The National Prosecuting Authority (NPA) says it will appeal the decision of the High Court to acquit Citizens Coalition for Change (CCC) activists Joanna Mamombe and Cecilia Chimbiri who were being accused of falsely accusing the state of abducting and torturing them back in 2020.
Mamombe and Chimbiri, who were initially charged with fellow party activist Netsai Marova who skipped the country over alleged persecution, were accused of faking their abduction to soil the government’s image.
They were accused of publishing falsehoods.
In a statement released on Wednesday, 05 July, the NPA said it will appeal Harare High Court judge, Priscilla Munangati Manongwa’s decision to acquit the duo.
The NPA said the judge erred in reaching the not guilty verdict. Reads the statement:

The State will be appealing the decision of the High Court in the case of Joana Mamombe and Cecelia Revai Chimbiri versus the Chief Magistrate F Mushure NO and the State The State is of the considered view that the judgment is defective for want of compliance with the High Court Act (Chap 7:06) as well as precedent which provides that another Judge must concur with the presiding Judge before the judgment is handed down.
The State is also contending that the Judge grossly misdirected herself by interfering with the unterminated proceedings from the lower court as the termination of proceedings in this case was unjustified.
Furthermore, the State is certain that another court presented with the same facts might come to a different conclusion.

In her ruling, Justice Manongwa said the state case was full of “malice and falsehoods” in its pursuit of the case.

NPA Says Will Appeal Mamombe, Chimbiri Acquittal

Prosecutor Micheal Reza has indicated that he wants 2 government doctors to examine MDC Alliance Legislator Joanna Momombe who has been described as unstable and experiencing sleeping problems, palpitations, fatigue and anxiety disorder and taking sleeping tablets as part of her treatment, The Herald reports. This was revealed by her doctor Dr Fungisai Mazhandu who testified in court and revealed that she attended to her.
The state, led by Micheal Reza has notified Mamombe’s lawyers that they want Mamombe to be examined by 2 government doctors. Reza argued that:

Dr Mazhandu said another doctor may reach another finding since the symptoms do not necessary point to mental, but also physical condition.
This court is allowed at law that accused be examined by two medical practitioners to determine whether she is suffering from mental illness so that she can be treated or is not suffering at all. That can only happen when two Government doctors examine her and present their findings to court

Reza has also said there is evidence that Mamombe who was alleged to be sick on 4 September was in fact caught on CCTV shopping in Harare. Mamombe was discharged from hospital by police officers after a warrant of her arrest was issued for her after she failed to appear in court.

Mamombe Should Be Examined By 2 Government Doctors - State

Investigation Officers have reportedly found evidence that MDC Alliance legislator Joanna Mamombe was faking her illness, The Herald reports. The matter came to light in court where the state led by Micheal Reza said it was in possession of video evidence that suggests that Mamombe who was reportedly caught on CCTV was shopping on the day she is said to have been sick.
Reza told the court that:
<blockquote>The State wishes to make an application in terms of Section 26 of the Mental Health Act. Last night, I was advised by the investigating officer that they have come with evidence which seems to suggest she might not be suffering from the illness revealed in court.
The evidence is on a CCTV footage and the investigating officer has downloaded the evidence on a flash disc. On the video, it shows that she was perfectly functioning and performing her normal duties and it was taken on September 4 when she was supposed to be at hospital. She was shopping,</blockquote>

Joanna Was Shopping On The Day She Was Alleged To Be Hospitalised - Prosecutor

MDC Alliance MP Joanna Mamombe was on Tuesday afternoon forcibly discharged from hospital by eight anti-riot police officers, after a provisional warrant for her arrest had been issued by a Harare magistrate earlier in the day.
The warrant of arrest was issued against her for failure to appear in court notwithstanding representations by her lawyers that she is in hospital. Her part said in a statement:
<blockquote>Police have stormed the hospital where Joana Mamombe is receiving treatment. They are taking her away. A warrant of arrest was issued against her for failure to appear in court notwithstanding representations by her lawyers that she is in hospital.</blockquote>
Mamombe’s lawyer Alec Muchadehama told Harare magistrate Bianca Makwande that she failed to attend court, as she was admitted at a health centre in Harare.
Mamombe and two other MDC-Alliance members, Cecilia Chimbiri and Netsai Marova are facing allegations of faking their abductions.

