Zambia has rejected allegations made by the United Nations Special Rapporteurs of the Human Rights Council regarding the state of human rights in the country.
On Thursday, August 29, UN independent experts expressed concern over numerous reports of arbitrary arrests and detentions involving leaders and members of opposition parties, parliamentarians, human rights defenders, and activists.
The experts claimed that those arrested faced charges including unlawful assembly, espionage, hate speech, and seditious practices, urging the Zambian government to immediately stop infringing on the fundamental rights of its citizens.
In a statement released on Friday, August 30, Zambia’s Minister of Information and Media, Cornelius Mweetwa, dismissed the allegations, stating that the UNHRC Special Rapporteurs’ report contains “inaccuracies and misrepresentations.” Reads the statement:

The Government of the Republic of Zambia takes note of the statement issued by the United Nations Special Rapporteurs of the Human Rights Council, expressing concerns about the alleged infringements on fundamental freedoms in Zambia.
While we appreciate the role of the UNHRC in monitoring and upholding human rights globally, we must express our deep concern and disappointment regarding the inaccuracies and misrepresentations contained in the report.
First and foremost, the assertion that members of the clergy have been arrested under this administration is not only misleading but also alarming, especially coming from a body such as the UNHRC, because it is completely false.
The Government of Zambia under UPND, has no record of any such arrests, and we are perplexed as to the source of this erroneous information. Zambia has always upheld the freedom of religion and expression, and any claims to the contrary are baseless.
Furthermore, the report’s claim that State Actors have instrumentalised legal provisions to suppress the legitimate exercise of freedom of expression is equally unfounded.
The Zambia Police Service, under the current administration, has been mandated to safeguard the peace and security of the country.
However, we have also been very clear in condemning any excesses by law enforcement officers. The government is committed to ensuring that the rule of law is upheld, and any actions by the police are conducted within the bounds of legality and respect for human rights.
It is also important to address the report’s suggestion that there is no democratic space left for the opposition in Zambia.
The UPND Government has made significant strides in upholding and protecting the democratic values of our country.
We have initiated a consultative process for the review and possible repeal of the Public Order Act, a move that underscores our commitment to enhancing democratic governance and expanding the democratic space for all Zambians.
Claims relating to attacks on journalists are equally inaccurate. To the contrary, under the current administration, journalists are free to criticise the Government without fear of retribution.
The media plays a crucial role in our democracy, and we are committed to ensuring that journalists operate freely and without intimidation.
Moreover, it is surprising and disappointing that the UNHRC has not acknowledged the progress made by this Government in removing draconian laws, such as the defamation of the President law, the death penalty, and the enactment of the Access to Information Law. 
These are significant steps that demonstrate our dedication to enhancing human rights and democratic freedoms in Zambia.
Human rights cannot be fully enjoyed in a state of lawlessness. The very concept of rights inherently creates duties for rights holders to exercise those rights responsibly and within the boundaries of the law. 
In this regard, we have always encouraged the police and other law enforcement agencies to exercise careful judgement when cautioning citizens who commit offences in the exercise and enjoyment of their freedoms.
We must clarify that contrary to the claims made in the report, the UNHRC Special Rapporteurs have not been in touch with the Zambian Government regarding these concerns.
Had the UNHRC reached out, we would have graciously welcomed the opportunity to provide clarification and address any misunderstandings. 
Open and constructive dialogue is essential in ensuring that accurate and fair assessments are made, and we regret that this opportunity was missed.
Nevertheless, the Zambian Government will engage with the UNHRC to reaffirm our commitment in upholding and protecting human rights and ensuring that all citizens, regardless of political affiliation or social standing, enjoy their rights and freedoms in a safe and democratic environment.

Zambia Denies UN Allegations On Human Rights Violations

United Nations experts, including the Special Rapporteur on the situation of human rights defenders, Mary Lawlor, have called for the immediate release of numerous activists who have been arrested and detained by authorities in Zimbabwe in recent weeks.
In a statement issued on Thursday, August 15, the experts said that Zimbabwean authorities must take action to free the human rights defenders currently in custody.

