Constitutional lawyer, Professor Lovemore Madhuku and member of the Political Actors Dialogue (POLAD) forum has said that the government needs to withdraw the constitutional bill in Parliament.
Speaking to News Day, Madhuku said that the subcommittee he chairs which was mandated with evaluating the Bill made a thorough analysis of the Bill and observed that most of the things in it are not acceptable. He said:
<blockquote>We have taken a two-stage approach and we are calling on the government to withdraw the Constitutional Bill in Parliament and this is what we are going to be recommending to our plenary…
What we did is we went into that Bill clause by clause and some things would be acceptable while some are not acceptable. We looked if there were good ideas in the Bill and on balance we found that most of the things are not acceptable and we completely rejected the Bill.</blockquote>
These remarks are a clear departure from those Madhuku reportedly said earlier. A state-run paper, <a href="https://news.pindula.co.zw/2020/01/31/proposed-constitutional-amendments-get-the-nod-from-polad/">The Chronicle yesterday</a> quoted Madhuku as having said:
<blockquote>There were people who were feeling that clause is a dangerous clause as a person who is a running mate and waiting to become President may actually harm the existing President. It creates instability, because if you know that I’m going to be the next President and it’s guaranteed by the Constitution it tends to create problems.</blockquote>
Conclusions from the remarks above were that POLAD had given the nod to proposed amendments.

"We're Calling On The Government To Withdraw The Constitutional Bill In Parliament," POLAD

Zimbabwe’s Justice Minister, Ziyambi Ziyambi has reminded members of the Political Actors Dialogue (POLAD) forum that they cannot be consulted on policy issues nor can they direct government on such matters since they are not an arm of the government.
Ziyambi’s remarks come when members of POLAD are expressing displeasure after the government gazetted the Constitutional amendment bill which they say needed input from all stakeholders first. Ziyambi responded:
<blockquote>We are shocked that they want to stop a process which is allowed by the country’s laws, they want us to sit down and consult them, yes they are in POLAD but if you check with Bills we don’t take them to POLAD
They are trying to make POLAD an arm of government, if they have their views and ideas they can discuss them there and then they are brought to Cabinet and discussed then they become policy, but that we as government to go to them to ask them on laws, policies or budgets as they want us to do, that would mean we have lost the mandate that we were given by the people to rule.</blockquote>
He added that if POLAD members have concerns, they can channel them through proper channels including the clerk of parliament.

Justice Minister Reminds POLAD Members That They're "Not An Arm Of Government"

The opposition MDC led by advocate Nelson Chamisa has, in its bid to reverse the High Court ruling which nullified Chamisa’s presidency, added an affidavit purportedly by the late party founding father, Morgan Tsvangirai.
The appeal at the Supreme Court comes after the High Court in May this year <a href="https://news.pindula.co.zw/2019/05/08/high-court-rules-that-chamisa-is-illegitimate-mdc-president/">ruled that Chamisa was not the legitimate MDC leader</a>.
In their application for rectification of the appeal record, legal counsel, Tafadzwa Chagonda said the application was incomplete. The application read:
<blockquote>On May 8, this year the High Court handed a judgment against the applicants who subsequently prepared a notice of appeal making reference to earlier High Court judgement which was in favour of the applicants.
The Registrar prepared the record and the applicants were called to inspected and certified on June 19, this year. The last party inspected and certified the record on July 25, this year. Thereafter, the record was forwarded to the Registrar of the Supreme Court. On July 17, the Registrar directed the applicants to file their heads of argument.
This is when the legal counsel noticed that the certified record was incomplete. The affidavit which is critical to the resolution of the matter had been omitted.</blockquote>
