The <a class="MarkdownLink_linkifiedLink__KxC9G">Financial Intelligence</a> Unit (FIU) of the <a class="MarkdownLink_linkifiedLink__KxC9G">Reserve Bank</a> of Zimbabwe has issued a statement warning businesses against engaging in illegal <a class="MarkdownLink_linkifiedLink__KxC9G">forward pricing</a> practices that manipulate the foreign exchange rate. In a statement seen by Pindula News, the FIU notes that businesses are allowed to apply a margin of up to 10% above the <a class="MarkdownLink_linkifiedLink__KxC9G">interbank exchange rate</a> under the law. However, some businesses are engaging in non-compliance with legal limits and manipulating the <a class="MarkdownLink_linkifiedLink__KxC9G">exchange rate</a>, resulting in “<a class="MarkdownLink_linkifiedLink__KxC9G">unjustified” pricing</a> of goods and services that negatively affect the consumers.
The FIU emphasizes that such practices are illegal and detrimental to the economy and warns that it will take remedial and punitive measures against delinquent businesses. These measures include imposing <a class="MarkdownLink_linkifiedLink__KxC9G">administrative fines</a>, freezing culprits’ bank accounts indefinitely, referring culprits to relevant authorities for suspension/revocation of trading or operating licenses, and prosecution. The FIU urges the public to report non-compliance by businesses and provides <a class="MarkdownLink_linkifiedLink__KxC9G">WhatsApp hotline numbers</a> for reporting. Reads the statement:

<h3>WARNING AGAINST BUSINESSES ENGAGING IN EXCHANGE RATE MANIPULATION</h3>
The Financial Intelligence Unit (FIU) has noted with grave concern that some businesses are engaging in illegal forward pricing practices thereby manipulating the foreign exchange rate.
In terms of the law, businesses are permitted to apply a margin of up to 10% above the interbank exchange rate. There is no justification for non-compliance with the legal margins in light of the recent implementation of a market-determined interbank exchange rate system. The forward pricing and non-compliance with legal limits is being done at the detriment of the consumers who bear the brunt of the resultant unjustified pricing of goods and services.
With immediate effect, the FIU will be escalating and widening remedial and punitive measures against delinquent businesses by not only imposing administrative fines but also directing that culprits’ bank accounts be frozen indefinitely and referring the culprits to relevant authorities for the suspension/revocation of trading or operating licenses and prosecution. Liability will also be extended to directors and owners of the concerned businesses.

RBZ's FIU Warns Against Businesses Accused Of Manipulating Foreign Exchange Rate

The Reserve Bank of Zimbabwe’s Financial Intelligence Unit (FIU) has frozen <a href="https://www.pindula.co.zw/Harare_City_Council">Harare City Council (HCC)</a>’s foreign currency accounts for charging prices exclusively in foreign currency and using parallel market rates.
This is part of a raft of measures the FIU will continue to implement to maintain prevailing market stability, according to <a href="https://www.sundaymail.co.zw/harare-city-forex-accounts-frozen">The Sunday Mail</a>. 
HCC and other municipalities have been under investigation <a href="https://zero.pindula.co.zw/local-authorities-defy-treasury-directive-on-forex-charges/">for defying Treasury</a> going against the law by <a href="https://zero.pindula.co.zw/harare-city-council-announces-that-some-services-are-now-paid-exclusively-in-usd/">pegging prices for some exclusively in foreign currency.</a>
FIU director-general Mr Oliver Chiperesa told <a href="https://www.sundaymail.co.zw/harare-city-forex-accounts-frozen">The Sunday Mail</a> in an interview that the net is closing in on all non-compliant local authorities. He said:

We have frozen the Harare City Council US dollar accounts. In terms of the law, they are expected to allow the public to pay in either currencies, but they are having a practice where they are insisting on US dollar payments without the option of paying in Zimbabwe dollars for some services. We have been engaging them, to bring them to order.
So we are going to be targeting public entities, not only those refusing to accept the local currency for certain services, but also businesses that are charging using parallel market rates. There’s no excuse for anyone, especially public institutions.

Harare City Council (HCC) announced on 31 August that <a href="https://zero.pindula.co.zw/harare-city-council-announces-that-some-services-are-now-paid-exclusively-in-usd/">some of its services shall be paid in United States Dollars (USD) with effect from the 1st of September 2022. </a>
In a notice seen by Pindula News, the local government authority said the move was aimed at ensuring continued service delivery. The notice said the fees exclude all charges that are accessible through the monthly bills, that is, water consumption, sewerage, refuse collection and rates.

