Two brothers from Gokwe who are beneficiaries of a recent Presidential amnesty were brutally attacked by a mob after they had fatally assaulted their father on April 23, 2024.
According to <a href="https://tellzim.com/presidential-pardon-beneficiaries-kill-father-injured-in-mob-attack/">TellZim News</a>, Evans Mupamhanga (25) and Elvis Mupamhanga (21) both of farm 21, Chemagora area Gokwe South District, fatally assaulted their father before they were also brutally attacked by a mob over past disputes.
Zimbabwe Republic Police (ZRP) spokesperson, Inspector Emmanuel Mahoko, confirmed the mob attack, saying the suspects were in police custody at Gokwe South Hospital.
Inspector Mahoko also said Police have launched a manhunt for the 10-member gang that meted instant justice on the two brothers. He said:

We are appealing for information that may assist in the arrest of the 10-member group which attacked the two brothers and we further appeal to members of the public to respect the sanctity of human life by not engaging in violence as a way of solving disputes.
</blockquote>
It is alleged that Evans and Elvis were recently released from Gokwe prison under the Presidential amnesty where they had been imprisoned for possessing an illegal firearm.
On that fateful day, the suspects were at home with their parents, Kennedy Mupamhanga and Monica Mupamhanga. They disagreed about not filling up the water tank (Jojo tank) at their house.
The two brothers reportedly left their parents’ house after the altercation and proceeded to their father’s young brother, Forever Sikochi’s homestead on the same farm.
They demanded to know why he had not filled up the tank and this resulted in a misunderstanding. The suspects then force-marched Sikochi towards Kwekwe-Gokwe road threatening to kill him.
While on their way, the trio met Kennedy following them and suddenly held him and informed that him they wanted to settle the issue of a firearm which he had previously reported to the police against them.
The duo then escorted both Kennedy (their father) and Sikochi (their uncle) back to the latter’s homestead.
It is alleged that at around 7 PM, Evans instructed Elvis to bring an axe so that they could torture their father over the firearm issue.
On hearing this, Sikochi fled the scene leaving behind his brother Kennedy in the hands of his two sons.
The suspects took turns to strike their father using an axe and stones several times on the head until he died.
After killing their father, the two brothers went to Job Mupamhanga’s (76) home to inform him of the murder they had committed.
As they were explaining to Job what they had done to their father, a gang of about 10 unknown people entered the house armed with axes, machetes and knobkerries.
The mob attacked the two brothers over a previous dispute, striking them all over their bodies until they became unconscious after which the assailants vanished to an unknown destination.
Sikochi later on returned in the company of police officers and found his brother already dead. After a few minutes, he received a call from his father, Job informing him of what had transpired at his homestead.
The police proceeded to Job’s homestead where they found both Evans and Elvis badly injured. The two were rushed to Gokwe South District Hospital where they are in police custody and are both in serious condition. The deceased’s body was taken to the same hospital.

Presidential Pardon Beneficiaries Kill Father For Reporting Them To The Police

Zambian President Hakainde Hichilema has pardoned 588 inmates in various prisons across the country, <a href="https://www.africanews.com/2023/12/25/zambia-president-hakainde-hichilema-pardons-588-prisoners/">reported africanews</a>.
Zambia’s Minister of Home Affairs and Internal Security Jack Mwiimbu said that the freed prisoners include 11 elderly and one mother with a baby.
Addressing journalists in the capital Lusaka on Sunday, Mwiimbu said the life sentence of an inmate was commuted to 35 years while two inmates on death row had their sentences commuted to life.
Article 97 of the Zambian Constitution confers authority on the president to pardon or substitute punishments imposed on convicted persons.
Mwiimbu said that the pardoned inmates had demonstrated good conduct after undergoing rehabilitation processes that will enable them to integrate well into society.
President Hichilema’s decision was met with praise, particularly from human rights organisations.
In May 2023, Zimbabwean President Emmerson Mnangagwa was criticised by rights groups after he paroled thousands of prisoners, including dangerous convicted rapists.
<a href="https://www.voanews.com/a/mass-pardon-in-zimbabwe-frees-convicted-rapists-stirs-uproar-/7111090.html">VOA News</a> cited lawyers and rights groups as saying those convicted of rape should not have been released as their offences are classified as “specified,” which do not qualify for presidential pardons.

