Chinese bus manufacturer, Zhongtong, says it has started installing speed limiters on all the new coaches destined for the Zimbabwean market in a move meant to reduce accidents involving buses.
Zhongtong buses Zimbabwe representative Colin Luhaitang told <a href="https://www.herald.co.zw/compulsory-speed-limiters-for-new-buses/">The Herald</a> on Sunday that among its customers who bought buses fitted with speed limit devices are Mukumba Brothers (Inter Africa), CAG, Mandaza and Timboon, among others.
He said several months ago, the Minister of Transport and Infrastructure Development engaged the bus manufacturers following a bus accident. Said Luhaitang:

I told him that to reduce accidents the drivers should concentrate and avoid tired driving.
Secondly, they must control their speed as some of the buses can reach up to 140km/h which is too much for a bus.
I reported to our mechanics in China. After July 2023 all the buses coming after that date our buses already have speed limiters.
The speed limiter is between 100 to 110 kilometres per hour being the maximum.

He also said the speed limiters would complement the tracking system which was a little bit expensive and time-consuming in the monitoring.
Luhaitang added that the speed limiters are installed permanently and can work for a lifetime if the drivers avoid tampering with them.
In 2023, the Government gazetted Statutory Instrument 118 of 2023 which stipulates that all public service vehicles have to be fitted with a speed limiting device so that such vehicles will not exceed 100km/h.
The regulations were passed after the drivers of a Zebra Kiss bus and a Rimbi bus, Mike Makwara and Misheck Penyaiwere, respectively, were involved in a road race along the Harare-Nyamapanda Road near Mutoko on 12 January 2023 which ended in a fatal accident that killed one person.
Both drivers, who were driving Zhongtong buses, were convicted of reckless driving by Mutoko Magistrate Elijah Sibanda in April.
Makwara was jailed for two years, and Misheck Penyaiwere was jailed for 30 months.
Zimbabwe Public Transport Organisation (ZPTO) chairman Sam Nhanhanga said they were now installing speed limiters on old buses. He said:

Zhongtong buses we have procured lately are coming in with speed limiters already fixed. The manufacturer will also be servicing the gadgets.
We are also in the process of engaging the manufacturer to fix old buses. As an association, we continue to encourage our members to comply and put speed limiters on their buses.
</blockquote>
He added that the government should push for the acquisition of Euro 3 buses that have a maximum speed ranging between 91-110 kilometres per hour.

Zhongtong Says Installing Speed Limiters On New Buses

Police have said more than 360 bus drivers were arrested this month for driving above stipulated speed limits, reported <a href="https://www.sundaymail.co.zw/over-360-bus-drivers-arrested-for-speeding">The Sunday Mail</a>.
Zimbabwe Republic Police (ZRP) spokesperson Assistant Commissioner Paul Nyathi said most of the arrests were made during the festive season. He said:

In a concerted effort to enforce road regulations and enhance public safety, law-enforcement authorities have arrested at least 368 bus drivers during this month alone for speeding.
Most of the arrests were made during the festive season holidays and we continue to urge bus drivers to respect the sanctity of life and their passengers.

In June 2023, the Minister of Transport and Infrastructural Development, Felix Mhona, promulgated Statutory Instrument 118 of 2023 which made it mandatory for passenger public service vehicles (buses/kombis) and other heavy vehicles to install speed limit and monitoring devices on their vehicles.
Public transport operators have until tomorrow, 01 January 2024, to comply with the Government directive to equip their vehicles with speed-limiting and monitoring devices.
Speaking to The Sunday Mail, the Zimbabwe Passenger Transport Organisation (ZPTO) urged public transport operators to comply with the new regulations. He said:

Bus operators are required to comply with this directive by January 1 by ensuring the installation of the necessary speed limiting and monitoring devices on their vehicles.
The tracking system has helped reduce the number of accidents. But we need to do more; we have operators who have not submitted their fleet and tracking numbers.
The police must help us to enforce that. As bus operators, we have been disciplining our drivers internally.
</blockquote>
The speed tracking system restricts the maximum speed of buses to 100km/h on open roads.
Bus operators and the ZRP have established a speed tracking centre at Harare Central Police Station to closely monitor the adherence of drivers to the prescribed speed limits.