Police 'Discharge' Joanna Mamombe From Hospital

A Harare magistrate on Tuesday issued an arrest warrant for MDC Alliance MP Joana Mamombe after she failed to attend court for trial.
The Harare West MP is being jointly charged with other MDC-Alliance members, Cecelia Chimbiri and Netsai Marova on allegations of faking their abductions.
Their lawyer Alec Muchadehama told Harare magistrate Bianca Makwande that Mamombe failed to attend court, as she was admitted at a health centre in Harare.
Mamombe reportedly collapsed last Friday due to traumatic stress following her abduction, torture, arrest and imprisonment.
The three MDC-A activists were allegedly seized from policy custody by armed men on 13 May after a flash demonstration in Harare, tortured and sexually abused before they were dumped two days later.
They were re-arrested on accusations of faking the abductions.

Warrant Of Arrest Issued For Mamombe

The Zimbabwe Peace Project (ZPP) has condemned a State-owned daily publication for alleged invasion of privacy and right to worship of three MDC Alliance (MDC-A) activists, Joanna Mamombe, Netsai Marova and Cecilia Chimbiri over its report claiming that the trio visited an Apostolic Sect shrine on 1 September this year.
In a statement posted on its social media channels, ZPP on Friday said the pictures used in the story by The Herald date back to 2016. ZPP said:
<blockquote>ZPP notes with great exception the sustained invasion of privacy [and] right to worship of 3 [MDC Alliance] leaders. ZPP has established the images used by [The Herald] to claim [Joana Mamombe], [Netsai Marova] and [Cecilia Chimbiri] were at an apostolic shrine recently, date back to 2016.
Such abuse of media privilege and deliberate targeting of women politicians raise great concern over the safety of all women who stand up to utilise their right to participate in opposition politics.</blockquote>
In the <a href="https://www.herald.co.zw/mdc-a-trio-turns-to-prophets/" rel="noopener noreferrer" target="_blank">article</a>, The Herald claimed that the MDC-A trio visited an apostolic sect leader, Madzimai Memory of Hatfield, Harare, who is allegedly famous among criminals and fugitives as she is said to possess spiritual powers that can make a serious crime collapse at the courts.

ZPP Condemns The Violation Of MDC Trio's Right To Privacy & Worship

The High Court has granted bail to the three MDC Alliance Youth Assembly leaders who are facing charges of faking their own abduction after it upheld their appeal against the ruling by the Magistrates Court.
The three are Harare West Member of Parliament Johana Mamombe, Cecilia Chimbiri and Netsai Marova. They are being accused of lying to the police about being abducted by state security agents.
The three were granted $10 000 bail each coupled with stringent conditions. They were ordered to report to the police three times a week, hand in their passports, not interfere with witnesses, reside at given addresses, and not to communicate with media including social media in connection with their case.
High Court Judge Justice David Foroma ruled that bail had been improperly denied by the Magistrates Court. He said:
<blockquote>In the circumstances, the exercise of the court a quo’s discretion denying the appellants bail pending trial was improperly impugned. The appeal accordingly succeeds.</blockquote>
Speaking after Justice Foroma had made the ruling, MDC Alliance spokesperson Fadzayi Mahere said the party was grateful that that justice had been served. She said:
<blockquote>As a political party, we are most grateful. Bail is a Constitutional right; we believe we have been vindicated. For women who were abducted, tortured for them to be jailed for a period of over two weeks in the manner that they were, was to turn justice on its head.</blockquote>