Zambian President Hakainde Hichilema Pardons 588 Prisoners

A 25-year-old man from Pumula North in Bulawayo who benefited from the recent Presidential Amnesty allegedly took his own life at his home soon after his release.
The incident occurred on 26 May when the now-deceased arrived home from Bulawayo Prison where he had been released from custody.
Zimbabwe Republic Police (ZRP) spokesperson in Bulawayo Province Inspector Abednico Ncube confirmed to <a href="https://www.sundaynews.co.zw/amnesty-beneficiary-commits-suicide/">The Sunday News</a> receiving a report of the suicide case. He said:

A case was reported where a 25-year-old man by the name of Dumisani Andile Mbusi was reported to have hung himself.
The incident took place on 26 May around 5 pm when the now deceased came home from Grey Prison where he had been remanded in custody.
</blockquote>
Mbusi allegedly had an argument with his tenant and later went to his room and that was the last time he was seen alive. Added Insp. Ncube:

On 29 May last week, around 5 AM, the tenant smelt an odour emanating from the now deceased’s bedroom.
He opened the curtain which was used to separate the rooms and saw the deceased hanging from the roof trusses.
A report was made to the police who attended the scene and removed the body. It was taken to United Bulawayo Hospitals (UBH) for a post-mortem.
Investigations are still in progress to ascertain the events leading to the deceased committing suicide.

Presidential Amnesty Beneficiary Commits Suicide

At least 15 convicts who were released last month under the Presidential Clemency Order issued by President Emmerson Mnangagwa last month have been rearrested for various offences, including murder and armed robbery.
The Presidential Clemency Order was aimed at de-congesting national prisons and improving living conditions by reducing the sentences of 4,270 prisoners nationwide.
The national police spokesperson, Assistant Commissioner Paul Nyathi, confirmed that 15 people had been rearrested countrywide, with charges varying from theft, unlawful entry, and stock theft to armed robbery and murder. Some of the individuals had pending court cases, while others had already been convicted. Nyathi said:

They were arrested for offences such as theft, unlawful entry and theft, stock theft, armed robbery and murder.
</blockquote>
A recent case involved Brian James, a Harare man who was rearrested and sentenced to one year in jail for stealing blankets, phones, and an inverter from a house in Borrowdale. Harare magistrate Mrs Ethel Rutendo Chichera initially sentenced James to 15 months in jail but suspended three months on the condition of good behaviour.
The Presidential amnesty caused a stir with members of the public protesting the release of convicted rapists who had served only a portion of their sentences. The early release of such individuals has led to public outcry and raised concerns about the safety of communities.
The Hwange Colliery Company Limited (HCCL) has also raised concerns about <a href="https://www.pindula.co.zw/2023/06/02/criminality-rising-since-presidential-amnesty/">an increase in crime in the mining town since the release of over 4,000 criminals</a>, including rapists, through the Presidential Amnesty Order. The HCCL Acting Loss and Control Manager, James Phiri, released a memo urging employees to be vigilant and take necessary precautions, such as locking doors and not leaving valuables outside the house.

