The government has issued 11,000 title deeds in Harare’s sprawling Epworth suburb since 2023, as part of an initiative to regularise informal settlements throughout the country, a Cabinet Minister has said.
In the lead-up to the August 2023 general elections, the ruling ZANU PF party committed to regularising over 80,000 illegal settlements where tenants faced the risk of having their homes demolished.
To support this effort, the Cabinet endorsed the Kwangu/Ngakwami Presidential Title Deeds Programme Consortium, which aims to provide the necessary financial and technical assistance for the issuance of these titles.
On Wednesday, during a session in the National Assembly, Lands, Agriculture, Fisheries, Water and Rural Development Minister Anxious Masuka, who was acting as the leader of government business in Parliament, addressed parliamentarians regarding the progress made in the regularisation exercise. The regularisation of such stands is important and the issue of human dignity should be addressed. In Epworth, there are a few people who were given title deeds, but we were told in the meeting that we held recently that there are 11,000 title deeds which have been distributed and that the team is now going to Caledonia and other new residential suburbs.

Masuka said authorities need to understand why settlers were receiving eviction notices despite the government’s commitment to regularising illegal settlements.
According to government reports, the Harare Metropolitan Province contains approximately 52,000 houses constructed in illegal settlements, with 25,000 of these structures located in Chitungwiza as of 2023.

Police have intensified operations against illegal land allocations by land barons across the country following the rise of illegal settlements on communal, local authority, and state lands, especially around major towns, cities, and growth points.
In a statement issued this Friday, 25 October, ZRP spokesperson Commissioner Paul Nyathi warned that land barons are using falsified documents to deceive home seekers, leading to unlawful constructions on state, wet, and grazing lands. Reads the statement:

The Zimbabwe Republic Police has intensified operations against illegal land allocations by land barons across the country.
This follows the proliferation of illegal settlements on communal, local authority and state lands, particularly around major towns, cities and growth points.
The Police has established that land barons are using falsified documents to deceive unsuspecting home seekers, resulting in unlawful constructions on state, wet and grazing lands.
The actions by land barons violate the country’s laws including the Gazetted Land (Consequential Provisions) Act, Chapter 20:28, Land Commission Act, Chapter 20:29, Rural District Councils Act Chapter 29:13 and Regional, Town and Country Planning Act, Chapter 29:12.
So far, the Police has made one hundred and eighty-four (184) arrests on illegal land allocations.
Members of the public are urged to come forward and report illegal acts by land barons to enable the law to take its course.

ZRP Intensifies Operations Against Land Barons

The demolitions of poor people’s homes and other structures across the country to deal with illegal occupations of State land are mainly driven by three factors: politics, power and money.
<a href="https://thenewshawks.com/reasons-for-mnangagwas-ruthless-house-demolitions/">The NewsHawks</a> cited sources as saying President Emmerson Mnangagwa and Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi are using power and politics to create a new land market where money would be the main determinant of land occupations and settlements. One unnamed government official was quoted as saying:

The minister has made it clear to us in government what’s going on here. The land belongs to the President, which means he uses his power for its spatial distribution and his politics of patronage and loyalty influence the dynamics of it.
But in the end, money will take centre stage and the land will now be sold at market rates, creating a new land market which is driven by power and politics. It’s a symbiotic relationship.
Since the beginning of February this year, authorities have demolished houses and settlements built on land acquired illegally in peri-urban communities including, for example, Gutu and Mushandike in Masvingo province, Chipinge in Manicaland, Dema and Goromonzi in Mashonaland East and different other places.
The illegal settlers bought the land from village heads and land barons linked to ZANU PF.

The NewsHawks reported a source as saying it is also the government’s intention to sell the land after demolitions to create a new market in which ordinary people pay fair value for land even though Mnangagwa and other ZANU PF leaders got land for free. Said source:

To be sure, the demolition of informal houses and structures is not a new phenomenon in Zimbabwe and elsewhere. 
What is new is some of the political actors, policy approach, frequency and intensity, as well as the motives and visibility which do vary.
What is new is the intensity, frequency, and agency (visibility and changing dynamics of its triggers and mechanisms of its unfolding in specific contexts).
There are three objectives of the demolitions: politics, power and money. These are the real underlying motives.
From the top, that is the Office of the President and Cabinet down to the minister’s office and government officials’ positions, they are all aware of the agenda.
The President and the Minister of Justice know very well what this is all about. It’s an elite project being driven by those who own land and houses which mostly they didn’t even buy in the first place. It’s hypocrisy of the worst order.
Of course, the rule of law must apply whenever there are illegal activities and criminality, but it must be applied even-handedly not just to the poor and vulnerable as the situation shows at the moment.

