In an unfortunate incident reported by a Sunday Mail reporter, the Chikwanha family which includes Bulawayo Businessman Martin Chikwanha and Judicial Service Commission Secretary (JSC) Mr Walter Chikwanha lost both their parents to suspected COVID-19 last month The Sunday Mail reports.
Mr and Mrs Chikwanha reportedly died 3 days apart and it is believed they contracted the disease at a family event in Mutare. According to the publication, Mrs Chikwanha died just after the burial of her husband.
Meanwhile, Bulawayo City is investigating <a href="https://news.pindula.co.zw/2020/08/02/city-of-bulawayo-investigating-claims-that-a-dozen-people-tested-positive-for-covid-19-after-attending-a-lavish-party-in-the-city/">a gathering that resulted in a dozen people testing positive for COVID-19 after attending a lavish party in the city</a>. Gatherings of more than 50 people are still prohibited by the government but local transmission cases have surged with Zimbabwe recording 485 local transmission cases yesterday.

JSC's Secretary's Parents Succumbs To COVID-19 - Report

The Judicial Service Commission (JSC) is reportedly acquiring PPE for its workers as they have announced that courts will be fully operational starting Monday 11 May 2020, The Chronicle reports.
This was revealed by the Chief Justice Luke Malaba who said this to the publication:
<blockquote>Following the proclamation on 1 May 2020 by His Excellency, the President that the country is moving into level two lockdown from 4 May 2020, these directions are issued to guide court operations during the level two lockdown period. For the purposes of implementing the measures introduced under level two lockdown, practice direction number 1 of 2020 as amended shall remain effective until the 10th of May 2020.
Accused persons automatically remanded to dates between 4 May 2020 and 8 May 2020 under practice direction 2 of 2020, will be remanded by the courts to dates after 11 May 2020. All courts shall become operational with effect from May 11</blockquote>
However, the solemnisation of marriages will only begin after the lockdown. The courts during the lockdown have been attending to urgent matters only.

Courts To Resume Operations With Effect From 11 May 2020

The opposition MDC led by Nelson Chamisa has accused the Zimbabwe Republic Police of being double-faced after they allegedly blocked MDC demonstrations at the same time assisting the ruling ZANU PF in organising its events.
The accusations were made by MDC youths who yesterday stormed into the Harare Magistrates Court with tape covering their mouths to show dissent to “State-assisted closure of democratic space”.
Gift Ostallos Siziba, the MDC Youth Assembly Spokesperson, who was leading about twenty youths spoke to News Day and said that the party was not happy with the bans on its demonstrations. He also expressed displeasure in the judiciary system which he accused of taking forever to deliver justice. Siziba said:
<blockquote>They staged their anti-sanctions demonstration (on October 25) without even as much notifying the police. They are doing these demonstrations countrywide, including rallies, and in most cases, you actually see police organising these events on behalf of the (Zanu PF) party. We are arrested, beaten and jailed. This is unconstitutional and unacceptable.</blockquote>
His remarks come after the police have blocked over thirteen MDC demonstrations in August and September alone and have also violently dispersed MDC supporters in the event that they would have managed to gather.

MDC Accuses Police Of "Personally Organising ZANU PF Rallies Whilst Blocking MDC Demos"

Magistrate Tawanda Muchemwa who was dismissed by the Judicial Service Commission (JSC) has approached the Labour Court challenging his dismissal.
Muchemwa was dismissed in July for misconduct after he had allegedly failed to respond to his superiors’ correspondence, failed to check registers and record movement. Muchemwa was also accused of absenting himself from duty without official leave, insubordination and failure to comply with the Chief Magistrate’s instructions.
In his notice of appeal at the Bulawayo Labour Court through his lawyer Mr Mclean Mahaso of Tanaka Law Chambers, Muchemwa said that the disciplinary hearing that presided over his matter did not present evidence to substantiate the allegations. He said:
<blockquote>The disciplinary authority grossly misdirected itself by holding that the appellant had failed to obey a lawful instruction from the Chief Magistrate when there was no evidence to sustain and convincingly motivate such a position. The disciplinary authority grossly misdirected itself by holding that the appellant had neglected to carry out his duties when there was no evidence to sustain such a finding.</blockquote>
Muchemwa contends that the ruling failed to meet the justice of the case hence the need to replace it with a written warning.