15 Released Convicts, Rearrested After Committing More Offences

Hwange Colliery Company Limited (HCCL) has noted that crime has started going up in the mining town since President Emmerson Mnangagwa released more than 4 000 criminals that include rapists from jails through Presidential Amnesty last month.
HLCC Acting Loss and Control Manager James Phiri released a memo encouraging the colliery’s workers to be extremely vigilant. It reads:

With the recent release of criminals from Zimbabwe prisons through an Amnesty, criminality in the community has started rising. We urge all employees and their families to observe the following all times:
<ul>
<li>Do not leave any valuable belonging outside the house at night chairs, clothes on the washing line, shoes and horse pipes.</li>
<li>Make sure all doors are locked and secured properly all the time.</li>
<li>Do not rush to open the door when someone knocks, check through the window first and be sure it is someone you know before you open the door.</li>
<li>Teach your children not to open the door to strangers.</li>
<li>Train your children to stay indoors all the time or have an adult watching over them as they play outside the home.</li>
<li>Train your children not to get “lifts” from strangers.</li>
<li>Train your children to shout “help! help! help! when in danger or suspicion.</li>
<li>Train your children not to use short cuts when coming back from school or going to school</li>
</ul>

Phiri warned employees against leaving their valuables such as phones or laptops with unknown people and also to report all suspicion with immediate effect to HCCL security.

Criminality Rising Since Presidential Amnesty

The release of rapists from prison under a recent Presidential Amnesty has been castigated by activists and legal experts who argue that the move undermines efforts to combat gender-based violence (GBV) and to protect victims.
President Emmerson Mnangagwa recently granted amnesty to more than 4 000 prisoners to decongest the country’s overcrowded jails.
Rapists who are over 65 years and had served two-thirds of their prison terms benefited under the amnesty.
Social commentator Pardon Taodzera told <a href="https://www.newsday.co.zw/local-news/article/200012113/amnesty-for-rapists-hitting-victims-harder">NewsDay</a> that the release of rapists raises serious concerns about the government’s commitment to addressing GBV. Said Taodzera:

The decision to grant amnesty to rapists by Mnangagwa raises serious concerns about the government’s commitment to addressing gender-based violence.
While prison overcrowding is undoubtedly a pressing issue, it should never come at the expense of survivors’ rights and safety.
This decision undermines the efforts of activists, organisations, and individuals who have tirelessly worked towards creating a society free from violence and discrimination.
It sends a message that the state is prioritising the convenience of the justice system over the well-being of survivors and the deterrence of future crimes.
It is crucial for the government to consider alternative measures that do not compromise the principles of justice, such as implementing comprehensive rehabilitation programs and improving the efficiency of the judicial process.
Failure to do so not only erodes public trust but also perpetuates a culture of impunity that further endangers the lives of women and girls.
</blockquote>
Legal commentator Admire Huniuswa said granting presidential amnesty to rapists could be in violation of international human rights norms and domestic laws that guarantee protection against GBV. He said:

The amnesty to rapists raises significant legal concerns and questions the adherence to international human rights standards.
While the issue of prison overcrowding is a legitimate concern, it is crucial to prioritise the rights and safety of survivors and ensure that justice is served.
Granting amnesty to rapists undermines the principle of accountability and sends a detrimental message to both survivors and potential offenders.
It is essential to explore alternative solutions, such as improving the efficiency of the justice system, implementing restorative justice programmes, and providing comprehensive support to survivors.
Moreover, this decision may be in violation of domestic laws and international human rights instruments that guarantee protection against gender-based violence.
It is imperative for legal experts and human rights organisations to challenge the constitutionality of this amnesty and advocate for a justice system that upholds the rights and safety of all individuals, particularly survivors of sexual violence.

Opposition CCC spokesperson Fadzayi Mahere on Wednesday said it was “grossly irrational to release dangerous, unrehabilitated offenders back into society” before informing or preparing rape victims.