GENEVA (15 August 2024) – The Zimbabwean authorities must immediately release human rights defenders who have been arbitrarily detained for over two weeks and drop charges against them, independent human rights experts said today.
Woman human rights defender Namatai Kwekweza, teacher and labour rights defender Robson Chere, the Secretary-General of Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ), along with local councillor for Harare Ward 5, Samuel Gwenzi, were forcibly removed from a departing flight at Harare Airport on 31 July 2024.
Unidentified men escorted the three to a high-security zone within the airport and held them incommunicado for eight hours.
During this time, the three were reportedly subjected to enforced disappearance, torture and other cruel, inhuman or degrading treatment or punishment, including waterboarding.
Additionally, they were severely threatened against protesting in advance of or during the Southern African Development Community (SADC) summit scheduled for 17 to 19 August 2024 in Harare.
“The enforced disappearance, incommunicado detention and torture, followed by the arbitrary detention of these human rights defenders is inexcusable, and not only violates international human rights law but also makes a mockery of the safeguards contained in Zimbabwe’s own Constitution,” the experts said.
At around 9 PM on 31 July 2024, the human rights defenders were handed over to the Zimbabwe Republic Police at Harare Central Police Station, when they were informed, for the first time, that they were facing charges of “disorderly conduct” under section 41 of the Criminal Law Codification and Reform Act.
These charges relate to their alleged participation in a demonstration calling for the release of a detained opposition politician. Namatai Kwekweza was apparently not even in Zimbabwe at the time of the demonstration in question.
The experts said, “These baseless charges are being used as a fig-leaf to target human rights defenders and opposition voices for calling for greater democracy, human rights and accountability in Zimbabwe. At a time when Zimbabwe is preparing to host the SADC summit, whose values include institutions that are “democratic, legitimate, and effective”, it is unconscionable that these human rights defenders working to strengthen such institutions remain arbitrarily detained.”
The release of the human rights defenders on bail has been opposed by the prosecutor and a further bail hearing has been scheduled for tomorrow, 16 August 2024.
The experts have been in touch with the Government of Zimbabwe on the issue.

UN Experts Demand Immediate Release of Detained Activists in Zimbabwe

Human Rights Watch has called on the Southern African Development Community (SADC) to speak out against the intensified crackdown on the opposition and civil society organizations by Zimbabwean authorities, ahead of the regional bloc’s upcoming summit in Harare.
According to the rights group, since assuming power in a military coup in 2017, President Emmerson Mnangagwa’s government has committed serious human rights violations and demonstrated a failure or unwillingness to institute lasting human rights reforms.
Opposition members and civil society activists have borne the brunt of violence, intimidation, harassment, and repression, which appears aimed at restricting civic and political space in the country.
The past year, in particular, has witnessed the abduction and torture of several activists, as well as the weaponisation of the criminal justice system against the ruling party’s political opponents.
Human Rights Watch has urged SADC to use the Harare summit as an opportunity to address the deteriorating human rights situation in Zimbabwe and press the Mnangagwa government to end its crackdown on dissent and uphold fundamental freedoms.
Opposition politicians have been held in prolonged pretrial detention or convicted on baseless, seemingly politically motivated charges. <a href="https://www.hrw.org/news/2024/07/08/zimbabwe-sadc-should-respond-intensified-crackdown-opponents">Said Allan Ngari, Africa advocacy director at Human Rights Watch</a>:

The heads of state of SADC’s 16 members are scheduled to convene for their 44th regional summit on August 17, 2024, in Harare.
At this gathering, Mnangagwa is poised to assume the chairmanship of the sub-regional organisation.

SADC Should Respond To Intensified Crackdown On Opposition In Zimbabwe - Human Rights Watch

The Department of Immigration has refuted reports that two Egyptian nationals were detained in the country under unclear circumstances before they were freed and allowed to leave the country following the intervention of human rights lawyers.
Last month, the Zimbabwe Lawyers for Human Rights (ZLHR), said that Emad Awny Elgamal and Khaled Fuozi Foudza, who are both male, were arrested by Zimbabwean Immigration officials on 6 March 2024 and arbitrarily detained under opaque circumstances at Harare Remand Prison.
However, an official at the Department, Prosper Kambarami told Pindula News that several claims made by ZLHR are “materially false claims”.
Kambarami said that it is not true that the two Egyptian nationals entered Zimbabwe lawfully and had valid visitor permits, that the Egyptian nationals were arbitrarily detained under opaque circumstances, or that they were released following the intervention of human rights lawyers.
The Department also refuted claims that the Chief Director of Immigration conceded that they were unlawfully detaining the two Egyptians and that they were entitled to their release, or that the matter was removed from the court roll owing to the concessions made by the Chief Director of Immigration.
According to Kambarami, the two Egyptian nationals are fraudsters and entered the country illegally. He said:

Facts on record are that:
1. The two (2) Egyptian nationals are confirmed fraudsters who entered Zimbabwe using fraudulently acquired Mozambican passports.
2. The Zimbabwe Lawyers for Human Rights (ZLHR), as an organisation was not party to any of the proceedings.
3. The Chief Director of Immigration never made any concession in court that her Department unlawfully detained the two (2) Egyptians.
4. The Urgent Chamber Application HCH 1600/24 was removed from the roll by consent as the court held the view that the order sought was incompetent in that it sought an order of constitutional invalidity through an Urgent Application.
5. Consequently, it was removed from the roll after Sadowera Kuwana Legal Practitioners conceded that their application was improper.
6. In fact, Sadowera Kuwana Legal Practitioners, are now seeking to rectify their error through a fresh High Court application HCH 2321/24 in Tatenda Chakabva vs Chief Immigration Officer filed on 28 May 2024.
7. The two (2) Egyptian nationals were deported from prison, under escort, as prohibited persons, only after confirmation of their actual identities and nationalities.