Fired Magistrate Challenges Dismissal

Judicial Services Commission (JSC) secretary Walter Chikwana told The Sunday Mail that they have started building new courts in Mt Darwin, Lupane and Chinhoyi.
Construction of the new courtrooms is expected to be completed by the end of this year. Said Chikwana:
<blockquote>As the Chief Justice (Luke Malaba) has mentioned before, 233 people were recruited. This number included 60 magistrates; (consequently) the courts that had been closed have been reopened. We have also started building new courts in Mt Darwin, Lupane and Chinhoyi. In Mt Darwin, we have started; in Chinhoyi, we are at roof level and (in) Lupane, we have started the pre-construction preparations</blockquote>

Judicial Service Commission (JSC) secretary Mr Walter Chikwana confirmed senior Masvingo magistrate Peter Madhibha’s dismissal for gross incompetence, among other reasons. He had served as magistrate for 17 years.
Masvingo Provincial Magistrate Mr Langton Ndokera said Masvingo now has 18 magistrates following Madhibha’s departure. Chikwana said Madhibha was fired after appearing before a JSC disciplinary committee. Madhibha was found guilty of contravening the Commission’s Regulations of 2015 that demands high levels of competence on the part of court officials. He was served with his letter of dismissal last week. Madhibha was found guilty of passing non-custodial and lenient sentences for some offences that would under normal circumstances warrant stiffer penalties.
Madhibha also failed to satisfactorily respond to queries raised by Masvingo resident High Court Judges, Justices Garainesu Mawadze and Joseph Mafusire during their review of a case he handled. The case involved the State versus Ernest Chifumuro (Case: MSVP 549/18). Madhibha ordered Chifumuro to just pay a fine of $1 000 after convicting him of culpable homicide. Chifumuro was convicted after a bus he was driving caused the death of six people along the Masvingo-Beitbridge highway. Madhibha should have slapped Chifumuro with a custodial sentence considering the circumstances surrounding the fatal crash.

Senior Masvingo Magistrate Fired For Gross Incompetence

In an interview with The Herald, Secretary for Justice, Legal and Parliamentary Affairs Mrs Virginia Mabhiza said the Judicial Service Commission (JSC) is expected to advertise the vacancy for the Prosecutor-General position.
Mabhiza said JSC can now advertise the vacancy following the publication of the resignation of Prosecutor-General Advocate Ray Goba in the Government Gazette on Friday. After JSC conducts interviews it will forward the names of the best candidates to the Presidium for appointment. Said Mabhiza:
<blockquote>The resignation has been confirmed and in terms of the law, the procedure of selecting a new PG must now commence. The ball is now in JSC’s court and it must now advertise the vacancy, inviting nominations. The candidates will be subjected to public interviews from where the best candidates will be selected and the names forwarded to the Presidium for appointment.</blockquote>
The two previous Prosecutor- Generals having been fired for misconduct. The acting Prosecutor-General Kumbirai Hodzi had been Deputy Attorney-General in charge of the Legal Advice Section since 2012.

Mnangagwa Set To Appoint New Prosecutor-General

The Judicial Services Commission (JSC) is looking to fill vacancies for 30 Magistrates who will be based in across Zimbabwe. In a notice, the JSC said,
<blockquote>Applications are invited from suitably qualified and experienced persons to fill the positions of MAGISTRATE which have arisen within the Judicial Service Commission. The Commission is a dynamic organization that comprises of competent and professional staff. The vacancies to be filled are around Zimbabwe.
KEY DUTIES AND RESPONSIBILITIES
The key roles and responsibilities of a Magistrate are to: 
a) Preside over criminal cases, civil cases, maintenance inquiries, juvenile court cases and claims in the Small Claims Court
b) Assesses the propriety of deposit fines
c) Act as a Marriage Officer
d) Preside over appeals from Local Courts
e) Inspect Prisons and other holding cells as a visiting justice
f) Conduct inquests into sudden deaths p,) Supervise support staff
THE PERSON
a) Must be a holder of a good law degree or equivalent legal qualification from a recognized university 
b) Be a fit and proper person for appointment to judicial office
Former magistrates who resigned with clean disciplinary records and wish to be considered for appointment are encouraged to apply.
In selecting the appropriate candidates, the Judicial Service Commission will endeavour to comply with section 184 of the Constitution which requires judicial appointments to reflect broadly the diversity and gender composition of Zimbabwe.
