawyers are working on that case to secure justice for my child.</blockquote>

Grace Will Not Be Arrested When She Goes To SA, She Still Has Diplomatic Immunity For Assaulting Model Says Lawyer

Deputy Minister for International Relations and Co-operation (Dirco) Luwellyn Landers said that Grace Mugabe’s assault case will not be dropped if she is granted political asylum in South Africa. Grace stands accused of assaulting South African model Gabriella Engels with an electric cable in a Johannesburg hotel suite in August. 
Landers said that South Africa’s courts are independent and that granting Robert Mugabe and Grace asylum would not have a bearing on any pending case. AfriForum is pursuing a private prosecution against Grace, who left South Africa under controversial circumstances after being granted diplomatic immunity by Dirco. Briefing the international relations portfolio committee, Landers indicated that there was no request for asylum by the Mugabes.

Grace Mugabe will face justice for assaulting Gabriella Engels if she applies for asylum in SA

In her disposition Zimbabwe’s first lady Grace Mugabe has dismissed South African model Gabriella Engels’ version and said that she was attacked when she went to help her sons.
Part of the statement by Grace reads:
<blockquote>Notwithstanding her right to diplomatic immunity, it is submitted that on Sunday 13 August 2017 her sons were in trouble with a drunken young woman. She was worried about them and went to see them at their hotel suite.    Upon her arrival Ms Engels, who was intoxicated, and unhinged, attacked Dr Grace Mugabe with a knife after she was asked to leave the hotel room. Security was left with no other option but to remove Ms Engels from the hotel suite.</blockquote>
The statement alleges that Engels’ injuries were sustained when she had a fight with a woman at Taboo nightclub the previous night. The statement reads:
<blockquote>It has come to the Consulates attention that Ms Engels had been in a fight with other women at Taboo nightclub on Saturday the previous night (12 AUGUST 2017) before she went to the hotel where Dr Grace Mugabe’s children were. It is unclear whether some or all her injuries, posted on social media,were a result of a fight at Taboo nightclub, or when she was removed from the hotel because of her drunken behavior.</blockquote>
She also threatened to sue Engels for attempted murder and said:
<blockquote>Dr Grace Mugabe denies the malicious allegations made against her by Ms Engels,and her friends,who were intoxicated at the Dr Grace Mugabe reserves the right to press charges of attempted murder against Ms Engels.</blockquote>
The Consulate wants the allegations against Grace Mugabe to be dismissed. However, speaking to EWN, AfriForum, an Afrikaans civil society group acting on behalf of Engels, denied both accusations and said:
<blockquote>Gabriella never attacked Grace Mugabe in any way and she did not participate in the fight at Taboo. It is clear that Grace Mugabe is desperately trying to escape responsibility for her own violent behaviour by using lies to falsely portray the victim in this case as the perpetrator.</blockquote>

'An intoxicated Gabriella Engels attacked me with knife': Grace Mugabe

Speaking to The Standard’s chief reporter Everson Mushava (EM), Tourism Minister Walter MZembi (WM) said that Zodwa Wabantu and Gabriella Engels are being used to sour relations between the South African and Zimbabwean governments.
Below is an excerpt of an interview:
<blockquote>EM: What implications does the ban on Zodwa have on tourism and our relations with South Africa? How come the government has no problem with samba dancers from Brazil, Cuba and locals like Beverley, Zoey etc?
WM: If you follow social media and commentaries on this Zodwa issue, you will see its links to other unrelated matters, and how xenophobia and reciprocation issues are invoked by haters of sound relations between Zimbabwe and South Africa.
The two liberation movements, ANC and Zanu PF need an intelligent and analytical conversation soon around how some of these characters like Zodwa, (Gabriella) Engels etc are exploited as pawns in a bigger game of distancing the two erstwhile movements and ultimately their governments and agendas, and we have not seen the end of it.
Both liberation movements have serious elective business ahead of them, and must understand these generational affronts better and how to react to them, especially in this social media environment.
Equally, our government agencies must be alert to these machinations and not play into them, sometimes inadvertently and torching unnecessary storms.
So when we correct them, it’s because we see better, and have a helicopter view and political competencies that they may not have or see in their narrow briefs.
Equally, we have very good relations with both Brazil and Cuba and understand their cultural heritage and they are here to endorse our carnival, but you can’t tell me advertising to a nation that I am coming to dance for you without a panty is South African, we know what is authentically South African and constructive entertainment for our people.
The local girls too self-censor when performing in public, we saw them last time.</blockquote>