Mamombe, MDC-A Activists Granted $10 000 Bail Each

MDC Alliance youth assembly officials – Joana Mamombe, Cecilia Chimbiri and Netsai Marova – were on Monday denied bail by Harare regional magistrate Bianca Makwande. They were remanded to June 26.
The three are accused of stage-managing their abduction from the time they staged a demonstration in Warren Park on May 13th to May 15th when they were found by their lawyers and police at Muchapondwa Business Centre in Bindura.
The three notified the state of their intention to challenge their placement on remand on the next court date.
In denying the bail application, the state argued that there was overwhelming evidence that the trio could abscond trial. She said:
<blockquote>The state argued that the three committed a very serious offence and are likely to flee if granted bail. The police also said they are yet to establish the accused’s real addresses since they gave different addresses, adding further that investigations were to be completed in 14 days.
“The accused vehemently denied the allegations and feel they are good candidates for bail, and that the investigating officer’s evidence was too comical for a court to accept that. They asserted that the charges are nonsensical.
“The court is of the view that the state’s opposition of bail in respect of propensity to commit a similar offence is acceptable. It is highly likely that if convicted, they will be given a stiff custodial sentence which may induce them to skip bail.”</blockquote>
Meanwhile, MDC Alliance spokesperson Fadzayi Mahere has lamented the continued incarceration of the trio. She said:
<blockquote>My heart breaks for these women. Bail denied. They are in jail for reporting their torture to the police. Where is police protection? Where is the safety? Where is the conscience of this nation?</blockquote>

Abducted MDC Alliance Officials Denied Bail

The State ordered three hospitalised MDC Alliance activists to wear female prison garb while lying on their beds when the magistrate court convened at the hospital earlier this week.
In a statement, the party’s Welfare Department said nine prison guards were stationed in the trio’s ward and this could create conditions for re-traumatisation. The statement read:
<blockquote>After the magistrate court convened at the hospital, #MDCA3 were put under heavy guard with 9 prison guards in their ward.
They were also made to wear the female prisons green dress and the #njema jersey.
State’s inconsiderate actions are creating conditions for re-traumatisation.</blockquote>
The activists, Harare West MP Joana Mamombe, Cecilia Chimbiri and Netsai Marova were granted $1 000 bail each by a Harare magistrate at their hospital beds on Thursday.
They were charged with contravening lockdown regulations by engaging in an illegal demonstration on 13 May 2020.
The three were seized by gunmen at a police roadblock while coming from the demonstration in Warren Park, Harare and physically and s_xually assaulted by suspected State agents two weeks ago.

The Zimbabwe Lawyers for Human Rights (ZLHR) has demanded that police detectives and other state security agents who have inundated a private hospital facility where three MDC Alliance (MDA) activists are admitted should leave immediately.
ZLHR lawyers, who are representing Harare West MP Joana Mamombe, Cecilia Chimbiri and Netsai Marova, are concerned over over their clients’ safety and threatened to take the matter to court.
In a letter dated 29 May 2020 and directed to the officer-in-charge, CID Harare, ZLHR director Roselyn Hanzi said:
<blockquote>We have been advised that the police officers in uniform and civilian clothes and other suspicious-looking people in civilian clothes who look and act like State security agents and who have not identified themselves to our clients or to us as the legal representatives have continued to have a domineering presence at the hospital where our clients are receiving treatment following their abduction, enforced disappearance and torture on May 13-14 2020.
… It is our considered view that the presence of your teams, including those who have been armed to the teeth, is now breeding mayhem and confusion at the hospital.
In the event that the police officers in uniform or otherwise, are not withdrawn within one hour of receiving this letter, we will approach the courts to assert the rights of our clients. We will also be claiming costs de bonis propris against yourself.</blockquote>

Security Agents 'Armed To The Teeth' Watching Hospitalised MDCA Trio

Justice minister Ziyambi Ziyambi said that the three MDC Alliance officials who were allegedly abducted by unknown assailants and assaulted in Bindura last week staged the abduction and should be arrested for violating the national lockdown.
Ziyambi told the Daily News that the three women – Harare West MP Joanna Mamombe, Cecilia Chimbiri and Netsai Marova — are feigning s_xual assault and should be treated as lawbreakers. Said Ziyambi:
<blockquote>They are trying to run away from the fact they broke the law by undertaking the demonstration, contrary to the declaration made under the current lockdown, which bans all public gatherings.
They are now faking abduction and going to the hospital in their futile bid. The fact remains that they broke the law by undertaking the demonstration.
So, their diversionary tactics will not work. The police must arrest them and bring them to book.
I am very sure that the police will do their job to ensure that the organisers of the demonstration face the consequences of their actions.</blockquote>
The three MDC Alliance activists disappeared last week on Wednesday after participating in a flash demonstration in Harare’s high-density suburb of Warren Park.
The trio reappeared on Friday and alleged that they were seized by gunmen from Harare Central Police Station and taken to Bindura were they were assaulted s_xually, physically and emotionally.