In 2005, the ZANU PF-led government launched “Operation Murambatsvina” (Clear Filth) which resulted in mass evictions of urban dwellers from housing structures and the closure of various informal sector businesses throughout the country.
According to the United Nations, 700 000 people were forcibly evicted from their homes, made homeless or lost their source of livelihood.

Mnangagwa's House Demolitions Mainly Driven By Politics, Power And Money | Report

Two village heads from Nyamandlovu appeared before Bulawayo Magistrate Maxwell Ncube on Friday, 23 February facing a charge of unlawfully allocating 38 stands to home seekers.
As reported by the <a href="https://newsday.co.zw/southerneye/local/article/200023533/village-heads-up-for-selling-state-land">Southern Eye</a>, the accused are Chikombingo Moses Nyamande (84) and village development committee member Danisa Nyathi (59).
They were not asked to plead before being remanded to 21 March for trial.
Nyathi and Nyamande are resettled farmers on gazetted State land.
It is the State’s case that since 21 January 2023, Nyamande and Nyathi have allocated stands to 38 villagers without State authority.
The villagers allegedly moved onto the land and built structures.
On 22 January this year, police received a tip-off that the duo were illegally parcelling out State land and visited the area where they discovered that 38 illegal settlers had already built housing structures.
The accused failed to produce documentation authorising the settlers to occupy the land in question leading to their arrest.
Police recently launched “Operation Order No To Land Barons” targetting people accused of being irregularly settled on State land.
This has resulted in the arrest of hundreds of villagers across the country.
Four village heads from Dema in Mashonaland East Province were convicted after appearing in court for selling stands in undesignated places and pocketing the proceeds.

Village Heads In Court For Selling State Land

The Zimbabwe Congress of Trade Unions (ZCTU) has criticised the government’s approach in dealing with illegal occupations of land and likened the eviction of villagers to the seizure of Arab land by Jewish settlers in Palestine since 1948.
This comes after the government demolished the homes of some villagers in Masvingo and Matabeleland South provinces raising fears that the nation is slowly backsliding to the 2005 Operation Murambatsvina demolitions.
Many occupants facing demolitions had settled in the areas for decades only to be arrested and prosecuted for illegal land occupation.
Speaking to <a href="https://www.newzimbabwe.com/labour-blasts-govts-zionist-approach-to-land-evictions/">NewZimbabwe.com</a> on Tuesday, ZCTU secretary general, Japhet Moyo implored government officials to be humane and desist from creating a needless humanitarian crisis. Said Moyo:

Land is a right and thus should be accessible to all individuals. In the past, we have noted the regularisation of informal settlements for political expediency.
Now that elections are over, politicians are looking the other way as if nothing is happening.
We are faced with a humanitarian crisis, we expect the government to approach the issue with cool heads.
A “Zionist” approach towards alleged illegal settlers is not a solution.
</blockquote>
Moyo said the ZCTU stands against the perpetuation of exclusionary colonial laws adding that some villagers are being evicted by greedy political bigwigs who want more land for themselves. He said:

The same laws being invoked to evict villagers are also undermining the authority of traditional leaders who settled the villagers in the first place.
These villagers were not settling themselves, but they got a go-ahead from traditional leaders and in some cases, they got a go-ahead from land officers.
The operation has exposed our government’s ineptitude. It left the villagers undisturbed for decades only to bombard them with evictions on short notice.
If our leaders have the conscience and time for some soul-searching, they will realize their errors and omissions.

On 13 February this year, the Zimbabwe Republic Police said 3 700 people had been arrested countrywide under the ongoing Government operation dubbed “No To Land Barons and Illegal Settlements on Land”.
According to the Police, 28 people were arrested in Tokwane-Ngundu Resettlement, 26 people were arrested for allegedly occupying grazing lands and distributing gazetted land to their relatives at Lazy Five Farm in Karoi, and 123 people were arrested at Enyandeni Resettlement Area, Gwanda.