In their report, the ZLHR said Elgamal and Foudza were released from prison on 6 April 2024 and their lawyers escorted them to Robert Gabriel Mugabe International Airport, where they flew back to Egypt.

Department Of Immigration Says Two Egyptians Deported From Zimbabwe Were Fraudsters

The United States of America has accused President Emmerson Mnangagwa’s Government of lacking the political will to “identify, investigate, or prosecute officials who may have committed human rights abuses”.
In its Zimbabwe 2023 Human Rights Report, the United States Government said significant human rights cases which include credible reports of arbitrary or unlawful killings, extrajudicial killings, cruel, inhuman, or degrading treatment or punishment by the government and harsh and life-threatening prison conditions, have not been addressed. Reads the report:

The government did not take credible steps to identify, investigate, or prosecute officials who may have committed human rights abuses.
There were credible reports of human rights abuses by criminal gangs in the artisanal and small-scale mining sector. Authorities did not systematically investigate or prosecute such abuses.
There were several reports that the government or its agents committed arbitrary or unlawful killings, including extrajudicial killings, during the year.
On September 15, Persuade Mandara was reportedly killed in Mashonaland Central province by [the] Zimbabwe Republic Police (ZRP).
According to the Human Rights NGO Forum, officers investigating his connection with a grain theft case broke into Mandara’s home, assaulted him with burning logs that were being used for cooking, and fired gunshots.

The United States also alleged that throughout 2023, security forces used excessive force to apprehend, detain and interrogate criminal suspects. It said:

Police and military officers used excessive force and violent means to disperse peaceful demonstrations and to disrupt informal trading. Security forces often acted in the interest of the ruling party.
On January 14, members of the ZRP assaulted Kudzai Kadzere, a member of Zimbabwe Lawyers for Human Rights (ZLHR), in Budiriro while he was responding to a call for legal assistance by a group of opposition supporters.
ZLHR stated police officers used truncheons and fists to assault Kadzere, leading to injuries including a fractured hand.
</blockquote>
The report also said prison conditions in Zimbabwe were harsh and life-threatening due to overcrowding, food shortages, and lack of water.
It stated that Zimbabwe’s jails are infested with lice, there is a shortage of blankets in the cold season, and prisoners lack of access to personal hygiene products, as well as inadequate sanitary conditions and medical care. Reads the report:

The Constitution and law prohibited arbitrary arrest and detention, although other sections of the law effectively weakened these prohibitions. The government’s enforcement of security laws often conflicted with the constitution.
Security forces arbitrarily arrested and detained persons, particularly political and civil society activists, labour leaders, street vendors and journalists perceived as opposing the government.
The government regularly used arbitrary arrest and detention as tools of intimidation and harassment, especially against opposition party members, political activists, civil society members, journalists, attorneys and ordinary citizens asserting their rights.
</blockquote>
The United States also alleged that the Zimbabwean Government has continued to violate the property rights of citizens. It said:

The Constitution protected property rights, but the government frequently violated this right. On January 7, media reported two ruling party Zimbabwe African National Union-Popular Front (Zanu-PF) activists seized a sugar plantation belonging to a white commercial farmer in Mwenezi, Masvingo province, leaving the owners and scores of workers and their children homeless.

Speaking to <a href="https://www.newsday.co.zw/local-news/article/200026164/us-digs-at-mnangagwa-govt">NewsDay</a>, ZANU PF information director Farai Marapira demanded the US to provide evidence substantiating its allegations. He said:

Accusations and observations unsubstantiated by verified facts serve to expose the speaker not the spoken of. The US must lose agendarism [sic] and vindictive engagement with governments that refuse to cower before it.
We are undeterred in our mission to serve our people and the President’s doors remain open to genuine impartial overtures for engagement. In the absence of that, as ZANU PF we march unfazed, unbothered and more resolutely.

In March this year, the US Office of Foreign Assets Control (OFAC) designated 11 Zimbabwean individuals including President Emmerson Mnangagwa, who became the first sitting head of State to be designated by the US under its Global Magnitsky Programme early this year. They were designated for their alleged involvement in corruption and serious human rights abuse.

