Former Harare mayor <a href="https://www.pindula.co.zw/Herbert_Gomba">Herbert Gomba</a> allegedly abandoned a former employee at his mine in Kadoma after he suffered a serious leg injury at work.
27-year-old Tatenda Chimunyu told Pindula News that he started working at Gomba’s Mine, Davina South Gold Mine, on 21 December 2018.
Chimunyu fell into a mine shaft on 18 May 2019, according to a Police document, and broke his leg.
He said he spent some time in the hospital and surgeons inserted a rod into his broken leg.
Herbert Gomba reportedly provided some money to cover medical expenses for Chimunyu.
He said his parents and some relatives also chipped in with some cash but it was not enough as he could not go to the hospital for review.
Chimunyu said Gomba promised to give him money for his upkeep, a pledge he reportedly did not fulfill.
In one of the alleged WhatsApp chats between Chimunyu and Gomba, the former Harare mayor wrote:

Don’t worry my young brother, I will compensate you for the injury you suffered. I know you experienced long-term injuries and won’t be able to work again. Don’t worry, I will give you your money and will not abandon you because I know that you were injured at work. I’m grateful that even your relatives did not cause me any problems. I’m also pained by your condition, don’t be angry with me. It’s your brother Herbert Gomba. When was the last time that Frank gave you money for hospital expenses?

However, Gomba, who is a member of the Citizens Coalition for Change (CCC) and Harare City Council Ward 27 (Glen Norah) Councillor, denied the allegations when contacted by Pindula News.
Gomba said Chimunyu was never employed by Davina South Mine and challenged the latter to provide documents to prove that he was indeed employed by the company.
He said Chimunyu was among a team of “makorokoza” or artisanal miners who worked at his mine, but not as his employees.
Gomba said there was an arrangement whereby the team of artisanal miners would get a share of the proceeds from the gold produced by the mine.
He admitted that Chimunyu was injured while working at his mine, saying he helped with medication and bills and some money as an act of benevolence since he was not his employee.
Gomba said the WhatsApp chats do not prove that Chimunyu was his employee and demanded that he provides an employment contract. In another alleged WhatsApp chat, Gomba wrote:

Gomba insisted that if Chimunyu was his employee, he should produce the contract or at least a payslip and he would instruct his manager to pay him his dues.
Gomba’s manager, Francis “Frank” Nyamuronda, also denied that Chinyumu worked for Davina South Mine.
Chimunyu said he suspects Frank was the one feeding Gomba with wrong information and has a hand in his tribulations.
<h2>Compensation for work-related injuries in Zimbabwe</h2>
The National Social Security (NSSA) has a scheme, called the Accident Prevention &amp; Workers Compensation scheme that was established in terms of Statutory Instrument 68 of 1990 for the provision of financial relief to workers and or their dependents when a worker is injured or killed in a work-related accident or suffers from a work-related disease or dies thereof.
The scheme covers all workers in the formal sector but excludes civil servants, domestic workers, and informal sector workers.
However, workers who are injured at work cannot make any claim unless they were making contributions to NSSA through their employer.

Former Harare Mayor, Herbert Gomba, Accused Of Abandoning Injured Employee

Former Harare mayor Herbert Gomba, who is the Ward 27 councillor (CCC), was arrested on Wednesday morning and released later that day without a charge.
He was arrested by the police while officiating at a borehole commissioning ceremony in Glen Norah.
Gomba said he was released with the help of the Zimbabwe Lawyers for Human Rights (ZLHR). He said:

We applied to the police to have our event with our partner China Aid which was donating four boreholes in my ward.
We made a follow-up to the police on Tuesday and they said we should continue with the event preparations and they were coming with our approval letter.
Police who were maintaining peace at the event came and started asking questions and nothing happened until police bosses called me aside, that is when I was arrested in the morning and taken to Glen Norah Police Station.