368 Bus Drivers Arrested For Speeding - ZRP

The Ministry of Transport and Infrastructural Development has sought to explain the meaning of Statutory Instrument 118 of 2023 for ordinary citizens and also the consequences of not complying with the SI for vehicle owners and drivers. Below is a statement released by the Ministry of Transport:

SI 118 of 2023 on Speed Limiting and Monitoring Devices
1. So what does the new Statutory Instrument mean for the ordinary citizen?
An analysis by the Ministry of Transport and Infrastructural Development, through its leading road safety agency, the Traffic Safety Council of Zimbabwe, on the causes of Road Traffic Accidents showed that the main cause of fatalities was over-speeding which accounts for 37% of the fatalities.
About 92% of the established causes were due to human error, especially over-speeding. Likewise, Hon. Minister F.T. Mhona called for a National Road Safety Indaba that was held in January 2023, bringing together all transport stakeholders across the country.
The Indaba resolved to regulate Public Service Vehicle (PSV) speed to a maximum of 100km/hr. The PSVs must also be fitted with speed monitors and speed limiters so that they do not exceed this prescribed speed limit to ensure improved road safety.
Through Statutory Instrument 188 of 2023, the installation of speed-limiting devices has been made compulsory for Public Service Vehicles (PSVS) as this will go a long way in controlling over-speeding by PSV drivers.
This S.I. is meant to protect ordinary citizens i.e. commuters and other road users.
Over the years, Government has rehabilitated major highways such as Harare-Masvingo- Beitbridge, and Plumtree-Mutare, however, an unintended consequence of this development has been over-speeding by drivers on the good roads.
Therefore, speed regulation is an important strategy for improving the country’s road safety performance and saving lives.
2. What happens if the heavy vehicle owners and drivers do not comply with the new SI?
According to Section 5 of Statutory Instrument 188 of 2023, owners, operators and drivers who do not comply will be liable to a fine not exceeding level 5, or to a period of imprisonment not exceeding 6 months or both fine and imprisonment.
At the current Standard Scale of Fines provided for in S.I 14A of 2023, a level 5 fine is USD200.
To ensure compliance with the new S. I 118 of 2023, the Ministry of Transport and Infrastructural Development will not licence PSVS to operate without speed limiting and monitoring devices.
These vehicles will not be issued Certificates of Fitness by Vehicle Inspectorate Department and will not be issued Route Permits by the Road Motor Transportation Department.

EXPLAINER: Ministry Of Transport Speaks On Speed Limiting And Monitoring Devices

The Ministry of Transport and Infrastructure Development (MOTID) has said it is now mandatory for passenger public service vehicles (buses/kombis) and other heavy vehicles to install speed limit and monitoring devices on their vehicles with immediate effect.
In terms of <a href="https://news.pindula.co.zw/wp-content/uploads/2023/06/S.I.-118-of-2023-Road-Traffic-Act-Speed-Limiting-and-Monitoring-Devices-nom.pdf">Statutory Instrument 118 of 2023</a>, operators and drivers of any heavy vehicle with a net mass of 4 600kg or more should ensure that a speed monitoring device is fitted on the vehicle. The new regulations read in part:

