A Ugandan tourist, Tom Ssekamwa, who was arrested in Masvingo for possessing a sex toy in his bag, has been acquitted by a local magistrate after spending 24 days in remand prison.
As reported by <a href="https://masvingomirror.com/another-tourist-acquitted-after-24-days-in-jail/">The Mirror</a> on 26 August, Magistrate Isaac Chikura found Ssekamwa not guilty of being a criminal nuisance, saying the presence of the artificial penis did not pose a threat to the public or create any disturbance.
The magistrate noted that the item was found in a private context and said Ssekamwa had no intention of using it in public.
The police have been criticised for arresting people in order to investigate. Critics argue that such actions have caused significant harm to the reputation of Zimbabwe’s tourism and hospitality industry.
Ssekamwa faced charges under Section 26(1)(a) with an alternative charge of criminal nuisance under Section 46(2)(v), as well as a violation of Section 26(1) of the Censorship Act. However, these charges were ultimately dismissed by the magistrate.

Ugandan Tourist Acquitted After 24 Days In Remand For Possessing Sex Toy

A Masvingo magistrate has dismissed bail applications for two foreign tourists charged with publishing falsehoods and possessing a sex toy, respectively, reported <a href="https://masvingomirror.com/magistrate-denies-foreign-tourists-bail/">The Mirror</a>.
Masvingo Provincial Magistrate Franklin Mkwananzi ruled that there was overwhelming evidence that Lucas Slavik from the Czech Republic and Tom Ssekamwa from Uganda committed the offences they were charged with.
The magistrate said that if the two were released, they would likely abscond because of the country’s porous borders.
Prosecutor Tarisai Muvengi also argued that Slavik faces 20 years in jail and that was a serious offence.
The Czech’s charge was altered from spreading falsehoods to publishing a false statement with the intention to incite the public.
Slavik is alleged to have recorded a statement in a video in which he said that there was no water or electricity in Masvingo.
His lawyer told the court that Masvingo was going for days without water and 12 hours without electricity.
The State dropped another charge against Slavik, that is, criminal nuisance.
Slavik reportedly wailed in court after he was denied bail.
Ssekamwa, who was allegedly found with a rubber toy penis, is being charged with violation of the Censorship Act.
The two were initially both remanded to August 16, 2024, but this was later changed to be the trial date after their lawyer, Knowledge Mabvure protested and the magistrate concurred. Said:

The State has overwhelming evidence against the accused person as they have a video in which he features making utterances which they say is circulating on social media.
The State also has overwhelming evidence against Ssekamwa as the artificial penis was recovered from his bag.

Masvingo Magistrate Denies Foreign Tourists Bail

A Ugandan national, Tom Ssekamwa (24), was arraigned before the Masvingo Magistrates’ Court on allegations of contravening the Censorship and Entertainments Control Act, alternatively criminal nuisance.
According to the National Prosecuting Authority (NPA), on August 1, 2024, the police received a tip-off that Ssekamwa was in possession of sex toys at the Backpackers Rest Budget Accommodation in Masvingo.
The police acted on the information and conducted a search, which allegedly led to the recovery of sex toys and lubricant from the accused person’s bag. Ssekamwa was promptly arrested.
Ssekamwa is expected to appear in court this Tuesday for a bail ruling.

The Zimbabwean government has been sued over the ban on the importation of sex toys.
In a High Court application filed on Thursday, Women’s Academy for Leadership and Political Excellence (Walpe) executive director Sitabile Dewa sought an order declaring the ban on the importation, possession and or use of sex toys unconstitutional.
Dewa filed the application after a Gwanda State University (GSU) female lecturer was jailed for six months late last year after she imported sex toys from Germany.
Shirley Chapunza was given an option of paying a $60 000 fine to escape the jail term.
The sex toys were seized by the Zimbabwe Revenue Authority (ZIMRA).
Dewa argued that the criminalisation of the importation of sex toys infringed Chipunza’s rights as the gadgets were therapeutic and good for anyone’s well-being. Dewa said:

In the alternative, I seek a declaration from this court to the effect that devices for personal and private lawful sexual acts (sex toys) are exempt from the application of the aforesaid provisions.
I further aver that in the interests of my sexual and reproductive health, I must engage in some sexual activity. Some form of penetration is key to exercising my pelvic floor muscles and is therapeutic.
Vibrators and other sex enhancing devices are not only toys, but are also therapeutic devices that can be used to attain the highest standards of physical and mental well-being.