Former Harare mayor, Herbert Gomba, who is Ward 27 Councillor (CCC) has been arrested, the party’s spokesperson Fadzayi Mahere has said.
Mahere said Gomba was arrested by Southerton Police at a residents’ meeting. 
Gomba was scheduled to unveil new community boreholes as well as hear the concerns and feedback of residents. Mahere tweeted:

Gomba was arrested in March last year on allegations of perjury and transmitting a declaration form that had false information.

Former Harare Mayor, Councillor <a href="https://www.pindula.co.zw/Herbert_Gomba">Herbert Gomba</a>, has been re-elected as Harare Ward 27 councillor defeating ZANU PF’s and MDC Alliance’s candidates.
Gomba who was representing the newly-formed <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change (CCC)</a> polled 2851 votes while the ZANU PF representative attained 779.
The MDC Alliance candidate got 198.
<a href="https://news.pindula.co.zw/2020/08/20/mwonzora-recalls-harare-mayor-5-other-mdc-a-councillors/">Gomba was recalled in 2020</a> by the opposition MDC-T which claimed that he had “ceased to belong to the <a href="https://www.pindula.co.zw/MDC">Movement for Democratic Change</a> which is a member of the Movement for Democratic Alliance which was formed in terms of the constitutive agreement…”
The MDC-T, armed with a <a href="https://news.pindula.co.zw/2020/04/02/full-supreme-court-ruling-on-mdc-leadership-crisis-case/">2020 Supreme Court</a> ruling on the MDC leadership crisis case ruling that reinstated <a href="https://www.pindula.co.zw/Thokozani_Khupe">Thokozani Khupe</a> as the party’s leader, on an interim basis, has been recalling legislators and councillors aligned to Nelson Chamisa. 
Out of the 28 parliamentary seats that were up for grabs in the 26 March 2022 by-elections, 18 fell vacant by recalls by MDC-T. Meanwhile, 121 local government seats were up for grabs most of which became vacant by recalls by MDC-T. 
Gomba who is perjury and breaches after he allegedly supplied false information when registering as a voter, is currently out on bail. 
The state says the 45-year-old registered as a voter at Ruvheneko Primary School in Glen Norah in 2017 by providing an address where he was not ordinarily resident.
The state further alleges that between October and December 31, 2017, 22 more individuals submitted affidavits while registering as voters also listing the same residential address as Gomba. Nine of the registrants share a surname with Gomba.
The National Prosecuting Authority (NPA) alleges that the 22 were not residents at the stated house consisting of four rooms, including two bedrooms and a combined kitchen, dining room, and lounge.

By-Elections Update: Former Harare Mayor Herbert Gomba Re-elected

Former Harare mayor Herbert Gomba was freed on bail Thursday following his arrest on Monday accused of supplying false information when registering as a voter.
The 45-year-old was arrested on Monday and charged with perjury and breaches of the electoral law.
Harare magistrate Stanford Mambanje, after reserving judgement on Gomba’s bail application on Wednesday, set bail at Z$50 000 for the former ward 27 councillor.
On the first count, prosecutors say Gomba registered as a voter at Ruvheneko Primary School in Glen Norah in 2017 by providing an address where he was not ordinarily resident.
His lawyers say the address is his parents’ house, and insist that Gomba lived there at the time and only moved out in 2018. He moved to another house also in Glen Norah and his polling station did not change.
On the second count, the prosecution says between October and December 31, 2017, another 22 individuals submitted affidavits while registering as voters also listing the same residential address as Gomba. Nine of the registrants share a surname with Gomba.
The National Prosecuting Authority (NPA) alleges that the 22 were not residents at the stated house consisting of four rooms, including two bedrooms and a combined kitchen, dining room, and LOUNGE. The NPA charges:

The defence argues that Gomba is not responsible for individuals using an address that is not his to register as voters.
Defence lawyers say the charges are a conspiracy to disrupt Gomba’s campaign ahead of by-elections on March 26 in which Gomba will represent the Citizens Coalition for Change in ward 27. 
He won the seat in 2018 before only to lose it after being recalled by the MDC-T party.

