The World’s top-ranked tennis player, Novak Djokovic has returned to detention in Australia after Prime Minister Scott Morrison’s <a href="https://news.pindula.co.zw/2022/01/14/novak-djokovic-faces-deportation-as-australia-cancels-his-visa-for-a-second-time/">government revoked his visa for a second time</a> amid public outcry over violations of COVID rules.
Authorities declared the unvaccinated tennis superstar a threat to the public.
Djokovic had surrendered to officials in Melbourne for an interview at about 8 am local time on Saturday (21:00 GMT on Friday), following a court order issued on Friday night.
Australian Border Force (ABF) officers accompanied the 34-year-old player to his lawyer’s offices for the online hearing in the Federal Court at 10:15 am local time on Saturday (23:15 GMT on Friday).
His case now moves to an appeals court and a hearing is scheduled for Sunday.
Just two days before the Australian Open begins, the world number one is again fighting detention and deportation – the latest twist in a high-profile row over his COVID-19 vaccine status.
This is the second attempt by Australia’s government to deport Djokovic, one of the world’s most high-profile COVID-19 vaccine sceptics.
The 34-year-old Serbian had used a medical exemption to enter Australia earlier this month, hoping to challenge for a record 21st Grand Slam title at the Open.
Amid public outcry, Prime Minister <a href="https://news.pindula.co.zw/2022/01/06/covid-19-vaccination-australia-cancels-novak-djokovics-visa/">Scott Morrison’s government had revoked Djokovic’s visa</a> on arrival but <a href="https://news.pindula.co.zw/2022/01/10/novak-djokovic-wins-appeal-against-decision-to-deny-him-australian-visa/">a judge reinstated Djokovic’s visa and allowed him to remain in the country.</a>
This time, the government has invoked exceptional – and difficult to challenge – executive powers to declare him a threat to public health and safety.
Government lawyers are expected to argue that Djokovic’s presence stirs anti-vaccine sentiment in Australia amid a tidal wave of Omicron infections.

Novak Djokovic Returns To Detention As He Fights Australian Deportation

The Australian government has cancelled Novak Djokovic’s visa for a second time, saying the unvaccinated tennis player may pose a risk to the community.
Djokovic’s lawyers are expected to appeal the cancellation in the Federal Circuit and Family Court as they successfully did after the first cancellation.
The Australian government cancelled his visa on Friday, saying the world’s top-ranked men’s tennis player, unvaccinated for COVID-19, may pose a risk to the community.
Immigration Minister Alex Hawke used discretionary powers to again cancel Djokovic’s visa after a court quashed an earlier revocation and released him from immigration detention on Monday. Said Hawke in a statement:

Today I exercised my power under section 133C(3) of the Migration Act to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so.
</blockquote>
He added that the government “is firmly committed to protecting Australia’s borders, particularly in relation to the COVID-19 pandemic”.
Hawke said he had “carefully considered” information from Djokovic, the Department of Home Affairs and the Australian Border Force.
Under the section of the Migration Act which the minister used to exercise his power to cancel the visa, Djokovic would not be able to secure a visa to come to Australia for three years, except in compelling circumstances that affect Australia’s interest.
Prime Minister Scott Morrison welcomed Djokovic’s pending deportation, saying Australia had achieved one of the lowest pandemic death rates, strongest economies and highest vaccination rates in the world. Morrison said in a statement:

Later on Friday, a court spokesperson said a preliminary hearing regarding the cancellation will be held at 09:45 GMT.
Djokovic’s exemption from a COVID-19 vaccination requirement to compete was approved by the Victoria state government and Tennis Australia, the tournament organiser. That apparently allowed him to receive a visa to travel.
But the Australian Border Force rejected the exemption and cancelled his visa upon arrival in Melbourne a development that saw him spend four nights in hotel detention before a judge on Monday overturned that decision.

Novak Djokovic Faces Deportation As Australia Cancels His Visa For A Second Time

Novak Djokovic has won an appeal against a decision to deny him a visa in the Federal Circuit Court of Australia ahead of the Australian Open.
Judge Anthony Kelly has quashed the visa cancellation and ordered the Australian Government to pay legal costs and release Djokovic from detention within half an hour.
Earlier in the day, Djokovic was removed from detention to be with his lawyers during the hearing, and Judge Anthony Kelly expressed agitation over the rejection of Djokovic’s medical exemption.
Djokovic’s lawyer, Nicholas Wood, argued the notice of intention to cancel his visa was defective because it was made on “a confusing blend of two grounds”.
At a press conference before the appeal verdict, Australia’s Prime Minister Scott Morrison said he would not comment on the since it was before the courts. 
It was revealed in court documents submitted by Djokovic’s lawyers that the World’s top tennis player had been infected with COVID-19 in December 2021. The documents said the infection was the basis of Djokovic’s medical exemption.
The documents also noted that Djokovic expressed “shock”, “surprise, and “confusion” when he was notified of his visa cancellation “given that (as he understood it) he had done everything he was required to enter Australia”.
But Australia’s Home Affairs Department filed court documents in which it stated “there is no such thing as an assurance of entry by a non-citizen into Australia” and noted that the Minister has the power to cancel Djokovic’s visa a second time if the court rules in his favour.
