President Robert Mugabe praised the late retired Chief Justice Godfrey Chidyausiku for his role is defending the country’s land reform programme. Speaking at Chidyausiku’s burial at the National Heroes Acre yesterday, the President praised Chidyausiku for applying his sharp mind to overturning the judgements of the previous courts and protecting the programme from people who wanted to challenge the program through the legal system.

As chief justice, the late Godfrey Chidyausiku will be remembered for the most important role he played in defending and shaping the course of our land reform programme.
He applied his sharp legal mind to overturn the Justice Gubbay judgements
He was defending us on the land reform programme because there were whites who wanted to spoil it by going to the courts, even to those in Britain. If you have judges who understand your circumstances and who are sons of the soil too; who fear that if the land is taken they too will be left poor, they will defend the country well</blockquote>

Mugabe says retired CJ Chidyausiku shaped and defended the land reform from "whites" who wanted to go to court

The Roman Catholic Church will on Friday hold a mass for Retired Chief Justice Godfrey Chidyausiku at Chishawasha Mission ahead of his burial at the National Heroes Acre on Saturday.
Speaking after a church service held yesterday evening at the Chidyausiku family home in Highlands, the Master of Ceremonies and Chaplain General of the Zimbabwe Defence Forces, Colonel Joseph Nyakudya said the body will leave Harare at 10 am heading to Chishawasha for the mass.
Colonel Nyakudya said the mass will start at 11 am at the mission grounds to accommodate the masses. Chidyausiku’s body will be ferried back to Harare where it will lie in state at the family’s Highlands home. On Saturday morning, the body will be taken to Stodart Hall in Mbare for body viewing, before proceeding to the National Heroes Acre for burial.

Roman Catholic Church to hold mass for Chidyausiku

Online publication New Zimbabwe is alleging that the family of the late Retired Chief Justice Godfrey Chidyausiku is supecting foul play in his death. Some family members reportedly believe that Chidyausiku, who died earlier this week in South Africa, was poisoned at his retirement party. After that night, he never fully recovered and had to be admitted to the Avenues clinic before being airlifted to South Africa. The party was boycotted by all Ministers except former Minister of Justice, Patrick Chinamasa.
One of the relatives who spoke to New Zimbabwe said:
<blockquote>It is true that we suspect that he was poisoned on the day of his farewell party. That is what all the relatives are saying; if you go to the funeral wake, you will hear it for yourself,</blockquote>
Chidyausiku had been involved in a nasty public fight with the Minister of Justice, Vice President Emmerson Mnangagwa over the appointment of his successor.  The Minister wanted to wait until the constitution was amended, for the successor to be chosen, while the Retired Chief Justice stuck to his guns and advocated for following the procedure laid out in the Constitution.  The fight went all the way to the Supreme Court, where Chidyausiku was vindicated.  However, the other side appealed to the Constitutional Court, but the matter became academic after President Mugabe appointed Luke Malaba as the new Chief Justice, using the procedure advocated for by Chidyausiku.

Foul play suspected in Chidyausiku's death amid  allegations that he was poisoned

Chief Justice Chidyausiku’s 16 year tenure as head of the judiciary has come to an end this Tuesday (today) the 28th of February 2017.
Chidyausiku has reached the 70 year mandatory retirement age limit for judges and vacates the post of head of judiciary. He is a former politician who acted in opposition to the Smith regime in 1974. After independence in 1980 he was appointed Deputy Minister of Local Government and Housing and of Justice before being promoted Attorney General in 1982. He was appointed to the bench where upon he was appointed to head the Constitutional Convention in 1999 before his subsequent appointment to the post of Chief Justice in 2001 upon the resignation of Chief Justice Antony Gubbay.
Meanwhile Deputy Chief Justice Luke Malaba is expected to takeover on an acting capacity until President Robert Mugabe appoints a new Chief Justice.

Chief Justice Godfrey Chidyausiku retires

Legal experts, Veritas have tipped <a href="http://www.pindula.co.zw/Rita_Makarau">Rita Makarau</a> to become Zimbabwe’s first female Chief Justice. Only 4 candidates are left and the other candidates in the race are Deputy Chief Justice, Luke Malaba, Supreme Court Judge, Paddington Garwe and Judge President, George Chiweshe.
Veritas notes that all the three men in the race have been career judicial officers, unlike Makarau, who also has private practice experience. The four will appear at public interviews to be held in the capital on December 12. Meanwhile, Veritas has noted with concern that there are two vacancies on the Judicial Services Commission that have not been filled.

Legal experts tip Makarau to become Zimbabwe's first female Chief Justice

Twenty nine aspiring High Court judges have proved that they cannot write a judgment, an elementary skill that every judge must possess. For fear of more embarrassment, four of the candidates walked out of the waiting room with tails between their legs.
The panel, that was made up of 10 commissioners from the Judicial Service Commission, had to adjourn early after dealing with the remaining six candidates. Out of 43 candidates who on Friday sat for a two-hour exercise to test the candidates’ ability to write judgments ahead of the public interviews for the selection of eight High Court judges, only 14 passed.
In his remarks at the beginning of the public interviews yesterday, Chief Justice <a href="http://www.pindula.co.zw/Godfrey_Chidyausiku">Godfrey Chidyausiku</a> said,
<blockquote>I am somewhat disappointed to report that out of the 43 candidates who turned up for the exercise, only 14 obtained a passing mark of five and above out of the total mark of 10. The Judicial Service Commission regards the writing of judgments as the competence of any judge. It is like the possession of a driver’s licence for all driver.</blockquote>