United States Of  America Criticises Mnangagwa Govt's Human Rights Record

The Zimbabwe Human Rights Commission (ZHRC) says it has recorded 1 290 human rights violations since January this year.
Speaking during commemorations of International Day of Human Rights recently, ZHRC deputy secretary for programmes Vengesai Erick Mukutiri said complaints received included violation of political rights and discrimination in the distribution of farming inputs. <a href="https://www.newsday.co.zw/local-news/article/200020697/1-290-violations-recorded-this-yearzhrc">NewsDay</a> quoted Mukutiri as saying:

Just for this year from January to date, we received so many cases and we have grouped them into two.
We have received 808 cases of human rights abuses and then for administrative justice, it’s 432. So these are receiving attention at different levels of investigation.
The first stage is to assess whether we have a mandate or the best institution to address the issue.
During this election year, political rights issues dominated from the issues that we were dealing with, including court cases, and issues to do with agricultural inputs.
So, the commission managed to deal with these issues made make sure that we hold the public officials accountable.
</blockquote>
Most of the cases were recorded in Mashonaland West, Manicaland, and Matabeleland provinces, according to Mukutiri.
ZHRC chairperson Elasto Mugwadi said elections in Zimbabwe are characterised by politically motivated violence, saying there is a need to inculcate a culture of respect for human rights in communities. He said:

Much remains to be done to improve the human rights situation in the country and to ensure that a culture of human rights becomes ingrained in our society.
In particular, the commission notes that the polarisation and intolerance of divergent political views persist in our country, characterised by incidents of violence as the country is holding by-elections a few months after harmonised elections.

Mugwadi urged responsible authorities to respect and act on ZHRC recommendations.
He also said it was imperative to align some laws impacting human rights such as the Zimbabwe Human Rights Act to the Constitution.

Human Rights Commission Records 1 290 Human Rights Violations

Villagers in Marange District have petitioned the government to withdraw the recently deployed state security agents whom they accuse of human rights violations, including torture.
Last week, representatives of the villagers held a meeting with Mines and Mining Development minister Winston Chitando, state security agents, and Marange diamond mining companies among other stakeholders in Harare to discuss the issue.
The chief executive officer of Chiadzwa Community Ownership Trust Hardwork Mukwada represented the villagers.
Mukwada refused to comment on the outcome of the meeting when he was contacted by <a href="https://www.newsday.co.zw/thestandard/local-news/article/200002081/fresh-rights-abuses-hit-marange">The Standard</a> saying this will jeopardise the engagements. He said:

It was a closed-door meeting and it is not proper for me to discuss what was discussed in the meeting.
l don’t want to discuss what happened in the meeting because this will jeopardise what we discussed in the meeting.
I am not brushing you aside but I am leading an engagement with some authorities and communities so please don’t publish it.

The Standard reported a source as saying Mukwada and other civil society organisations (CSOs) highlighted the abuses being perpetrated by State security agents in Marange. Said the source:

Mukwada also pointed to the arrogance of the base commander of the soldiers (name withheld) who has refused to engage with the traditional leaders upon request.
He also spoke about the issue of security checkpoints where villagers are being asked to pay cash and that they solicit cash from passers-by and commuter omnibuses.

Newman Chiadzwa of Chiadzwa Development Community Trust (CDTT) also confirmed the meeting and human rights abuses.
Chitando reportedly spoke briefly during the meeting before calling for continuous dialogue among stakeholders.

Human Rights Abuses Hit Marange

Lawyers representing jailed opposition legislator, Job Sikhala (Zengeza West), say they will not give up on fighting for him to be granted bail by the courts.
Zimbabwe Lawyers for Human Rights (ZLHR) lawyer, Jeremiah Bamu working together with Beatrice Mtetwa under instructions from the Zimbabwe Human Rights NGO Forum, filed another application for bail on Friday notwithstanding the fact that Sikhala has been denied bail five times. ZLHR said:

We are not tiring in our efforts to get Zengeza West MP Hon. Job Sikhala released from Chikurubi Maximum Security Prison &amp; our lawyer Jeremiah Bamu working together with Beatrice Mtetwa under instructions from @ZimHRNGOForum, on Friday filed yet another application for bail at Harare Magistrates Court citing changed circumstances.
In the application, Bamu &amp; Mtetwa argued that society is losing faith in the criminal justice system including the bail system as a result of the denial of bail to Hon. Sikhala.
Hon. Sikhala has spent more than 3 months in remand prison after he was arrested on 14 June &amp; charged with inciting public violence &amp; also with obstructing or defeating the course of justice as defined in Section 184(1)(e) of the Criminal Code.

Lawyers Not Giving Up On Sikhala Freedom Bid

The Zimbabwe Peace Project (ZPP) has said it recorded 257 human rights violations in August, with ZANU PF and the Zimbabwe Republic Police (ZRP) being the main perpetrators.
In its report titled “Politics Ruling the law in Zimbabwe”, ZPP said ZANU PF was responsible for 51% of the human rights violations. Part of the report reads:

In August, ZPP monitored and documented 257 human rights violations, with 3,321 victims identified [2,334 Males and 987 Females, including 31 (14M/17F) people with disabilities (PWDs).
The majority of human rights cases were perpetrated by the ZANU PF party, responsible for 51% of the violations, followed by the Zimbabwe Republic Police (ZRP) at 28%.
The general citizens populated the highest percentage of victims, 89%, and Citizens Coalition for Change (CCC) supporters followed with 11%.
Law enforcement agents and the ruling party have collectively subjected the citizens of Zimbabwe to gross human rights violations.