Former Harare Mayor Herbert Gomba Granted Bail

Former Harare mayor, Herbert Gomba’s lawyers Wednesday said his arrest on perjury charges was politically motivated to deny him time to campaign for the March 26 by-elections.
Gomba, who was being represented by Harrison Nkomo and Garikai Mhishi, appeared before Harare magistrate Stanford Mambanje.
He was remanded in custody to this Thursday for a bail hearing.
The State, represented by Lancelot Mutsokoti opposed bail, saying Gomba was a flight risk as he faced other charges, falsified his address and had several people registered under his residence.
But Nkomo said Gomba was a suitable candidate for bail since he had not violated previous bail conditions.
Nkomo also argued that denying Gomba bail was political persecution to deny him an opportunity to canvass for votes ahead of the polls.
The State alleges that on an unknown date in 2017, Gomba submitted a false address during a voter registration exercise.
Twenty-two persons used the same address, with nine of them alleged to be sharing the Gomba surname. The State alleges that this was intended to manipulate the 2018 council election results in Gomba’s favour.
This is happening after reports that Gomba had been abducted by suspected state security agents. The reports proved to be fake after he was reportedly “found in the custody of his family.”

Former Harare mayor and Citizens Coalition for Change (CCC) member Herbert Gomba was arrested on Monday on accusations of perjury and contravening electoral laws.
On Saturday CCC said Gomba (45) was missing after becoming unreachable on his phone just hours after police went to his house looking for him.
Gomba handed himself to the police on Monday in the company of his lawyers and was promptly arrested.
According to ZimLive, police had planned to charge Gomba with arson over a 2020 incident in which a car belonging to Gilbert Mbwende was set on fire outside his home in Belvedere.
Mbwende is the MDC-T’s Highfield East candidate for the 26 March by-elections.
After Mbwende had indicated that he wanted to withdraw the charges, Gomba went into hiding waiting for the charges to be withdrawn.
Mbwende withdrew his complaint on Sunday, and the following day, Gomba went to Harare Central Police Station with his lawyer Harrison Nkomo confident the charges had fallen away.
However, police arrested Gomba, accusing him of violating the Electoral Act on issues related to voter registration.
Police accuse Gomba of registering as a voter using a Glen Norah address where he does not live.
Gomba is also accused of registering a further 12 voters using his parents’ address and yet some of the people do not reside at the address.
The complainant is Jephson Matewe, the ZANU PF candidate for the Ward 27 by-election who has lost to Gomba three times in a row.
In the 2018 elections, Gombo garnered 7 676 votes to Matewe’s 1 918.
CCC says the charges are meant to block Gomba from contesting for the council seat in the 26 March by-elections.

Former Harare Mayor, <a href="https://www.pindula.co.zw/Herbert_Gomba">Herbert Gomba</a>, who was reportedly <a href="https://news.pindula.co.zw/2022/03/12/former-harare-mayor-herbert-gomba-has-gone-missing/">abducted</a> from his home on Saturday by suspected State security forces has been found in police custody.
Gomba who was allegedly kidnapped from his house in Glen Norah C, Harare by unknown men, has been found in the custody of Law and Order police at Harare Central Police Station.
He is accused of burning a vehicle belonging to MDC-T member, Gilbert Mbwende, in 2020 in Belvedere, Harare.
Mbwende is contesting for the Highfield East Parliamentary seat representing MDC Alliance. By-elections are scheduled for the 26th of this month. 
The <a href="https://www.pindula.co.zw/Zimbabwe_Republic_Police">Zimbabwe Republic Police (ZRP)</a> is still looking for Denford Ngadziore and Lovejoy Chitengu who are said to be accomplices in the burning of the vehicle case.
Gomba is also facing corruption charges after he allegedly sold residential stands without following Harare City laws.
Gomba and three others, who are former council workers, are expected to come back in court on Monday the 14th of this month.