ZCTU Condemns Govt's "Zionist" Approach Towards Illegal Land Occupiers

Members of Parliament on Tuesday pleaded with the Government to show empathy towards illegal settlers who are facing evictions, arrests and the destruction of their homes countrywide.
As reported by <a href="https://www.newzimbabwe.com/mps-plead-with-govt-to-treat-illegal-settlers-with-empathy-as-evictions-intensify/">NewZimbabwe.com</a>, the lawmakers argued that though the Government was enforcing the law, the timing was wrong as the country is battling a cholera outbreak and in the middle of the rainy season.
Midlands Proportional Representative MP Tsitsi Zhou (ZANU PF) said the illegal allocation of land dates back to 2004. She said:

Some evictions are ongoing countrywide and people are being arrested and taken to courts because they are settled illegally in resettlement and communal areas.
The government had taken a position to first identify land to allocate the illegal settlers in communal, resettlement and urban areas.
We need to appreciate the population growth and the government should treat illegal settlers the same way, whether they are in urban or communal areas with empathy to achieve the desired results.
</blockquote>
The Speaker of the National Assembly, Jacob Mudenda, asked the MP to clarify whether she was condemning the Executive for implementing the law or not. Said Mudenda:

The Executive is administering the law. What is the problem? You are condemning how the evictions are taking place?
</blockquote>
However, Zhou said it was how the process was being done that needed to be revisited. She said:
<blockquote>
I would like to believe that people have a right to shelter. There has been population growth since the Land Reform Programme and rural-to-urban migration.
Whilst we appreciate this, people are being resettled illegally. They are allocating land to each other through the village heads, councillors and all.

Mudenda concurred with Zhou that the matter could be of national interest but requested her to ask the question to the relevant minister (Anxious Masuka) during the Q and A session. He said:

Well, that may be a matter of national interest. I think you need to ask the question tomorrow. That will suggest what you are observing.
There is no way you can stop the Executive from evicting people who have illegally settled themselves.
</blockquote>
Maxwell Mavhunga (CCC) told Parliament that the timing of the evictions and not the enforcement of the law was wrong. He said:

The enforcement is not the issue but the timing of the enforcement. It is during the rainy season and people have nowhere to go.
We are in a pandemic where there is cholera and people are being displaced at this particular time.
We have people on farms who are being evicted when they have planted their crops and they are told to leave within seven days.

An estimated 700 000 people lost their homes and/or livelihoods, with a further 2.4 million people indirectly affected. An estimated 92 460 homes were destroyed during the blitz.

MPs Criticise Evictions, Arrests Of Illegal Settlers

Self-exiled former Minister of Foreign Affairs, Walter Mzembi, has suggested that ZANU PF has been hijacked by imperialists and neoliberals who are now forcing rural people off State land.
Mzembi said the ruling party would not evict landless people even if they occupied State land illegally and would instead, regularise the irregular settlements as happened with the Fast-track Land Resettlement Programme around the year 2000.
He made the comments in response to the Government’s ongoing “No To Land Barons and Illegal Settlements on Land” operation which has resulted in more than 3 700 arrests countrywide.
Posting on X, Mzembi said the law can easily be amended to align with the situation on the ground, adding that nothing stops President Emmerson Mnangagwa from putting the evictions to an end. Said Mzembi:

ZANU PF will not evict the landless even if they are on State land illegally, unless it has been hijacked by imperialists and neoliberals.
Fast Track Land Reform in itself was an illegality according to the laws of the land of the time.
Law is a product of a political process, so it was made legal by the political objectives of addressing skewed land ownership of the time.
So we have a revolutionary precedent that prevents abuse of the landless in the name of the law.
President Mnangagwa is symbolically what the King is in England except we are a Republic but he can stop this bureaucratic nonsense on instruction.

"ZANU PF Has Been Hijacked By Imperialists And Neoliberals"

