Justice Minister <a href="https://www.pindula.co.zw/Ziyambi_Ziyambi" rel="noopener noreferrer" target="_blank">Ziyambi Ziyambi</a> said that the banning of MDC public meetings is not based on political instruction since the police are authorised to clear them or explain the reasons against the demonstration.
He was speaking to the Daily News following the violent police clampdown on MDC supporters and passersby in Central Harare on Wednesday. Said Ziyambi:
<blockquote>The law allows them [MDC] to negotiate with the regulatory authority [Police]. That’s the whole purpose to maintain peace and order.
People must not wake up one morning demonstrating and in the process affect other people’s rights.</blockquote>
Since August 16 this year, the police have banned most of the MDC’s planned demonstrations across the country.
Recently, police blocked the MDC from having rallies in Harare and Domboshava, and on Wednesday, party president <a href="https://www.pindula.co.zw/Nelson_Chamisa" rel="noopener noreferrer" target="_blank">Nelson Chamisa</a> was blocked from holding a gathering at Africa Unity Square.

A NewsDay report claims that the opposition MDC party is divided over the issue of staging demonstrations to force the government to address the worsening economic and social crises bedevilling the country.
The report cites an unnamed source who revealed that the party is now searching for a new direction following a spike in the cases of activists who have been abducted and tortured by masked gunmen. Said the source:
<blockquote>There is a desire to get a new direction for the party because the leadership is obviously worried about the abductions, torture and assaults.
There is a need to balance between getting results and appearing (not) to be the same as the regime that we are fighting. However, others want an all-out confrontation.</blockquote>
Former MDC spokesperson and current MDC-T vice president, Obert Gutu, told HStv that some senior MDC officials are now questioning the party’s strategy. He said:
<blockquote>Senior party members in the MDC are beginning to question the strategy being employed in the party. Some want him (party leader Nelson Chamisa) to join POLAD [Political Actors Dialogue] because dialogue is the only way. They want him off the streets, but he (Chamisa) is power hungry.</blockquote>
Gutu claimed to have talked to a senior MDC official who has long been advocating for dialogue but was branded a coward for speaking against protests.

MDC Deputy National Organiser, Hon Sibusisiwe B. Masara was n Thursday afternoon taken into custody at Harare central police station and will appear for a bail hearing on Friday at 9 am. Hon Masara was the deputy Convenor of the 16 August.
The party’s national organising secretary, Amos Chibaya was arrested last week for failing to stop a demonstration by MDC supporters in Harare on 16 August. He was released on bail.

MDC Senior Official, Sibusisiwe Masara Arrested

Permanent secretary in the Ministry of Information, Ndavaningi Nick Mangwana, said that the demonstrations which took place in January and August this year were acts of insurgency and banditry.
Responding to a question by NewsDay senior reporter Blessed Mhlanga if the government regrets the heavy-handed response to protests in Harare on August 16, Mangwana said:
<blockquote>When we say this is a New Dispensation we mean our approach to democracy is modern. But that is not saying we should compromise on national security.
National security is about the safety of a nation from threats such as internal insurgency, terrorism and economic sabotage, among others.
It is about the stability of the nation. So when people threaten to overthrow an administration outside the provisions of the Constitution, the State will protect the nation.
This is why you see certain countries have had controversial actions like “extraordinary renditions”, Guantanamo Bay and Abu Ghraib, etc. There are circumstances when national security trumps all else.
The government will always give space to all those who want to express their discontent or dissent within the confines of the law.
But violence like we saw in August 2018 and January 2019 has no place in a democracy. That is not a legitimate political expression.
That is urban insurgency and banditry. If the conveners of the protests work with law and order institutions to ensure the protection of life, limb and property, we will have demonstrations.
But surely they have to tell the police who their stewards are so they can be briefed by the police who are the experts at this.
But they completely refuse to work with the police indicating other motives. There is no price for guessing what their ulterior motive is because they have declared. They are too desperate for power and 2023 is way too far for them.</blockquote>

Movement for Democratic Change (MDC) leaders are brainstorming on what course of action to take to make the government listen to their grievances after police banned protests that were scheduled for Harare, Bulawayo and Gweru.
The party’s MDC Midlands provincial spokesperson, Takavafira Zhou said that there is a need for the party to change tactics going forward. He said:
<blockquote>We certainly need to change our strategy and tactics. Conducting a demonstration is one option that has left us vulnerable to the might of Zanu PF as it can concentrate its forces and cripple our quest for democratic expression through manipulation of the law, force or naked violence and thuggery.
Henceforth, we need to consider elements of diversion, surprise, spontaneity in various areas to guarantee success.
The cause of liberty should not be surrendered, even at the last moment of defeat. Defeat is just temporary, but giving up makes it permanent.</blockquote>
The MDC had planned a series of demonstrations in the country’s major urban centres to force the government to address the concerns of citizens.
However, police have so far banned protests that were planned for Harare, Bulawayo, Gweru and Masvingo.