RBZ's Financial Intelligence Unit Freezes Harare City Council’s Foreign Currency Accounts

Zimbabwe’s Financial Intelligence Unit has fined a Harare-based Chinese restaurant Shangri-La US$30 000 for charging services using unofficial foreign exchange rates. We present a letter dated 11 February 2022:

<h2>Imposition of Penalty on Shangri-La Restaurant and Takeawav for converting prices of a product using an exchange rate above the official rate.</h2>
On or around 9′ of February 2022, Shangri-La Restaurant and Takeaway which operates a restaurant in Harare, sold and advertised for sale products using an exchange rate above the ruling official rate of the day. that is to say, sold or advertised —
Various products offered by Shangri-La Restaurant and Takeaway, at an Exchange rate of USS I to ZW$240 thereby breaching section 3(7) of Statutory Instrument 127 of 2021.
<h2>1. Imposition of penalty</h2>
For the said breaches involving various products, the following penalty is imposed on Shangri-La Restaurant and Takeaway:
(a) Shangri-La Restaurant and Takeaway shall pay a fine of US$30,000 (or equivalent in Zimbabwe dollars, at the ruling auction-rate applicable on date of payment); and
(b)The amount referred to in pars (a) shall incur a further penalty of 5% of the said amount or any portion thereof that remains unpaid, calculated starting from the date of service of this notice up to the date of payment.
Payment of the penalty shall be made into the following account: Account Name: RBZ Settlement Account Account Number: 00000001 Bank: Reserve Bank of Zimbabwe.
<h2>2. Suspension of operation of penalty for 48 hours </h2>
a. The operation of the penalty referred to in paragraph 2, above, is suspended for seven days from date and time of service of this notice to allow Shangri-La Restaurant and Takeaway to make written representations, if any, why the penalty should not be confirmed.
b. In the event that Shangri-La Restaurant and Takeaway fails to show sufficient cause, within seven days, why the penalty should not be confirmed, the penalty shall be deemed confirmed from date of expiry of the seven days, in which case payment of the full fine shall become due within 48 hours thereafter.

Zimbabwe FIU Fines Chinese Restaurant Shangri-La US$30 000 For Using Unofficial Forex Rates

The Reserve Bank of Zimbabwe (RBZ)’s Financial Intelligence Unit has issued measures to curb the abuse of physical airtime vouchers for money laundering. Pindula News presents Chiperesa, the Director-General of the RBZ Financial Intelligence Unit.

<h2>Measures to curb abuse of physical airtime vouchers for money laundering </h2>
1. The Financial Intelligence Unit has noted that bulk airtime recharge vouchers are being abused by airtime dealers to facilitate illegal foreign currency trading and money laundering. 
2. Airtime dealers have been purchasing airtime vouchers in bulk from mobile telecommunication service providers using local currency and then disposing same at discounted foreign currency prices. The bulk airtime traders have not been depositing the significant foreign currency proceeds so generated into the banking system but have instead channelled same to fuel trade on the foreign exchange parallel market. 
3. In order to curb this abuse, the following measures shall apply in respect of mobile telecommunication and mobile payment service providers: 
4. Mobile telecommunication service providers shall — 
(a) take steps to decrease the production and sale of bulk physical air time recharge vouchers and promote the increased use of electronic airtime recharge; 
(b) reduce sales of physical airtime recharge vouchers to twenty percent (20%)of all airtime sales by 31 January 2022 and to ten percent (10%) by 30 April 2022; 
5. Mobile telecommunication service providers shall submit a written plan to the FIU no later than 7 November 2021 detailing the measures to be taken to meet the above targets by the set dates.
6. In addition to the measures referred to above, mobile telecommunications service providers shall issue circulars to their respective airtime distributors to enforce limits on till-point airtime voucher purchasers. To ensure that customers purchase airtime vouchers for personal use and not for re-sale, a customer shall be allowed to purchase airtime of not more than ZW$10,000 in value in any one transaction. A customer can buy up to five vouchers at a time but not exceeding ZW$10,000 in total. 
7. In order to facilitate electronic airtime recharging through customers’ mobile money wallets, individual mobile wallet holders may, with immediate effect, be allowed to conduct cash-in to their mobile money wallets, at designated outlets, up to ZW$5,000 per week. Cash-outs shall not be permissible.