Zimbabwe Lawyers for Human Rights (ZLHR) lawyers are representing hundreds of villagers across the country who have been evicted from their ancestral land by the Government for allegedly occupying gazetted land without lawful authority.
Some of the villagers have been in occupation of their land for more than 40 years and made tremendous improvements to their land.
Under the ongoing “No To Land Barons and Illegal Settlements on Land” operation launched by the Goverment this year, more than 2 700 people have been arrested. The ZLHR said:
<blockquote>
Across Zimbabwe, we are representing hundreds of distressed villagers, who are accused of illegally occupying their ancestral land.
In Chipinge in Manicaland province, our lawyer [Tariro Tazvitya], is representing 327 villagers, who reside in Mahachi village and are accused of illegally occupying Mahachi village.
Of the 327 villagers, 80 of them reside in Munyokowere village and are accused of illegally occupying Munyokowere village.
In Masvingo Province, we have filed an appeal at Masvingo Magistrates Court seeking to suspend an order for the eviction of some villagers from their ancestral land.
The villagers were recently convicted of occupying gazetted land without lawful authority as defined in section 3(1) of the Gazetted Land (Consequential Provisions) Act by Masvingo Magistrate Ivy Jawona and sentenced to serve three months in prison, which was wholly suspended.
In addition, Magistrate Jawona ordered the villagers to vacate their land within 7 days. Now, the villagers, who are represented by Phillip Shumba of the Zimbabwe Lawyers for Human Rights, have asked the Masvingo Magistrates Court to stay their eviction pending the determination of their appeal against both conviction and sentence by the Masvingo High Court.
The villagers filed the appeal at Masvingo High Court on 9 February 2024 challenging their conviction and sentence by Magistrate Jawona.
In the appeal, the villagers argue that Magistrate Jawona erred and misdirected herself in convicting and sentencing the villagers for illegally occupying gazetted land as some of them have been in occupation of their land for more than 40 years and had effected tremendous improvements to their land.
The villagers want the High Court to overturn their conviction and set aside their sentence and refer their matter to the Constitutional Court for a determination of the constitutionality of their eviction.

Human Rights Lawyers Challenge Eviction Of Villagers From Ancestral Lands

Police have said more than 3 700 people have been arrested countrywide under the ongoing Government operation dubbed “No To Land Barons and Illegal Settlements on Land” which seeks to eradicate illegal settlements.
In a statement issued on Tuesday, 13 February, ZRP Senior Staff Officer [Press and Public Relations], Assistant Commissioner Paul Nyathi said arrests were made in Mashonaland West, Masvingo, Matabeleland North and South provinces. He said:

The Zimbabwe Republic Police appreciates and commends the public for the cooperation and information received in the ongoing Government’s country-wide operation, “No To Land Barons and Illegal Settlements on Land” in either rural or urban setups.
The operation started in January 2024 and is progressing well. As of 12th February 2024, a total of 3 775 suspects have been arrested with 985 convictions being made by the courts, while 3 360 cases are pending trial.
Notable arrests have been made in Masvingo where 28 suspects were accounted for in Tokwane-Ngundu Resettlement.
The suspects had illegally settled on the grazing lands without the authority of the Ministry of Land, Agricultural, Fisheries, Water and Rural Development.
In Mashonaland West Province, Police in Karoi arrested 26 suspects who were occupying grazing lands and distributing gazetted land to their relatives at Lazy Five Farm.
Investigations carried out unearthed that the suspects were paying US$15.00 or maize equivalent, to the plot holders.
In Matabeleland South Province, 123 suspects were arrested at Enyandeni Resettlement Area, Gwanda. The suspects settled themselves on the gazetted land without lawful authority.
In Matabeleland North Province, Thulani Nzima aged (53) was arrested for illegal allocation of land in which he allocated six residential stands to desperate home seekers for payment in Siganda, Mbembeswana 1 Village, Nyamandlovu.
Investigations carried out unearthed that the beneficiaries paid US$300.00 and ZAR4 000.00 to the suspect.

Asst Comm Nyathi said the Zimbabwe Republic Police will continue to issue regular updates on the operation to the public.
He urged members of the public to verify the status of any land before being settled or made to pay for the allocation or development.

3 700 People Arrested Under Operation "No To Land Barons And Illegal Settlements On Land"

