A court has acquitted four parents—Jennifer Sithole, Tafirenyika Boterere, Shadreck Manyange, and Brighton Manyange—of misconduct charges related to a protest against maladministration at Sagambe Primary School in Honde Valley.
According to the Zimbabwe Lawyers for Human Rights, the four were arrested alongside a 3-year-old toddler and Esther Kuseri, who was pregnant at the time.
The prosecution alleged that the parents organized a protest against school head Evans Mwaturura and disrupted students’ attendance.
The grievances were initially raised during a School Development Committee meeting, leading to tensions with school authorities.
Kuseri was arrested for disorderly conduct during a subsequent meeting with Ministry officials but later paid a fine to avoid the discomfort of detention due to her pregnancy.
Another individual, Chikosa, faced separate charges related to the protest but was released from remand pending further action from prosecutors.
On September 4, 2024, Mutasa Magistrate Artwell Sanyatwe found the four parents not guilty at the close of the prosecution’s case, with their lawyer Tatenda Sigauke representing them. Said ZLHR:

A court has absolved 4 parents of misconduct charges after they stood trial for allegedly staging a protest against maladministration by some school authorities in Honde Valley.
The parents namely, Jennifer Sithole, Tafirenyika Boterere, Shadreck Manyange and Brighton Manyange, had been standing trial at Mutasa Magistrates Court in Mutasa District in Manicaland Province after they were arrested by police officers together with a 3-year-old toddler, and Esther Kuseri, who was pregnant at the time of arrest, and charged with disorderly conduct in a public place as defined in section 41 of Criminal Code.
During trial, prosecutors claimed that Sithole, Manyange, Boterere and Manyange, who reside in Sagambe village in Mutasa District in Manicaland Province, masterminded a protest against Evans Mwaturura, the school head at Sagambe Primary School, who stood accused by some parents and guardians, of presiding over maladministration at the school.
The villagers were also accused of stopping school children from attending lessons at Sagambe Primary School.
The allegations of maladministration had been raised during a School Development Committee (SDC) Annual General Meeting, which was held at Sagambe Primary School, where some parents intended to raise several concerns against Mwaturura.
The disgruntled parents had sought to engage officials from the Ministry of Primary and Secondary Education and eventually, a meeting was held with officials from the ministry in the presence of some ZRP officers from Ruda Police Station.
Kuseri was arrested during the meeting for allegedly raising her voice against an official at the consultation.
She was later released from Ruda Police Station on Thursday 7 March 2024 after she paid an admission of guilt fine for disorderly conduct in a public place for contravening section 41 of the Criminal Code following the intervention of ZLHR lawyers.
Kuseri opted to pay an admission of guilt fine for disorderly conduct in a public place because she was pregnant and the conditions of police detention were making her uncomfortable and she was not comfortable with the inconvenience of court processes considering her condition.
Chikosa who is the former SDC Chairperson at Sagambe Primary School, was separately charged with contravening section 37 of the Criminal Code for allegedly participating in a gathering with intent to promote public violence, breaches of the peace or bigotry.
He was accused of being the one who had written a list of grievances levelled against Mwaturura, which had been presented at the meeting with officials from the Ministry of Primary and Secondary Education.
Chikosa was removed from remand and advised that he would be summoned to stand trial if prosecutors decide to pursue the matter.
On 4 September 2024, Mutasa Magistrate Artwell Sanyatwe acquitted Sithole, Boterere and Manyange, who were represented by Tatenda Sigauke, after finding them not guilty at the close of the prosecution case.

Four parents in Zimbabwe were accused of protesting against their school principal at Sagambe Primary School. They were charged with misconduct. During a meeting with school officials, tensions rose because parents had complaints about the school. A pregnant woman was arrested for speaking loudly at the meeting but later paid a fine to avoid going to jail. Another person was charged with promoting violence during the protest. However, the parents were found not guilty in court on September 4, 2024. Their lawyer represented them, and they were cleared of all charges.