RBZ Orders Mobile Network Operators To Reduce Sales Of Physical Airtime Vouchers

The Reserve Bank of Zimbabwe (RBZ) has released a list of people accused of abusing mobile phone services and social media to facilitate and promote illegal foreign currency exchange transactions and money laundering. In a statement, RBZ Governor Dr John Mangudya said:

<h2>MEASURES AGAINST INDIVIDUALS ABUSING MOBILE PHONE SERVICES AND SOCIAL MEDIA TO PROMOTE AND FACILITATE ILLEGAL FOREIGN EXCHANGE TRANSACTIONS AND MONEY-LAUNDERING ACTIVITIES</h2>
The Financial Intelligence Unit (FIU) has identified individuals listed hereunder who are abusing mobile telecommunications services and other social media platforms to promote and facilitate illegal foreign exchange transactions and money laundering activities.
The FIU has instructed banks, mobile money operators and other financial service providers to identify and freeze any accounts operated by these individuals and, further, to bar them from accessing financial services for a period of two years, with immediate effect. 
The FIU has also requested the Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ) to bar the said individuals from operating mobile phone lines.
The FIU, in collaboration with law enforcement agencies, will continue to monitor various social media and bank accounts to identify and take action against perpetrators of illicit dealings. Over and above the corrective measures of barring the delinquent individuals from accessing banking and financial services and operating mobile phone lines, the FIU has forwarded their names and particulars to law enforcement agencies for prosecution.

RBZ Lists People Abusing Mobile Phones, Social Media Through Money-Laundering

The Reserve Bank of Zimbabwe has announced a cocktail of new measures meant to address illegal money trading in the country.
Below is the apex bank’s statement in full.
<blockquote>ACTION AGAINST ILLEGAL FOREIGN CURRENCY TRADING ADVERTS 
1. The Financial Intelligence Unit (FIU) has been monitoring social media platforms where foreign currency dealers have been advertising and promoting their illegal trade. The FIU is aware of WhatsApp groups that have mushroomed in the country for the specific purpose of promoting and facilitating illegal foreign currency trade. 
2. The FIU, in collaboration with the police, banks, mobile money / mobile phone service providers and relevant regulatory agencies, has embarked on an exercise to identify and take action against individuals who create, advertise on or participate (actively or passively) in WhatsApp groups or other platforms for illegal foreign currency trading. 
3. The FIU and relevant institutions will take the following immediate actions:
• The mobile phone numbers used to join or advertise on the illegal groups will be shared with mobile phone operators and POTRAZ for barring;
• Other mobile phone numbers registered in the names of such persons will also be identified and barred;
• Any mobile money wallets registered in the names of such persons will be frozen and the persons barred from accessing mobile money services with any operator;
• Bank accounts owned by a person so identified will be frozen and the person will be blacklisted and barred from accessing banking services with any bank; and
• Identified persons will be investigated and prosecuted for illegally trading in or advertising illegal trading in foreign currency. 
4. Members of the public are requested to report to the FIU any person, mobile phone number or bank account that continue to be used to engage in or advertise illegal foreign currency activities, using the following contact details:

RBZ Goes After Forex Dealers Who Advertise Their Business On WhatsApp

<blockquote>PRESS STATEMENT ON CERTAIN INDIVIDUALS MASQUERADING AS RESERVE BANK OF ZIMBABWE OFFICIALS
It has come to the attention of the Reserve Bank of Zimbabwe (the Bank) that there are certain people posing and masquerading as Bank officials in their foreign exchange dealings on the parallel market. The Bank does not deal on parallel markets and does not and will not deploy any of its officers or employees on the foreign exchange parallel market as suggested by those defamers or imposters.
The Bank urges members of the public to dismiss this misinformation with the contempt it deserves. Allegations or misrepresentations that the Bank deploys its officials to engage in foreign currency parallel market activities is not only mischievous but also defamatory and designed to cause panic and instability in the foreign exchange market. 
The Bank takes a serious view of such mischief and urges any person with information of any defamer or imposter to make a report to law enforcement authorities or to the Financial Intelligence Unit on 071 9 447 295. A monetary reward will be paid, in line with the Bank’s Whistleblowing Policy, for positive identification of the defamers or imposters.

FULL TEXT: RBZ Warns The Public About Bogus Officials

The Reserve Bank of Zimbabwe has directed all banks to temporarily lower daily and monthly ZIPIT limits. We present below the central bank’s directive.
<blockquote>Temporary Downward Review of ZIPIT Limits to ZW$20,000 per Day and ZW$100,000 per Month
The FIU has noted that the existing ZIPIT transaction limits which have no monthly cap are being misused, primarily for illicit foreign currency transactions.
The current ZIPIT limits of ZW$100,000 per day allow a customer (subject to any bank-specific limits) to move about ZW$3 million per month, using a single account, and much more if he/she is multi-banked and/or uses third party accounts.
The FIU has noted KYC shortcomings in the ZIPIT system that make it difficult for banks, regulators and law enforcement agencies to speedily identify counter-parties to a transaction, or to identify multi-banked users. 
Until such time when adequate safeguards are built into the ZIPIT system to minimize the money laundering risk, ZIMSWITCH is directed to implement, with immediate effect, daily and monthly ZIPIT limits of ZW$20,000 and ZW$100,000, respectively.
The limits have been arrived at cognizant of the reality that very few Zimbabweans earn more than ZW$100,000 per day, and those who do have other payment options available for higher value transactions.