The Government has ordered people who illegally occupied agricultural land and pastures in rural and urban areas across the country to vacate the areas or risk being prosecuted.
<a href="https://www.herald.co.zw/govt-orders-illegal-settlers-off-state-land/">The Herald</a> reported the Minister of Lands, Agriculture, Fisheries, Water and Rural Development Anxious Masuka as saying the Government has noted with concern the increased number of illegal settlers on agricultural land. Said Masuka:
<blockquote>
Government has noted with concern the increased number of illegal settlers on agricultural land. As a result, the public is notified that only the Minister of Lands, Agriculture, Fisheries, Water and Rural Development is authorised to issue tenure documents on agricultural land, as he administers relevant Acts assigned to him by the President.
</blockquote>
Masvingo Minister of State for Provincial Affairs and Devolution, Ezra Chadzamira recently ordered “illegal” settlers to land acquired without following due process. He said:
<blockquote>
You are ordered to vacate immediately and follow the due processes in acquiring land. Government condemns without any reservation the illegal settlements, occupations, parcelling out and selling of the land without the permission of relevant authorities.
The land belongs to the President. No one, but the delegated powers in various departments has permission to parcel out land. Report such activities.
</blockquote>
According to the Land Commission Act, it is a criminal offence in terms of the Gazetted Lands (Consequential Provisions) Act to occupy State land without lawful authority in the form of a permit, an offer letter or a lease.
Traditional leaders are also not allowed to sell land and those found guilty will be punished.
Meanwhile, the Masvingo Centre for Research, Advocacy and Development (MACRAD) Trust has urged the Government to stop the ongoing summary removal of people accused of being irregularly settled on State land in the Province under “Operation Order No To Land Barons”.
In Masvingo Province, scores of villagers who have been living on the land for the past two decades have been arraigned before the courts for alleged illegal settlement and are now homeless.

Govt Orders Illegal Settlers Off State Land

The government says it is open to partnerships with the private sector in the provision of infrastructure and key services in new urban settlements.
Local Government and Public Works ministry chief director for spatial planning Shingirai Mashamba on Thursday said that the majority of new settlements lacked social services such as roads, water, power and health facilities.
He made the remarks while addressing delegates during the ground-breaking ceremony for the AfreximBank trade centre in Harare. Mashumba said:

We also have opportunities right now. When we took over the land reform programme, quite some processes happened and there was some appropriation of urban land so we have significant settlements that are fairly planned but lack services.
There are huge opportunities for captains of industry and commerce for us to partner as we regularise those settlements and we begin to provide onsite and offsite bulk infrastructure in terms of sewer, roads and water facilities, street lighting, health and water and sanitation facilities.

Govt Seeks Partners To Regularise New Settlements

Villagers who have settled illegally in parts of Umzingwane, Matabeleland South Province, including close to the Zimbabwe National Army (ZNA) cantonment area face eviction.
This was said by Local Government deputy minister Marian Chombo in Parliament this week while responding to Umzingwane legislator Levi Mayihlome (ZANU PF).
Mayihlome wanted to know “when the ministry was going to stop and reverse illegal settlements in communal and A1 settlement areas in Umzingwane.”
Chombo said land barons and local authorities accused of parcelling out land to illegal settlers will bear the cost of eviction and relocation.
She also revealed that an inter-ministerial committee has been set up to resolve challenges related to “dysfunctional” settlements, both urban and communal areas with a view of regularising, demolition and evicting affected people. Chombo said:

In Umzingwane, the areas affected by illegal settlers are wards 20 and 5 where people settled themselves and established an urban settlement in communal and resettlement areas in the Mbalabala area, 40 km from Bulawayo; ward 19 of Godlwayo area where people settled themselves and were given eviction notices; in wards 1 and 2, people were settled next to the cantonment area of the Zimbabwe National Army, the people need to be resettled to safe areas.
We have been going through the 10 provinces to make sure that we identify where all those dysfunctional settlements are.
There is a programme that is being drawn up to make sure that we identify who settled those people there.
Was it the land barons? Was it the local authority or was it us, the Local Government and Public Works ministry?

Illegal Settlers In Umzingwane Face Eviction

Government has ordered illegally resettled farmers to vacate the land or face the wrath of the law. This was said by Minister of Lands, Agriculture and Rural Resettlement, Air Marshal Perrance Shiri (Rtd) during a media briefing with journalists.
Said Shiri:
<blockquote>If we are to meet the goals set out by Government to use agriculture as the mainstay of the economy, we need to ensure unquestionable sanity on the farms. To achieve that, the Zimbabwe Land Commission shall be seized with the responsibility of settling land disputes emanating from resettled farmers and shall report to the Minister from time to time. Constitutionalism should be the guiding principle and as such behaviour and actions not conforming to this are not permissible under whatever circumstances. Only those people with documentation of land occupancy and or those who were allocated land legitimately should remain on the farms and concentrate on production unhindered. All those who were illegally settled or who just settled themselves on resettlement land should vacate immediately.</blockquote>