Parents Cleared Of Misconduct Charges After School Protest

The Ministry of Primary and Secondary Education has dispatched officials to investigate claims some school authorities in Harare were turning away pupils for non-payment of fees.
This was said by Edgar Moyo, who is Primary and Secondary Education Deputy Minister during the Question and Answer session in the National Assembly on Wednesday.
Responding to MPs, Moyo said disciplinary action was being instituted against school authorities that were violating the Ministry’s directive that pupils should not be sent home for non-payment of school fees. He said:

Schools are not allowed to send away students. The contract of school fees payment is between the school and the parents and not the students.
Where schools are sending away children who have not paid fees, there are penalties.
The penalty is a charge that is attracted by that action.
As I speak, yesterday (Tuesday) we got information that some schools here in Harare sent away children who had not paid fees and this morning our officers were in those schools where we expect charges to be preferred against the culprits.
If those cases are reported to us, we take corrective measures.
As I have already indicated, I may not name the schools in Harare where we sent officers this morning to go and interview the children, interview the teachers, the heads, with a view of preferring charges on those headmasters.
When I say charges, I am referring to disciplinary processes where we prefer a charge and say in terms of this section, you have committed an act of misconduct.

Arguably, the main reason why some parents in Zimbabwe are unable to pay school fees for their children is the prevalence of poverty.
Zimbabwe has a high poverty rate and many families struggle to make ends meet. In such cases, paying school fees may not be a priority for some families.
Moyo also said measures were being taken against schools that were rejecting payment in local currency and accepting payment in foreign currency only.
Schools are allowed to set their fees in US dollars but if a parent wants to pay in Zimbabwe dollars, they use the prevailing interbank rate on the date of payment.

School Heads Under Probe For Turning Away Learners Over Non-payment Of Fees

A Form Six learner who committed suicide at ZRP High School in Harare on Monday reportedly had a pending disciplinary issue with school authorities.
<a href="https://www.hmetro.co.zw/leading-school-in-shock-as-student-hangs-himself/">H-Metro</a> reported sources as saying Prince Taonezvi (18) was expected to appear before a school disciplinary committee for allegedly fondling a female student’s breasts. Said a source:

Prince proposed to a female student sometime last week and his proposal was spurned.
He then found the girl standing next to a wall and grabbed her from behind, and fondled her breasts.
The girl screamed for help and shouted at him in anger.
The matter was reported to the headmaster, who asked the two to submit reports of what transpired.
Prince handed in his report and was told he would be called in for a hearing on a misconduct charge.

Prince reportedly hanged using a rope in a building that is still under construction at the school.
His body was discovered by two caretakers working on the school grounds.
Prince reportedly left a suicide note, whose contents were not released by the police.

Suicide ZRP High School Learner Was Facing A Misconduct Charge

Rufaro Marketing Pvt Ltd chief executive Daniel Mutiwadirwa has been suspended without salary and benefits, as well as from handling any company business.
Mutiwadirwa was suspended for allegedly refusing to furnish important documents to the Obey Shava-led board which intended to sift through the company’s financials, according to the City of Harare.
In a letter written to Mutiwadirwa, Shava accused the former of committing an act of serious misconduct. He said:

The employer has good cause for believing that you have committed serious misconduct in that you contravened Section 4(b) of the Code i.e. S.I. 15 of 2006 by ‘willfully disobeying lawful orders in one or more of the following ways; i. ii. On 13 January 2023, the Chairman of the Rufaro Marketing Board instructed you to issue a Notice to all Board Members convening an extraordinary general meeting on Wednesday, the 18th of January 2023 at 1430hrs.
Despite the written instruction, you have refused, failed and/or neglected to convene that meeting.
On the same date, 13 January 2023 the Chairman also requested you to furnish him with copies of the lease agreements in respect of all the Rufaro Marketing tenants and the contracts of employment in respect of all its employees by the 16th of January 2023.
Despite that clear and unequivocal instruction, you refused, failed and or neglected to provide the requested documents and information.

Rufaro Marketing Boss Suspended For Serious Misconduct

The Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ) has called on the government to enact legislation that will ensure unlimited paid maternity leave for female teachers.
This comes after a female teacher was arrested recently and charged with misconduct for bringing her baby to school with her during learning.
The teacher, Mercy Kagone of Mudzimu High School allegedly brought her baby with her to school as she could not afford a domestic worker.
She was also charged with absenteeism at work and failure to invigilate the 2021 Zimbabwe Education Council (ZIMSEC) Ordinary level examinations twice.
The Ministry of Primary and Secondary Education described the teacher’s actions as “unbecoming or indecorous behaviour”.
In a statement on Wednesday, ARTUZ accused authorities of prosecuting the teacher, saying her salary is too little for her to afford a babysitter. ARTUZ said:

We demand fully paid and unlimited maternity leave for workers. Ahead of the 16 days of activism, we believe administrative injustice like limited maternity leave should end.
We are outraged because a woman is being persecuted for playing the dual roles of being a professional teacher and a caregiver.
No woman should be subjected to this. The teacher cannot afford a childminder because of underpayment.