Zimbabweans have expressed concern over the alleged <a href="https://news.pindula.co.zw/2022/03/12/former-harare-mayor-herbert-gomba-has-gone-missing/">abduction</a> of former Harare Mayor <a href="https://www.pindula.co.zw/Herbert_Gomba">Herbert Gomba</a> on Saturday.
Gomba who is Citizens’ Coalition for Change (CCC) council candidate for Glen Norah is still uncounted for.
Renowned author, <a href="https://www.pindula.co.zw/Tsitsi_Dangarembga">Tsitsi Dangarembga</a>, asked Amnesty International Zimbabwe, a human rights organisation if they heard that “Mayor Gomba is missing?” Dangarembga also asked the <a href="https://www.pindula.co.zw/Zimbabwe_Republic_Police">Zimbabwe Republic Police (ZRP)</a>:

"That's How Itai Dzamara Disappeared" - Responses To Gomba Disappearance

Former Harare mayor and Citizens Coalition for Change (CCC) council candidate for Glen Norah, Herbert Gomba, has reportedly gone missing.
According to journalist Hopewell Chin’ono, a group of men went to his home looking for him and two of the man told his security team that they were from the Criminal Investigations Department. Chin’ono <a href="https://twitter.com/daddyhope/status/1502699711232458756">tweeted</a>:

'Former Harare Mayor, Herbert Gomba, Has Gone Missing'

Following MDC Alliance Councillor Jacob Mafume’s election as Harare mayor, beating the MDC-T nominee Luckson Mukunguma by 19 votes to 14, a political analyst said the MDC-T leaders should be careful of the treacherous political terrain they have chosen to walk on.
Pedzisai Ruhanya, who is also a Communications, Media and Democracy expert, said Thokozani Khupe and Douglas Mwonzora, the MDC-T president and secretary-general respectively, should be warned of the price for “selling out”. He tweeted:
<blockquote>Lawyer Jacob Mafume of MDC Alliance [Nelson Chamisa] is the new Mayor of Harare after Councillors elected him defeating [Douglas] Mwonzora, Khupe, Zanu PF candidate one Mukunguma who had defected. Dear Doug, this is a warning and price of selling out!
By the way, Mwonzora had fired 10 MDC Alliance (Chamisa Councillors) including Mayor Herbert Gomba before this election to advantage his evil agenda but lost as Councillors remain defiant. He wants to control fraudulently, without the mandate of the people.</blockquote>
On Thursday, the odds appeared heavily staked against Mafume with councillors risking recall to vote him into office.
Mafume joined the MDC Alliance under Tendai Biti’s Progressive Democratic Party (PDP) and is therefore immune from recall.
His win shows that the majority of MDC Alliance councillors have rejected Khupe and chose to remain loyal to Chamisa even though the threat of recall by Mwonzora hangs like the Sword of Damocles over them.
Recently, Mwonzora recalled several MDC Alliance councillors including the then mayor Herbert Gomba.
Mwonzora said he derived the authority to recall the councillors basing on the Supreme Court of Zimbabwe judgement in SC 56/20.

Mafume's Victory Is A Warning To MDC-T 'Sellouts' - Analyst

Harare Mayor, Cllr Gomba has revealed that the rehabilitation of one of the biggest waterworks in the capital, Morton Jaffray is already underway.
The development comes after the central government disbursed $37,4 million to the local government authority towards the project, overhaul of the water distribution network, sewer reticulation system upgrade and installation of 8 000 residential prepaid meters. Gomba said”

The Herald reports that the central government allocated $495 000 and $296 000, in that order for phase one of the project rehabilitation of the Morton Jaffray clarifiers and for filters.
Phase 1 is expected to be completed within two months whilst filters should be completed in three months.
The development comes when the capital has had water challenges for years which resulted in the outbreak of cholera and other waterborne diseases.