"Mamombe And Other Party Members Found In Bad Shape," - MDC

There has been a fresh twist in the arrest/enforced disappearance of MDC secretary for policy and Harare West legislator Joanna Mamombe, youth assembly vice-chairperson Cecilia Chimbiri and deputy organising secretary Netsai Marowa by police in Harare on Wednesday.
National police spokesperson Paul Nyathi confirmed that the trio was arrested for holding an unsanctioned demonstration in Warren Park suburb.
However, on Thursday, MDC Alliance Secretary for Welfare Maureen Kademaunga visited Harare Central Police with their lawyers but the Officer In Charge insisted that they never arrested the trio.
Speaking to the Daily News on Wednesday, Ass Comm. Nyathi promised to give more details following the arrest of the trio. He said:
<blockquote>There was an unsanctioned demonstration that took place in Warren Park. Police are still conducting some investigations over the matter.
Yes, there are some people who have been picked up over the demo, but we will give finer details later.
People should desist from engaging in illegal activities such as unsanctioned demonstrations, especially this time when the nation is fighting the coronavirus.</blockquote>
Meanwhile, the British Embassy in Harare has urged Zimbabwean authorities to locate the missing activists and for the security services to act in line with the national Constitution.

New Twist In The Arrest Of MDC Alliance Activists

Harare West Member of Parliament Joanna Mamombe has criticised Finance and Economic Development Minister Mthuli Ncube for his alleged failure to come up with a clear programme of identifying and assisting vulnerable people.
Mamombe said it is pointless for Ncube to talk of some “complicated algorithms” and using cellphone numbers to identify the vulnerable as this will overlook people without phones. Said Mamombe:
<blockquote>It’s unfortunate that at this critical time when we are having a crisis not only as Zimbabwe but the entire world that a Minister of Finance can talk of some complicated logarithms.
If you are going to use mobile phone numbers to identify the vulnerable, what about those without mobile phones? It is really unfair.</blockquote>
The government recently has announced it will be assisting one million vulnerable families with ZWL$180.00 a month using a database lifted from mobile phone service providers’ users.
Using current parallel market exchange rates, ZWL$180.00 is less than US$5.00 and is not enough to buy a bag of potatoes.

MDC Harare West MP Joana Mamombe was on Tuesday targeted for sexual harassment by some unidentified Zanu PF legislators when she appeared in Parliament after her arrest on treason charges.
The ZANU PF legislators shouted hur* (prostitute) when Mamombe returned to the August House.
Norton Member of Parliament, Temba Mliswa was not happy with the behaviour exhibited by ZANU PF MPs. Said Mliswa:
<blockquote>It is important for us to have a human face and I think the lack of human face talks about our inhumane attributes in us.
I think the issue of one having been incarcerated and being freed is something that I think is human.
For some of you (Zanu PF MPs), you are the ones who incarcerate, so we also understand. Some of us have been incarcerated.
My point of order is that there is no smoke without fire. So when you see them heckling, they are the biggest human rights violators.</blockquote>
Mamombe was arrested in Nyanga more than a week ago soon after attending a Parliament workshop.
The 25-year-old MP was subsequently charged with treason in relation to the fuel riots which broke out in the middle of January this year.