MDC To Change Tactics And Strategy On Protests

The MDC chairperson, Thabitha Khumalo was on Saturday arrested alongside the party’s Bulawayo provincial women’s affairs chairperson Tendai Masotsha.
Police in Bulawayo alleged that the officials were trying to mobilise residents to participate in the demonstrations the party had planned to hold in the city this Monday.
Reports indicate that Ms Khumalo and her colleague were arrested in the city after they were found distributing T-shirts and conducting door to door mobilisations.
The duo was taken to the Bulawayo Central Police Station by officers from the Law and Order section where they are detained.
Ms Khumalo and Ms Masotsha will appear in court on Monday facing charges of communicating falsehoods or statements that are likely to be prejudicial to the state.

The Chamisa-led MDC will this Monday morning file an appeal against the Police order to ban their march in Bulawayo.
The party’s lawyers, Tanaka Law and Chambers in a notice to the Bulawayo Magistrates Court, wrote:
<blockquote>RE: NOTICE OF APPEAL AGAINST PROHIBITION ORDER
Reference is made to the above matter in terms of which we act for and on behalf of the Movement for Democratic Change Alliance Appellant herein.
We hereby file an appeal by the Movement for Democratic Change Alliance against the prohibition notice issued by the officer commanding Zimbabwe Republic Police Bulawayo Central Chief Superintendent Elizabeth Phiri.
It is our considered view that the aforementioned prohibition order flies in the face of the Constitution of Zimbabwe and cannot be sustained, hence the present appeal in terms of Section 27 B (2) of the Public Order and Security Act.
Such an appeal should be heard on an urgent basis and prior to the date of the proposed gathering, in this case, the impending demonstration of 19 August 2019…

MDC To Appeal Against Police Order To Ban Bulawayo Demo

<blockquote>MOST probably ensconced in the comfort of their homes, the violence mongering leaders of the opposition used their proxies to ignite chaos in the heart of Harare but that was never to be because the police who had gathered intelligence of the evil machinations were on top of the situation.
While I am no prophet, I know just as the sun will rise tomorrow that any attempts to reverse the will of the people, expressed unequivocally in last year elections will never be accepted, we have our next election in 2023, and until then-President Emmerson Mnangagwa remains our President.
Chamisa and his band of sore losers, whose recalcitrance is a stuff of legends should eat the chill-pill and move on because we have so many things to do yet so many distractions from all sorts of clowns who crave unnecessary attention especially whimpering adult man who believes they must be part of government even when the people rejected them
As we watched from the sidelines, a few inebriated MDC youths who had been sponsored to descend on Harare and stir up emotions, a melancholy feeling settled in, we asked among ourselves why are the leaders of the opposition so heartless, they call for demonstrations but when push comes to shove they drive to the safety of their homes and to use Thomas Hardy classic novel “Far from the Madding Crowd”.
I really felt sorry for the men and women who dared to cross the line and pushed the police to the limits because in the madness that was swiftly splashed on social media—I was being haunted by Chamisa’s own words that protestors are stupid, yes, the ambitious advocate cum pastor described his supporters as such just a year ago and it seems the would-be-demonstrators learnt nothing from that gaffe.
While the right to demonstrate is something enshrined in our Constitution, the law enforcement agents had good reason to believe that the MDC was spoiling for violent demonstrations, using their powers, the police prohibited the demonstrations.
A High Court judge also dismissed an application by the MDC to proceed with its demonstration but defying all logic and daring to take the bull by the horns MDC supporters were unleashed into the streets, fortunately for peace-loving Zimbabweans, the police were at hand to protect peace and also businesses.
All this happened as the cowards who lead the opposition were in the comfort of their homes or offices, drinking tea or coffee while the youth they had bought cheap drugs like nyaope challenged the police.
Can we locate Chamisa’s grievances and why he thinks (wrongfully) that demonstrations are his ticket to the power table, no authority is derived from people through elections, it is not derived through streets protests, that is a subject that lawyers or is it liars in the sinking ship that is the MDC should accept, embrace and move on.
In their infantile imaginations, fed by their handlers who are tinkling a few pieces of silver in order to subvert the will of the people, the opposition leaders think that they will trigger an Arab Spring revolution in the country even as they lack the masses to back that fantasy.
President Mnangagwa has extended his hand, he is talking to progressive opposition figures but like ostriches the likes of Chamisa have stuck their heads in the sand, they want to make noise but no one, not in Zimbabwe or outside is prepared to listen to the fictitious concoctions.
Zimbabwe is not on the brink, the economy is on a recovery path and it is the bitter medicine that ensures healing that we must take no matter how vile it is to the palate, the country is set to regain its lost lustre and that is one of the major reasons why Chamisa and his misfits would want to ensure they spoil the party and rock the boat.
As the leader of the Zanu PF youth league, I am comforted that we have a youth movement that is patriotic, a wing that is well informed and appreciate the headwinds and yet never lose focus of the goals, unfortunately, Chamisa, whose only weapon against Zanu PF is the economy knows that when the economy recovers he will be rendered useless and irrelevant, time is indeed running out for him.
We are also alive to the power struggles in the MDC and Chamisa’s desperation to fend off competition from the likes of Biti, the man he betrayed in 2014 in order to clear his path for the presidency.
Biti’s is breathing hard on Chamisa’s neck and the later is now behaving like a desperate slut, hitching skirts to grab the attention of donors and save his position which needs I say is a hot seat. All the prancing is to convince donors that he is still relevant.
From the above, it is as clear as daylight that Chamisa just wants to use and abuse people for his gain, he is living large yet he forces people to go on a rampage and disrupt everyday life. People should refuse to be used by such charlatans.
Another, disgraceful ending to so-called demonstrations that are nothing but a desperate bid to stir up emotions and trigger a bloodbath.
Kudos to our Government arms for protecting and maintaining peace. I salute the peace loving people of Zimbabwe for resisting these soldiers of fortune.
For those who were used as cannon fodder by some machonists in the opposition, it’s time to introspect and choose peace for the good of our Great Country.</blockquote>