Zimbabwe Peace Project Records 257 Human Rights Abuses In August

Zimbabwe’s human rights record will be examined by the UN Human Rights Council’s Universal Periodic Review (UPR) Working Group for the third time on Wednesday, 26 January 2022 in a meeting that will be <a href="http://webtv.un.org/" rel="noopener" target="_blank">webcast live</a>.  
Zimbabwe is one of the States to be reviewed by the UPR Working Group during its upcoming session taking place from 24 January to 3 February, which marks the end of the UPR third cycle.  
The UPR 40th session was originally scheduled to be held in November 2021, although was <a href="https://www.ohchr.org/EN/HRBodies/HRC/Pages/NewsDetail.aspx?NewsID=25733&amp;LangID=E" rel="noopener" target="_blank">postponed</a> due to COVID-19 measures. 
Zimbabwe’s <a href="https://www.ohchr.org/EN/HRBodies/UPR/Pages/ZWIndex.aspx" rel="noopener" target="_blank">first and second UPR reviews</a> took place in October 2011 and November 2016, respectively.  
The documents on which the reviews are based are
1) national report – information provided by the State under review;
2) information contained in the reports of independent human rights experts and groups, known as the Special Procedures, human rights treaty bodies, and other UN entities;
3) information provided by other stakeholders including national human rights institutions, regional organizations and civil society groups.

The three-country representatives serving as rapporteurs (“troika”) for the review of Zimbabwe are Namibia, Luxembourg, and Armenia.

The list of speakers and all available statements to be delivered during the review of Zimbabwe will be posted on the <a href="https://uprmeetings.ohchr.org/Sessions/40session/Pages/Zimbabwe.aspx" rel="noopener" target="_blank">UPR Extranet</a>. 
The UPR Working Group is scheduled to adopt the recommendations made to Zimbabwe at 15.00 on 28 January.  
The State under review may wish to express its positions on recommendations posed to it during its review.

UN To Examine Zimbabwe’s Human Rights Record

Police in Kutama have arrested a 10-year-old boy on allegations of stealing money that belonged to members of the Zimbabwe Republic Police (ZRP).
According to the Zimbabwe Human Rights NGO Forum, the boy was arrested on Saturday and assaulted by Kutama police.
The boy reportedly picked a plastic bag with US$140 which he handed over to his mother.
When police officers approached him asking for the money, the mother handed over the US$140. The police then claimed it was $200.
It is not clear where the cash was stolen from or why police officers stashed the money in a plastic bag.

MDC-T national chairperson Morgen Komichi said that he has “lots of ideas” that can be harnessed to improve Zimbabwe’s tarnished image.
In a recent interview with NewZimbabwe.com, Komichi said the Zanu PF government is as rogue under President Emmerson Mnangagwa’s administration as it was under the late former president, Robert Mugabe. Komichi said:
<blockquote>We are being labelled as a rogue state by things that can be resolved at home. This is where I strongly believe that the human rights issue can be resolved by Zimbabweans, and I personally feel that I have got a lot of ideas I would to put forward so that this can actually improve our human rights record image outside the country.
It’s not worth it. Some of the things that we see happening in Zimbabwe. (President Emmerson) Mnangagwa needs to improve on the human rights element, which is currently the country’s number one enemy.
This affected the image of the country, and it has affected him personally in terms of sanctions that are there.</blockquote>
The Midlands senator said Mnangagwa has carried on Mugabe’s legacy of lawfare as evidenced by the arbitrary arrests of opposition activists such as Joanna Mamombe and Makomborero Haruzivishe, among others. He said:
<blockquote>Basically, there is a small difference that has taken place from the First Dispensation to the Second Dispensation. There is a need to improve human rights.
The Second Dispensation has found itself caught on arbitrary arrests, the Joanna (Mamombe) team, look at the (Hopewell) Chin’ono team, the Allen Moyo team and Makomborero (Haruzivishe) team.</blockquote>
Komichi however commended Mnangagwa’s administration for ending political violence, intimidation and harassment in rural areas by Zanu PF supporters and state security agents against perceived opposition members.

Komichi 'Has Lots Of Ideas' To Improve Zimbabwe's Stained Image

Civil Society Organisations (CSOs) in Malawi have urged the country’s President Lazarus Chakwera, to engage President Emmerson Mnangagwa on human rights abuses in the country.
In a letter dated 29 September 2020, and addressed to Malawi’s Foreign Affairs Minister Elsenwhower Mkaka, the Centre for Human Rights and Rehabilitation (CHRR) and the Youth and Society (YAS) requested that Chakwera should raise the issue with Mnangagwa on his two-day visit to Harare which commences today.
CHRR acting executive director Micheal Kaiyatsa and YAS executive director Charles Kajoloweka condemned arbitrary arrests, abductions, expulsions, disappearances and torture if journalists, political activists, government critics and human rights defenders by the Zimbabwean government. They wrote:
<blockquote>Time has come for Malawi and its leadership to take a just stand against continued impunity and draconian attempts at silencing the peoples of our neighbouring nations.
The ‘See no evil, hear no evil, speak no evil’ pact has not helped make Zimbabwe a better place for all but made SADC member States, including Malawi, complicit to the horrifying human rights violations and a breakdown of rule of law currently getting worse.</blockquote>
When Malawi opposition supporters staged demonstrations across the country following a disputed election in 2019, the country’s courts ordered a rerun, while in 2018, soldiers shot dead six fleeing civilians and injured several others in Harare following election-related protests.