Dewa cited ministers <a href="https://www.pindula.co.zw/Mthuli_Ncube">Mthuli Ncube</a> (Finance), <a href="https://www.pindula.co.zw/Ziyambi_Ziyambi">Ziyambi Ziyambi</a> (Justice), <a href="https://www.pindula.co.zw/Kazembe_Kazembe">Kazembe Kazembe</a> (Home Affairs), Zimra and the Attorney-General’s Office as respondents, respectively.
She argued that section 61 of the Constitution provides for the right to freedom of expression as well as freedom of thought, opinion and expression regarding sexuality.
Dewa said this section covered the right for a person to express themselves in sexual conduct of their choice.
The Walpe executive director said laws against sex toys were intrusive and an affront to the absolute right to dignity.
She added that the moral indignation and pontification with which the authorities and the courts find sex devices are feigned and hypocritical as these have always been part of our cultural heritage. Dewa argued:

We publicly acknowledge sex devices through the display of similar artefacts in the Great Zimbabwe Museum for the public and international tourists to view. It is an indication that these were designed, possessed, and used by my ancestors.
The openness and the pride with which the sex artefacts are held, is irreconcilable with the position taken in statutes as currently interpreted that such objects stand for moral depravity.
</blockquote>
She said the government, by freely distributing condoms, condoned any sexual activity by adults.
According to Dewa, there are many ways that government can regulate sex toys such as putting in place measures where the objects are only accessible to adults through strict licencing methods.
Dewa argued that section 71 of the Constitution entitles her to acquire, hold, use, and dispose of all forms of property as an individual anyhow.

Government Sued Over Ban On Sex Toys

Some Zimbabwean women have welcomed a recent court application by a women’s rights and leadership organisation Women’s Academy for Leadership and Political Excellence (WALPE) challenging the ban on sex toys as prescribed by the Customs and Excise Act.
WALPE executive director Sitabile Dewa recently lodged a court application challenging the legality of Section 47 (1) b of the Customs and Excise Act which criminalises the importation of goods regarded as indecent, obscene, or objectionable.
Dewa argued that the law infringes on women’s right to pleasure.
The court application followed the conviction of Ayanda Muponda, a Harare-based socialite who was involved in the sale of sex toys (dildos).
Muponda was sentenced to a two-year prison term which was wholly suspended on condition she does not repeat the offence and performs 640 hours of community service.
Speaking during an interview with B-Metro, Emma, who did not want her last name used for privacy reasons, said:
<blockquote>
We welcome the court application because the banning of sex toys infringes on our right to pleasure as women.
This is because just like masturbation, vibrators are great and they’re easy to use like when you want someone one-on-one time without the help of anyone else.
Remember it is not an easy task to stimulate your mind and body both at the same time and this is where a sex toy plays that part.
Even for married women sex toys will help them to boost their bedroom romance with their partners.
With the option of joy toys, they can lengthen their intimacy duration with their partners.

Gladys from Cowdray Park suburb in Bulawayo said dildos make her reach “the Promised Land”. She said:
<blockquote>
It’s true that the law violated our right to pleasure as women and the right to privacy.
As much as I love the connection with another person, with a sex toy, I am able to control my own pleasure.
They always make you reach the Promised Land and sometimes men don’t.
</blockquote>
Another woman who also requested her name not be published told B-Metro:
<blockquote>
I think people have the right to decide for themselves whether these devices help their intimate life or not.
What people do in their own private time with themselves is their own business.
Even if the court application does not succeed, women will always continue flying under the radar to avoid being arrested.
</blockquote>
However, Brian Sibanda, fears that the proliferation of sex toys will render men obsolete. Sibanda said:
<blockquote>
Judging from the fact that a lot of husbands were being replaced by these obscene devices, the law banning the use of sex toys should not be overturned.
This is because as men we are being rendered useless by these vibrators.
As men, we should, however, fear not, because it is just that kind of false praise given to these vibrators.
Just imagine they don’t talk to women, they won’t kiss them and hold them as men do and these are the kind of stuff that makes sex more pleasurable.
</blockquote>
Allen Sithole thinks that there is something wrong with women who require vibrators to fulfill their pleasures. He said:
<blockquote>
Men, unlike sex toys, can read women’s facial expressions and during the act. 
They know how to respond to their squirming and moaning.

Erica Moyo, who has been married for 20 years sided with men, saying sex toys were alien to African culture. She said:
<blockquote>
You are just dealing with plastics, and I think it is a perversion to use a vibrator on your skin.

"God Created Women For Men, Not For Plastics", Sex Toys Ban Divides Opinion

The Women’s Academy for Leadership and Political Excellence (WALPE) is challenging the Customs and Excise Act which prohibits the importation of sex toys (dildos), saying the law violates women’s right to pleasure.