ZANU PF MPs Heckle Mamombe, Call Her A Prostitute

Joanna Mamombe’s mother, Kudzai Chiwanza broke down after a Harare magistrate remanded in custody her daughter to the 19th of March.
Mamombe was arrested in Nyanga on Saturday and brought to Harare the same day. She has since been charged with attempting to subvert a constitutionally elected government.
In an interview with 263Chat, Mamombe’s mother said:
<blockquote>When I came to court I expected positive results for my daughter but it’s unfortunate that after all the testimonies from Joanah and all the arguments from her lawyers I came in high spirit telling myself surely my daughter was unlawfully brought before the court.
So, I was going home with my daughter but I broke down because I did not expect the magistrate’s ruling that it would remand her again until the 19th of March.
… I will be strong for her I know, she is also strong but she did not think this will take longer. Over the weekend she was in jovial mood consoling me and encouraging me to be strong saying mama I am fine I will be out soon.
But today I have seen it that my daughter’s life is being shattered down. Is it because she entered into politics while she is young or is it because she is influential I don’t know? I will just pray to God because it’s hard for me.
For now, I am pleading for prayers because I myself I can’t even pray sometimes. Joanna has been a peaceful and a happy person and has never fought anyone but surprisingly she is charged with treason.</blockquote>
Some reports indicate that with the possible exception of human rights advocate Jestina Mukoko, Mamombe is the first Zimbabwean woman to be charged with treason since Mbuya Nehanda at the end of the First Chimurenga/Umvukela.

MDC MP Joanna Mamombe had her application for refusal of remand rejected by a Harare magistrate on Tuesday morning. A ZimLive reports read as follows:

The court ruled she was brought to court on time, only that the court was overwhelmed with other cases; arrest lawful and reasonable suspicion she committed the offence.</blockquote>
She has been remanded in custody to 19 March as the magistrate insisted that even though the state witness was not eloquent, she was still convinced that there is reasonable suspicion that she committed a crime. Lawyers are now proceeding with bail application at High Court.
Mamombe was arrested on Saturday in Nyanga where she was attending a Parliamentary workshop. She is facing treason charges.

<h4>Hon Mamombe’s trial a case for Criminal Justice Reform</h4>
Law enforcement has been captured by very dangerous people who are neither police officers nor understand how the Zimbabwe Republic Police operate.
A man named Muroyiwa appeared before the court today testifying that he was the arresting officer responsible for the apprehension of Hon Joanna Mamombe, during cross-examination the following issues were revealed.
I. That the man was not from CID Law and Order Section and neither was he a police officer.
II. That the bunch of people who followed Hon Mamombe at the parliamentary meeting in Nyanga failed to identify themselves, today Muroyiwa produced a defaced police identity card which by his admission could not ascertain his identity. He told the court that there was an impending program to give individuals such as him new ZRP identity cards.
III. Muroyiwa failed to name a single case he dealt with prior to arresting Hon Mamombe in his 3 years of claimed Law and Order service and 7 years of total ZRP service.
IV. Muroiwa also failed to name departments within the Law and Order section
V. He also failed to identify the senior leaders of the Law and Order section
VI. That Muroyiwa has failed to inform Hon Mamombe of the reason of her arrest and her rights.
VII. That Muroyiwa only arrested the Hon MP without ascertaining reasonable suspicion that a crime had been committed, he was not even aware of the words that she uttered at a press conference which constituted an offence.
VIII. More dangerously, Muroyiwa confirmed that he was part of the group which broke into the home of Hon Mamombe’s mother knowing very well that it was not hon Mamombe’s place of residence.
IX. That Hon Mamombe had been detained for over 48 hrs before appearing before a competent court of law as required by the Constitution.
Overall the MDC finds the conduct of the police in handling this matter to be shocking and unacceptable in a democratic society.
Their papers highlight that encouraging people to hold “a peaceful march” and “dressing in black” formed the basis for subverting a constitutionally elected government.
During the hearing, the “officers” who took the witness stand contradicted each other, changed their statements and even produced different versions of the same affidavit.
We find this behaviour to be in contradiction to the conduct of members of the security forces set out in section 208 of the Constitution.
More importantly, the police blatantly violated the supreme law which states that “The police must be non-partisan, national in character, patriotic…”
It is clear that the police has been used to pursue partisan objectives, persecuting members of the people’s party and their families.
The MDC calls for the establishment of the independent complains mechanism set out in section 210 of the constitution.
Hon Mamombe will be back in court on the 5th of March 2019 for a ruling on an application against remand.
Several members of the MDC Parliamentary Caucus attended the proceedings including Hon Happymore Chidziva, Hon Lynnette Karenyi, Hon Prosper Mutseyami, Hon Buda Masara, Hon Regai Tsunga and Hon Starman Chamisa.