Chakwera Urged To Engage Mnangagwa On Human Rights Violations

President Emmerson Mnangagwa on Thursday criticised human rights advocates saying they should not waste time talking about human rights but should rather look at the “good” in the country.
He was addressing Zion Christian Church (ZCC) Mbungo members at the launch of the Pfumvudza Presidential Input Scheme in Masvingo yesterday. He said:
<blockquote>We have people in this country who just shout from morning to dusk talking of human rights. They do not have time to see the good in their country. They look for the negatives.</blockquote>
Mnangagwa’s tenure has also been rocked by allegations of gross human rights abuses which have raised eyebrows in South Africa with President Cyril Ramaphosa and the ruling African National Congress (ANC) sending delegations to ascertain what is going in Zimbabwe.
Leader of the ZCC, Nehemiah Mutendi, one of Mnangagwa’s closest allies, said it was too risky for the nation to depend on donor food handouts, adding “a hungry man is ungovernable”.

President Mnangagwa Chides Human Rights Defenders

<blockquote>LAW SOCIETY OF ZIMBABWE STATEMENT ON DETERIORATING HUMAN RIGHTS SITUATION IN ZIMBABWE: 16 AUGUST 2020
The Law Society of Zimbabwe notes with grave concern and condemns the deteriorating human rights situation in the country, including the wanton and unmitigated attacks on legal practitioners carrying out their Constitutionally protected jobs of representing citizens, by the State or certain of its organs.
It is unacceptable that remand prisoners such as Hopewell Chin’ono and Jacob Ngarivume should have to incur legal expense in order to enforce respect by the State of simple and obvious rights such as private counsel with their lawyers, access to clothing and food, and not being subjected to inhuman and degrading treatment in prison, amongst other rights clearly spelt out in the Constitution of Zimbabwe. Remand prisoners remain innocent until proven guilty.
We condemn the arrest of innocent citizens, not wanted for any crime, but simply because they are related to a suspect and are seemingly being used as bait, in gross violation of their right to liberty, such as in the case of Mduduzi Mathuthu’s sister, Nomagugu Mathuthu.
We also condemn the illegal and wanton use of unnecessary force by State Security Services in the enforcement of lockdown regulations, such as in Beitbridge, where police officers set dogs on unarmed and non-violent civilians, causing extensive injuries to some who had to be hospitalized, simply because the citizens failed to get public transport home before 6 pm. Such arbitrariness and use of violence by arms of the State undermines the Constitution and the rule of law.
The Law Society further condemns the abduction and torture of citizens across the country by State Security agents and individuals allegedly unknown but clearly aligned to the State, with the case of Mduduzi Mathuthu’s nephew, Tawanda Muchehiwa being a sad example of such after he was abducted and severely tortured and only produced at court after the intervention of the High Court following a petition by his diligent lawyer.
We call upon the State to seriously investigate these cases and bring these perpetrators of human rights abuses to justice.
It is extremely concerning that no arrests have been made or action taken against known State officials who have knowingly committed these human rights abuses.
Urgent action to reverse and eradicate these abuses needs to be taken by the State as a tangible assurance to the nation that the State does not approve of this conduct and that it has no hand in these activities. Failure to do so renders the State complicit.

The Zimbabwean government has warned that it will continue arresting human rights activists for violating COVID-19 lockdown regulations.
Speaking during an interview with South African television channel eNCA, permanent secretary in the Ministry of Information, Publicity and Broadcasting Services, Ndavaningi Mangwana said:
<blockquote>Human rights activists or so-called, are not above the law. Lawyers are not above the law, permanent secretaries are not above the law. Anyone who breaks the law has to face their day in court. And this is what’s happening.</blockquote>
This comes after several activists, lawyers, journalists, and members of the MDC Alliance have bee arrested over the past few weeks by authorities.
The latest “victims” are anti-constitutional amendment activists – Namatai Kwekweza aged 21 years, Youngerson Matete aged 29 years and Prince Gora aged 24 years.
The three were last week arrested by police in central Harare and charged with contravening section 37(1)(b) of the Criminal Law (Codification and Reform) Act for allegedly participating in a gathering with intent to promote public violence, breaches of the peace or bigotry.