In a statement, WALPE said the law is archaic and infringes on women’s rights to sexual pleasure. Part of the statement reads:

Women’s Rights Group Challenges Ban On Sex Toys

A woman who was arrested for smuggling and selling sex toys in Harare, including to school children, was ordered to perform 640 hours of unpaid work by a Mbare magistrate.
The woman, Unity Ayanda Muponda, was initially jailed for 24 months before six months of the jail term were suspended on the condition that she does not commit a similar offence within the next five years.
The remaining 16 months were suspended on condition that she performs community service.
Muponda used social media platforms to market her products.
She was convicted for violating the Custom and Excise Act and exposing children to pornographic material.

Woman Who Sold Sex Toys To Schoolchildren Gets Community Service

A female Gwanda State University lecturer was recently sentenced to six months in prison after she was found in possession of sex toys.
Shirley Tendai Chapunza (27), of St Helens Road in Parklands, Bulawayo, was sentenced by Bulawayo magistrate Shot Game on 27 October 2022.
She was sentenced to a six-month jail term but was then offered the option of a fine of ZWL$60 000 (less than US$100).
Customs officials had intercepted Chipunza’s parcel of three sex toys at the main post office, sent from Germany.
She was charged under section 47(1)b of the Customs and Excise Act which prohibits the importation of “any goods which are indecent, obscene or objectionable.”
The law under a section on “goods prohibited from importation” also bans the shipment of “any goods which might tend to deprave the morals of the inhabitants… of Zimbabwe,” reported <a href="https://www.zimlive.com/2022/10/sex-toys-in-your-luggage-can-land-you-in-jail-in-zimbabwe/">ZimLive</a>.
Allegations are that on 31 May this year, the geomatics and surveying engineer went to the main post office in Bulawayo to collect a parcel sent from Germany.
Francisca Mapurazi, a Zimbabwe Revenue Authority (ZIMRA) employee, insisted on checking the parcel to determine if did not contain any illegal items or duty-attracting goods.
Prosecutor Sehliselo Khumalo told the court that Mapurazi found three sex toys and immediately called the police.
Meanwhile, a 23-year-old Harare woman, Ayanda Unity Mponda was detained for 15 days in May before she obtained bail at the High Court in May after she allegedly imported sex toys for sale.
Mponda is awaiting trial.

Lecturer Fined $60 000 For Importing Three Sex Toys

The use of sex toys by married people which of late has been on the increase in Zimbabwe could be a trigger for loss of affection and desire in marriages leading to high divorce rates and spousal separation, a top Psychologist has warned.
In an interview with Health Times, a leading psychologist in Zimbabwe, Dr Kudakwashe Muchena said sex toys allow couples and partners to explore their sexuality.
He however warned that just like masturbation, uncontrolled use of sex toys could result in serious mental health issues which can lead to broken marriages and relationships.
Dr Muchena’s warning comes when there has been a rise in the marketing and distribution of sex toys in Zimbabwe.
In 2020 an Online Sex Toy Shop was licensed in the country and other distributors are using their social media platforms to market and sell the coitus enhancing products. Warned Dr Muchena:
<blockquote>The use of intimate toys or sex toys is around two things which is openness to experience and openness to communication.
Generally, the use of sex toys has been popularized in most developed countries where they are more interested in exploring their sexuality and they believe it is their right to do that.
In our context, Sex Toys have been something that is taboo and has been mostly linked to Homosexuality because they have been seen as a substitute for having a partner.
So in a heterosexual (between a man and a woman) marriage, the use of sex toys can actually destroy that marriage because one of the partners involved may actually feel like they are being replaced by a toy so that may destroy the relationship.</blockquote>
Dr Muchena added that using sex toys in marriages may lead to the other partner feeling inadequate and feeling insecure. He said:
<blockquote>That results in some serious damage in terms of mental health. It impacts heavily on the mental health of the other partner involved.
Research has shown that when there is open communication between the two parties and when they open up and say we need to explore more of our sexuality, they can actually get sex toys to help them.
Whilst the idea behind getting a sex toy is to enhance the sexuality of the partners involved. In most cases, it may end up replacing the other partner.
Once the part realizes that they can get satisfaction from a toy whether it’s a vibrator or anything, it then diffuses the idea of having a physical partner.
For men mostly, we are looking at masturbation even for women, research has shown that a lot of people who are involved in masturbation end up losing that personification in terms of sexual contact, they feel that they don’t necessarily need a physical partner to actually satisfy their sexual needs.</blockquote>