The government has issued a statement explaining the reason why the Zimbabwe Republic Police (ZRP) issued a prohibition order against the opposition MDC’s planned peaceful protest on 16 August 2019.
Foreign Affairs and International Trade Minister Sibusiso Moyo, in a statement on Sunday, said that the inflammatory statements made by the MDC-A leadership coupled with the discovery of a weapons cache (catapults and granite stones), necessitated the ban of the planned march. Part of the statement reads:
<blockquote>On 15 August, in the wake of highly irresponsible and inflammatory statements made by the MDC-A leadership and on the basis of a weapons cache discovered a few days previously, the Zimbabwe Republic Police (ZRP), as the civil authority responsible for ensuring law and order, issued a prohibition order effectively denying legal authority for the demonstration to proceed the following day.
The prohibition order was communicated to the MDC-A well in time to enable them to advise their supporters that authorisation for the demonstration had been denied. Per their constitutional rights, the MDC-A appealed to the High Court seeking to overturn the civil authority’s prohibition order. In its wisdom, the High Court upheld the civil authority’s decision and dismissed the MDC-A’s appeal.
The fact that the MDC-A leadership — themselves noted lawyers — decided to defy both the civil authority and the High Court and to proceed in a highly confrontational manner with an illegal demonstration was as irresponsible as it was unfortunate.
They must take full responsibility for the consequences of their injudicious actions and their statements to incite and encourage their followers to challenge the law whilst they ‘led’ from ‘positions of safety’.
Once again, the MDC-A, as part of its relentless attention-seeking agenda, has incited public unrest at home to coincide with a key international event.
The deliberate act of defiance of 16th August was timed to coincide with the SADC Summit meeting scheduled to take place the following day, 17th August, in Tanzania at which Zimbabwe will assume the Chairmanship of the Regional Organ on Politics, Defence and Security.
The action was designed to achieve two specific objectives: firstly, by fomenting instability at home, to cast doubt among SADC leaders with regard to the suitability of Zimbabwe to take on the leadership of this key SADC Organ; and, secondly, to have Zimbabwe included in the agenda of the SADC Summit with the hope of breathing new life into their already long-discredited ‘legitimacy’ claims and with the intention of attaining their and their foreign backers’ objective of imposing some form of regional or continental mediation process upon our Government.
Once again, they have failed. Both they and those within Zimbabwe and beyond who continue to harbour such fantasies and who continue to pursue the politics of regime change by way of violence and terror and who must surely shoulder much responsibility for the ugly scenes witnessed in the streets of Harare on 16 August and indeed the tragic events of 1 August 2018 and 14/15 January, 2019, should simply cease and desist.
… Whilst the scenes which unfolded in our streets were indeed distressing to behold — as they are in any such circumstances — order was swiftly re-established and instances of serious confrontation avoided.
There have been no reports of any serious injuries. Social media allegations of fatalities are simply ‘fake news’ and must be rejected with contempt.</blockquote>