Govt Vows To Continue Arresting Pro-democracy Activists

The United States Senate Foreign Relations Committee has condemned the harassment of members of the opposition Movement for Democratic Change (MDC).
The US demanded the release of the trio, Joannah Mamombe, Cecelia Chinembiri and Netsai Marowa. In a statement that was posted on Twitter on Thursday night, the US said:
<blockquote>The <a class="link-complex" href="https://twitter.com/search?q=%23Zimbabwean" rel="hashtag noopener noreferrer" target="_blank">#Zimbabwean</a> regime is once again showing its true colors by arresting its critics, denying them due process, and then not being able to account for their whereabouts. It is important the 3 women from the opposition MDC are found unharmed and provided access to their lawyers.</blockquote>
The trio was abducted during a flash protest in Warren Park and they were reportedly found early this morning after being badly beaten up and dumped at Muchapondwa shops in Musana, Bindura South.
Last year, a number of MDC officials and human rights defenders were abducted and tortured allegedly for planning to dislodge a constitutionally established government.
The TheUnited States and other countries criticised the government over the disappearance of citizens. Analysts said that Zimbabwe was soiling its image and was not prudent considering that it is on the course of engaging and reengaging the international community.

Speaking during the United Nations International Human Rights Day commemorations, the Forum’s chairperson <a href="https://www.pindula.co.zw/Jestina_Mukoko" rel="noopener noreferrer" target="_blank">Jestina Mukoko</a> said:
<blockquote>The overview of this year’s human rights situation indicates that we are not progressing, if anything we have gone several steps back.
The continued use of force on citizens who are suffering due to rising inflation, spiralling basic commodity prices, erosion of disposable incomes and power outages creates conditions for serious civil strife.
Currently, we also have this problem of the <a href="https://www.pindula.co.zw/MaShurugwi" rel="noopener noreferrer" target="_blank">MaShurugwi</a> who are unleashing terror using machetes across the country.</blockquote>
The year 2019 witnessed some of the most blatant human rights violations ever seen when, in January, 17 people were shot dead during fuel protests.
During the year, several human rights defenders and activists were abducted, beaten and left for dead by unknown gunmen.

Human Rights Situation Worsened In 2019 - Rights Groups

MDC-T vice president <a href="https://www.pindula.co.zw/Obert_Gutu" rel="noopener noreferrer" target="_blank">Obert Gutu</a> has seemingly played down human rights violations perpetrated by authorities in Zimbabwe by criticising foreigners for being concerned about the abuses.
Writing on Twitter, Gutu said those foreigners should rather be concerned about serious rights abuses in their own countries and puppet states. He wrote:
<blockquote>Zimbabwe is for Zimbabweans! When foreigners are more ‘concerned’ about so-called human rights abuses in Zimbabwe than they are about serious human rights abuses in their own backyards as well as in their client states, we should get very worried! Why cry more than the bereaved?</blockquote>
Since leaving the original MDC in 2018 alongside her boss, <a href="https://www.pindula.co.zw/Thokozani_Khupe" rel="noopener noreferrer" target="_blank">Thokozani Khupe</a>, Gutu has been using social media as well as State media to attack his erstwhile colleagues in the MDC led by <a href="https://www.pindula.co.zw/Nelson_Chamisa" rel="noopener noreferrer" target="_blank">Nelson Chamisa</a>.
His language has consistently dovetailed with that which is used by ZANU PF officials prompting observers to conclude that he has been co-opted by the ruling party for “30 pieces of silver”.

MDC-T VP Chides Foreigners For Speaking Against Human Rights Abuses In Zimbabwe

The Government has invited a special UN envoy to come and assess the country’s achievements and challenges in relation to the exercise of the rights to freedom of peaceful assembly and of association in the country.
The envoy, Clément Nyaletsossi Voule will be in Zimbabwe from 17 to 27 September and he will visit Harare, Bulawayo, Mutare and Marange communities. Speaking about the upcoming visit Voule said:
<blockquote>My upcoming visit to Zimbabwe represents a key opportunity to learn first-hand about laws, policies and national realities in relation to the rights to peaceful assembly and of association in light to the 2013 Constitution and the change of leadership.
My mission  will also serve to identify the opportunities and challenges the Government faces in implementing articles 21 and 22 of the International Covenant on Civil and Political Rights, particularly in relation to the management of assemblies in the context of  the recent protests.
I look forward to having a constructive engagement with the Government, independent institutions and a wide-range of civil society actors to identify needs and practical approaches in order to formulate constructive recommendations that can contribute to the strengthening of the civic space in the country</blockquote>
At the end of the visit Voule will share his findings with members of the media at first and the with the UN Human Rights Council in June 2020. The envoy is coming at a time when the police last month issued a series of prohibition notices to MDC’s planned protests. The envoy will meet with government officials and members of different civil society groups legislators etc during his visit.