IT is hereby notified that the Minister of Transport and  Infrastructural Development has, in terms of section 81 of the Road  Traffic Act [Chapter 13:11], made the following regulations:— 
Title and date of commencement 
<ol>
<li> (1) These regulations may be cited as the Road Traffic (Speed  Limiting and Tracking Devices) Regulations, 2023. </li>
</ol>
 (2) These regulations shall come into operation on the date  of publication. 
Interpretation 
</blockquote>
<ol start="2">
<li> 
<blockquote> In these regulations— </blockquote>
</li>
</ol>
<blockquote>
“speed monitoring device” means a device and its accessories  fitted on a public service vehicle capable of monitoring  the speed of such vehicle and recording or storing the  data thereof; 
“speed limiting device” means a device and its accessories fitted  on a public service vehicle capable of being set to control,  limit the speed of such vehicle not to exceed 100km/h;
“operator” means anyone engaged in the business of  transportation for hire and reward as provided for in  the Road Motor Transportation Act [Chapter 13:15]; 
“certificate of fitness” means a certificate of fitness issued in  terms of section 31 of the Road Motor Transportation  Act [Chapter 13:15]; 
“inspection officer” means a person who is appointed or  deemed to have been appointed as an inspecting officer  in terms of section 30 of the Road Motor Transportation  Act [Chapter 13:15]; 
“Commissioner” means the Commissioner of Road Transport referred to in section 3 of the Road Motor Transportation  Act [Chapter 13:15].  
Vehicles to be fitted with speed monitoring and speed limiting  devices 
3. (1) No person shall operate or drive on any road a passenger public service vehicle registered in Zimbabwe or a heavy vehicle with a net mass of four thousand six hundred kilograms (4 600kg) or more registered in Zimbabwe unless both of the following devices are fitted to the vehicle— 
(a) a speed monitoring device; and 
(b) a speed limiting device limiting such category of vehicles to a speed not exceeding 100km/h: 
Provided that the devices referred to in paragraphs (a) and (b) have been certified by the vehicle inspecting officer and approved by the Standards Association of Zimbabwe. 
(2) No inspecting officer shall issue a certificate of fitness for any passenger public service vehicle registered in Zimbabwe or a heavy vehicle with a net mass of four thousand six hundred kilograms (4 600kg) or more registered in Zimbabwe, unless both devices referred to in paragraphs (a) and (b) of section 3(1) of these regulations are fitted to the vehicle for which the certificate of fitness should be issued. 
(3) The Commissioner shall not issue an operator’s licence, route authority or any other form of licence or permit to any operator, owner or driver of public service vehicle registered in Zimbabwe or a heavy vehicle with a net mass of four thousand six hundred kilograms (4 600kg) or more registered in Zimbabwe unless both devices referred to in paragraphs (a) and (b) of subsection (1) of section 3 of these regulations are fitted to the vehicle with effect from the date of 1st August, 2023. 
(4) Notwithstanding subsections (2) and (3), those public service vehicles registered in Zimbabwe or heavy vehicles with a net mass of four thousand six hundred kilograms (4 600kg) or more registered in Zimbabwe which had not been operating without both devices fitted to them prior to 1st August, 2023, shall comply by 1st January, 2024. 
Duty to maintain, comply with fitment of and efficiency of the devices 
4. (1) The owner, operator or driver of a motor vehicle referred to in section 3(1) shall ensure that the speed monitoring and speed limiting devices are properly fitted and are operating efficiently at all times whenever the motor vehicle is operating or being driven on the road. 
(2) The owner, operator or driver of a motor vehicle referred to in section 3(1) shall keep in a safe place for a period of not less than six months, all data and records from the speed monitoring and speed limiting devices to his or her vehicle and are subject to inspection by the inspection officer.
Offences and penalties 
5. Any person who contravenes or fails to comply with sections 3 and 4 commits an offence and shall be liable, on conviction, to a fine not exceeding level 5, or to a period of imprisonment not exceeding six months or both to such fine and imprisonment. 
Repeals and amendments
6. Subsections (2) and (3) of section 64 of the Road Traffic (Construction, Equipment and Use) Regulations, 2015, published in Statutory Instrument 129 of 2015, are hereby repealed. 
Exemptions by Minister 
7. (1) The Minister in consultation with the relevant authorities, may exempt any vehicle or class of vehicles from any provision of the Road Traffic Act (Speed Limiting and Monitoring Devices) Regulations, 2023 
these regulations, and may impose conditions upon such exemption to ensure the safety of the public or the preservation of roads. 
(2) An exemption in terms of subsection (1) shall— 
(a) be in writing, if it is given in respect of a particular vehicle; or 
(b) by notice in the Gazette, if it is given in respect of a class of vehicles. 
(3) Any person who drives on a road a vehicle in respect of which a written exemption has been given in terms of this section shall carry such authority on the vehicle and produce it on demand by a police officer or an inspecting officer. 
Savings 
8. Any exemption which was granted or issued in terms of the Road Traffic Act [Chapter 13:11] or any other enactment, with regards certain classes of passenger public service vehicle registered in Zimbabwe or a heavy vehicle with a net mass of four thousand six hundred kilograms (4 600kg) or more registered in Zimbabwe and which was in force immediately before the date of commencement of these regulations shall continue in force as if it had been granted or issued in terms of the equivalent provision of these regulations.

Govt Orders Operators To Install Speed Limit Devices On Buses, Kombis

Speed limits for buses are going to be enforced, with the police capacitated to ensure compliance.
This was said by the Transport and Infrastructure Development Minister Felix Mhona on Monday during a tour of the Chivhu accident scene where a Tinboom Coaches bus crashed on Sunday morning.
12 people, including the driver, died on the spot and another passenger later died at Chivhu Hospital. Several others were injured.
The bus was carrying 60 passengers, 13 died, and 40 sustained injuries, of which 27 were treated and discharged. 8 are still admitted at Chivhu Hospital, whilst 5 were transferred to Parirenyatwa Hospital.
Preliminary investigations indicated that the bus was speeding and the driver lost control of the vehicle before it veered off the road and crashed into trees.
Mhona urged bus operators to ensure their drivers are sticking to their timetables. He said:

We are saddened as a Ministry and Government that we are losing people due to road accidents.
After we were informed of this accident, we informed the President who then sent us here to the accident scene and hospital to see and understand what could have happened and what needed to be done, to assist the affected.
We are told that the driver was speeding. Maybe if he was not speeding, lives could have not been lost.
I want to appeal to Zimbabweans and motorists to always value life.
We are noting that drivers are not respecting the sanctity of life, this is very sad.
Therefore, as a Ministry, we are now, and urgently advocating stiffer penalties on those who would be found breaking road rules and regulations.
We are also, immediately, encouraging our buses to obey speed limits. This is crucial in saving lives.
We are also urging bus operators to ensure their drivers are sticking to their timetables.
</blockquote>
Minister of State for Provincial Affairs and Devolution for Mashonaland East Aplonia Munzverengi, who was part of the delegation, called for stiffer penalties for drivers who break road rules and regulations.
The Government has since declared the accident a national disaster.
This means that the Government will provide support towards the burial of the deceased, and also support towards the injured.