"Releasing Rapists Undermines Fight Against Gender-based Violence"

Rape victims have condemned the release of rapists before fully serving their prison sentences under a recent Presidential Amnesty.
Victims of rape said it was painful to see convicted rapists “boasting” on camera about their offences after being released from jail
Emelka (not her real name) was only 11 years old when a 59-year-old villager raped her.
The rapist violated her several times, threatening to kill the young girl using witchcraft if she dared reveal the assault to anyone.
The issue only came to light when the girl contracted a sexually transmitted infection.
The man was arrested and sentenced to 12 years in prison but was among those released last week after a Presidential Amnesty.
Speaking to <a href="https://www.newsday.co.zw/local-news/article/200012113/amnesty-for-rapists-hitting-victims-harder">NewsDay</a>, Elmelka’s mother said the Presidential Amnesty is a betrayal of rape victims’ trust in the justice system. She said:
<blockquote>
I am appalled and devastated by President (Emmerson) Mnangagwa’s decision to grant amnesty to rapists.
My daughter, who was brutally assaulted, fought tirelessly for justice and now it feels like her struggle was in vain.
This amnesty sends a message that the pain and trauma endured by victims are insignificant.
It is a betrayal of our trust in the justice system and a blow to all the survivors who summoned the courage to come forward.
I fear for the safety of women in our society, as this decision only encourages more violence and leaves us without recourse.
</blockquote>
Vimbiso (not her real name), a 33-year-old rape survivor told NewsDay that she was “devastated” by Mnangagwa’s decision to grant amnesty to rapists. She said:

As a survivor of rape, I am devastated by President Mnangagwa’s decision to grant amnesty to rapists.
It feels like a betrayal to know that the person who violated me may be set free without serving their full sentence.
This decision dismisses the pain and trauma endured by survivors like me. It sends a message that our suffering doesn’t matter and that justice can be easily disregarded.
It took courage for me to come forward and seek justice, and now I feel defeated.
Amnesty on rapists perpetuates a cycle of violence and leaves us vulnerable.
I implore the government to reconsider this decision and prioritise the safety and mental well-being of survivors.
We deserve justice and support, not the fear that our perpetrators will go unpunished.
</blockquote>
Under the Presidential Amnesty, rapists who are over 65 years and had served two-thirds of their prison terms were released.

Rape Victims Condemn Release Of Rapists Under Presidential Amnesty

Former Ministry of Mines permanent secretary, Francis Gudyanga who was in jail was among thousands of inmates who benefited from the latest Presidential Amnesty.
Last week, President Emmerson Mnangagwa declared a Presidential Amnesty releasing over 4 000 inmates.
Gudyanga was serving two and a half years for abuse of office at the Harare Central Prison.
<a href="https://www.newzimbabwe.com/gudyanga-released-in-presidential-amnesty-ex-perm-sec-jailed-in-2022-for-abuse-of-office/">NewZimbabwe.com</a> reported that after his conviction, Gudyanga was sentenced to four years in prison in February last year.
The magistrate suspended 18 months of Gudyanga’s sentence on condition he restituted the Minerals Marketing Corporation of Zimbabwe (MMCZ) a total of US$25 228.
Speaking to journalists as he boarded a Zimbabwe Prisons Correctional Service (ZPCS) bus which was on its way to the Central Business District on Friday, Gudyanga said:

We want to thank our families, friends and well-wishers for their support and prayers and their visits but also, we want to thank the prison officers who looked after us very well.
I appreciate the companionship of our fellow inmates.

Francis Gudyanga Released In Presidential Amnesty

President Emmerson Mnangagwa has ordered the release of 4 279 prisoners under the latest Presidential Amnesty.
According to the Zimbabwe Prisons and Correctional Services (ZPCS), a total of 4 166 men and 104 women will be released from the country’s 47 main prisons and eight satellite prisons.
In a statement released on Thursday, ZPCS spokesperson Meya Khanyezi said:

These inmates were being rehabilitated and have been serving for the offences they committed against the state therefore, those aggrieved are encouraged to forgive them for their successful reintegration into society.
</blockquote>
According to a Statutory Instrument of an Extraordinary Government Gazette published last Friday by the Ministry of Justice, Legal, and Parliamentary Affairs, those who have been pardoned include terminally ill female prisoners and juveniles who are not serving specified offences.
Those to be released would have served one-third of their sentences by 18 April 2023 while those who remain in prison are convicts serving time for violence-related offences.
Khanyezi urged communities to forgive and embrace the inmates that have been given amnesty.<a href="https://www.chronicle.co.zw/over-4-000-prisoners-set-for-release/"> She said</a>:

