A freelance reporter for The New York Times, Jeffrey Moyo was this Tuesday found guilty of breaching the country’s immigration laws.
Moyo was being accused of obtaining fake press credentials for two Times journalists who entered Zimbabwe last year on a reporting trip.
<a href="https://www.nytimes.com/2022/06/14/world/africa/zimbabwe-trial-reporter-new-york-times.html">The New York Times’ Chief Africa correspondent, Declan Walsh reports</a> that before the hearing, Moyo’s lawyers said they would appeal the verdict in the event of a conviction. The lawyers maintain that Moyo’s charges are baseless. 
Moyo appeared before Bulawayo Magistrate Mark Nzira who said that “from the evidence before the court, it is clear that the accused may have connived” to make fake press cards for the two Times journalists.
Moyo was arrested in May 2021 when he helped two Times journalists, Christina Goldbaum and João Silva, to enter Zimbabwe on a reporting visit.
He obtained press cards for the journalists from the <a href="https://www.pindula.co.zw/Zimbabwe_Media_Commission">Zimbabwe Media Commission (ZMC)</a>, the state regulator, which they used to obtain visas at Bulawayo airport on May 5. 
Three days later, an immigration officer cancelled those visas, claiming the accreditation was fraudulent and the police ordered Ms. Goldbaum and Mr. Silva to leave.
Two weeks later, Moyo was arrested on charges of helping the journalists to acquire fake documents.
Mr. Thabang Manhika, the ZMC official who provided them, was also arrested and tried separately.
Moyo was moved to a prison in Bulawayo and was<a href="https://news.pindula.co.zw/2021/06/16/update-on-jailed-new-york-times-journalist/"> released after spending 21 days in custody.</a>
A magistrate initially denied him bail describing him as “a threat to national security.”

In February 2022, the prosecution abruptly ended its case without calling major witnesses, including the chief police investigator. 
Manhika, the Media Commission official accused of supplying the fake press cards, was acquitted in March. Still, the case against Moyo dragged on.
 Moyo is among many journalists who have been arrested in Zimbabwe since the ascendancy of President Emmerson Mnangagwa to power in 2017. Others include Hopewell Chin’ono, Mduduzi Mathuthu, Blessed Mhlanga, Ruvimbo Muchenje, and Chengeto Chidi.
Analysts called the case part of a wider assault on press freedoms in Zimbabwe adding that the arrests are meant to suppress critics in advance of elections scheduled for next year.

The New York Times Journalist Jeffrey Moyo Found Guilty Of Breaching Zimbabwe’s Immigration Laws

Jeffrey Moyo, a Zimbabwean journalist with a US publication, New York Times, has been released after spending 21 days in custody.
Moyo was arrested on 26 May in Harare and charged with violating Section 36 of Zimbabwe’s Immigration Act by allegedly helping two New York Times journalists, Christina Goldbaum and Joao Silva, obtain false media accreditations.
He is also accused of securing fake accreditation credentials for them from the Zimbabwe Media Commission (ZMC) after conniving with an official from the regulatory body Thabang Farai Manhika, who also remains in jail.

Speaking on the latest development, Moyo’s lawyer, Doug Coltart described his prolonged detention as illegal. He said:
<blockquote>_New York Times journalist Jeffrey Moyo has finally been released after 21 days in custody. His detention was characterized by a series of illegalities &amp; violations of his constitutional rights including prison officials’ refusal to release him yesterday despite being granted bail._
_After detaining him for three weeks, the State has now essentially conceded on appeal that they have no case against Jeff and that the grounds on which they opposed bail in the Magistrate’s court were baseless._</blockquote>
The High Court freed him on bail on Monday but officers at the Bulawayo Central Prison were rejecting his warrant of liberation claiming it has an error.

UPDATE On Jailed New York Times Journalist

New York Times Zimbabwean correspondent, Jeffrey Moyo, was denied bail on the basis that he “poses a flight risk and is a threat to national security”.
Moyo who has been in jail since his arrest was remanded in custody to 10 June at Bulawayo Prison.
Zimbabwe authorities should not contest journalist Jeffrey Moyo’s appeal of a recent ruling denying him bail and should drop the criminal case against him, the Committee to Protect Journalists (CPJ).
Doug Coltart, the journalist’s lawyer, told CPJ that Magistrate Rachel Mukanga agreed with prosecutors that Moyo was a flight risk, and “threat to national security” and that the country’s “sovereignty was undermined because foreign journalists interviewed Zimbabweans.”
Authorities arrested Moyo in the capital, Harare, on May 26 and charged him with violating Section 36 of Zimbabwe’s <a aria-label="External link: Immigration Act" href="https://zimlii.org/zw/legislation/act/1979/18" rel="noopener" target="_blank">Immigration Act</a> by allegedly helping two New York Times journalists, Christina Goldbaum and Joao Silva, obtain false media accreditations.
If convicted, Moyo could face up to 10 years in jail, according to those reports.
Coltart said Moyo’s defense team planned to appeal to the High Court in Harare. said Angela Quintal, CPJ’s Africa program coordinator, in New York.