<blockquote>*Guidance on Buying Urban Land*
When buying stands the first thing is that you must ask for the relevant papers from the seller.
These should then be verified with relevant authorities which may be Council, Registrar of Deeds, Surveyor General or Urban Stateland Office
Ask for the following documents and information (The Proof): 
1. For Private land Proof of ownership in the form of a Title Deed 
1. For Government or Council land Valid Offer/Allocation letter and Agreement of sale between Government or Council and the Seller (in their name).
2. On private land Approved Subdivision permit- issued by the relevant authority.
2. On State or Council land approved layout plans have been approved. 
3. Approved Survey Diagrams from the Surveyor General whether on Private, Government or Council land.
4.Approved Engineering Designs for water, sewer and roads which would have been approved by Council Engineering Department.
5. Approved infrastructure successfully implemented and approved on the site in the form of water, sewer and roads signed for by Council.
6.Certificate of Compliance- issued by council certifying that 1- 5 above has been done to the Council’s satisfaction.
The title deed of the property gives the legal name of the property which can be verified from the Registrar of Deeds after paying a very small fee, including the person who owns the property or stand. The offer letter can be verified with the Ministry of Local Government, Public Works &amp; National Housing, through the Department of Stateland or Department of Physical Planning or relevant Local Authority.
If someone holds an offer letter from Ministry of Lands, be suspicious because he/she needs to get a change of use permit from say agriculture to residential/housing, then layout has to be approved by Department of Physical Planning. Besides in Zimbabwe, State Agricultural land is not supposed to be sold by individuals.
NB. In Zimbabwe only two Local Authorities are allowed to give subdivision permits (at this point in time) without passing through the Ministry of Local Government, Public Works and National Housing, that is Harare and Bulawayo City Councils.
If he/she fails to produce these when you request them, put a big question mark. It is most likely that their project or development is not compliant and you might be duped. Even if he/she tries to persuade you that they will be done with all the paperwork soon, just walk away.
Many people have been told that before and there are areas which still have no compliance as far back as 1998.
Because the Council will not approve your plans to build for you to build if the listed papers are not in place and you will also not get title to the stand you would have bought.
We all know that investment in Real Estate (Buildings) is one of the best investments one can ever make in life. But if you are not careful you will be duped. So be observant and analytical. Do not be given a contact person by the developers for enquiries. Visit and call the government and local authorities offices. Visit their websites. Most councils are now online, even Deeds Office has an online portal for enquiries about deeds. However, you have to know the name of the property as it is on the title deed.
The Government or Council offices can only be able to help you if you produce papers, so you need to ask for the above-listed papers from the seller which you then take to the relevant offices for verification.
If you ask for these papers and the seller turns hostile and threatens to sell it to someone else it tells you they do not have the papers and you were about to be duped, so walk away happily with your money. If you want social justice, report to the responsible authority about this experience with the seller.
Those who are genuine sellers would not deny you your right to verify the stand before you part with your hard-earned cash.
In fact, they should be happy to assist you to verify whatever you need before you pay.
Please do not let them rush you to pay property is a lifetime investment.
Take your time to visit the site first and see if you like the stand and the neighbourhood, verify the papers and then enter into an agreement with the assistance of lawyers</blockquote>

FULL TEXT: Harare City Council Differentiates Between Genuine & Bogus Land Sellers

Harare City Council (HCC) Mayor, Hebert Gomba has said that the local government authority is planning to install prepaid water meters as a debt recovery measure.
Speaking to New Zimbabwe, Gomba said that their prepaid water system will operate like the ZESA prepaid metre system which automatically deducts a predetermined percentage when customers recharge their accounts. He added:
<blockquote>If you look into these deals we want to get into, they involve prepaid water meters. So we have to find a way to install prepaid meters which will enable us to collect the debt from that. We are looking at maybe 10% of every transaction, we will have to look and consider things closely given the amounts people can be able to pay. The debt will be spread over a period.</blockquote>
The HCC has over a long period of time planning to install prepaid water meters but had to delay after residents and their representatives constantly shot the idea down.
They argued that the metres would deprive residents of their right to water as enshrined in Section 77 of the Constitution. Residents argued that the system disconnects water for those who would not have paid which will likely cause an outbreak of many diseases.