A local journalist identified as Doubt was reportedly arrested while trying to help a woman in her 50s who had been knocked down in central Harare after anti-riot police attempted to disperse protestors.
The journalist was taken to Harare Central Police where he is detained.
The Zimbabwe Lawyers for Human Rights are said to be trying to help him get his freedom.

Journalist Arrested While Helping Unconscious Woman - Report

<blockquote>The Zimbabwe Human Rights NGO Forum (the Forum) condemns the ongoing torture, cruel inhuman and degrading treatment as well as the ancillary arbitrary arrests of people suspected to have participated in the August 16 protests.
The protest had been organised by the opposition Movement for Democratic Change (MDC). By 1500 hours on 16 August 2019, Zimbabwe Lawyers for Human Rights (ZLHR) had attended to 128 arrests. Some of the arrests were executed in a dragnet manner.
A total of 12 people have been treated by medical doctors following assaults and torture at the hands of the police. This number is expected to increase as more reports are received.
It is clear from eye-witness accounts and video footage that the protestors gathered at Africa Unity Square were peaceful, posed no threat to people or property.
Our monitors on the ground witnessed the crowd sitting on the ground when the police suddenly and menacingly advanced towards the protestors mainly targeting women.
One woman was reportedly left unconscious following the attack.
Several groups of people were rounded up at Corner Second Street and Samora Machel and Parliament Building in the Harare Central Business District.
Thereat, they were thoroughly beaten while already under arrest and not attempting to escape. Other reports were received from Chitungwiza and Norton. The total number of victims is still to be ascertained.
The brutal attacks on protestors are in clear violation of the Public Order and Security Act (POSA) which provides for a clear procedure of dispersing illegal gatherings.
We expect law enforcement agents to follow provisions of the laws that they are supposed to enforce. The Constitution states that the police, as part of the security sector, must not violate fundamental rights or freedoms of any person.
The police also have a constitutional obligation to uphold provisions of the Constitution, which includes fundamental freedoms and human rights. In particular, section 53 that guarantees freedom from torture or cruel, inhuman or degrading treatment or punishment.
We are concerned that the government continues to brutalise innocent citizens with impunity.
We call upon the relevant government departments of Zimbabwe to: 
• investigate these cases of torture, cruel, inhumane and degrading treatment and make perpetrators accountable; 
• Respect the pre-trial rights of all persons arrested in a series of dragnet arrests around the city to be respected as provided in section 50 of the Constitution.
As we continue to monitor the situation, we urge the international community to condemn the ongoing violations and call on the SADC leaders currently meeting in Tanzania to remind the government of Zimbabwe to respect the fundamental rights of the people to peaceful assembly and association, freedom from torture and the freedom to demonstrate and petition.</blockquote>