'Zodwa Wabantu & Gabriella Engels are pawns in a bigger game': Mzembi

Marian Chombo, the former wife of Minister of Home Affairs Ignatius Chombo and chairperson for the opposition National People’s Party (NPP) Women’s Assembly has criticised First Lady Grace Mugabe following her alleged assault of South African model Gabriella Engels. In a statement, Chombo said:
<blockquote>Being a national chairwoman for the ruling party of this behaviour is very unbecoming. August is the month the world is highlighting the plight of the women. What a time to choose to showcase such shebeen queen behaviour. Clubbing a young girl for what reason?
That is unAfrican, if I might say.
….ou threw a $10 million wedding for your daughter when the economy was on its knees. We kept quiet when you bought a $1,3 million ring yet 90% of Zimbabwe cannot afford a meal on their table. You took your grandchild for a check-up in Singapore when our mothers die in hospital giving birth.</blockquote>

Decision on Diplomatic Immunity relating to an alleged assault case in Sandton
On Wednesday 16 August 2017, the Embassy of the Republic of Zimbabwe invoked immunities of Dr Grace Mugabe in relation to the alleged case of assault widely reported in the media.
The Minister considered the communication from the Embassy in accordance with the discretion granted to her by section 7(2) of the Diplomatic Immunities and Privileges Act.
According to Section 7 (2) of the Act: “The Minister may in any particular case if it is not expedient to enter into an agreement as contemplated in subsection (1) and if the conferment of immunities and privileges is in the interest of the Republic, confer such immunities and privileges on a person or organisation as may be specified by notice in the Gazette”.
After careful consideration of all the relevant factors, including the following:
• the need to uphold the rule of law, ensure fair administration of justice and uphold the rights of the complainant;
• the imperative to maintain good inter-governmental relations within the SADC region, and in particular between the Republic of South Africa and the Republic of Zimbabwe;
• the fact that the matter coincides with South Africa’s hosting of the 37th SADC Summit of Heads of State and Government;
• legal considerations, including derivative immunity of spouses of Heads of State,
The Minister has made the determination that the conferring of diplomatic immunity is warranted in this particular instance.
The Department wishes to convey the message that the Minister has agonised over this matter and the decision was not an easy one to make.

SA government explains why Grace Mugabe was granted diplomatic immunity

A waitress at the Capital 20 West is reported to suffer a miscarriage after she was pushed by a fleeing Robert Mugabe Jr as he escaped from his mother’s wrath last Sunday. The attack happened at a Sandton Hotel and resulted in the assault on model Gabriella Engels, who alleged that she had been attacked with an extension cord.
A hotel employee said:
<blockquote>She was not hit by Grace. It was Robert jnr who pushed her out of the way as he ran away from his mother.
Grace did hit staff members … She was hitting everyone – her sons, their friends, the girls and staff members.</blockquote>
Garnet Basson, chief operating officer at The Capital Hotel Group refused to confirm the incident saying:
<blockquote>We are handling this thing internally. Please respect that. We will decide on how to deal with this matter going forward.
It’s the staff member’s privacy that we must respect. I can assure you that we are doing everything in all aspects to ensure that we follow the necessary steps.</blockquote>
Engels pressed assault charges against Grace, but the South African government granted diplomatic immunity to the First Lady, who has since left the country.

Hotel waitress reported to have suffered miscarriage after by pushed by Robert Jr while escaping Grace's anger

State radio, ZBC Radio has reported that President Robert Mugabe and First Lady Grace Mugabe arrived from South Africa in the early hours of Sunday morning.
This seems to conclude a week of frenzied speculation on whether Grace Mugabe was going to answer for her alleged assault of South African model Gabriella Engels using an extension cord at a Sandton hotel, on the previous Sunday.  At one point South African Minister of Police Fikile Mbalula said there was a red alert at all of South Africa’s borders to prevent Grace from leaving until the matter was resolved. However, later reports indicated that the South African government was going to grant Grace Mugabe diplomatic immunity for her alleged assault.

Grace Mugabe hit the hell out of me, Gabriella Engels tells BBC

The opposition MDC-T has warned that First Lady Grace Mugabe’s alleged assault of South African model Gabriella Engels(20) may result in South Africans retaliating by attacking Zimbabweans in the diaspora. MDC-T spokesperson, Obert Gutu said:
<blockquote>Grace Mugabe is a disgraceful woman. Zimbabweans living in the Diaspora in South Africa will be targeted for victimization largely because of her behaviour. It’s a very unfortunate incident.
Grace should be held personally to blame if and when Zimbabweans in South Africa are harassed as a result of her thuggish and uncouth behaviour .This crude behaviour is totally unbecoming of a First Lady.
Grace Mugabe is a very violent and intolerant character. Grace Mugabe has exhibited her violent nature to the whole world and is also on record stating that opposition supporters should be beaten up. We call upon SADC and other progressive forces to stop such madness ahead of the general actions next year.</blockquote>