Harare To Install Prepaid Water Meters

Harare mayor, Herbert Gomba, has raised the red flag over possible siltation of Lake Chivero by gold mining activities at Kintyre Estate which is located within the catchment area of the city’s main water body.
Speaking during NewZimbabwe.com’s programme, The Agenda, Gomba revealed that he had engaged Harare Minister for Provincial Affairs, Oliver Chidawu. Said Gomba:
<blockquote>We have had people going to the Kintyre Estate from the mountain that is a supporting wall to Lake Chivero.
People have started mining gold and they are disposing heavy chemicals such as mercury into Lake Chivero.
We just have to stop them so we had discussions with Minister of State for provincial affairs, Oliver Chidawu for assistance so that the central government can deploy officers to remove the people.</blockquote>
Gomba said that Harare’s water supply is also being threatened by urban farmers and manufacturing companies who are disposing of chemicals into the water.

His Worship the Mayor of Harare Cllr Herbert Gomba officially opened Kuwadzana library today (Thursday). The project was started many years ago but due to lack of finances, it had stalled.

Harare Mayor Herbert Gomba told the Daily News that council is considering selling selected residential and commercial stands in foreign currency.
Gomba said they have revised their pricing with the cheapest going for $15 per square metre. He said the matter is still not finalised from a legal point of view. Said Gomba:
<blockquote>We have revised the pricing of most of our stands with the cheapest going for $15 per square metre. We had noticed that people were buying the stands from as little as 50 cents a square metre and reselling them for the equivalent in United States dollars and that was disenfranchising council. The matter is not yet finalised as we have to look into it even from a legal stand-point. The money raised will not be for salaries but will be channelled towards service delivery. All our endeavours are to ensure that residents get value for their money.</blockquote>

Harare City Council Considers Selling Stands In US Dollars

Harare Mayor Herbert Gomba is scheduled to open Kuwadzana library this Wednesday.
The library which has been under construction for more than two decades has finally been completed. In an interview with HMetro in November last year, Harare City Council spokesperson Michael Chideme said the library will have internet connectivity and will be open to everyone. Chideme said the library has a children section, so that children in primary school can actually enjoy using the library. He also confirmed that there was another library being constructed in Glen Norah.

Kuwadzana Library To Be Officially Opened After Two Decades

Harare City mayor Herbert Gomba said that the erratic water supply being experienced in the city is a result of a shortage of two key water treatment chemicals, that is sulphuric acid and aluminium sulphate.
He said that efforts are being made to acquire the chemicals. He, however, said that the major challenge is to source the foreign currency to import the chemicals from China and South Africa.
The other challenge militating against water delivery is the water cuts experienced at Morton Jeffrey, the City’s water treatment plant. Watch the Press Conference below:

The Harare City Council has launched an operation to rid the central business district of pirate taxi operators, colloquially referred to as mshika-shika. This follows the City’s successful removal of vendors in the CBD. Harare Mayor Herbert Gomba told the Daily News,

We are geared to cleaning up the city once and for all. At times we have seen that the police and our staff are not doing enough to reign in illegal pirate taxis. We sometimes see municipal police parked opposite illegal pirate taxis with no action being taken. This will no longer be tolerated.</blockquote>

Speaking to The Herald, Harare Mayor Herbert Gomba said he will ask the Mayor’s Cheer Fund board to look at paying fees for children of cholera victims.
The Cholera outbreak has claimed 21 people so far. Said Gomba:
<blockquote>Today I have directed that council stops all water disconnections in view of the cholera outbreak, I also will ask our Mayor’s Cheer Fund board to look at paying fees for children of cholera victims. To all citizens, we are on the wheels dealing with this outbreak, be assured our workers are working overtime, under constant supervision and with the required instructions and instruments. To ratepayers and  leaseholders, please continue to pay your bills so that we transform this city.</blockquote>