<blockquote>We understand that today’s planned protests in Harare have just been called off by the organisers, following a High Court decision to uphold a Government ban.
The crowds that had already gathered were dispersed by police, with reports emerging of the use of force against protestors.
With opposition demonstrations still likely to take place in Zimbabwe in the near future, we urge the Government to find ways to continuously engage with the population about their legitimate grievances on the economic situation and to stop cracking down on peaceful protestors.
If demonstrations go ahead we urge the security forces and protesters to ensure they proceed calmly and without any violence.
We are deeply concerned by the socio-economic crisis that continues to unfold in Zimbabwe. While acknowledging efforts made by the Government, the international community and the UN in Zimbabwe to mitigate the effects of the crisis and reform process, the dire economic situation is now impacting negatively on the realization of the economic and social rights of millions of Zimbabweans.
Long-term neglect and structural deficiencies have contributed to hyperinflation, resulting in soaring prices for fuel, food, transport and health services, which is having a dramatic impact on the population, and particularly on marginalized working-class people.
The fact that key commodities and services have become less affordable for poor families, means there is an increasing need for strong social protection measures.
The economic crisis is converging with the impact of cyclone Idai that hit Zimbabwe last March, as well as the El Niño-induced drought, to create a rapidly deteriorating humanitarian situation, with the result that around five million Zimbabweans, or one third of the total population of 16 million people, are now estimated to be in need of humanitarian aid.
Ahead of today’s planned protest, which was called off at the last minute, there were worrying reports of threats against citizens who wish to exercise their right to express their opinions of the economic situation via peaceful protests, with allegations of increased surveillance of, and threats against, civil society organizations by State agents.
More disturbing still, there have been reports of actual physical attacks on, and arrests and detention of, civil society leaders and activists over the past few months, with one human rights defender and one political activist reportedly temporarily abducted and severely beaten by unidentified armed men a few days ago, apparently because of their role in helping to organize the protests today.
In the last few hours, we have heard reports of more such cases and are looking into them. Senior officials have also reportedly issued threats against organisers of demonstrations or against people who take part in them.
State authorities have a duty to ensure people’s rights to freedom of expression and to facilitate and protect the right to peaceful assembly.
In addition, we urge the Senate when reviewing the Maintenance of Peace and Order Bill to protect the essential democratic freedoms of peaceful assembly and demonstration by ensuring Bill’s compliance with the Constitution, decisions of the Constitutional Court, and international human rights standards.
In January, we expressed concerns about reports of excessive use of force, including live ammunition, by Zimbabwean security forces during protests following the announcement of an increase in petrol prices.
We are not aware of the indictment or prosecution of a single alleged perpetrator of human rights violations committed during or after those protests.
The Government does not appear to have carried out the requisite investigations into the violence, including the alleged excessive use of force by security forces, in a prompt, thorough and transparent manner, with a view to accountability, and we urge it to do so without further delay.
We also urge the Government to redouble its efforts to address the current challenges through a national dialogue, with the support of the international community, and to ensure that civil society organizations, human rights defenders, and activists can carry out their activities in a safe and secure environment without fearing intimidation or reprisals for their work.</blockquote>

MDC vice president, Tendai Biti has condemned the Zimbabwe Republic Police for its seeming double standards.
Biti said that police told the High Court that they did not have enough manpower to monitor the MDC’s march, yet they have enough police officers to cordon off Harare. Biti used Twitter to express his anger:

WATCH: Police Officers Order Citizens Off Bus, Tell Driver To 'Go Back Home'

The Zimbabwe Republic Police has warned all would-be protestors that they will be arrested as such gatherings are illegal.
Speaking to ZBC News after the High Court upheld a police ban on protests planned by the MDC, National police spokesperson Assistant Commissioner Paul Nyathi said that the prohibition still stands and no demonstrations are allowed throughout the country. He said:
<blockquote>Our law enforcement agents are on the ground to ensure peace and harmony prevails in the country…..We have come across and received reports of some mobs in Harare CBD, Budiriro, Chitungwiza and Tshabalala in Bulawayo…..and we would like to warn all Zimbabweans that such gatherings are illegal and police will arrest those defying the law………I would like to emphasise that no one should cry foul for being arrested if they decide to proceed to wilfully break the law…
We have all the evidence showing that this particular demonstration was not meant to be peaceful, hence the prohibition. We as the police are mandated to protect the rights of the majority of Zimbabweans and their peace and security comes first.
There should not be a situation where some individuals speak of having their rights respected while they are mobilising people to engage in activities that infringe on others’ rights.</blockquote>
Meanwhile, a woman was knocked unconscious after police went on the rampage, beating up protestors and passerby’s in Harare on Friday morning. The woman was ferried to hospital and her condition could not be immediately ascertained.

Police Vow To Clamp Down On Illegal Protests Countrywide

The government of Zimbabwe, through the Ministry of Information’s Twitter handle, acknowledged that an unidentified woman was injured when anti-riot police officers tried to break up a citizens’ march in Harare on Friday morning. Below is the statement:
<blockquote>We note an incident where an unidentified woman was injured during a stampede at the corner of Jason Moyo and Sam Nujoma Roads when the Police tried to disperse an illegal demonstration.
The woman was taken to hospital and efforts are underway to establish her condition.</blockquote>

The Zimbabwe Republic Police on Friday violently dispersed protestors after the High Court of Zimbabwe upheld a ban by police of MDC-planned demonstrations.

A woman was knocked unconscious after police reportedly used baton sticks to break up a small group of opposition protesters in Harare this morning. The High Court earlier upheld a police ban, prohibiting the opposition from going ahead with the demonstration.