UN Special Rapporteur To Visit Zimbabwe To Assess The Country’s Achievements And Challenges Regarding Freedom Of Peaceful Assembly

The opposition MDC has mourned the passing of the former President of Zimbabwe, Robert Mugabe. The party reflected on their relations with the veteran leader and noted that it was not all rosy. MDC said that although they clashed with Mugabe particularly on the violation of human rights, they still acknowledged his contributions to an independent Africa and Zimbabwe in particular. The MDC notes with sadness the passing on of Zimbabwe’s founding leader, Mr. Robert Mugabe.
As a party that advances the ideals of the liberation struggle, we acknowledge Mr. Mugabe’s important role in laying the foundation of an independent Africa and an independent Zimbabwe.
Mr. Mugabe missed an opportunity of leading and leaving. He could have bowed out earlier and left the political scene in a more dignified manner than being stampeded out.
In 2008, Mr. Mugabe lost the election but he stayed on, through the influence of his sidekicks, some of whom have today become an albatross to the country.
We had our differences with him, particularly on the issue of respecting human rights and his failure to create a truly inclusive society that failed to place the country on a positive trajectory for growth.
In the true African value of ubuntu, we pay our condolences to the Mugabe family as we join the nation in mourning a founding African statesman.

The government of Zimbabwe says that the removal of sanctions imposed on the country by Western powers will enable it to expedite the compensation of white commercial farmers who lost land during the land reform programme.
Writing in the influential Foreign Policy magazine, the Minister of Foreign Affairs and International Trade, Subisiso Moyo also touched on “some tragic and lamentable incidents [that] have taken place since” President Emmerson Mnangagwa came to power. He wrote:
<blockquote>Lifting the Mugabe-era U.S. economic sanctions that prevent full international engagement would remedy this problem.
Free to enjoy the full benefits afforded by global engagement, Zimbabwe—with its rich mineral resources and land, a highly educated workforce, and solid infrastructure—would thrive. And with it would come a bigger budget to expedite land reform.
… Some tragic and lamentable incidents have taken place since this administration came to power. Yet those incidents should not be read as government intent nor obscure the country’s progress. We cannot change the past, only our future.
The six deaths that followed post-election clashes between security forces and protesters is one such event. Immediately, the government instituted an international commission of inquiry headed by former South African President Kgalema Motlanthe and the international human rights lawyer Rodney Dixon.</blockquote>
Moyo said that even though nobody was prosecuted for the August 1 killings, those responsible will be punished. He wrote:
<blockquote>The fact that nobody has yet been prosecuted does not mean that the recommendations have been dismissed. To be absolutely clear, those responsible will be held accountable. Meanwhile, other changes are in motion.</blockquote>
Moyo further argued that the removal of sanctions will help the government strengthen the protection of human rights and avert further abuses.

MDC-T Manicaland provincial spokesperson Trevor Saruwaka yesterday urged G40 members not to apologise to President Emmerson Mnangagwa’s government since they were exercising their rights when they supported former First Lady Grace Mugabe.
Saruwaka was referring to former Manicaland Provincial Affairs minister Mandi Chimene who reportedly skipped the border to Mozambique and is reportedly seeking refuge in Burundi after escaping Operation Restore Legacy. Said Saruwaka:
<blockquote>When people are in power they should remember one day they will wake up out of power, hence, they must lead with honour and restraint. She (Chimene) went overboard like someone who was intoxicated. Now she is out of power reality has dawned on her. Remember she (Chimene) is someone who was used to claiming that she was a powerful war veteran. So she should come back to Zimbabwe and enjoy her freedoms. Why is she running away? We used to tell her that there is no freedom in Zimbabwe and she was scornful. "G40 Should Not Apologise To Mnangagwa For Supporting Grace Mugabe"

Human rights activists from Bulawayo have rallied to <a href="http://www.pindula.co.zw/Linda_Masarira">Linda  Masarira</a>‘s defence.  Masarira is currently embroiled in controversy after allegedly labelling  <a href="http://www.pindula.co.zw/news/2016/12/16/linda-masarira-refutes-zimeye-report-claiming-said-ndebeles-cowards/" target="_blank">Ndebele people as cowards</a>.  However, some activists have rushed to her aid, saying that this was an effort to divide human rights activists.  They aalso said that this was a tactic to divert them from major issues.
Bulawayo Youths Arise (Buya) chief executive officer, Mthokozisi Ncube said:
<blockquote>This is a clear sign of someone wanting to divert us from the major issues to small issue.</blockquote>
This Constitution Campaign leader, Abigail Mpambi said:
<blockquote>l am grateful our chairperson clarified the Masarira issue. We will continue to recognise Linda Masarira as a human rights defender, who, of course, might have her own shortcomings, where she can be answerable as an individual. We, as activists, are very far from prioritising fighting our fellow comrade, while a system that invested in dividing the people of Zimbabwe’s attention is taking a spectator role.</blockquote>