We would like to appeal to the close family members, stakeholders, and the society at large to embrace and accept inmates who have been released on amnesty.
Successful reintegration of inmates back into society is not the sole mandate of ZPCS alone but it requires combined efforts from all citizens of Zimbabwe.
These inmates were being rehabilitated and have been serving for the offenses they committed against the state, therefore, those aggrieved are encouraged to forgive them for their successful reintegration into society.

President Mnangagwa Grants Amnesty To Over 4 000 Prisoners

The Zimbabwe Republic Police (ZRP) is set to raid targeted homes and business premises in search of illegally held firearms commonly linked to rampant violent crimes involving the use of dangerous weapons in the country.
This follows the Friday expiry of the 53-day amnesty declared in August by President Emmerson Mnangagwa on all illegal gun owners to voluntarily surrender their weapons without any prosecution.
Police announced Thursday 545 firearms and 260 rounds of ammunition had been surrendered since the start of the amnesty. Said police in a statement seen by Pindula News:

On 29/09/22, seven firearms were voluntarily surrendered to the Police throughout the country on the operation, “Firearms Amnesty,” bringing the cumulative figures to 545.
Meanwhile, 260 rounds of ammunition have so far been voluntarily surrendered to the Police across the country.

The number however excluded any weapons that may have been surrendered between the period the statement was issued and 30 September, the date set as the official end of the amnesty.
Police spokesperson, Assistant Commissioner Paul Nyathi said police will soon conduct an operation targeting those who did not surrender illegal weapons with criminal charges hanging over the heads of culprits. <a href="https://www.zimlive.com/2022/10/police-plan-home-raids-in-search-of-guns-as-amnesty-nets-545-firearms/">ZimLive</a> cites him as saying:

The Zimbabwe Republic Police urges those who are yet to surrender the firearms to utilise the opportunity before criminal charges are preferred against anyone who will be found in possession of unlicensed firearms during the pending physical check exercise to be conducted by the police on all residential and business premises where illegal firearms are suspected to be kept or hidden.
Meanwhile, the Zimbabwe Republic Police implores all unlicensed firearm owners to visit local police stations and update their records in compliance with the Firearms Act Chapter 10.09.

He said the government extended the amnesty after finding that a lot of guns were “generally being held illegally by those with expired firearm licenses, members of gun clubs who are no longer active, farmers, hunters and individuals who may be no longer be practising.
Nyathi also said there are some firearms holders who died and their guns are inherited by their relatives.

Police Plot To Raid Homes, Business Premises In Search Of Firearms

A thief who was recently released from prison through the presidential amnesty is back in jail after he was <a href="https://news.pindula.co.zw/2018/03/30/man-arrested-same-day-after-being-released-on-presidential-amnesty/">involved in another theft after his release.</a>
It is reported that Raison Chenjere (23) of 1084 Chinotimba was rearrested after he stole a bottle of face lotion from OK Supermarket in Victoria Falls.
He was arrested after an alert security spotted that he was hiding something under his armpit and searched him upon which the product valued at $690 was recovered.
The security handed Chenjere to the police leading to his arrest and the stolen product was recovered.
Chenjere pleaded guilty to theft when he appeared before Victoria Falls magistrate Ms Linda Dzvene Wednesday who sentenced him to six months in prison before bringing into effect one month that was suspended in November.
He argued that he stole the lotion to sell it to have money to buy food since he had not eaten anything since his release.
The serial thief had previously been convicted and put in jail for breaking into and stealing at Sawanga Mall in Victoria Falls.
Chenjere had served more than a third of his jail term when he was recently released on Presidential Amnesty.