Angela Quintal, Committee to Protect Journalists’ Africa program coordinator, said in New York:
<blockquote>_Zimbabwean authorities should recognize that New York Times freelancer Jeffrey Moyo has not threatened the country’s national security, and should not contest his appeal for bail._
_It is only because of Zimbabwean authorities’ paranoia about international media coverage that Moyo is facing up to a decade in jail on spurious charges._</blockquote>
In an emailed statement to CPJ, New York Times spokesperson Danielle Rhoades Ha said the paper was deeply disappointed by the magistrate’s decision and urged the High Court to grant Moyo bail.

New York Times Journalist "A Threat To National Security" - Court

Journalist Jeffrey Moyo was on Monday denied bail for the second time when he appeared before a Bulawayo magistrate.
Moyo, a freelancer for the New York Times, spent the past seven days in jail and has been remanded in custody to 10 June at Bulawayo Prison.
He was arrested last Wednesday for allegedly contravening Section 36 of the Immigration Act through assisting two South African-based New York Times journalists Joao Silva and Christina Goldbaum to fraudulently acquire media accreditation cards.
He is also accused of conniving with Zimbabwe Media Commission (ZMC) employee, Thabang Manhika in committing the offence.
He denies the charge against him.
New York Times spokesperson Nicole Taylor, in a statement emailed to <a href="https://cpj.org/2021/05/zimbabwe-detains-ny-times-freelancer-jeffrey-moyo-over-alleged-accreditation-misrepresentation/" rel="noopener" target="_blank">Committee to Protect Journalists (CPJ)</a>, said:
<blockquote>We are deeply concerned by Jeffrey Moyo’s arrest and are assisting his lawyers to secure his timely release. Jeffrey is a widely respected journalist with many years of reporting experience in Zimbabwe and his detainment raises troubling questions about the state of press freedom in Zimbabwe.</blockquote>
Silva and Goldbaum were deported back to South Africa.
Moyo was represented by Doug Coltart.

<li dir="auto">Prior to their arrival the two individuals as per legal requirement for foreign journalists had applied for clearance to work in the country but the responsible authorities had denied their application. However, the two had proceeded to come to the country anyway.</li>
<li dir="auto">The presentation of forged accreditation cards only added to the irregularity of alleged illegal entry.</li>
<li dir="auto">The ZMC staffer implicated in the illegality is currently helping law enforcement authorities with investigations and has been sent on leave to enable investigations to establish all the facts.</li>

The Commission does its work in a transparent and accountable manner. The fact that the fraudulent accreditation cards were quickly identified by immigration officers and confirmed as fraudulent by the ZMC is testimony of the professional and secure manner in which the ZMC conducts the accreditation.</div>

ZMC Responds To Deportation Of New York Times Reporters

The Secretary of Information in Zimbabwe, Nick Mangwana has said press freedom rights have been waivered for New York Times journalist, Jeffrey Moyo who was arrested on allegations of facilitating an unlawful reporting trip for two foreign journalists from the US-based newspaper.
Moyo was arrested in Harare on Wednesday and charged with violating the Immigration Act after allegedly presenting false information to authorities to help his colleagues into the country.

His arrest has resulted in many stakeholders calling for the immediate release of the journalist while The New York Times said on Friday it was “deeply concerned” over the arrest of its Zimbabwe correspondent. Responding to calls for the journalist’s freedom, Mangwana said:
<blockquote>_If a Zimbabwean journalist gets involved in people smuggling and or the corrupting of officials through payment of bribery &amp; they are arrested, there are no Press Freedom issues there. The law is blind to how you earn your living._</blockquote>
Moyo, 37, is also accused of securing fake accreditation cards for his colleagues from the Zimbabwe Media Commission (ZMC) after conniving with an official from the regulatory body Thabang Farai Manhika, who is also in custody. Speaking on the arrest of its Zimbabwean correspondent, The Times said:
<blockquote>_We are deeply concerned by Jeffrey Moyo’s arrest and are assisting his lawyers to secure his timely release,” The Times said in a statement._

Moyo and Manhika appeared before Bulawayo magistrate Rachel Mukanga for a bail hearing on Friday with prosecutors arguing that they were not eligible for bond as they had breached national security.
The two visiting New York Times reporters Christina Goldbaum and João Silva were ordered out of the country four days into their trip after flying into Bulawayo on May 5 to report on the situation in Zimbabwe.
Authorities told them that their accreditation credentials had been obtained without approval from the information ministry.
Moyo’s lawyer Douglas Coltart complained in court that his client had been subjected to inhumane conditions at Bulawayo Central Police station where he was thrown into a crowded and stinking cell with 18 other detainees.
He had been stripped of warm clothes and left at the mercy of frigid temperatures, Coltart said.

The Committee to Protect Journalists, a New York-based advocacy group, accused Zimbabwe of continuously violating the right to press freedom and the public’s right to know, and called for Moyo’s immediate release.
Moyo, who is based in Harare and has a wife and 8-year-old son, has also done work for a number of other news outlets, including The Globe and Mail of Canada.
